중국의 WTO.TRIMs 협정 위반 분쟁사례에 관한 연구 - 자동차 부품 사례를 중심으로 - (A Case Study on the Violation of the WTO-TRIMs Agreement in the China - Focusing on the Auto Parts Case-)

  • 무역관련투자조치(TRIMs)협정은 산업정책의 일환으로서 어느 국가가 외국 투자가에게 적용하는 국내규제와 관련된 규칙이다. 이 협정은 WTO의 모든 가입국이 합의한 내용이다. 이 협정은 국내제품에 유리한 법, 정책 또는 행정적 규정을 적용하는 것을 금지한다. 이것은 국내적으로 지역산업을 보호하는 방법으로서 제품을 생산한 것을 사용하는 기업을 조력하기 위한 정부의 인센티브도 포함한다. 이 협정은 WTO 체제 내에서 유일한 제한조치이다. 지역의 무역균형규칙과 같은 정책은 국내산업의 이익 증진과 현재는 경쟁적으로 제한하는 기업관행은 금지되어 있지만, 과거에는 활용되어 왔다. 여러 면에서 WTO-TRIMs 협정은 서비스 등에 관한 WTO 협정보다 그다지 중요한 협정은 아니다. TRIMs 협정은 전혀 새로운 규칙이 아니며 기존의 GATT 규정에서 정한 것을 언급하고 있을 뿐이다. 그러나 GATT 규정과는 달리 내국민대우에 관해서는 강경하게 규정하고 있으며, 또한 WTO-TRIMs 협정은 자동차 부품 등에 관해서는 광범위한 효과를 가지게 되었다. 한편 중국은 2001년 뒤늦게 WTO 회원국이 되어 한때 수입부품에 대한 고율의 관세를 부과한 조치는 고율의 관세를 회피하려는 자동차 부품 수입업자들을 규제하기 위한 것이었다. 본 연구에서는 중국의 WTO TRIMs 협정 위반 분쟁사례에 대해 중국의 자동차 부품 사례를 중심으로 분석하고 있다.

Assessment of China's Policies Regarding Grain Import and Export

  • 이 논문은 우리나라 대외 무역 및 곡물 수입 안정화 정책 수립에 있어서 중요한 역할을 하는 중국의 곡물 수출입 관련 법 제도를 분석하고자 한다. 본 연구의 결과로는 「대외무역법」에 근거한 중국의 대외무역제도는 대외무역관리기관에 대한 권한 위임의 범위와 책임이 명확하지 않은 것이 특징이다. 우리나라는 「대외무역법」과 그 시행령 및 관리규정에서 대외무역관리의 권한 위임에 대한 범위와 책임을 명확히 규정하고 있지만, 중국의 개정 「대외무역법」에서는 대외무역관리에 대한 권한 위임이 명확하게 명시되지 않아 지방정부나 기타 행정기관의 자의적 판단에 의한 개입의 여지가 있다. 전반적으로 중국의 곡물 수출입 관련 법 제도는 WTO 규정에 부합하는 제도적 틀을 갖추고 있는 것으로 평가된다. 하지만 법률 또는 법규의 모호성과 제도의 운영과정에서 나타나는 불합리성과 투명하지 않은 절차 등은 유의해야 하는 항목으로 여겨진다. 따라서, 향후 중국과의 교역 과정에서의 발생할 수 있는 불합리한 상황에 대한 사전 예방 중요할 것이다.

민간기록물관리에 관한 조례 현황 연구 (A Study on the Status of Ordinances Related to the Private Records)

