A Study on the Internet Defamation Policy and Law - Focusing on the Communications Decency Act of 1996 and the Brodie Case (인터넷 명예훼손 방지를 위한 정책과 법안에 관한 연구 - 미국의 통신품위법과 Brodie 사건을 중심으로)

  • Defamation is one of the most frequently occurring daily legal violation because it can easily be done by words. In the internet generation with flooding internet forum websites and social network services, internet defamation is becoming one of the most serious problems in many leading IT countries including Korea and the United States. Being such a critical issue that can lead to a suicide, Korean policy makers has undertaken efforts to prevent the internet defamation by defining the liabilities of internet users and internet service providers. Many of the policies and laws including "the Telecommunication Information Usage Promotion and Security Protection Act of 2007" are modeled after that of the United States. Thus, the study aims to explore American defamation law and internet defamation law analyzing "the Communications Decency Act of 1996" and a recently decided precedent, "Brodie" case, in Maryland state court.

  • Cyber defamation is the act of damaging the reputation of the other person on the Internet, and the act of attacking by the commenting the article through a word or blog. The reason why punishment is stronger than general contempt is that the nature of crime about defamation is worse than contempt. Also, punishment intensity is higher than defamation because the nature of cyber information spreads widely. Honor is not only a question of self-esteem or identity, but also a function that economically reduces the cost of seeking information or socially trustworthy. Through these two functions, it has been developed as a legal system to protect the honor as well as asking the legal sanction for defamation. However, although honor is used in various meanings in everyday life, the honor of legal level is understood in a more limited sense. It is because the law cannot actively lead and protect all honor feelings for one's feelings or mood occurred by hurt. However, if the social evaluation of a group or individual is undermined through a certain distortion of the truth, the law will actively intervene. However, due to the ambiguity of the legal sanctions standards and the identification of the parties involved in the defamation of cyberspace, it was difficult to solve the problems related to defamation in fact. Therefore, this paper will try to find out the problems of civil legal remedy due to the cyber defamation, and seek a solution for civil legal remedy.

A Study on the Scope of Protection for Freedom of Expression on Internet: Focused on the Analysis of Judicial Precedents on Cyber Conflicts (인터넷에서 표현의 자유 보호 법리에 관한 연구: 사이버 분쟁에 대한 법원 판례 분석을 중심으로)

  • Various opinions are expressed about the Internet Regulation. Some people argue that it is impossible to control because of the technical characteristics of Internet, while other people argue that it is easy to control. Recently in Korea, a move to reinforce the Internet Regulation through the extension of cyber real-name system is emerging, whereas the concern for its excessive infringement of the Freedom of Expression is increasing. This paper was intended to draw a reasonable direction for Internet Regulation in our society. And accordingly this paper tried to suggest a desirable direction of Internet Control in the future and to draw a criterion for domestic court judgement by analyzing cases of cyber defamation so far. The result of this study proposed that the Freedom for Expression be widely secured in the case of cyber defamation of criticism and political comments upon public officials and that the legitimacy and effectiveness of Internet Regulation be ensured. This result of study is expected to help establish the direction and principle of Internet Regulation in the future around Korea Communications Commission and Korea Communications Standards Commission.

  • Despite the increased social demand for strengthening the punishment for ghost surgery in Korea, the governmental management is very passive compared to other offenses of medical law, and the punishment for ghost surgery is insufficient, so that medical malpractices are continuously occurring. A plastic surgeon who posted the names of clinics performing ghost surgery and the number of deaths on the internet bulletin board, was charged with the violation of the Information Telecommunication Act(defamation). Thus, this study aimed to present the legal/institutional issues and implications of defamation by the release of ghost surgery, by initially examining the charged case after posting the contents showing the death of patients by ghost surgery in clinics on the internet bulletin board. This study aimed to understand how strictly the court approached the ghost surgery in the aspect of public interest, and also to understand the judgment standard of punishment for defamation by investigating the publicly alleging facts and public interest by the disclosure of ghost surgery. Moreover, this study aims to provide the basic data necessary for guaranteeing the national health right by arousing attention to ghost surgery.

