The term "articles for ship" is a general term for all relevant mechanical accessories (SPARE) and consumable materials (STORE) commonly used in ships. Ships commonly are at sea, so it is difficult to respond rapidly to the demand for them in an emergency situation. In particular, it is more difficult to determine the boarding location of tramper ships as it is more difficult to predict the next sailing route in advance. The purpose of this study was to identify the important factors to be considered in determining the boarding location of tramper ships through a survey of each ship owner and ship management company. This valuable information on the proposed supply procedures for each country and port, would be an efficient way to supply articles for ships.

The Treaty of Friendship, Commerce and Navigation between the Chosun dynasty and Japan and the United States of America etc. began signing procedures from Feb. 1876. Thus, Busan port became an open port to foreign vessels in 1876. This has resulted in Busan port becoming the greatest port in Korea. This study explored records which were made by the Chosun dynasty and Japan on the opening and development of Busan port. The results are as follows ; According to making treaties between the Chosun dynasty and foreign countries, Chosun dynasty gradually opened a door to the international community. Various institutions were established in and around Busan port by Chosun and Japan. For example, maritime customs, a court of justice, police station by the Chosun side, a Japanese consulate, the Board of Trade for Japan etc by the Japan side. Records made by or related to these institutions and on the development of the Busan port during the open-port period and the Japanese colonial period were preserved at the Kyujanggak Institute for Korean Studies, the National Institute of Korean History, and the Busan Metropolitan Simin Municipal Library.
Logistics and transportation are increasingly playing a crucial role in international trade relations. Logistics services provide sectoral connections within the local economy. The efficient logistics services facilitate the flow of products; besides ensuring safety and speed of movement, they can reduce the cost of cross-border trade. The Logistics Performance Index (LPI) evaluates the efficiency of customs, quality of transportation service, and infrastructure for overland and maritime transport in each country it covers. The objective of this article is to analyze the impact of the various LPI indicators of Korea's trading partners. The impact of LPI on trade varies according to the income level of the trading partners. The results show that an improvement in any of the components of the LPI can lead to significant growth in a country's trade flow. Exports to Korea will increase as the LPI of the trading partner country is higher. This index has a greater impact on the exports of low-income countries.

Since the 9·11 terror attack in 2001, the Maritime Logistics Security System has been strengthened and required X-ray image for every imported cargos from manufacturing countries to United States. For scanning cargos, the container inspection systems use high energy X-rays for examination of contents of a container to check the nuclear, explosive, dangerous and illegal materials. Nowadays, the X-ray cargo scanners are established and used by global technologies for inspection of suspected cargos in the customs agency but these technologies have not been localized and developed sufficiently. In this paper, we propose the X-ray array detector system which is a core component of the container scanning system. For implementation of X-ray array detector, the analog and digital signal processing units are fabricated with integrated hardware, FPGA logics and GUI software for real-time X-ray images. The implemented system is superior in terms of resolution and power consumption compared to the existing products currently used in ports.
Purpose - International trade leads to the international division of labor, improving the efficiency of the global economic system. Transport costs are a more serious barrier to international trade than customs tariffs. An increase in competition in the transport sector may thus lead to a reduction in transport costs. However, if a carrier's nationality significantly influences transport costs, simply adding more competing carriers of different nationalities would be ineffective. Therefore, it is necessary to establish national or regional carriers to influence competition and reduce transport costs. This study investigates this "nationality effect" by treating Hanjin Shipping's collapse as a natural experiment. Design/methodology - The theoretical basis of this study is the 3rd-degree price discrimination in container shipping market. By using the monthly data of container freight rates of Korea, China and Japan, this study shows the so-called Korea Premiums, which are the empirical counterparts of nationality effect in Korea container shipping market. For this empirical investigation, the structural model with state-space form is used and the dummy models are also estimated. In addition, because China has been also affected by the Hanjin's collapse, the China premiums are considered too. Findings - Compared with Japan's case, it is shown that there had been the so-called Korea premiums since the collapse of Hanjin Shipping. These results are robust from both the state-space model and dummy models. The time pattern of Korea premiums was consistent with the market evolution, especially the pattern of substitutability in container shipping markets. In addition, this paper shows the magnitude of Korea premiums. Originality/value - The argument of this study that the nationality effect can be interpreted as an extended concept of the home market effect is original, which is expected to evoke future research efforts. Further, the discussion on the shipping industrial policy from both horizontal and vertical aspects will provide the relevant policy makers with solid information, especially for the policy coordination in a global scale.
