제품안전을 위한 제조물책임(PL)에 관한 연구 (A Study on the Product Liability for Product Safety)

  • In July 2002, law of product liability will be established in Korea. Therefore, prevention for product liability(PL) will be immediately needed for many companies. So, in this paper, following topics will be discussed: 1) what are product liability and product safety, 2) why they are needed, 3) why important, 4) what's the difference between considering PL and not considering PL for companies, 5 ) what are risk management methods and risk evaluation system, 6) what is SASA(Systematic Approach to Accident Scenario Analysis) method for applying PL, 7) providing a final conclusion and discussion for future PL law.

  • PL(product liability) is a major social, market, and economic force. The legal obligation of manufacturers and sellers to compensate for injury or damage caused by defective products is not a recent phenomenon. The concept of Product liability has been in existence for many years, but its emphasis has changed recently. This PL prevention program has shown that the two area of product quality assurance one is a PLD(product liability defense) and the other is a PLP(product liability prevention.

전사적 PL 대응시스템의 핵심요인이 기업 성과에 미치는 영향 (Effects of Essential Companywide Components of PL Response System on Company's PL Performance)

  • PL (Product Liability) refers to the legal responsibility of a manufacturer or seller for bodily injuries or property losses caused by product defects. Therefore, it is important for companies to construct a product liability response system that strategically manage and effectively adapt to product liability. A PL response system refers to companywide operations of PL prevention (PLP) measures, product safety (PS) measures, and PL defense (PLD) measures appropriate for a company's scale and environment. To establish an enterprise product liability response system, each essential component of corporations should be systematically operated and maintained considering the scale and characteristics of the corporations. Essential components of PL response system is Strategy, Organization, Training, Technology, Investment, and Awareness. Role of essential components is that companies need specific strategies to secure product safety and protect customers from product defects, and appropriate organizations must be composed for effective operation of such strategies. The objective of this paper seeks to examine the relationships among the essential components of the product liability response system and PL performance. PL performance consists of positive performance and negative performance. In particular, positive performance include increased efforts in product or process innovation such as strengthening research and development (R&D) to produce safer products without defects. In order to carry out this research we obtained 98 questionnaire of manufacturing company. A summary of the analyses is as follows: First, the awareness and technology among essential components affect significantly to the positive performance. Second, the awareness and strategy among essential components negative affect to the negative performance.

제조물책임을 대비한 어린이 완구의 경고문안에 대한 설문조사 (A Study on Warning Messages of Child Toy for Product Liability)

  • Recent reports studied that injuries or deaths frequently occurred in consumer product accidents by product defects. Broadly speaking, product liability is liability which is imposed upon a manufacturer or other seller for personal injury, death, property damage and/or commercial loss arising with respect to a product or service provided by it. In this study, we want to search a method of prevention against appling PL laws. The way was researching on the level of appreciation of PL law, warning messages's means and design criteria for seller or consumer of child toys. As a result, most people didn't understand PL laws. Although they read them before purchasing child toy, many consumers didn't differentiate means of "Notice", "Warning", and "Danger" in warning messages. In addition, they considered important factors in warning messages as notice warning, safety mark(UL, etc), age recommendation and color in order. This study will be effective to search a method of prevention against PL laws.

제조물책임법 소비자보호 효과분석 (The Impact Analysis of Product Liability Law with Policy Delphi Method from a consumers' perspective)

  • PL law seeks consumers'just compensation and effective deterrence through shirting liability principle from negligence to strict liability. Impact analysis of Product Liability(PL) Low requires consumers' perspectives. This paper performed a policy delphi to predict the impact of PL law on consumers. The study surveyed the opinions of 30 specialists in PL area, ranging from government, officials, professors, researchers, consumer activists, to business executives, for three times. The consumer are as follows: first of all, PL law can contribute to damage compensation significantly in that it stimulates consumer complaints through non- court procedures. It is very unlikely that suits will be increased rapidly due to PL because of the current law environment. The degree of influence of PL law on damage compensation will very according to the content of PL law. Secondly, PL law can contribute to deterrence in that it encourages companies' efforts for product safety while it doesn't undermine consumers' attentions to safety. The influence on companies' efforts will vary according to the content of PL law.

