The rapid growth of electronic commerce increases the potential for conflicts over contracts which have been entered into online(e.g. about price, late delivery, defects, specifications...). Using arbitration as a dispute resolution alternative is becoming increasingly popular especially in cases involving intellectual property rights and technology disputes since speed and secrecy are essential. The use of online dispute resolution(ODR) mechanisms to resolve such e-commerce conflicts is crucial for building business, consumer confidence and permitting access to justice in an online business environment. However, the use of the Internet and the World Wide Web in dispute resolution has an impact on the types of communication implied in the relevant processes(negotiation, mediation and arbitration). This paper deals with legal issues with respect to the practice of online arbitration. The paper begins with a brief introduction to the theories behind arbitration. These sections will be followed by a discussion on the specifics of online arbitration and the problems the process faces online arbitration by the legal community.
Traditionally construction has been an industry that favoured ADR over formal litigation due to the complexity of technical issues. However, over the past decade construction arbitration has come under increasing attack for its rising costs and growing delays, and expansion of arbitration processes to the point that those processes are approaching the more complex and formal processes followed to resolve disputes litigation. As a result, parties are looking for new methods of resolving their disputes in a more efficient and economical manner, such as ODR. A review of the history of ODR and the practical applications of ODR in use today lead to the conclusion that the concept of ODR for construction dispute resolution appears to be possible and realistic. The advantages seem to outweigh the disadvantages, especially given the solutions suggested to overcome many of the disadvantages. While ODR may not be a realistic venue for large complex construction cases, it may be just the ideal venue for smaller and simple construction disputes. In conclusion, given the advantages that ODR arbitration does offer, the most realistic use of ODR in the short term would involve disputes consisting of a simple, one-dimensional dispute within which the parties can stipulate to the facts in the case. In such simple disputes ODR may be not only an appropriate vehicle within which the dispute can be resolved; it might be more easily accepted by the parties as the preferred platform for resolution. Hopefully, international institutions of arbitration will be successful in their development of a international standards and platform fir disputes that can be adapted for use in construction and will serve as the first step in developing ways to handle small construction claims, thereby allowing parties to resolve their disputes in a faster and more economical manner.
The purposes of this study are as follows: First, this study reviews the Online Dispute Resolution (ODR) regulations of the EU to resolve disputes which can arise in international e-commerce in the future. Second, this study tries to seek out alternative solutions to dispute resolutions based on these regulations. Third, this study increases the efficiency of the transactions by proposing effective and satisfactory dispute resolution methods for international e-commerce. First, this study reviews the concept of cross-border e-commerce, generally explores ODR, and creates comparisons with Alternative Dispute Resolution (ADR). Subsequently, this study looks into domestic ODR system and analyzes the regulations of EU ODR. This study suggests the implications of the European ODR regulations in the conclusion. The EU ODR platform is considered greatly significant in that it has increased the possibility of settlements in small disputes by enhancing consumers' accessibility to ADR procedures. Therefore, this thesis proposes a method for Korean companies to resolve disputes that may arise in e-commerce with EU by using the ODR platform. As a result, it is expected to increase the competitiveness of Korean companies in the EU market. Both legislative trends related to the ODR of the EU and establishment of the EU ODR platform have significant implications for Korean businesses in Europe. This study is expected to be useful for our businesses in the EU in reviewing the applicability of the EU ODR regulations and the dispute settlement procedures through the EU ODR platform. In addition, this study is expected to prove useful in relation to consumer protection by enhancing consumers' accessibility to dispute settlement institutions in domestic electronic commerce.
Today's Internet environment is growing rapidly, and transactions based on it are also rapidly increasing. E-commerce allows merchants and consumers in different countries to easily trade goods across borders. However, the increase in international consumer transactions through the Internet is accompanied by an increase in disputes. International consumer transactions are characterized by a distinction among long distance, small sum, and different jurisdictions. International consumer transactions cannot be solved only by way of resolving disputes in past international transactions. The best way to resolve disputes between international carriers and consumers is through the Internet. In this regard, UNCITRAL has been preparing to enact legislation on ODR as a solution to international electronic trade disputes and, as a result, UNCITRAL adopted guidelines for operating the ODR procedure for building the ODR platform. The European Union has also increased its disputes in the European Union, which is active in the intra-regional market. Institutional improvements were made to solve this problem; therefore, the European Union (EU) has enacted the ODR Regulations for EU consumer disputes. Based on such, this study constructed the ODR platform, which is used as a way to resolve consumer disputes in the regional market.
