전시 화생방위험으로부터 국민을 보호하기 위한 법제정 정당성 및 입법방향 (The legitimacy and directions of legislation for the protection of citizens against nuclear, biological and or chemical attack under war conditions)

  • 국가는 "헌법"에 따라 국민의 안전을 확보하고, 생명 신체에 대한 위험으로부터 국민을 보호할 의무가 있다. 우리나라와 같이 북한의 화생방전 공격의 위협이 있는 국가에서는 국가의 기본권 보호의무의 이행차원에서 국민의 생명 신체를 보호하기 위한 법제를 마련하여야 한다. 현행 법제를 검토한 결과 전시상태에서 적용되는 "통합방위법", "민방위기본법"등 전시관련법은 전시상황에서 발생하거나 발생할 우려가 있는 화생방위험으로부터 국민을 보호하기 위한 법제로 충분치 못하다. 그러므로 국가는 "화생방사태시 국민보호에 관한 법률"을 제정하여 전시 화생방위험으로부터 국민을 보호할 수 있는 체계를 구축하여야 한다. 이 논문은 이와 같은 결론을 도출하기 위하여, 전시사태에서 국민을 보호해야 하는 헌법상 국가의 보호의무의 이론적 논의, 화생방에 특수하게 국민보호조치가 필요한 이유와 이에 따른 입법적 정비방안의 방향 제시, "화생방사태시 국민보호에 관한 법률"의 다른 법률과의 관계와 이 법에 포함되어야 하는 사항을 정리하였다.

국방 핵심기술 활용성 증대를 위한 개선 방안 연구 (A Study on the Improvement Plan for Enhancing Utilization of Defense Critical Technologies)

  • 본 다양한 위협이 대두되는 현재의 안보상황에 대응하기 위해서는 적절한 무기체계 선정과 이를 견인할 수 있는 핵심기술 개발이 필수적인 상황이다. 북한의 핵실험, ICBM 개발 등의 안보위협이 대두되는 현 상황과 경제성장률이 둔화되고 있는 우리나라의 경제실정을 고려했을 때, 적절한 무기체계 선정과 신속하고 효율적인 국방획득제도가 절실한 시점이다. 이러한 측면에서 적절한 무기체계 선정과 이를 견인할 수 있는 핵심기술 개발이 절실하다는 점에서 현재의 국방획득제도와 국방연구개발의 추진과정이 적절하게 진행되고 있는지 그리고 개선할 수 있는 좋은 방향을 모색하는 것에서 본 연구가 시작되었다. 본 논문에서는 현재의 국방연구개발이 효율적으로 진행되고 있는지에 대한 고민에서 발단이 되어 핵심기술이 개발되고 무기체계에 적용되는 현황, 핵심기술의 적절한 관리, 필요한 핵심기술이 기획되고 개발되는지에 대한 조사와 분석을 진행하여 핵심기술과 무기체계 개발 간 연결고리를 분석하고, 강화할 수 있는 획득시스템의 개선방안에 대해 이론적 연구를 실시하였다. 이를 통해 무기체계 개발과 핵심기술 개발 간 연계성 증대가 필요하다는 점과 핵심기술의 활용성의 극대화가 제도적으로 필요하다는 시사점을 도출할 수 있었다. 개선방안으로는 핵심기술 및 무기체계 소요기획을 통합할 수 있도록 장기무기체계 개념기획서라는 신규문서를 통해 목표지향적인 소요기획 분위기를 형성하고, 기획의 실효성 증대를 위한 사전기획연구 제도에 대한 방안을 연구하였다.

강대국 간의 경쟁시대와 미 해군의 증강 노력 (USN's Efforts to Rebuild its Combat Power in an Era of Great Power Competition)