This study analyzes the economic effect through the use of the RCEP direct transport rules, and suggests the necessacity of logistics efficiency and policy alternatives. The advantage of the hub network has been widely applied to the international logistics system, but there is a limit in the FTA logistics system in which goods must be directly transported between two contracting parties. Therefore, based on the new RCEP direct transport rules and the theoretical review on the possibility of an FTA logistics hub, FTA logistics efficiency improvement is estimated. This study quantitatively estimated the economic effect of direct transportation, unlike the previous studies, which were limited to the analysis of judicial precedents or surveys. GTAP model was used through five scenarios according to the impact of the RCEP tariff cut and the FTA logistics hub establishment in Singapore or Korea. As a result of the analysis, Korea's trade volume increased by 0.38% of exports and 1.63% of imports, and RCEP would increase exports by 0.27% and imports by 0.42%. In particular, the establishment of an FTA logistics hub (0.71%) was found to have a greater effect on the improvement of terms of trade than a tariff cut (0.12%), confirming the necessity of establishing an FTA logistics hub in RCEP. As a policy proposal, the institutional support of the customs authorities for the use of RCEP, the expansion of the free trade area where BWT traded cargo can be stored, and the establishment of a system for issuing back-to-back certificates of origin with approved exporters.
The purpose of this study aims to analyse the effect of class arbitration under voyage charter with Asbatankvoy form. This study analyses the Stolt-Nielsen case as a data. In this case, One Class Rule requires an arbitrator to determine whether an arbitration clause permits class arbitration. The parties selected an arbitration panel, designated New York City as the arbitration site, and stipulated that their arbitration clause was silent on the class arbitration issue. The panel determined that the arbitration clause allowed for class arbitration, but the District Court vacated the award. But the Second Circuit reversed, holding that because petitioners had cited no authority applying a maritime rule of customs and usage against class arbitration, the arbitrators' decision was not in manifest disregard of maritime law; and that the arbitrators had not manifestly disregarded New York law, which had not established a rule against class arbitration. However, the Supreme Court held, imposing class arbitration on parties who have not agreed to authorize class arbitration is inconsistent with the Federal Arbitration Act.
The free-trade-zone system has been implemented in industrial-complex-type free-trade zones with a focus on the manufacturing industry since 1970, and was intended to attract foreign investment and increase trade by providing benefits such as tax reduction and deregulation to tenant companies. However, foreign investment in these industrial-complex-type free trade zones has decreased significantly. On the other hand, port-type free-trade zones have great potential to attract foreign investment for development due to the increase in port traffic. The developmental trends in the free-trade-zone system have been studied primarily in the manufacturing industry, and those studies must be extended. In this paper, the role and operation of free-trade zones are examined and problems highlighted. We analyzed a business model specialized in port-type free-trade zones to identify problems, propose measures to improve the system for re-exporting domestic goods to the customs area for storage, and upgrade overall operations. The effects of our measures were analyzed by simple simulation. These proposed improvements in the operation of port-type free-trade zones will help attract foreign companies to these international logistics hubs and global delivery centers.