인터넷 참여와 공유를 모토로 하는 웹 2.0 시대를 대표하는 미디어는 바로 UCC라고 할 수 있다. UCC(User Created Contents)는 '이용자가 만드는 콘텐츠'를 의미하는데, 구체적으로 UGC(User Generated Contents 이용자 순수 창작 콘텐츠), UMC(User Modified Contents 이용자 가공제작 콘텐츠), URC(User Recreated Contents 이용자 재창조 콘텐츠)로 유형화 할 수 있다. 그런데 UMC, URC는 대부분 방송콘텐츠를 편집한 것으로 나타나 저작권 위반 문제가 야기되는 대표적인 유형이다. 2006년 <저작권보호센터>의 UCC현황조사에 따르면, 사용자가 직접 제작한 창작물은 전체 UCC의 16.25%에 불과하고, 83.75%는 기존 미디어 및 방송콘텐츠 등을 단순 복제하거나 제목을 삽입하는 등 약간의 편집만을 추가하여 제작한 것으로 저작권 침해물로 분류된다고 보고하여 방송콘텐츠를 이용한 UCC의 저작권 침해 문제가 심각함을 제기하였다. 해외의 YouTube나 국내의 방송3사와 UCC 업체간의 분쟁 사례에서 볼 수 있듯이 현재 방송콘텐츠를 이용한 UCC의 저작권 침해가 현저하게 나타나고 있음에도 불구하고, UCC 저작권에 대한 구체적인 법규나 준거가 존재하지 않아 UCC 저작권 문제 해결에 어려움을 겪고 있다. 특히 UCC는 온라인 매체라는 열린 매체적 특성 때문에 오프라인에서 적용하던 일방향적 법적 준거로는 명백한 분쟁 해결점을 도모하기 힘든 상황이다. 이러한 맥락에서 본 연구는 방송콘텐츠를 이용한 UCC의 저작권 문제의 분쟁사례를 살펴봄으로써 UCC 저작권의 본질을 이해하고 UCC 저작권 문제를 해결할 수 있는 방안을 검토하였다. 특히 UCC가 온라인이라는 열린 매체 특성을 고려하여 쌍방향적 온라인 분쟁해결방법인 ODR(online Dispute Resolution)을 중심으로 살펴본 결과, ODR의 한 방안으로써 CCL(Creative Common License)은 conversational law로 기능하면서 보다 유연한 법적 준거임을 시사하였다. CCL 을 통해 UCC 저작권 문제의 해결 가능성을 논의하는 것은 온라인 기술 구현을 통한 저작권 분쟁해결의 가능성을 모색한다는 점에서 의의가 있다. 그리고 미디어와 테크놀로지 접합을 통한 해결방안 모색이라는 측면에서 UCC 저작권 문제에 새로운 관점을 제시함과 동시에 다학제적 논의를 이끌어 낼 것으로 기대한다.
Electronic commerce and the Internet offer unprecedented opportunities. The explosive expansion of the use of the Internet makes it possible for businesses to expand their markets and render services. Global transaction costs are easy to cut off using Internet and transaction speed is faster than before. Where cyberspace is not free from claims, Offline transaction can lead to problems and disputes the same is for cyberspace transactions. However ADR is not meet for the online transaction for speed, cost and open network system, ODR methods to resolve electronic commerce conflicts is crucial for building confidence and permitting access to justice in an online business environment. The use of the Internet and the network in dispute resolution has an impact on the types of communication implied in the relevant processes such as automated negotiation, online mediation and online arbitration and involves new technological issues such as the integrity and confidentiality of data and communication used to transmit and store data. Among the ODR systems Online Arbitration is currently binding both parties disputed and can achieve the aim of dispute award the same as the traditional arbitration. Arbitration is based on the New York Convention 1958, Arbitration Model law 1985 and national Arbitration Act that are founded on territorial area and rested on arbitration agreement, constitution of the arbitral tribunal, due process, final and binding award and enforcement of the arbitration award. To compare with this issues Online arbitration has unnecessarily legal unstability and risk. ODR is the burgeoning field and has created a new issues. All such issues which have been debated in the ADR are composed with ODR. But these are not limited Some of issues are further complicated by the nature of the online environment such as confidentiality and principle of parties. It is true that online arbitration should comply with legal provisions, but which is impossible to adhere of the law. Flexible translation and functional equivalence of legal provisions are needed for acceptance of electronic commerce disputes. Finally electronic commerce now takes place on the Internet, it is inevitable that the commercial world wants access to dispute resolution process that best suits the new commercial environment. ODR methods are processing for development and legal issues are considered by both national and international authorities. The worldwide diffusion of COVID-19 contributes to electronic commerce all over the world. The proliferation of high volume and small value electronic commerce naturally has combined artificial intelligence with online dispute resolution (ODR). This paper investigates the age effect on Artificial Intelligence acceptability in online dispute resolution and its empirical findings are as follows. First, seven measures out of the nine employed in this case study shows a coherent dynamic pattern over the age spectrum. In other words, the total samples are a heterogenous group rather than a homogeneous one. Second, medium answer occupies a non-negligible portion across answers from nine research questions. It seems to indicate that a considerable portion of Korean respondents are hesitant to make a choice on artificial intelligence at this juncture. Third, all of the respondents agree that the introduction of AI to the dispute resolution could contribute to the hastening of the dispute resolution process. Fourth, most of the respondents agree that artificial intelligence might have the cognitive ability but not the sympathetic or affective ability to handle the electronic commerce disputes.
