Although tariffs are falling due to the establishment of WTO and the increase of FTA agreements, Non-tariff measures such as trade remedies, trade technology barriers (TBT), sanitary quarantine (SPS) and customs regulations have become trade barriers, limiting free trade. Korea, which has achieved export-led economic growth, should present countermeasures. As Non-tariff measures are complex and are applied in different countries, Customized countermeasures by type, industry and country should be presented. To this end, non-tariff DB should be established. In order to collect, analyze, and present measures for non-tariff measures, a dedicated organization dedicated to the government is essential. And consultation among the other parties on non-tariff measures is important, and activities are important at the WTO committee. In addition, it is necessary to foster expertise and expertise in non-tariff organizations. Existing research shows non-tariff measures in each country. As existing studies have been analyzed through studies based on the non-tariff measures of each country or reports of international organizations, there are limitations in the identification of regulations and comparative analysis between countries. Therefore, this paper analyzes on the basis of non-tariff measures DB of WTO I-TIP.
This study examined the impacts of tariff reductions on timber products in the new round of WTO negotiations on domestic timber products markets and presented the measures to minimize their impacts. Scenarios on reductions in tariffs were developed based on result of UR negotiation and prospective issues on scope of tariffs bound, base rates for negotiation, degree of tariff cuts, etc. emerged during preparatory meetings held to launch the New Round of WTO Negotiation. Korea Timber Market Model(KORTIMM) developed by Korea Forest Research Institute was used to simulate the impacts on forest products markets by scenario. It was estimated that their impacts on net imports would be much larger than those on both consumption and production. The results showed that their impacts on plywood market and on net imports of processed forest products would be much larger relatively but that their impacts on log market and on consumption and production of processed forest products would be less than 1 percent. It was estimated that log consumption would be reduced due to reduction in domestic production of processed products and thus both production and imports of logs would be reduced as well. In oder to minimize the impacts, efforts should be made to start negotiations to reduce tariffs with bound rates for bounded products and with applied rates for non-bounded products, to expand the implementation period and to maintain the status of developing country. In addition, it might be one of countermeasures to use legitimate measures consistent with WTO rules such as anti-dumping, countervailing measures and safeguards.
The rent seeking behavior of monopolistic online platform enterprises against digital contents suppliers is similar to the importing countries transfers the monopoly profit acquired by exporting companies in the imperfectly competitive market through optimal tariffs. If such an optimal tariffs imposing mechanism of importing countries, according to so-called strategic trade policy theories, is applied to the rent-seeking behavior of online platform companies, important insights can be obtained in discussions on regulatory reform. In other words, if an online platform enterprises impose a differentiated fee on each contents-suppliers in a monopolistically competitive markets that pursues contents differentiation through R&D investment, it would reduce the innovation investment by contents suppliers. Nevertheless, profit-maximizing online platform enterprises would not voluntarily give up the discriminatory fee system. Therefore, we would like to propose the introduction of a regulation that can force the introduction of an non-discriminatory fee system for all the contents suppliers.
The purpose of this paper is to study of WTO regulations related FTA such as Understanding on the Interpretation of Article XXIV of the General Agreement on Tariffs and Trade(GATT) 1994 and General Agreement on Trade in Service(GATS). In this study, the First introduced FTA rules of WTO in the chapter 2. The WTO agreement includes the "General Agreement on Tariffs an Trade(GATT) 1994". This instrument, known as "GATT 1994", is based on upon the original General Agreement on Tariffs and Trade referred to as "GATT 1947". The Second analyzed the relations between FTA and Article XXIV of GATT 1994 in the chapter 3. The Article XXIV of GATT 1994 is an agreement between the distinctive members for liberalizing trade. The Article XXIV of GATT 1994 is consist of three parts such as customs unions, free-trade area, and interim agreements that WTO is referred to as "Regional Trade Agreement(RTA)". There is a difference between the customs unions and the free-trade area. In the customs unions rules, the members should have the same tarifficatio and the same trade provision against non-members, but in the free-trade are a rules, the member is not necessary to have the same tarifficatio and the same trade provision against non-members. But, the both rules have a liberalization of trade in a common as a revoking tariffs and the government regulations for interfering with trade. In this case, however, the both rules include an inconsistency ele ment under WTO rules such as Most-Favoured-Nation Treatment(MFN) and National Treatment on Internal Taxation and Regulation(NTITR). This study reviewed neither inconsistency nor consistency on the both rules with the RTA of WTO under Article XXIV of GATT 1994. The Third analyzed the