Arbitration, which involves a final determination of disputes, has elements of the judicial process. Although an alternative to formal court litigation, it does not replace it in all aspect, but rather coexists with court procedure as an adjunct and part of administering justice. As the international trade has the basic problems of business managed between the parties of other countries having different laws, customs, cultures, currencies and religions. It has been known that these defects caused the commercial disputes and suspended economic fluence in world economic development through the foreign business. The United Nations launched 'the United Nations Convention on the Enforcement and Recognition of the Foreign Arbitral Awards' in 1958 to give effect to the international commercial arbitration. However, the convention has the limitation in excluding the legal obstacles originated from domestic arbitration systems of every states. As the result, the UN succeeded in making world wide arbitration law named 'The UN Model Law on International Commercial Arbitration' in 1983 and recommended all member countries to accept it to revise their domestic arbitration laws thereafter. Korea revised national arbitration law accepting 100% of the model law in 2000. In this respect korea became to have the international dispute settlement system. Korea will be able to settle more business disputes arisen from the international trade and enjoy the world credibility through the new arbitration system.
This study aims to verify the structural relationship among service orientation, employees' satisfaction and business performance primarily on the International Freight Forwarders. For carrying out the study, literature survey relating to service orientation, satisfaction and performance along with empirical analysis was carried out. Results of analyses were found to be as follows: first, International Freight Forwarder's service orientation has had influence on employees' satisfaction second, employees' satisfaction in the freight forwarding companies has had influence on financial performance.
Our country's sustainable trade growth fundamentally depends on the supply of excellent labors called global trade expert. He or she is required several knowledge and skills not only trade, marketing, information technology, foreign languages but also global mind. Universities have to supply excellent global trade expert to companies according to needs and wants. The object of this paper is to propose some ideas for training of global trade expert of Korea university under global trade environment. First, global companies prefer labors who have not only some skills about specialty and communication skill but also personality on passion, creativity, leadership and so on. Second, The university's curriculum needs to improved in terms of "convergence" and "specialty". In nature, trade major treats lots of subjects such as trade, business adminstration, economics, international law, international commerce, logistics, marketing, etc to catch up changing global business circumstances and companies' needs. Therefore convergence of adjacent field is very important in study and training. Finally, Universities need to use field-specialist to supplement of trade working experience as instructors and practitioners. The concept of convergence and specialty is not separated but harmonious each other.
Purpose - The objective of this research is to investigate how selected Korean General Trading Companies, (KGTCs), manage their international distribution channels to sustain the growth of the international marketplace. Specifically, the following questions were answered: What is the profile of the respondents in the position from the company, the experience in channel of distribution operations, the number of distribution channels existing in the international marketplace. Research design, data, methodology -The thirty-nine respondents representing 55 percent have less than 10 years of experience in channel of distribution operations while 34 respondents, equivalent to 45 percent have 10 or more years of experience. All of the respondent KGTCs are using the channel of distribution in their export operations in Asia. Respondent KGTCs' 2015 export sales in Asia were between US$ 100 to 200 million. Results - There are no significant differences in the perceptions of the two groups of respondents with regard to the perceived practices of KGTC in the management of international distribution channels. Exporting companies use common sense when managing conflicts and emphasize the importance of a clear contract which states what obligations and requirements there are of each party in order to prevent conflict. Conclusions - The higher level of details in the contract, the lesser would conflicts arise. The more intense communication, the higher level of information exchange. Construction firms have long sought success in the global construction market through diversifying revenue sources and project portfolios. The volume of international contracts has contributed to firms' sustained growth by mitigating the impact of the domestic market's cyclical nature. In spite of the importance of international construction, the uncertainty and dynamic changes surrounding global construction pose serious threats to global contactors. Over the last decade, the international construction industry has changed drastically in many ways, particularly including financial resource diversity, competition rules for the selection of contractors, and the terms of delivery systems requiring more competent total service providers. This paper investigates the important changes for global contractors through various documentation analysis as well as in-depth interviews with industry experts. This paper then analyzes the common strategies and lessons obtained from the cases of leading global contractors that have sustained their growth in the competitive global construction during the last decade. In addition, the authors further analyzed the comparisons between those firms and Korean contractors to discern any difference in sustaining their growth in the competitive market. It was found that those leading firms were quite proactive and responsive to changing markets by diversifying their market revenues to stabilize their revenue structure and enhancing their competency through a wide range of 'business convergence'. In addition, they significantly increased their upstream/downstream functional capabilities; hence becoming more competent service providers, able to grow in these rapidly changing market conditions. Finally, this paper benchmarks the critical strategies that support growth, which in turn can provide a strategic guideline for expansion into the global construction market.
Developing countries including poor countries cannot accumulate enough domestic saving and government budget for their industrialization. They need to finance the capital for development from abroad sources; foreign direct investment (FDI) and official development assistance (ODA). The developing countries can improve their business climate for more ODA. This paper examines whether ODA improve the business climate of developing countries. In this paper, the business climate are measured by the starting business scores and the scores of credit and protecting investor in Doing Business project of World Bank. According to the empirical result, ODA has significant effect on the starting business scores for low and lower middle income countries, but insignificant effect for upper middle countries. In the case of the scores of credit and protecting investor, ODA has significant effect only for lower middle income countries.
