An Analysis of Data Management Policies of Governmental Funding Agencies in the U.S., the U.K., Canada and Australia (국외 정부연구비지원기관의 연구데이터 관리정책 분석 - 미국, 영국, 캐나다, 호주를 중심으로 -)

  • This study aims to analyze data management policies offered by 15 government funding agencies in the U.S., UK, Canada, and Australia, and to make recommendations for developing data management policies in Korea. For the analysis of data management policies, five criteria were suggested based on literature review as follows: 1) the definition of research data, 2) principles of data management, 3) data management plan, 4) the implementation of data management, 5) legal and ethical issues. It was found that there was no policy that covers all the criteria for the analysis. Several funding agencies, however, commonly dealt with each criteria in their data management policies. Based on the findings from the analysis, this study made the following suggestions: First, data policies provide definitions and types of research data based on the understanding of data creation in the fields of funding interests. Second, data policies include principles of data management applicable to data practices in Korea. Third, data policies implement data management plans to promote responsibility of researchers for managing data. Fourth, data policies specify data management implementations to facilitate and support data sharing practices. Fifth, data policies should minimize legal and ethical challenges in data sharing through the review of the applicability of related laws and regulations and their improvement.

  • The purpose of this paper is to offer policies or laws governing the future of Korean seafood markets in view of societal marketing concept. The environment surrounding those markets is changing quickly and constantly. The proposals in this paper are meant to help the Korean seafood market coping with this swiftly changing environment. This paper sorts this changing environment in terms of institutional side and secio-economical side. The institutional side involves the enforcement of international and domestic seafood trade standards, the increase of seafood importation, the adoption of optional seafood sales system, the openness of distribution market, and the adoption of TAC system. The secio-economical side involves the development of telecommunication and transportation, and the changing of seafood consumption pattern. The forecast about the future of seafood market could be classified into three fields, that is, the production field, the distribution field, and the consumption field of seafood. In the production field of seafood, the stabilization of supply of seafood and the production management oriented seafood market could be forecasted. In the distribution field, the formulating of enforced trade standards, the dispersion of marketing function among fisher, wholesaler and retailer, the development of marketing skills, and the promotion of marketing information system could be forecasted. Finally, in consumption field, the promotion of standardization and diversification, the appearance of intellectual consumers could be forecasted. This paper seeks to offer policies or laws fur the three categories of the seafood market-the government, the fisher, and the distributor-coping with the changing environment on the above three fields, thereby benefiting the consumer's long-term welfare. For the government, this paper suggests the construction of a Seafood Transaction Information Infrastructure, a Seafood Dealer License System, and a Seafood Safety Security System. For the fishers, this paper proposes an Eco-labelling System, a Sustainable Production System, and a Real Naming System in dealing seafood. Finally, for the distributors, this paper offers a Seafood Production Controlling System, a Nature-friendly Marketing System, and a Consumer-oriented Marketing System.

  • It is necessary to look into multiple subjects, such as effectiveness, laws and polices of blockchain in order to easily accept blockchain technology in small and mid-sized enterprises(SME). This study analyzes the positive effects of applying the block chain to SMEs, examines the laws and policies required to apply them, and identifies the tasks. As a result, we confirmed that it can create positive effects such as optimizing supply chain management, simplifying import and export process documents, improving product quality, facilitating flow of funds, and improving transaction reliability. Also, we confirmed that it is necessary to improve the basic law of electronic transaction, electronic commerce law, electronic financial transaction law, personal information protection legislation, and needs policy supplement for platform development, education system for SMEs, transaction standardization guidelines, tax reduction policy, and block chain research and development. More extensive practical research and specific individual legal studies are needed in the future.

  • The various digital services that people are experiencing recently are bringing about changes in the daily lives, and these changes are due to the spread of the Fourth Industrial Revolution. The 4th Industrial Revolution is based on the development of ICT technology, and ICT technology inevitably generates issues such as the use and protection of personal information as well as the use of public data. Accordingly, countries around the world are making efforts to revitalize new industries by wisely solving conflicting issues between the use and protection of personal information through legislation. There are some differences in the protection and use of personal information in Korea, the United States, and the EU. Korea trys to make the legislation that prioritizes the use of data, and the United States establishes individual laws governing the protection of personal information by sector, while the EU has clarified the strengthening personal information protection. This paper aims to find out how personal information protection is defined in Korea, the United States, and the EU through enacted laws and organize the direction of the future policies.

Analysis of Female Development Fund Utilization of Primary Local Self-government : Focused on the City of Busan (기초자치단체 여성발전기금운용 분석 : 부산시를 중심으로)

  • The purpose of this study is to analyze current condition and features of female development funds of Busan primary local self-government, and to make useful implications out of this so that the local female development funds can contribute to its ultimate purpose, which is to achieve female development. The analyses show that 1) local self-governmental districts with good finance try to reserve funds by reducing programs; 2) local laws, which serve as the legal basis of female development fund utilization, do not reflect the value of gender equality; 3) the programs run by the female development funds lack contents; 4) beneficiaries of the fund programs aremixed; and 5) female policies and family policies are not separated, exhibiting the limitations of feministic perspectives. I propose that 1) the fund should be raised through the governance of local female groups and self-governments; 2) basic local laws should be revised: 3) gender perspective contents and birth support policy should be implemented.