  • 우리나라의 기록물관리제도는 20년이라는 짧은 역사에도 불구하고 비교적 안정적으로 정착되고 있다. 그러나 이러한 성장은 주로 '공공'의 영역에서 이루진 것으로 '민간' 영역으로의 발전은 다소 미진하였다. 다행히도 최근에 지방영구기록물관리기관 두 곳이 개원하게 되면서 그간 지지부진했던 지방기록물관리에 대한 관심이 증대되고 있다. 더불어 지방기록물의 한 축으로써 지역의 정체성과 다양성을 포함하는 민간기록물의 수집 및 관리에도 이목이 집중되고 있다. 지방기록물관리기관의 민간기록물 수집은 지방자치단체에서 정하는 조례에 따라야 한다. 이에 본 연구는 민간기록물의 수집 및 관리의 법제 근거가 되는 조례를 분석하고자 한다. 분석의 대상은 현재 우리나라에 제정된 민간기록물관리 관련 조례를 분석의 대상으로 정한다. 연구의 진행은 민간기록물관리에 관한 조례의 제정 현황, 조례의 제정 배경, 조례의 내용을 분석하였다. 본 연구의 결과는 실질적으로 우리나라 민간기록물의 수집과 관리를 위한 조례가 대상이라는 점에서 향후 민간기록물관리 관련 조례의 제정 시 참고할 만한 기반 연구로 활용될 수 있다.

서울시 환경영향평가 제도에 대한 연구 (A Study on Environmental Impact Assessment System of Seoul City)

  • Environmental Impact Assessment (EIA) is a kind of planning technique to seek ways to minimize environmental impact, a scheme to encourage sustainable development. With the launch of the Ministry of Environment in 1980, the EIA was introduced in Korea. Its full operation was initially driven by regulations on documenting EIA reports in 1981, which was piloted as a decision-making scheme where final decision were made at the development department after considering opinions suggested by the Ministry of Environment. At that time, dominance of the economic logic overwhelmed environ-friendly opinions, but thanks to the fourth revision of the Environmental Conservation Law in 1986, private projects came to be included on the EIA list. This was a turning point for the EIA to become a regulatory system. Local governments are also conducting the EIA regardless of the national-level EIA. In order to prevent and resolve increasingly severe environmental problems in Seoul in advance due to various construction projects, the Seoul Metropolitan Government, for the first time as a local government in Korea, legislated city decrees to introduce the EIA which has been underway from September 1, 2002. In particular, the Seoul government, unlike the Ministry of Environment, has included construction works on the list of evaluation projects, adopting the scoping and screen procedure scheme. In addition, complementing operational setbacks, the city government has revised and implemented decrees and enforcement laws on the Impact Assessment on Environment, Transportation and Disasters by shortening the consultation period, eliminating the submission of reports on construction, and expanding the waiver requirements in consultation over the reports. Therefore, development measures for the EIA scheme of the Seoul Metropolitan Government will be the target of the research. To that end, the up-to-date data of the Ministry of Environment, the Seoul government and local governments was collected, and latest materials from the EU, previous research and the Internet were gathered for analyses. By doing so, the flow of the EIA was reviewed, and the EIA schemes of local governments under the national EIA were analyzed. Furthermore, based on the Seoul government's recent data on the EIA based on the decrees, the background and legislation of the Seoul government's EIA were analyzed along with the developments for the environmental organizations. Setbacks were derived from the implementation period, evaluation procedures, consultation period and details of the EIA, and corresponding development measures were proposed.

Advanced Korean Industrial Safety and Health Policy with Risk Assessment

  • This article describes a systematic roadmap master plan for advanced industrial safety and health policy in Korea, with an emphasis on. Since Korean industries had first emergence of industrial safety and health policy in 1953, enormous efforts have been made on upgrading the relevant laws in order to reflect real situation of industrial work environment in accordance with rapid changes of Korean and global business over three decades. Nevertheless, current policy has major defects; too much techniques-based articles, diverged contents in less organization, combined enforcement and punishments and finally enforcing regulations full of commands and control. These deficiencies have make it difficult to accommodate changes of social, industrial and employment environment in customized fashion. The approach to the solution must be generic at the level of paradigm-shift rather than local modifications and enhancement. The basic idea is to establish a new system integrated with a risk assessment scheme, which encourages employers to apply to their work environment under comprehensive responsibility. The risk assessment scheme is designed to enable to inspect employers' compliances afterwards. A project comprises four yearly phases based on applying zones; initially designating and operating a specified risk zone, gradually expanding the special zones during a period of 3 years (2010-2012) and the final zone expanded to entire nation. In each phase, the intermediate version of the system is updated through a process of precise and unbiased validation in terms of its operability, feasibility and sustainability with building relevant infrastructures as needed.

