Resistance Model for Reliability Analysis of Existing Steel Girder Bridges (강거더 교량의 신뢰성해석을 위한 저항모델 개발)

  • Because of financial and safety concerns, there are needs for more accurate prediction of bridge behavior. Underestimation of the bridge load carrying capacity can have serious economic consequences, as deficient bridges must be repaired or rehabilitated. Therefore, the knowledge of the actual bridge behavior under live load may lead to a more realistic calculation of the load carrying capacity and eventually this may allow for more bridges to remain in service with or without minor repairs. The presented research is focused on the reliability evaluation of the actual load carrying capacity of existing bridges based on the field testing. Seventeen existing bridges were tested under truck load to confirm their adequacy of reliability. The actual response of existing bridge structures under live load is measured. Reliability analysis is performed on the selected representative bridges designed in accordance with AASHTO codes for bridge component (girder). Bridges are first evaluated based on the code specified values and design resistance. However, after the field testing program, it is possible to apply the experimental results into the bridge reliability evaluation procedures. Therefore, the actual response of bridge structures, including unintentional composite action, partial fixity of supports, and contribution of nonstructural members are considered in the bridge reliability evaluation. The girder distribution factors obtained from the tests are also applied in the reliability calculation. The results indicate that the reliability indices of selected bridges can be significantly increased by reducing uncertainties without sacrificing the safety of structures, by including the result of field measurement data into calculation.

Arbitration Agreement through Standardized Terms and its Validity (약관을 통한 소비자중재합의와 그 유효성)

  • Recently, there have been discussions about the necessity of consumer arbitration such as ADR. The debate has progressed, because this area of arbitration has expanded into the press and medical fields. However, there is not an act for regulating consumer arbitration in South Korea. Thus, this issue has been deliberated at UNCITRAL Working Group III. The core issue of this deliberation is the validity of consumer arbitration. Especially if a pre-dispute arbitration agreement is contracted online, it progresses by using standardized terms; therefore it is possible that the Standardized Terms Regulating Act judges the relevant terms. This thesis consists of the following: First, concepts and categories of arbitration agreements. These include arbitration agreement, pre-dispute arbitration agreement, and arbitration agreement through standardized terms. Second, the validity of the above agreements will be discussed. There are three positions concerning their validity: affirmative as de lege ferenda, negative, and restrictively negative. Similar discussions concerning German law and cases would be helpful to specify and compare the issue. When a consumer arbitration agreement is contracted through standardized terms, it is necessary that the required formality of the agreement has been satisfied, before the effect of the agreement may be regulated by the German Civil Code.

A Study on The effect of Set aside Arbitral award made abroad (중재지인 외국에서 취소된 중재판정의 효력에 관한 고찰)

  • Recognition and enforcement of the arbitral award play an important role in the settlement of the international commercial disputes. The New York Convention makes it a duty for the courts of signatories to recognize and enforce the foreign arbitral awards not taking the nationality of the party concerned into consideration. Recognition and enforcement of the arbitral award may be refused if the award has not yet become binding on the parties, or has been set aside or suspended by a competent authority of the country in which, or under the law of which, that award was made. The arbitral award has the same force as an irrevocable judgement including effect of excluding further litigation, its execution and formation. But the effect of set aside arbitral award made abroad in arbitral place was denied by France court for the interest of his people. There is no arbitral act but arbitral procedure is regulated by New Code of Civil Procedure in case of France. An appeal against the decision which grants recognition or enforcement is open if the recognition or execution is contrary to international pubic policy in virtue of Art. 1502. Arbitrator may consider compulsory provisions in arbitral place to assure to recognition and enforcement of the arbitral award.

  • In a previous paper, ambient vibration tests were conducted on a cable stayed bridge with resilient-friction base isolation systems (R-FBI) to extract the dynamic characteristics of the bridge and compare the results with a seismic analysis model. In this paper, a nonlinear seismic analysis model was established for analysis of the bridge to compare the difference in seismic responses between nonlinear time history analysis and multi-mode spectral analysis methods in the seismic design phase of cable supported bridges. Through these studies, it was confirmed that the seismic design procedures of the "Korean Highway Bridge Design Code (Limit State Design) for Cable Supported Bridges" is not suitable for cable supported bridges installed with R-FBI. Therefore, to reflect the actual dynamic characteristics of the R-FBI installed on cable-supported bridges, an improved seismic design procedure is proposed that applies the seismic analysis method differently depending on the seismic isolation effect of the R-FBI for each seismic performance level.

  • Under the Civil Code and related law in Korea, the liability for defects after delivery belongs to the Contractor. However, various disputes have occurred in relation to the remedy of such defects and the compensation for damages, which are the main liability of a contractor in the event of defects. Despite court decisions regarding defect liability, many problems prevail in the real world. For this reason, this working-level research considers the introduction of a performance warranty contract system. To establish the system successfully, it is necessary to analyze the trend of various warranty cases in the US. Therefore, the warranty system of the US was first examined, and the effect of acceptance, notification and burden of proof, remedies under warranty clauses, and default termination were investigated and analyzed in this study.

Effects of Additive and Preheat on the Partially Premixed $CH_4-Air$ Counter Flow Flames Considering Non-gray Gas Radiation

  • Detailed structures of the counterflow flames formed for different inlet fluid temperatures and different amount of additives are studied numerically. The detailed chemical reactions are modeled by using the CHEMKIN-II code. The discrete ordinates method and the narrow band based WSGGM with a gray gas regrouping technique (WSGGM-RG) are applied for modeling the radiative transfer through non-homogeneous and non-isothermal combustion gas mixtures generated by the counterflow flames. The results compared with those obtained by using the SNB model show that the WSGGM-RG is very successful in modeling the counterflow flames with non-gray gas mixture. The numerical results also show that the addition of $CO_2\;or\;H_2O$ to the oxidant lowers the peak temperature and the NO concentration in flame. But preheat of fuel or oxidant raises the flame temperature and the NO production rates. $O_2$ enrichment also causes to raise the temperature distribution and the NO production in flame. And it is found that the $O_2$ enrichment and the fuel preheat were the major parameters in affecting the flame width.