  • The purpose of this paper is to look at USN's efforts to rebuild its combat power in the face of a reemergence of great powers competition, and to propose some recommendations for the ROKN. In addition to the plan to augment its fleet towards a 355-ships capacity, the USN is pursuing to improve exponentially combat lethality(quality) of its existing fleet by means of innovative science and technology. In other words, the USN is putting its utmost efforts to improve readiness of current forces, to modernize maintenance facilities such as naval shipyards, and simultaneously to invest in innovative weapons system R&D for the future. After all, the USN seems to pursue innovations in advanced military Science & Technology as the best way to ensure continued supremacy in the coming strategic competition between great powers. However, it is to be seen whether the USN can smoothly continue these efforts to rebuild combat strength vis-a-vis its new competition peers, namely China and Russian navy, due to the stringent fiscal constraints, originating, among others, from the 2011 Budget Control Act effective yet. Then, it seems to be China's unilateral and assertive behaviors to expand its maritime jurisdiction in the South China Sea that drives the USN's rebuild-up efforts of the future. Now, some changes began to be perceived in the basic framework of the hitherto regional maritime security, in the name of declining sea control of the USN as well as withering maritime order based on international law and norms. However, the ROK-US alliance system is the most excellent security mechanism upon which the ROK, as a trading power, depends for its survival and prosperity. In addition, as denuclearization of North Korea seems to take significant time and efforts to accomplish in the years to come, nuclear umbrella and extended deterrence by the US is still noting but indispensible for the security of the ROK. In this connection, the naval cooperation between ROKN and USN should be seen and strengthened as the most important deterrents to North Korean nuclear and missile threats, as well as to potential maritime provocation by neighboring countries. Based on these observations, this paper argues that the ROK Navy should try to expand its own deterrent capability by pursuing selective technological innovation in order to prevent this country's destiny from being dictated by other powers. In doing so, however, it may be too risky for the ROK to pursue the emerging, disruptive innovative technologies such as rail gun, hypersonic weapon... etc., due to enormous budget, time, and very thin chance of success. This paper recommends, therefore, to carefully select and extensively invest on the most cost-effective technological innovations, suitable in the operational environments of the ROK. In particular, this paper stresses the following six areas as most potential naval innovations for the ROK Navy: long range precision strike; air and missile defense at sea; ASW with various unmanned maritime system (UMS) such as USV, UUV based on advanced hydraulic acoustic sensor (Sonar) technology; network; digitalization for the use of AI and big data; and nuclear-powered attack submarines as a strategic deterrent.

대한민국 해군창설 : 회고와 당부 (Reflecting on the History and Future of Republic of Korea Navy)

  • The Republic of Korean Navy (ROKN) started from scratch. However, ROKN demonstrated its Blue Navy capabilities successfully to the entire world by conducting "Operation Early Dawn" at the Aden Bay, Yemen in Jan 2011. On the event of the 70th anniversary of the ROKN, I would like to retrospect past gleaning from voyages and challenges we had in the past. At the very inception of the ROKN, Korean government as well as senior military leaders recognized that it had no time to spare to clean up military those were insinuated deeply by communist agents. It was the top priority of the government. The Mongumpo Operation which was not well known, conducted by ROKN was one of the clean-up drive. The Korean War sometimes called as "a fire from land put-off at the sea". The world famous "Incheon Landing" which reversed war situation from the Nakdong Perimeter also done by Sea Power. ROKN conducted various maritime operations including not only Incheon Landing, but amphibious operation at Hungnam, mine sweeping, sea convoy, Wonsan Withdrawal. On the same day of the Korean War started, 25th June 1950, unless the victory of the ROKNS Baekdusan (PC 701) at the Korean Strait, the waning lamp light of Korea could not be rekindled by the participation of the U.N. The ROKN rescued the 17th regiment of Korean Army from the isolation at the Ongjin Peninsular and transported gold and silver bars stored at the Bank of Korea to the Navy supply deposit in Jinhae safely. ROKN special intelligence unit conducted critical HUMINT which led Incheon Landing success. One of important mission ROKN conducted successfully was not only transporting war fighting materials but also U.S. provided grains to starving Koreans. ROKN participated Vietnam campaign from 1960s and conducted numerous maritime transportation operations supplying materials to Vietnam military forces along the long coastal lines. Experienced Naval Officers and enlisted men who discharged and acquired as merchant marine certificate supported most of the U.S. sea lift operations throughout the Vietnam campaign. ROK-US Combined Forces which had been honed and improved its war fighting capabilities through the Korean War and out of Vietnam jungle playing key deterrent against threat from north Korea. However, those threat level will be completely different when north Korea finish its nuclear weapon ambition. In order to stand firm against north Korean nuclear threat, I would like to expect strong political leadership supporting nuclear submarine for ROKN.

