Obviousness Standard and Ease of Interchangeability in the Doctrine of Equivalents (기술혁신의 관점에서 본 균등요건의 치환자명성과 특허요건의 진보성의 관계)

  • In 97hu2200, the Supreme Court of Korea suggested five requirements to apply the doctrine of equivalents, i.e. identity of problem-solving principles, interchangeability, ease of interchangeability, exception of known arts and file-wrapper estoppel. There have been arguments on whether the standard of ease of interchangeability could be regarded as the same as the obviousness standard in deciding patentability. The side who thinks that they are different (hereinafter, the side of difference) considers that the standard of ease of interchangeability is narrower than the obviousness standard. This side criticizes the side who thinks that they are the same each other (hereinafter, the side of the same) on the reason that doctrine of equivalents can be overly expanded. On the other hand, 'the side of the same' argues that every accused invention having no inventive step from the perspective of the patented invention should be considered to infringe. 'The side of the same' points that if the standard of ease of interchangeability is considered as narrower than the obviousness standard, 'grey area' should exist where the patent law cannot work. The difference between the two side may cause contradictory results in the decision of infringement under the doctrine of equivalents. Because 'the side of difference' construes claims narrowly than 'the side of the same,' an accused invention in the grey area is not regarded to infringe. 'The side of the same,' however, considers the accused invention to fall into the scope of the patent under the doctrine of equivalents. This paper concludes that the standard of ease of interchangeability should be regarded as the same as the obviousness standard from the perspective of economics of innovation.

Elementary and Secondary School Teachers' Perceptions on Inter-Disciplinary Science Education(IV) (학문 통합적 과학 교육에 대한 초중등 교사들의 인식(제IV보))

  • This is a survey research which investigated perceptions of 85 elementary and secondary school science teachers on inter-disciplinary teaching in general. It is expected that the results of this survey will help to find out the necessity, the appropriate time, the proper approach and the obstacles of inter-disciplinary education. Results indicated that 49.5% of the teachers were aware of inter-disciplinary teaching and 61.2% of the teachers agreed with the necessity of implementing inter-disciplinary strategy. However, considering difficulties in objective assessment and burdens of college entrance exam preparation, they responded that inter-disciplinary teaching could be more appropriate and feasible to be implemented for lower graders at elementary schools than secondary school students. Of the answers to the integrated approaches, 57.6% of teachers chose the theme-based approach, and 16.5% chose the problem-based approach. When they chose the theme-based approach, they stated the reason of educational readiness. On the other hand, when they chose the problem-based approach, they stated the reason of educational obligation which assumes that a problem solving needs inter-disciplinary approach. The teachers also selected 'lack of knowledge on other subjects' and 'lack of time to prepare teaching materials' as major predicaments in implementing inter-disciplinary approach. This suggests that there needs a clear and specific teaching strategy along with a guidance to teaching materials for inter-disciplinary teaching.

  • Simulation based Battle Experimentation is to examine the readiness for a battle using simulation technology. It heavily relies on the weapon systems modeling and simulation. To analyze the characteristics and complexity of the weapon systems in the experiment, the modeling & simulation environment has to be able to break down the system of systems into components and make the use of high fidelity components such as real hardware in simulation. In that sense, the modular and hierarchical structure of DEVS (Discrete EVent System Specification) framework provides potentials to meet the requirements of the battle experimentation environment. This paper describes the development of the DEVS integrated development environment for Simulation based Battle Experimentation. With the design principles of easy, flexible, and fast battle simulation, the newly developed battle experimentation tool mainly consists of 3 parts - model based graphical design tool for making DEVS models and linking them with external simulators easily through diagrams, the experiment plan tool for speeding up a statistic analysis, the standard components model libraries for lego-like building up a weapon system. This noble simulation environment is to provide a means to analyze complex simulation based experiments with different levels of models mixed in a simpler and more efficient way.

Exploring Differences of Customers' Perceptions toward Mobile Services (모바일 서비스에 대한 이용자의 품질인식 차이에 관한 연구 : 한국과 미국 이용자를 중심으로)

  • Because the mobile services is composed of heterogeneous attributes, it is hard to find out customer's potential needs and more difficult to analyze customer's satisfaction factors toward mobile services. Therefore, this study approached this issue from a new viewpoint and applied Kano Model in analyzing customer's satisfaction and dissatisfaction factors toward mobile services. By using Kano Model, it tried to find out how differently customers perceive the mobile services. Firstly, we found out perception gaps of Korean and American customers toward mobile services. While Korean customers perceived most mobile services as indifferent service attributes, American customers perceived them as attractive service attributes. We could find main reasons of these perception differences from different national backgrounds and adoption rates of smart phones between two countries. Secondly, based on TRI scores, we categorized subjects into four groups and named as Pioneers, Explorers, Skeptics and Laggards. And then we examined the perception differences to mobile services among four groups. We found that there were no significant perception differences among four groups.