건강기능식품에 대한 안전성 조사연구 (A study on safety of functional healths foods)

  • This study was conducted in order to get basic data on standards and specifications of health and functional foods. A total of 101 kinds of functional healths foods were examined during the period of January to December 2005. Among them, 89 kinds were local products and 12 kinds were imported products. Test items were 6 kinds of heavy metals (lead, cadmium, mercury, copper, zinc and manganese), 5 bacteria (common bacteria, coliform group, E coli, Bacillus cereus and Clostridium perfringens), and 6 preservatives (sorbic acid, benzoic acid, DHA, ethyl paraben, propyl paraben and butyl paraben). As a result of heavy metals, cadmium, was detected from the glucosamine products by 1.52ppm in average, mercury from cereal products by 0.004ppm in average, and lead from chlorella foods by 3.48ppm in average. Bacteria were identified from 3 cereal products, and amount of common bacteria were about $4.8{\times}105cfu/g$ in average. E Coli and Coliform group were isolated from 2 products and 4 products, respectively. All of those products were flour meal products. Any of 6 kinds of preservatives was not detected from all the products. It is thought that these test results will be available as basic data for enactment of relevant laws and regulations for production and control of safer and more hygienic foods in the future because the standards of the harmful heavy metals are not complete or available yet according to the Food Sanitation Law and the Functional Healths Foods Law.

한국의 환경오염방지산업 (Environmental Pollution Control Industry in Korea)

  • Since 1962, Korea has made a remarkable progress with continuous success of Five-Year Economic Development Plans. Over the last 30 years, Korea has achieved a fast growth in various industries including heavy industry and chemical industry with rapid urbanization at the same time. The fast industrialization and urbanization brought about huge amount of hazardous/toxic substances and wastes. The environmental pollution problems have now emerged from regional concerns to overall social issues accordingly. The situation has come to a point where pollution control and environment preservation have become one of the nation's major policies. Following the recent Earth Summit of UNCED Conference held in Riode Janeiro in June 1992, where the topic was environmentally sound and sustainable development, awareness upon the importance of environmental preservation has been heightened globally, The environmental issues will gradually influence the international society more and more, politically as well as economically, The environmental pollution control industry in Korea started in the early 70's with the development of the nation's industrialization, As the people's awareness on pollution increases and environmental laws and enforcing regulations were established, demand for pollution control began to increase. The environmental pollution control business came to be recognized as an independent industry in the mid'70's. It should be evaluated properly that over the last 30 years, the Korean pollution control industry has supplied locally manufactured pollution control facilities to the increasing local demand. Concerning the quality and customer satisfaction, however, there are still many aspects which need to be improved compared with those of advanced countries. Although the start of the pollution control industry in Korea is just 10 to 15 years behind the advanced countries such as Japan and European countries, current gap in the environmental technology is rather considerable. And, studies should be made to find out the reasons for the current technology gap, and therefore, to implement solutions to improve the technology and competitiveness of the environmental pollution control industry in Korea.

중국(中國) 관광농업(觀光農業)의 현황(現況) 및 발전(發展) 방향(方向) - 내몽고(內蒙古) 자치구(自治區) 탁극탁현(托克托縣)을 중심(中心)으로 - (A study on the present condition and development direction of China's Agricultural Tourism - Centered on Takgeuktak County of Inner Mongolia Autonomous Region in Particular -)