태평양 전쟁 전 미일관계와 현재의 미중관계 비교를 통한 미중간 전쟁 발발 가능성에 관한 연구 (Prospect for the Outbreak of War between U.S and China by Comparing of the U.S-Japan Relationship in the World WarII Era and the Modern U.S-China Relationship)

  • This paper aims to use crossover analysis to uncover similarities and differences between the U.S-Japan relationship in the World War II era and the modern U.S-China relationship, and to forecast the possibility of the outbreak of war between U.S and China by applying the steps to war theory. The steps to war theory argues that the probability of the outbreak of war between two states within five years would approach 90 percent, if they have ongoing territorial dispute, alliance, rivalry, and arms race. The comparison exposes some similarities with the territorial dispute, alliance, rivalry, but reveals dissimilarities with arms race. U.S-Japan relationship in the World War II era had the arms race, which does not exist the modern U.S-China Relationship. The result of comparison is that the probability for the Outbreak of War between U.S and China correspond to third stage(Risk Level). it means that the probability for the Outbreak of War between U.S and China is 55%. But, There are four elements(① Perception of Leader ② Mutual dependence of economy ③ Possession of nuclear weapon ④ Ravages of war) that reduce the probability for the Outbreak of War. Considering the four elements, the probability for the Outbreak of War between U.S and China is a slim chance. But the probability for the Outbreak of War between U.S and China is excluded because of territorial dispute, alliance, rivalry. So, This paper suggests three points.(① Developing military options ② Reducing the misconception of intend, ③ Promoting navy exchanges) to prevent of Outbreak of War.

한국해군의 새로운 도전과 기동전단의 발전 방향 (The New Challenges for the Republic of Korea Navy and the Development of Maritime Task Flotilla's Force Development)

  • The completion of Jeju Naval Base on February 2016 made the Republic of Korea Navy(ROKN) review the size and role of the Maritime Task Flotilla(MTF). The new strategic environment for the 12st century and the new challenges require the Navy to counter North Korea's provocations and prevent potential enemy's threat. The Navy is also required to take part in the variety of international roles and missions commensurated with Korea's global status to maximize the national interest. Despite these changes, Korea's military construction concept is still unable to break away from the old paradigm of the North Korean threat largely centered. In order to develop the current MTF into the Task Group with the construction of Jeju Naval Base, the Navy must newly not only establish new force development plan and fleet management concepts but also go to persuade and convince policy decision makers. To this end, the following efforts should be promoted. First, the ROK Navy steps up efforts in order to share with the Task Group's vision and strategy. The Navy should also provide the size and structure as well as the missions and roles of the Task Group to react to new maritime security environment. Second, the Navy analyse the MTF's ability and what is required and necessary to perform its duty. After that, it must set out the direction of the Task Group's force development. Third, the current missions and roles of the MTF should be re-established to respond various threats. Finally, accommodating of new technology to the MTF should intensify its strengths. The ROK Navy has a mixed force structure consisting of three fixed- base fleets and a MTF. The fixed base fleet has a passive force to defend and protect its own sea areas, but the MTF should actively not only counter North Korea's threats, including ballistic missiles, but also fight potential threats and takes international missions as a primary task force. However, the MTF has a limited capability to accomplish given missions and long-range operations, and thus, the ROK Navy is strongly required to construct the Task Group.

합동전장 환경에서 효과적인 Kill Chain 지원을 위한 표적정보전달 네트워크 분석 (Analysis of an Effective Network of Information Delivery for Supporting Kill Chain in the Joint Battlefield Environment)

  • 킬체인(Kill Chain)이 최근에 북한의 핵실험, 미사일 발사 등으로 인해 주목을 받고 있으며, 조기 구축의 필요성이 대두되고 있다. 킬체인 구축을 구체화하기 위하여 센서와 타격무기가 효과적으로 작전을 지원할 수 있도록 한국형 킬체인 네트워크에 대하여 검토해야 한다. 특히, 산악지역 및 해양을 포함한 짧은 종심의 합동전장 환경에서 적 위협으로부터 공격 대응시간을 단축할 수 있는 적합한 표적정보 전달 네트워크가 필요하다. 현재 작전에서는 다양한 유 무선 통신체계를 이용하여 음성, 데이터, 이미지, 문자 등을 작전에 활용하고 있다. 그러므로 본 논문은 킬체인에서 적용될 수 있는 표적정보 전달 네트워크에 대하여 분석하는 것이다. 그리고 네트워크의 정책적 대안에 대한 확증을 위해 AHP(Analytic Hierarchy Process) 기법을 적용하여 킬체인에 적합한 표적정보 전달 네트워크를 식별하였다. 이를 통해 합동 전장 환경하에서 적용 가능한 킬체인 표적정보 전달 네트워크 및 구축방안을 제시하였다.