relations between FTA and Article V of GATS under WTO in the chapter 4. The GATS is a rule of WTO for the growing importance of trade in services for the growth and development of the world conomy. The GATS is a new rule rather than GATT's rule for concerning goods trade. The Article V of GATS under WTO is a rule that makes based on upon the Article XXIV of GATT. Therefore, If it is to be examined the Article V of GATS, it should be referred to a and an interpretation of the text of the Article XXIV of GATT. However, the Article V of GATS is on the undeveloped stage compare to the Article XXIV of GATT. Because, the statistics of WTO showed that the RTAs under the Article XXIV of GATT have 150 cases completed between nations, but the RTAs under the Article IV of GATS have 10 cases completed between nations. The Forth examined the interpretation of FTA rules under WTO in the chapter 5. Concerning the consistency issue of customs unions and free-trade area under the Article XXIV of GATT, the working parties in customs unions and in free-trade area have been reviewed the consistency is sue which had been not if to GATT. However, the parties finished to get up with one accord the both that are a consistency of argument and an inconsistency of argument with the interpretation of the Article XXIV of GATT. The interpretation of the Article XXIV of GATT has been raised as the issues when EEC by Rome Treaty established in 1957. However, the consistency is sue only agreed 6 working parties out of 69 working parties finished the reviewing of the interpretation up to the end of 1994. Also the consistency issue concerned with the special privilege measure of the customs unions and tree-trade area under the Article XXIV of GATT discussed only 3 cases between working parties up to now and did not accepted as an issue for working parties' report. In conclusion in the chapter 6, this study raised the issues of WTO that are a conference of a new round under WTO and the issues of clarity between FTA rule and WTO regulation.

After 9 11 terrors in 2001, security problem is appearing to every nations and international organizations main pending issue than any problem and various countermeasure is prepared. Security is the major issue in international trade, with significant potential costs and economic impact. So, We need to ensure that supply chain security does not become a new non-tariffs barrier. The aim of this study is to examine the international maritime and aviation law on the supply chain security. Also I review the supply chain security in U.S. and other countries.
Purpose - Based on the Korea-China FTA as the starting point, this paper makes an empirical analysis of the main influencing factors of the FTA utilization and performance of SMEs. Design/methodology - Taking into account the relationship between the internal and external environmental factors on FTA activities and performance of Korea's SMEs, with PLS-SEM and data obtained by the questionnaire, Smart PLS was applied for the analysis. Findings - The recognition of FTA in SMEs has a significant positive effect on FTA utilization and performance, the international marketing orientation factor only has a significant positive effect on the performance, while the inadequate improvement of non-tariff barriers has a significant negative impact on FTA utilization. In addition, FTA activity has a significant mediation effect on two paths. Originality/value - This paper is of great practical relevance as a tool to enable SMEs to make effective utilization of Korea-China FTA and improve their imports and exports. The paper helps grasp the main factors affecting the utilization and performance of FTA for SMEs, also to establish FTA Business Model and FTA utilization plans for specific industries in the future regarding tariff and non-tariffs compatibility.
Most of all, this paper analyzes the current situation of EU(European Union) and ascertain EU's economic condition in terms of tariff lines and non-tariff barriers. and the purpose of this article is to find out the problems of EU's tariff lines and non-tariff barriers. Next, We suggest some future direction of export promotion from Korea to EU more largely for our companies. First, this paper describes the characteristics and outline of EU. The EU is a politico-economic union of 28 member states that are primarily located in Europe. The EU traces its origins from the European Coal and Steel Community(ECSC) and the European Economic Community(EEC), formed by the Inner Six countries in 1951 and 1958, respectively. After that, The Maastricht Treaty established the European Union under its current name in 1993. The latest major amendment to the constitutional basis of the EU, the Treaty of Lisbon, came into force in 2009. There are a combined population of over 500 million inhabitants and generated a nominal gross domestic product(GDP) of 16.692 trillion US dollars in EU. The results are as follows ; First of all, In terms of tariff lines and customs duties, Our companies have to know precisely EU's real tariff lines and other customs duties, and such as value added tax and exercise tax, corporate tax regulated by EU commission and EU's 28 members. second, our companies have to confirm EU's non-tariff barriers. such as RoHS, WEEE, REACH. These non-tariff barriers could be hindrances or obstacles to trade with foreign companies in other countries. We perceive all companies exporting to EU are related with these Technical Barriers to Trade irrespective of their nationality. So, Our companies fulfill the requirements of EU Commission concerning safety, health, environment etc. Also, Our companies choose market-driven strategy to export more largely than before in the field of marketing and logistics.
