온라인 사용후기에 대한 법적책임의식에 관한 (Consumers' Perception on Legal Liability of the Online Reviews)

  • 제품이나 서비스에 대한 사용후기 중에는 과격한 표현이 포함되거나 사업자에게 불리한 내용이 포함된 것들이 많아서, 후기 작성자와 사업자 간에 마찰이 빚어지거나 심지어 법률적 분쟁으로까지 이어지는 경우가 많다. 본 연구는 부정적이고 과격한 표현이 담긴 사용후기관련 사례를 분석한 후, 사례에 나타난 사용후기에 대한 소비자들의 윤리적, 법률적 인식을 비교하기 위해 설문 조사를 실시하였다. 사례연구에 따르면, 대법원 판례는 행위자의 주요한 동기나 목적이 공공의 이익을 위한 것이라면 부수적으로 다른 사익적 목적이나 동기가 내포되어 있더라도, 후기 작성이 상대를 비방할 목적이 있다고 보기 어렵다고 판시한 바 있다. 사례 요지를 바탕으로 소비자들의 인식을 조사한 결과, 사업자에게 불리한 내용의 사용후기일지라도, 응답자들은 대체로 작성자의 법률적 책임수준보다는 이러한 행위에 대한 지지수준이 더 높은 것으로 나타났다. 구체적으로, 이러한 사용후기는 공공의 이익을 위한 정보제공에 더 큰 의미가 있으며, 특히 소비자에게 정확한 정보를 제공하기 위해서 허용되어야 한다는 의견이 우세해서, 연구대상 사례에 대한 대법원 판결과 맥락을 같이 하고 있다. 결론적으로, 사용후기에 대한 윤리의식과 함께 법률적 책임의식을 향상시키기 위한 정책적 노력이 병행될 필요가 있으나, 표현의 자유가 과도하게 침해되지 않도록 균형을 이루는 것이 중요하다.

  • Clearly there are many legal arguments and criticisms surrounding the proposals for change in the Warsaw Convention and the need for a radical review. The question remains is unlimited liability the answer or should there be some other form of supplemental compensation and if so, what limits should be applicable. It does seem that the adopted limits of the Convention are seen by many as the first line of defence, which, dependent on political and cultural differences, the legal interpretation of contractual wording and the legal system globally have resulted in enormous differences in compensation paid whether or not the Convention limits were imposed. An example of this is in the United States, which highlights the significance of the problem in that domestic travellers without Convention Limits can, through the American legal system, obtain compensation in the multi-million dollar area for a death claim, whereas a passenger t1ying internationally would in the first instance be subject to Convention Limits. expensive legal action through litigation. To date, we can advise that insurers have not charged additional premium for unlimited liability coverage. Insurance rates as we have stated are hardening considerably. To date, average rate increases have been plus 56% for aircraft hull and plus 45% for liabilities. Insurers last year suffered global losses of around US $ 1.1 Billion against a premium income of US $ 800,000. The target premium income for 1993 is believed to be in the region of US $1.4 Billion.

  • The article explores the prospects and trends for the transformation of some basic concepts of law associated with the development of artificial intelligence systems and the problems of liability for harm caused by a robot. The prospects, conditions and consequences of vesting robots with partial (quasi) or full legal personality are explored. This process should lead to a revision of the concepts of will, subjective side and legal responsibility in the direction of their greater universalization. The legally significant signs of will, legal personality, legal liability in relation to robots, artificial intelligence systems and other complex automated information systems are clarified. The author identifies the following essential factors of legal qualification of an act committed by a robot: goals, reasons for setting goals, connections between the planned result and the action taken, the actual result, the reasons for the difference between the actual result and the planned one. The article pays special attention to the preventive function of legal liability, which, when applied to robot subjects, can be expressed in the following basic procedures. 1. Accounting for legal requirements in the behavior of the robot. 2. Timely adaptation of the robot to changes in legislation and other regulatory legal acts that affect its behavior. 3. Accounting for incidents. 4. Destruction of a series of robots whose actions lead to unacceptable consequences.

  • Since 1979, the People's Republic of China has been opeining their marke tprogressively toward all over the world for developing its own domestic economy and international trade. China also has paid a great attention to the international maritime transport due to the fact that its volume of international trade has increased continuoulsy. Under such circumstance, the Chinese Maritime Code was issued in 1992 in which the regulation with regard to carrier's liability occupied an important position. The author, therefore, selected this issue for demonstration of the legal proinciples about carrier's liability which is provided in the Chinese Maritime Code. The study on the issue is under guidance of related international conventions. On the basis of the above, the differences between the Code and relevant conventions have been pointed out in order to make the people in the field of shipping understood for legal system with regard to carrier's liability in China which is a great potential partner of Korea in shipping and trade.

  • As Complex Regional Pain Syndrome (CRPS) is a new and rare illness, medical cause for it has not yet been clearly found out. Nevertheless, the patients continue to file lawsuits for damage compensation against wrongdoers or their insurers, claiming that the cause of the illness is certain actions of the wrongdoers. Moreover, the claim amount reaches to hundreds of millions of won through billions of won unlike other illnesses. Therefore, CRPS has become an important legal issue in the damage compensation lawsuit. Even though the wound is slight, the development and result may be serious in the case of CRPS. As a result, a sharp conflict arises even regarding medical diagnosis of CRPS in the lawsuit. And, even if the medical diagnosis of CRPS is admitted, severe debates occurs with regard to many issues, which include the causation between accident and CRPS in connection with establishment of damage compensation liability and scope of liability like anamnesis, determination standard of aftereffect disability, and scope of admitted aftereffect medical expense in connection with scope of damage compensation. In this study, I will review fundamental medical research on CRPS up to now and discuss principal legal issues in the damage compensation lawsuit focusing on lower court rulings.

항공기 사고와 인적요인 -관제사의 불법행위를 중심으로- (Human-based aviation accidents with air traffic controller torts)

  • 항공산업이 비약적으로 발달을 함에 따라, 항공기사고의 위험성도 커지고 있다. 본 논문에서는 항공기사고의 인적요인 중 하나인 항공교통관제사 불법행위를 중심으로 다루었다. 현재 우리나라의 법령상 항공교통관제사의 불법행위 대한 책임을 규정한 명문은 없다. 따라서 국가공무원으로서의 항공교통관제사의 법적책임에 대하여 헌법제 29조1항과 국가배상법의 적용 여부를 살펴보았다. 실제로 우리나라는 항공사고의 원인이 항공관제사 과실에 의한 것이라는 유일한 판례가 1971년에 선고된 이후, 항공사고조사결과 관제사의 과실이 사고의 주요요인이었다고 함에도 불구하고 추가판례가 없는 상황이다. 본 논문은 항공사고에 있어서 관제사와 조종사간 요인 뿐만 아니라, 관제사에 대한 실제로 법령의 적용가능성을 해외사례를 통해 살펴보았다. 항공교통관제라는 특수한 업무가 고강도의 업무스트레스를 갖는 업무라 할지라도, 항공교통관제의 최종목적인 항공기의 안전한 운항을 책임지고 있는 전문가로서 항공기사고의 원인이 되었다면, 그에 따른 법적 책임은 져야 한다는 내용을 다루었다.

This thesis was established, based on current literature and business consulting cases in the position of companies, and is one of the operating subjects in a system for legal responsibility in manufactured products.