  • Product liability is the law of the manufacturer's responsibilities for the consumers' personal injuries or the losses of property resulted from defective products. In today's many countries, the product liability law are being enacted because of the safety of product use and the protection of consumer's right. In korea, the product liability is going to enforce on July 1, 2002. Though the construction of product liability response system is urgent situation, domestic manufacture company's PL response system is not nearly prepared in present. PEST-SWOT-AHP 분석을 이용한 중소제조기업의 제조물책임 대응전략 수립 (Developing Product Liability Response Strategies of SMEs using PEST-SWOT-AHP analysis)

  • Product liability (PL), which began enforcement in 2002, refers to the legal responsibility of the manufacturers or sellers (wholesales or retailers) for the property damage or bodily harm caused by their product. With a strong enforcement of the Product Liability (PL) Act, companies are required to structure and operate a response system to defend or prevent product accidents efficiently, but small and medium enterprises (SMEs) are unable to respond more aggressively due to limitation of management resources. In this manner, it is important to develop response strategies for SMEs to efficiently cope with the PL Act. In this paper, the PEST (Political, Economic, Social, and Technological) analysis is performed to reveal the impact of the PL Act on SMEs in macro-economic point of view. To formulate SME's PL response strategy, SWOT analysis is performed to categorize each factors from PEST analysis and AHP is applied to identify the intensities of SWOT factors. The prioritized SWOT factor, results of PEST-SWOT-AHP analysis, are used to formulate SME's PL response strategies. The study results are briefly summarized as follows. To reduce product defects, it is necessary for SMEs to formulate PL response strategies for each phase of the product life cycle by continuously collecting and analyzing PL cases in the same industry or for similar products. In addition, SMEs should invest more technological effort to ensure product safety. Further, SMEs should spread PL awareness to all staff members by training internal PL experts. Moreover, a SME should enroll in PL insurance and spread this information to its customers so that they become aware that the company is proactively conforming to the PL law.

제품안전 및 신뢰성 향상을 통한 제조물책임 예방대책 (Product Liability Prevention Policies through the Improvement of Product Safety and Reliability)

  • Product Liability(PL) is a legal policy to deal with global competition by improving domestic industrial competitive power and to reduce the cost of defect products. The purpose of this paper is to address the state of the art solutions to dispute on PL, in reality of a frequent occurrence of global product exchange focussing on product safety that is one of the most important functions of PL and to improve solution of the product safety and reliability responsive to PL. To minimize PL exposure, manufacturers should reflect comprehensive product safety and reliability concepts in establishing PL prevention policies. Total PL prevention policies are composed of total quality management and product safety management system in respect of safety design, risk, and reliability. These PL prevention activities should be performed consistently during the total product life cycle, especially product research and development periods.

  • 2002년 제조물책임법(PL)을 시행하여 소비자가 제조물을 생산하고 판매하는 기업에 대하여 제품의 결함에 따른 손해배상을 청구할 수 있도록 하는 제도적 장치를 마련하였다. 그러나 최근 가습기 살균제 사건 등으로 인해 기업의 제조물책임 강화와 소비자 피해구제를 위한 집단소송제도, 징벌적배상제 도입을 위하여 제조물책임법 개정안 등 현재, 12여건의 관련 법안이 국회에 발의되어 있으나 정작 법안의 이해 당사자인 중소기업의 62.6%는 이에 대해 잘 알고 있지 못한 것으로 나타났다고 하고 있다. 많은 기업들이 PL 방어대책(Product Liability Defense : PLD)으로 문서작성 보관의 적정화, 관련업자와의 책임관계의 명확화, PL 보험의 가입 또는 배상자금의 확보 등으로 대비하고 있으나 이와 같은 대비책은 제품의 설계와 제품의 안전성을 고려한 부분에 대하여 한계점을 느끼게 한다. 이에 본 연구는 먼저 PL의 명확한 개념과 대응방안에 대해 살펴보고 PL 시스템과 개별 경영시스템 간의 관련성을 파악하고 제조물책임법에 대비한 PL 대응시스템을 기업의 개별경영시스템에 통합하고 보다 제품의 안전에 중점을 둔 개별경영시스템 모델을 제시하고자한다. 이 같은 연구목적에 따른 결과는 중소기업의 PL법 대응을 위한 합리적 대응방안으로 평가 받을 것으로 기대된다.