  • Agricultural tourism is a new kind of industry, which combined agriculture with tourism. It not only has the productive function, but also has the function of improving the quality of ecological environment and supplying people with sightseeing, leisure, vacation. Agricultural tourism is a new kind of industry from the amalgamation of agriculture and tourism: it is based on farm work, characterized by agricultural management, combines agriculture and tourism, and includes the city as a market-place. It satisfies tourist demand with food, lodging, excursions, shopping and entertainment provided by agricultural places and agricultural products. After combining the substance of this study with the primary sources regarding the development of agricultural tourism, I suggest plans for the development of local agricultural tourism on the basis of sustainable tourism theory in case of the Inner Mongolia region. To conduct research, various data such as literature research and surveys are collected and analyzed. According to the result of the research, the Inner Mongolia region has great-wealthy resources for agricultural tourism. However, they have problems as well such as lack of funds, low infrastructure, low business-mind level, low management-mind, the scarcity of mid-supporting organizations for research and education, low awareness, and low service level of the agricultural tourism. In order to solve these problems, have to strengthen publicity, strengthen the county and city communication, educates continuously profession talented person, establish related laws and regulations, increase the integrity of infrastructure. As a developing industry, agricultural tourism is a new field of study which needs more encouraging research. The agricultural tourism of Inner Mongolia Autonomous Region has only just started development resulting in a limited amount of information available for this study. Future planned work entails a continuous in-depth study of Chinese agricultural tourism, considering Inner Mongolia Autonomous Region in particular.

수산물에 대한 부산지역 주부의 인식 및 이용실태 (Awareness and Usage Patterns of Housewives in Busan for Consuming Marine Products)

  • We conducted this study to compare the awareness and attitude of Busan housewives about consuming marine products. The survey was conducted from April 10 to May 31, 2019 by using a questionnaire. The degree of preference of seafood was higher among individuals in their 40s than those in the other age groups. Among the women in their 30s, 40s, 50s and 70s, the reason for liking seafood was 'taste', and for those in their 60s it was 'nutrition'. Overall the most common reason for disliking seafood was the 'fishy smell (37.4%)'. Conception degree of nutritive value of seafood was higher among individuals in their 30s and 40s than that for those individuals in their 50s, 60s and 70s. As for the price of seafood, the wives over 40s thought seafood was more expensive than did those wives in their 30s. The younger the individuals were, the lower was the perceived degree of safety was 49.8% of the subjects reported that the main concern for purchase was 'freshness'. The perceived degree of safety for imported seafood was better for the wives in their 60s and 70s than that for those wives in their 30s, 40s and 50s. The confidence level for local Korean seafood was higher for the wives in their 60s than that for the wives in their 50s. The degree of preference for seafood was moderate overall, except for Jellyfish. Age was positively correlated with conception for safety and dietary attitude (P<0.01), whereas age was negatively correlated with monthly food expenditure, nutrition knowledge and intake requirements (P<0.01). Preference for seafood was positively correlated with conception for safety (P<0.05), nutrition knowledge (P<0.05), dietary attitude (P<0.01), awareness for nutritive value (P<0.01) and intake requirements (P<0.01). Laws and regulations should be reinforced in order to promote eating more seafood and periodic research to determine the actual amount of consumed seafood and people's preferences should be conducted.

충청지역 공공도서관 조례에 포함된 도서관운영위원회 조항 분석에 관한 연구 (A Study on the Analysis of the Provisions of the Library Steering Committee Included in the Ordinance of Public Libraries in Chungcheong Province)

  • 본 연구는 충청지역을 중심으로 공공도서관 운영위원회 관련 조례 내용 중 도서관 운영위원회 관련 내용을 분석하여 문제점과 시사점을 도출하고 이를 기반으로 도서관 운영에 도움이 될 수 있는 운영위원회 조례 구성에 필요한 내용 및 보완 사항 등을 제안하고자 하였다. 이를 위해 첫째, 공공도서관 운영위원회의 의의와 역할, 조례의 성격에 관한 이론적 배경에 대해 살펴보았다. 둘째, 운영위원회 관련 조례제정 현황, 운영위원회 관련 조항 포함 여부, 구성 내용, 구성방식, 기능, 회의와 규정제정 및 수당지급 등 5개 영역으로 구분하여 분석하였다. 이 분석을 토대로 조례 담당 부서, 도서관운영위원회 의무 설치, 위원 구성에 있어 도서관장, 도서관 전문가의 참여 보장, 정기회의 개최, 회의록 공개, 위원회 심의 결과 반영 등이 필요함을 언급하였다. 또한 향후 도서관운영원회 관련 표준조례안 제정 시 운영위원회의 명칭, 성격과 역할, 구성, 회의, 하위 조직이나 규칙 제정 등에 관한 사항을 포함해야함을 제안하였다.