고출력 전자기파에 대한 전력망 피해 비용 산출 (Estimation of Damage in Electric Power Networks due to High Power Electromagnetic Pulse)

  • 본 논문은 거시적인 접근방법을 이용하여 고출력 전자기파에 대한 피해 비용을 보다 실제적으로 산출하기 위한 방법을 제시하고, 이에 대한 피해액을 계산하였다. 먼저 취약성 분석을 통하여 사회 기반 시설 중 사회적으로 가장 큰 혼란을 야기할 수 있을 것이라고 판단되는 전력망에 집중하여 연구하였으며, 이에 대해 고출력 전자기파에 의한 피해액 계산식은 GDP에 대한 총 에너지 소비를 고려하여 고출력 전자기파 피해 시 발생할 수 있는 피해 손실을 효과적으로 예측하기 위한 방법을 제시하였다. 피해액은 고출력 전자기파의 공격 형태에 따라 피해 범위를 설정하고 계산하였으며, 이러한 피해액 계산을 통하여 고출력 전자기파에 취약한 시설에 대해서는 피해액 산출 후 방호 비용과 비교하여 시설 방호 대책을 수립할 수 있는 기반을 마련할 수 있을 것이다.

국토안보 구현을 위한 기술 동향 연구 (A Study on the Technology Trends for Implementation of Homeland Security)

  • 세계 각국에서 개인 및 공공의 안전을 위하여 보다 강화된 국토안보 기술의 개발에 많은 투자를 하고 있으며, 우리의 경우 북한의 핵무기 개발을 둘러싼 국제적 긴장과 이로 인한 안보위협뿐만 아니라 최근 들어 문화재에 대한 화재 및 강력범죄의 증가 등으로 인해 국토안보의 중요성이 강화되고 있다. 그러므로 본 논문에서는 강화되는 추세인 안전을 위한 국토안보 구현을 위해 관련 기술의 개발동향을 분석하고 연구하였다. 국토안보에 활용되는 과학기술 중 주요 기술로는 집적기술, 통합기술, 협력기술, 분류기술, 지능기술, 마이닝기술로 분류할 수 있으며, 테러 위협이 존재하는 한 관련 산업의 성장 잠재력은 높은 편이다. 따라서 국내 관련 업체들이 모든 분야에서 단시간 내에 관련 기술의 경쟁력을 갖추기 위해서는 안보관련 기술의 적극적인 개발과 인력확보 및 지원이 요구된다.

북한의 수산업 실태와 국제기구를 통한 수산분야 협력 방향 (North Korean Fisheries Status and Cooperation through International Organizations)

  • The main purpose of this study is to explore a way of South-North Korea fisheries cooperation through international organizations under the principles of the Korean peninsula trust process. Considering the government policy toward the North, although some humanitarian aids or cooperations may be plausible with permission of the Ministry of Reunification. direct cooperations between the South and the North Korea must be much limited at leat under the present government. The 5.24 measures taken in 2010 banned in fact all economic/humanitarian cooperations by private sectors and government. Noting the present and the visible future, an important question is whether the North accepts all cooperations including fisheries, bartering giving up nuclear weapon development for the 5.24 measures. It would be a difficult question to be answered, because win-set to both parties is too narrow, so far as there is no change in the South-North conflicting priority policies. If so, one way of implementing South-North fisheries cooperations is to drive forward cooperative programs through UN organizations. Since for instance FAO and WFP secure justification and roles and has a global network, they have sufficient capacity of being abe to organize fisheries experts. If the South can finance the budget necessary for the programs, FAO or WFP would lead the programs through a negotiation with the North. In other words, it is a type of cooperative model that FAO or WFP leads the programs and the South finances. In addition, if World Fisheries University(WFU) is invited to the Republic of Korea, it might make a great contribution to expert exchange of the North.