Effects of Cyber Defamation Victims' Post-Traumatic Stress on Coping behaviour : Focusing on the Theory of Reasoned Action (사이버 명예훼손 피해자의 외상 후 스트레스가 대처행동에 미치는 영향 : 합리적 행동 이론을 중심으로)

  • The purpose of this study examined how post-traumatic stress, caused when internet users in web portal or social media are defamed in cyberspace, influence on coping behaviour, through the Theory of Reasoned Action's two major factors: Attitude on behaviour and subjective norm. In so doing, it aims to provide a technical and political solution that would fundamentally prevent future victims in cyberspace. In an effort to examine its research theory, a survey was conducted on people who have had the experience of being defamed in cyberspace. The results showed, first, hypersensual has no significant influence over attitude on behaviour and subjective norm. Second, intrusion has no significant influence over attitude on behaviour and subjective norm. Third, avoidance showed significant influence over attitude on behaviour and subjective norm. Fourth, attitude on behaviour and subjective norm showed significant influence on behaviour. This study has both theoretical and practical significance; Unlike previous studies on cyber defamation with qualitative research method, this study employed quantitative method through theory-based approach. In other words, the researcher did not arbitrarily set variables, but utilized the Theory of Reasoned Action for examination.

  • Defamation on the Internet is a criminal offense. Of late, the damage it has been causing has grown exponentially. Here, we suggest some ideas to expand the use of arbitration in Korea. We suggest that all disputes arising in connection with current contracts be settled under the rules of conciliation and arbitration. As a countermeasure to the requirements for defamation or damages, the field of criminal arbitration regulations needs to be defined strictly. In conclusion, the UK does not make provisions for arbitration as a specific subject. With respect to foreign legislation, it is necessary to take a look at ways to expand arbitration in our country. The scale of arbitration must be expanded to allow for greater protection of criminals in exchange for their cooperation in arbitration cases and relative to the amount of the damages in dollars. There must also be detailed instructions regarding the eligibility criteria for and proper handling of these arbitration cases.

  • Online defamation incidents such as Internet news comments on portal sites, SNS, and community sites are increasing in recent years. Bias and hate expressions threaten online service users in various forms, such as invasion of privacy and personal attacks, and defamation issues. In the past few years, academia and industry have been approaching in various ways to solve this problem The purpose of this study is to build a dataset and experiment with deep learning classification modeling for detecting various bias expressions as well as hate expressions. The dataset was annotated 7 labels that 10 personnel cross-checked. In this study, each of the 7 classes in a dataset of about 137,111 Korean internet news comments is binary classified and analyzed through deep learning techniques. The Proposed technique used in this study is multi-channel CNN model with attention. As a result of the experiment, the weighted average f1 score was 70.32% of performance.

A Study on the Toxic Comments Classification Using CNN Modeling with Highway Network and OOV Process (하이웨이 네트워크 기반 CNN 모델링 및 사전 외 어휘 처리 기술을 활용한 악성 댓글 분류 연구)

  • Purpose Recently, various issues related to toxic comments on web portal sites and SNS are becoming a major social problem. Toxic comments can threaten Internet users in the type of defamation, personal attacks, and invasion of privacy. Over past few years, academia and industry have been conducting research in various ways to solve this problem. The purpose of this study is to develop the deep learning modeling for toxic comments classification. Design/methodology/approach This study analyzed 7,878 internet news comments through CNN classification modeling based on Highway Network and OOV process. Findings The bias and hate expressions of toxic comments were classified into three classes, and achieved 67.49% of the weighted f1 score. In terms of weighted f1 score performance level, this was superior to approximate 50~60% of the previous studies.

A Study on the coverage of e-commerce insurance (전자상거래 보험의 담보범위에 관한 고찰)

  • Todays, computers in business world are potent facilitators that most companies could not without them, while they are only tools. They offer extremely efficient means of communication, particularly when connected to Internet. What I stress in this article is the risks accompanied by e-commerce rather than the advantages of Internet or e-commerce. The management of e-commerce companies, therefore, should keep in mind that the benefit of e-commerce through the Internet are accompanied by enhanced and new risks, cyber risks or e-commerce risks. For example, companies are exposed to computer system breakdown and business interruption risks owing to traditional and physical risks such as theft and fire etc, computer programming errors and defect softwares and outsider's attack such as hacking and virus. E-commerce companies are also exposed to tort liabilities owing to defamation, the infringement of intellectual property such as copyright, trademark and patent right, negligent misrepresent and breach of confidential information or privacy infringement. In this article, I would like to suggest e-commerce insurance or cyber liability insurance as a means of risk management rather than some technical devices, because there is not technically perfect defence against cyber risks. But e-commerce insurance has some gaps between risks confronted by companies and coverage needed by them, because it is at most 6 or 7 years since it has been introduced to market. Nevertheless, in my opinion, e-commerce insurance has offered the most perfect defence against cyber risks to e-commerce companies up to now.