Institutional Issues in Promoting Korean Spatial Data Exchange

  • The information system fields of spatial applications have rapidly grown during the last decade in Korea. Spatial data has been produced for a variety of systems without common standards until national GIS Committee defined the data exchange formats among spatial databases in the middle of 1990's. It aimed at promoting data sharing between the different systems in similar application fields. However, a considerable number of databases built prior to the introduction of the standards are not yet standard compliant but still play the roles of the main producers/consumers in the data collection field such as early developed huge AM/FM systems maintained by governmental organizations. The strong autonomy of these databases keeps their own data models, formats and descriptions from being standardized, which leads the sharing to a more difficult stage. Sharing is another way of data acquisition with least efforts and time away from direct collection. A data clearinghouse is the core module which directs users to the relevant data resources. The contents of datasets should be described with predefined metadata standards for precise indexing. Moreover, a number of technical problems have to be resolved for the common use of data between heterogeneous spatial database systems. However, the technical issues can be covered by the present information technologies. The difficulties persist in the political/institutional issues. Institutional issues are derived from the diverse sources such as political background, governmental policies, related laws and/or regulations. The paper will firstly make an analysis of current situation in terms of Korean policies, laws and regulations, secondly abstract the institutional issues from the situation analysis, lastly present guidelines for promoting spatial data sharing in Korea.

  • So far we have investigate and analyzed the actual conditions of building maintenance in Korea and compared the building maintenance laws and systems between Korea and other countries. Now, based on the results from such comparison and analysis, this study proposes the following ideas for improvement: 1) As we can learn from domestic and foreign case studies, in the existing built-up areas becoming obsolete, many building owners remodel their buildings illegally in reaction to current economic and social changes. Therefore, for efficient maintenance of buildings, it is required to improve building maintenance systems by formulating information about inspection items, inspectors, supervisors, inspection costs and intervals of reporting results, depending on how large the buildings are and what they are used for. 2) In addition, to ensure the success of a building maintenance system, it is necessary to keep and manage a history of building maintenance thoroughly and introduce a certification program which gives an appropriate grade to maintenance performance and commits the government to expand their public roles and supporting policies, as widely used in some foreign countries. Further, in keep the building maintenance system secure, there should be a nationwide consensus as well as a favorable evaluation from building owners and manager, and all related people.

A New Policy Study on Technical Document Review Changes and User-Centric Medical Device Advertising (사용자 중심의 의료기기 광고를 위한 기술문서 심사 변경의 새로운 정책 연구)

  • In the case of domestic medical device advertisements, it is possible to proceed with the advertisement after medical device certification, and pre-deliberation is possible based on the medical device technical document. However, there are some medical device advertisements that stakeholders in administrative procedures have no choice but to misunderstand in customs and laws that do not consider users. In addition, medical equipment and the pre-deliberation system were judged to be unconstitutional, and unconstitutional decisions were made in accordance with the principle of prohibiting pre-censorship based on the Constitution. This is because in domestic medical device advertisements, structural contradictions and user damage occur in the central structure of each stakeholder. It is necessary to reestablish stakeholder relationships, increase water solubility from customs and laws, and seek new policy proposals. In this study, we reestablish relationships with stakeholders by applying the Autopoiesis theory, and present the grounds and directions that can prevent hype and misidentified advertisements through the establishment of user-centered policies, and the measures to be taken by the Constitutional Court unconstitutional decision.

Establishing Policies towards Integrated Management of Soil Pollution and Damage (토양오염 및 훼손 통합관리를 위한 정책방향 설정)

  • In this study, the concepts of soil degradation, soil pollution and soil damage are defined, and the domestic and foreign administrative systems related to soil pollution and soil damage management are analyzed. In case of foreign countries, laws and regulations on the soil conservation and soil damage management were analyzed. In case of Korea, the present state of the legal system governing soil pollution and damage management was analyzed in each aspect. Through this study, suggestions for amendments of relevant laws were proposed by establishing policy direction for integrated management of soil pollution and soil damage. The results of this study will provide a basis for integrated management of soil pollution and damage, and it can be utilized in establishing integrated management strategy of long term soil conservation and sustaninable soil development at national level.

Studies on Problems and Improvement of Introducing No Wetland Loss (습지총량제 도입에 따른 문제점과 개선방안에 대한 연구)

  • Wetlands considered to be an important natural resources because they provide biodiversity and habitat for species to breed and survive. In this regard, many countries in the world provide wetlands and have policies and laws to protect them. In Korea we hosted RAMSAR COP-10 at Changwon in 2008 representing Korea's endeavor to wetland protection. But, in the process of development Wetlands are easy target to be lost due its easy access and the laws and regulations to protect them are relatively weak. Thus, this research focused on the introduction of No Wetland Loss(NWL) and we can achieve wetland protection in the economy market ways. Thus, NWL should consider 1) a clear definition of NWL and harmony and consensus of introduction of NWL, 2) considering most wetlands be private we need a financial support for securing wetlands, 3) inventories for wetlands in Korea, draw a line of demarcation, technic to evaluate wetlands, 4) wetland restoration considering function of ecosystem not total amount of wetlands. Wetland protection should be a part of Basic Law of Water Management which in its progress and we need further studies on wetland protection because of watershed management, deserted agricultural paddies, etc.