Numerical Study of Contaminant Pathway for Risk Assessment in Subsurface of Contaminated Sites (오염부지 위해성평가 시 오염물질 노출이동경로 평가를 위한 수치모델 적용에 관한 연구)

  • The purpose of this study is to suggest conceptual models based on finite numerical method that can be used to assess contaminant transport through subsurface and estimate exposed concentration at contaminated site. This study tested various assumptions of the numerical models for contaminant transport in unsaturated and saturated zones to simulate the pathways to the human exposal point. For this purpose, models for seven possible scenarios of contaminant transport were simulated using the numerical code MODFLOW and MT3D. The simulation results that showed different peak concentrations and travel times were compared. In conclusion, the potential utility of the numerical models in the site specific risk analysis suggested as well as future research ramifications.

Investigation on Ultimate Strength of STS304L Stainless Steel Welded Connection with Base Metal Fracture Using Finite Element Analysis

  • Many studies on the application of stainless steels as structural materials in buildings and infra-structures have been performed thanks to superior characteristics of corrosion resistance, fire resistance and aesthetic appeal. Experimental investigation to estimate the ultimate strength and fracture mode of the fillet-welded connections of cold-formed austenitic stainless steel (STS304L) with better intergranular corrosion resistance than that of austenitic stainless steel, STS304 commonly used has carried out by authors. Specimens were fabricated to fail by base metal fracture not weld metal fracture with main variables of weld lengths according to loading direction. All specimens showed a block shear fracture mode. In this paper, finite element analysis model was developed to predict the ultimate behaviors of welded connection and its validity was verified through the comparison with test results. Since the block shear behavior of welded connection due to stress triaxiality and shear-lag effects is different from that of bolted connection, stress and strain distributions in the critical path of tensile and shear fracture section were investigated. Test and analysis strengths were compared with those by current design specifications such as AISC, EC3 and existing researcher's proposed equations. In addition, through parametric analysis with extended variables, the conditions of end distance and longitudinal weld length for block shear fracture and tensile fracture were suggested.

In-Plane Stability of Concrete-Filled Steel Tubular Parabolic Truss Arches

  • For determining the in-plane buckling resistance of a concrete-filled steel tubular (CFST) arch, the current technical code GB50923-2013 specifies the use of an equivalent beam-column method which ignores the effect of rise-to-span ratio. This may induce a gap between the calculated result and actual stability capacity. In this study, a FE model is used to predict the buckling behavior of CFST truss arches subjected to uniformly distributed loads. The influence of rise-to-span ratio on the capacity of truss arches is investigated, and it is found that the stability capacity reduces as rise-to-span ratio declines. Besides, the calculations of equivalent slenderness ratio for different truss sections are made to consider the effect of shear deformation. Moreover, based on FE results, a new design equation is proposed to predict the in-plane strength of CFST parabolic truss arches under uniformly distributed loads.

A Comparative Study between International Convention and National Legislation in Respect of the Liability of the Carrier in the Carriage of Cargo by Air (항공화물운송인의 책임에 관한 국제협약과 국내입법의 비교연구)

  • The purpose of this paper is to research the contents and issues of the draft legislation of Part VI the Carriage by Act of Korean Commercial Code in respect of the liability of the carrier in the carriage of cargo by air, comparing to the related provisions of the Montreal Convention of 1999. The Montreal Convention in respect of the international carriage by air was adopted in 1999, and Korea has ratified the Montreal Convention in 2007. However, there is now no national legislation in respect of the carriage by air in Korea. Thus, the Ministry of Justice has prepared the draft legislation of Part VI the Carriage by Air of the Korean Commercial Code in July 2008, and the draft legislation is now being reviewed by the National Assembly. The draft provisions of Part VI the Carriage by Air are basically adopting most of the related provisions of the Montreal Convention in respect of the carriage of cargo by air and some draft provisions are applying the related provisions of the Korean Commercial Code in respect of the carriage of cargo by land and sea. In respect of the liability of the carrier in the carriage of cargo by air, the contents of the draft legislation of Part VI the Carriage by air are composed of the provisions in respect of the cause of the liability of the and the application for the non-contractual claim, the limit of liability, the exoneration from liability, the extinguishment of liability, the notice of damage to cargo, the liability of the agents and servants of the carrier, and the liability of the actual carrier and successive carrier. The draft legislation of the Carriage by Air of Korean Commercial Code is different from the provisions of the Montreal Convention is respect of the liability of the carrier in the carriage of cargo by air as follows : the draft Article 913 paragraph 1 provides additionally the riot, civil war and quarantine as the exoneration causes from the liability for damage to the cargo of the carrier in the Article 18 paragraph 2 of the Montreal Convention. In respect of the liability of the carrier in carriage of cargo by air, the draft legislation of Part VI the Carriage by Air does not provide the settlement by arbitration of dispute relating to the liability of the carrier and the requirement of adequate insurance covering the liability of the carrier which are provided in the Montreal Convention. In author's opinion, it is desirable that the above mentioned provisions such as the arbitration and the insurance shall be inserted into the draft legislation of the Carriage by Air of Korean Commercial Code. In conclusion, the legislation of Part VI the Carriage by Air of the Korean Commercial Code shall be made by the National Assembly as soon as possible for the smooth and equitable compensation for damage to cargo arising during the carriage by air.