In the current digital age, most of the countries in the world recognize the electronic business to be a very prospective area in the future and plan to activate for the preoccupation of the business. As a result, this led a rapid increase of the electronic business volume. Electronic business takes place in the cyber space, using internet. However, the intellectual property rights have a high degree of possibility of being infringed as the digitalized intellectual property is easy to receive, copy and transmit in the cyber space. The language structure on the web, represented by HTML, makes easier to copy the intellectual property. And, as the internet has no national boundary, the infringement of the intellectual property rights is easier regardless of country, which could lead to the commercial disputes between the concerned countries. There are in fact many legal disputes nowadays on the infringement of the intellectual property rights in such field as computer programming, infringement of the copyright, business model patent and infringement of the trademark right on the registered name of the domain. It is, therefore, time now to prepare a new theory or legal system to protect the intellectual property rights on copyright, patent and trademark right so as to comply with the digital environment together with such a splendid growth of "electronic business." USA and Germany are nowadays making a significant movement on the legislation of the electronic business, and this study will focus on the legislative contents, judicial precedents and interpretation of law in the above countries.

In this paper, a contribution is presented covering the data set in improving and developing electronic services provided to citizens through e-government services based on business intelligence in government agencies in the Republic of Sudan. The Business Intelligence Concept Survey was conducted from the perceptions of information department employees in government agencies. The survey was conducted from April to June 2021 using questionnaires. The dataset contains responses about the factors that influence the use of business intelligence and the barriers and limitations to the use of business intelligence. A five-point Likert scale was used to analyze the quantitative data. The opportunities and challenges associated with it were also discussed and explored. As evidenced by the results, the information department employees agree that business intelligence improves the government decision-making process, which helps decision makers and decision-makers to find alternatives and opportunities that contribute to making more accurate and timely decisions. The results also indicate that creating the infrastructure for applying business intelligence in the e-government work model contributes to the successful implementation of business intelligence in Sudan.
INCOTERMS have been changed almost every 10 years since ICC established INCOTERMS as trade terms for International transaction. Recently transportation has become bigger, and modernized by means of electronic appliances such as RFID, IT, and containerization. FRC, FOR/FOT, FOA were added in INCOTERMS1980 and every conditions are unified into three alphabets in INCOTERMS1990. The best features of INCOTERMS2000 are that FCA substitute FRC, FOR/FOT, FOA and customs formalities were simplified to make clear for each party of contract. It seems that business circles still stick to old customs of their trade like FOB or CIF not only in Korea but in an international practice even though there have been several revisions of INCOTERMS until now. ICC have tried to provide INCOTERMS3000 to solve problems between a theory and an actual condition of international trade. This study has tried to suggest opinions against INCOTERMS3000 and has surveyed a recognition, an actual using situation and issues of INCOTERMS to get improvements. For a recognition of INCOTERMS has been spread as you can find at tables many kinds of business circles still stick to old customs of their trade terms FOB and CIF. Now there are two alternative plans. Firstly, we need to suggest improvements against inconsistency of INCOTERMS to be applied on newly revised INCOTERMS3000 and educating business circles to use proper conditions of INCOTERMS for their doing business. Secondly, we shall participate in revising INCOTERMS to activate multimodal transport conditions of INCOTERMS and provide solutions to fill gap between a theory and an actual condition of international trade. It seems that terms of multimodal transport such as FCA, CPT, or CIP can be a perfect condition for each party of contract. We have examined the inconsistent features of Ship's rail and notions of on board, and observed how to activate multimodal transport terms. These would be hot issues of next revision of INCOTERMS and we provided improvements on each trade terms, THC charges, or others against INCOTERMS.
The importance of trade in services has been increasing day by day, but the research on it is insufficient so far in terms of basic information, statistics, influence, industrialization and so on. To foster of professional trader in services, we need curriculums, textbooks and training centers like academy or college in advance. We have well developed curriculums for trade in goods since 1960's in Korea, so we can transfer the trade in goods' curriculum to trade in services. There are some differences between trade in goods and trade in services basically, but we can borrow a lot of idea from trade in goods in terms of basic framework like international economics, international business and international commercial transactions. This study propose the basic framework for trade in services' curriculum. First, trade in services economics handle the basic concept, statistics, characteristics, theories etc. Second, trade in services business treat the global companies to expand their business to global market, so characteristics of service companies, marketing plan and strategies and so on. Third, international commercial transaction of trade in services concentrate for procedures and contracts in terms of formation, implementation and finish of contract. Finally, Services industries can be a future strategic industry to any contries, so there are some national and corporates' strategy for expanding their business. This study acts on the initial idea for curriculums of trade in services, so I am looking forward to many criticism and development from another researchers to develop the model curriculums and textbook for education of specialized trader in services.