In recent times, the volume of cross-border e-commerce has witnessed an upward trend and has been accompanied by increased disputes, with cross-border e-commerce being characterized mainly by low value and large volume issues. For this reason, Online Dispute Resolution (ODR) was formed to carry out dispute resolutions in cross-border e-commerce. A virtual multi-door ODR platform for small value, cross-border disputes in e-commerce is then proposed in this paper. For a couple of decades, researchers have tried to employ Artificial Intelligence (AI) to Law. However, it turns out that they were faced with a couple of obstacles to integrate AI to Law since it is highly difficult to program AI to process the common sense of a human being. For example, AI cannot assimilate the affective side of a human being, and it is problematic to integrate a human being's common sense into the AI system. Considering this situation, this study puts forward an ODR model for cross-border e-commerce in the evolutionary perspective.
In recent years, with the rapid development of electronic commerce, companies engaging in e-commerce want to take advantage of fast and easy way to solve ever-growing disputes online. South Korea's e-commerce disputes are mainly solved by mediation process of Korea E-commerce Mediation Committee. The whole process of online mediation can be carried out by the network, with the advantages of high efficiency and speed. On the other hand, the introduction of CIETAC's online Arbitration Rules in China meets the actual needs. Especially the requirement of hearing trials' procedures should be easier and faster, making the dispute can be resolved in a short time. Furthermore, the whole process from applying to ruling is conducted online, which meets the needs of e-commerce business that want to solve the disputes faster and more efficient. In addition, the cost of online arbitration is much lower than the average arbitrations. The implementation of the CIETAC's Online Arbitration Rules, will further promote the development of e-commerce in China. With the increase of trade volume between China and Korea, the e-business are also increasing. Although South Korea has not yet implemented online arbitration until now, CIETAC's effort for combining arbitration and mediation have good implications for development Korea's e-commerce online dispute system to promote e-Commerce between Korea and China.
본 논문에서는 상거래과정에서 발생하는 분쟁해결을 위하여 적용가능한 ODR시스템의 특성과 선진국의 ODR의 시험 운영사례를 통하여 이에 따른 문제점을 분석하였다. 또한 국제상거래의 분쟁해결수단으로 일반화되고 있는 중재에 대하여 온라인중재의 도입에 따른 법적인 문제를 검토하고, 이러한 분석 검토결과를 토대로 ODR의 발전방안을 제시하였다. ODR은 신속성, 비용의 경제성, 해결방법의 개선 등의 장점으로 인하여 온라인에서 발생한 분쟁뿐만 아니라 오프라인에서 발생한 분쟁까지도 그 영역이 확대되어 가고 있으며, 앞으로 전자정부에서도 이를 채택하게 됨에 따라 급격히 발전할 것으로 생각된다. 최근의 상거래분쟁이 복잡하고 전문성이 요구되며, 신속한 해결을 지향하고 있으므로 종래 ADR제도의 장점과 정보 통신적 요소를 가미한 새로운 ODR제도를 도입 추진하는 것이 무엇보다도 중요하다고 할 수 있으며, 이를 위하여 ODR제도의 정통성과 실효성을 확보할 필요가 있다.