The air waybill is supposed to be made out by the consignor. If the carrier makes it out, he is deemed, subject to proof to the contrary, to have done so on behalf of the consignor. The air waybill shall be made out in three original parts. The first part shall be marked "for the carrier", and shall be signed by the consignor. The second part shall be marked "for the consignee", it shall be signed by the consignor and by the carrier and shall accompany the goods. The third part shall be signed by the carrier and handed by him to the consignor, after the goods have been accepted. According to the original Warsow Convention article 8, the air waybill must contain 17 particulars or items. However, the Hague Protocol reduced to three the number of particulars required to appear on the air waybill. Only one item is obligatory, namely, the notice that the carriage is subject to the rules of the Warsaw Convention. The absence of the air waybill entails unlimited liability of the carrier because it deprives him of the right to avail himself of the provisions of the Warsaw Convention which exclude or limit his liability. The consignor shall be liable for all damages suffered by the carrier or any other person by reason of the irregularity, incorrectness or incompleteness of the particulars and statements in the air waybill. Although the contract of the carriage of goods by air is not a formal contract, the document of carriage is issued. The issue of air wayhill is not essential for the existence or validity of the contract, but serves merely as a means of proof. The Hague Protocol has lessened the consequences of the carrier's neglect to faithfully accomplish the required formalities. Henceforth, these formalities no longer constitute legal obligations. The air waybill is the consignment note used for the carriage of goods by air. It is often called an air consignment note and is not a document of title or transferable/negotiable instrument. It is basically a receipt for the goods for despatch and is prima facie evidence of the conditions of carriage. Each of the original parts of the air waybill has evidential value and possession of his part is a condition for the exercise by the consignor or cosignee of his rights under the contract of carriage. Oveall, it is an usage that under a documentary letter of credit, the consignee on the air waybill is the opening bank of the letter of credit, and the notify party is the importer who applied for the letter of credit. In Korea there is an usage as to process of cargo delivery in air transportation as follows: The carrier carries the cargo into the bonded area of the airport and gives both the notice of arrival of the cargo and the consignee's air waybill to the notify party who is the importer. Then the notify party obtains the Letter of Guarantee from the opening bank in exchange for reimbursing the amount of the letter of credit or tendering the security therefor to the opening bank. The notify party then presents this document to the customs authorities for the process of customs clearance. The opening bank becomes a consignee only to ensure repayment of the funds it has expended, and the only interest of the opening bank as consignee is the reimbursement of the money paid to the exporter under the documentary letter of credit. Just as the bill of lading in maritime law, the air waybill has always been considered negotiable although the Warsaw Convention does not emphasize this aspect of negotiability. However, the Hague Protocol article 4 corrected the situation by stating that "nothing in this Convention prevents the issue of a negotiable air waybill." This provision officially recognizes that the air waybill must meet the needs of the present day business circles by being a negotiable instrument. Meanwhile, Montreal Additional Protocol no. 4 has brought important changes. Registration by computer is acceptable and the parties to the contract of carriage are allowed to replace the air waybill with a receipt for the goods. In conclusion, as the Warsaw Convention has not details of provisions relating to the issuing of the negotiable air waybill, it is hoped that there should be supplement to the Warsaw Convention and establishment of international commercial usage with regard to the negotiable air waybill.
The Uniform Customs and Practice for Documentary Credits (UCP) is a set of rules on the issuance and use of letters of credit. Historically, the commercial parties, particularly banks, have developed the techniques and methods for handling letters of credit in international trade finance. This practice has been standardized by the ICC (International Chamber of Commerce) by publishing the UCP in 1933 and subsequently updating it throughout the years. The ICC has developed and moulded the UCP by regular revisions, the current version being the UCP600. This latest version, called the UCP600, formally commenced on 1 July 2007. During the revision process, notice was taken of the considerable work that had been completed in creating the International Standard Banking Practice for the Examination of Documents under Documentary Credits (ISBP), ICC Publication 745. This publication has evolved into a necessary companion to the UCP for determining compliance of documents with the terms of letters of credit. It is the expectation of the Drafting Group and the Banking Commission that the application of the principles contained in the ISBP, including subsequent revisions thereof, will continue during the time UCP 600 is in force. This paper focuses on documents including various certificates, Packing List, Weight List, Beneficiary's Certificate, Analysiis, Inspection, Health, Phytosanitary, Quantity and Quality Certificates, Courier Receipts, Shipping Advice etc. and suggests some implications in the field.