Opening of trade relationships through an increasing number of international free trade agreements and the now defunct General Agreement on Tariffs and Trade has resulted in an increase the number of the species being exchanged in the world. In the last 20 years, international environmental laws have multiplied and a number of treaties address harmful non-indigenous species (NIS) directly with specific provisions, while other treaties deal with related environmental issues and indirectly affect international regulation of NIS; however, such treaties are weak due to lack of enforceability. From the stand point of national law, many countries including the USA, Australia and New Zealand enforce national laws and regulations to protect biological resources. Typical strategies include : 1) strengthening quarantines to prevent unintentional and illegal introduction of harmful NIS, and 2) developing technologies for managing harmful NIS. However, the recent international trend for managing NIS has shifted. In 2002, the Bonn Guidelines on Access to Genetic Resources and Fair and Equitable Sharing of the Benefit Arising out of their Utilization was adopted at the 6th Conference of the Parties to the Convention on Biodiversity. One major issue highlighted in the document is that "there is no more free of charge to get a biological resource from other countries". The Bonn guidelines will affect international and national NIS regulatory systems because the NIS is a potentially disrupts ecosystems as well as native species. A number of impacts are expected including the revamping of national biodiversity policy regimes in many countries in the world. In particular, the ROK, which is not very biologically diverse, has to evolve national laws to protect valuable ecosystems from NIS. In the meanwhile, national rights of using beneficial indigenous and non-indigenous species as biological resources should be considered through the investigation and national registration of NIS around the world for the promotion of the biotech industry.
The Korea China FTA was signed on June 1 2015. It includes some concessions regarding major export items in the manufacturing sector for the protection of primary industries and preferential tariffs for a number of products produced in the Kaesong Industrial Complex. Primary industries are what the Korean government paid the greatest attention to. Rice was excluded from the negotiations from the get go, and was joined by 548 other food items including pork, apples, pears, beef, chili, garlic etc. These foodstuffs account for about one-third of the agricultural and livestock products that Korea produces, and are not going to be subject to tariff elimination. The results of the study are as follows: Korean government policy is to maintain of agri-food export support system, eliminate of agri-food non-tariff barriers, foster of agri-food export SMEs and expand of investment of foreign agri-food company. Korean firms strategy is to establish of regional marketing strategy, ensure of high quality agri-food and develop of food packaging technologies, establish of agri-food export logistics center and take advantage of the FTA preferential tariff.
The amount of the Korean export & import in 1987 reached $88.3 billion which was 1.75% of the total world trade and the proportion of foreign dependence to G.N.P was 74.5%. From these facts, we can infer that the development of national economy is largely dependent upon trade. Therefore the role of transportation, especially Ocean transportation, as a basis of economic development through trade is one of the main factors that can not be passed over. Here, We can define that a port as a subsystem of transportation determines the efficiency of the total transportation system. Thus, the purpose of this paper is to contribute in improvement of the efficiency in port, reinforcement of the international competitiveness for exporting goods by the analysis of the cargo handling charges. In order to do this, this paper deals the case of B.C.T.O.C. Furthermore, this study gives some important informations related to the level of tariffs for establishing an autonomous port administration. The Summary of the conclusions of this paper is as follows ; 1) The object of port administration in Korea has been emphasized on the maximization of efficiency in using the port facilities. Nowadays, however, it should be moved to a direction that port is operated under the compound aims considering the public interests and economy. 2) For a criterian of tariff calculation, A tariff system based on the cost accounting is desirable. In general it is recommended that the cost for construction, management, and operation of port is compensated by the revenue from port operation. Therefore, it is necessary for the administration bodies of each port to establish a tariff system on the basis of the independent profit system. 3) For the investigation of actors of tariff adjustment by the Break-even point analysis, (1) When we conducted the B.E.P analysis using total cost as cost term, we got 3.8% discount in tariff at 12% of target profit rate and 1.5% discount at 15% of rate. when we set the target profit rate as 17% we could have the proper tariff level. (2) When using operating cost as cost term, we got 13.1% discount in tariff at 12% of target profit rate and 10.9% discount at 15% of rate. When setting the target profit rat as 28%, we could have the proper tariff level. 4) Comparing with the tariffs of foreign ports for the basic terminal rate, The tariff level of B.C.T.O.C showed 33% of stevedoring charge and 80% of marshalling charge incurred at Kobe port. The comparison with Singapore port gave 50% of transhipment charge and 17% - 20 % of stevedoring charge. 5) We found that the financial structure of B.C.T.O.C was better than those of other companies and the worth fixed assets ratio was too low. The fact of low worth fixed assets ratio implies that the cargo handling facilities should be increased. Moreover, The return of assets for B.T.T.O.C was good but non-operating expenses were still contained too much in. Therefore, we think that it is necessary for B.C.T.O.C. to rationalize business management. Although the present cargo handing charge for B.C.T.O.C is a proper level in terms of a public corporation, for the final recommendation in connection to the results, It is required to take the rationalization process for business management.