  • The development and accomplishment of Open Source Software(OSS) is one of the hottest, as well as the most recent topics in the software industry. Prior studies with respects to OSS have concentrated on discovering both developers and users' rationales of participating OSS projects, analyzing specific OSS solutions or OSS movement itself. However, the empirical study on identifying determinants that influence organizational adoption of OSS and further diffusion of the technology has been a scant. Thus, the main purpose of this study is to investigate the key determinants affecting organizational adoption of OSS. The proposed research model incorporates organizational needs(Evolutional Leadership, Adaptive performance, Readiness for Change) and technological needs(Job Relevance, Cost Benefits, Software Quality) in order to explain organizational OSS adoption. Further, this study assesses the impact organizational OSS adoption has on the OSS Performance and OSS Diffusion. Results from 366 adopting organizations in various industries show three constructs in organizational needs and two constructs in technological needs with exception of Job Relevance have a significant influence on OSS Adoption; and adoption impacts its performance, and diffusion. The implications of the results suggest not only a new theoretical model for OSS research, but also the important implications for OSS diffusion.

  • This paper aims to develop a Korea wind chill temperature index using an experimental method. For this, the researchers carried out a preliminary experiment in order to of for provisions necessary for the selection and safety of test participants, accuracy of experiment, and readiness for various situations that may occur during experiment. The researchers also investigated test subjects' safety and experiment conditions in which wind speed changes from calm condition into strong wind speed condition under the constant air temperature of $5^{\circ}C$. The results of this study are as follows. With regard to the variation of facial skin temperature such as forehead, cheek, nose, and chin, the skin temperature of cheek closely appears to depend on the change of air temperature and wind speed, exhibit a stable variation trend of skin temperature, and indicate the lowest temperature than any other facial parts. The skin temperature of women tends to be more sensitive than that of man and the skin temperature of human tends to decrease at weak wind speed under constant air temperature. It was also found that it is not necessary to take the influence of standard wind speed into consideration when a wind chill index is developed.

A Study on Determinants of High-growth Firms: Focusing on Technology Appraisal Indicators (고성장기업의 결정요인에 관한 연구: 기술평가지표를 중심으로)

  • This study analyzed the determinants of high-growth firms using the technology appraisal data of the Korea Technology Finance Corporation. This study is differentiated from previous studies for three reasons. First, it analyzed the determinants of firms that will grow into high-growth firms in the future, not the characteristics of current high-growth firms. Second, it analyzed high-growth firms by dividing them in two aspects: sales and employment. In other words, they were divided into three types: the case in which a firm achieves high growth in both sales increase and creation of jobs, the case in which a firm achieves high growth in creation of jobs but low growth in sales increase, and the case in which a firm achieves high growth in only sales increase but low growth in creation of jobs. Third, this study applied the technology appraisal indicators of Kibo Technology Rating System(KTRS) by the Korea Technology Finance Corporation as the explanatory variable. As a result of analysis, it was found that a firm achieved high growth in both sales and employment if the position in the technology life cycle was appropriate and the technology readiness level was high. However, it turned out that the management system of technical manpower had conflicting effects on high growth of employment and sales. In other words, a firm that had well managed its technical manpower achieved high growth in terms of employment, but rather showed low growth in terms of sales. This result suggests the inference that firms showing high growth in employment may appear mainly in the high-tech industry where management of technical manpower is important. Accordingly, as a result of adding dummy variables that represent whether or not firms are in the high-tech industry, it was found that the result supported the inference, as firms in the high-tech industry were highly likely to achieve high growth in employment.

A Phenomenological Study on Mother-Infant Interacting Behavior Patterns Related to Newborn Infant Feeding in Korea (한국인 영아초기 수유시 모아상호작용 행동형태에 관한 현상학적 연구)

  • The purpose of this study was to describe mother -infant interacting behavior patterns related to newborn infant feeding and to explore the mother's cultural belief about their infant. The data collection was conducted by observation and interview. Twenty-five mothers and their newborn infants who were normally delivered and were also planned to breast feed were comprised as the subjects of this study. All subjects were interviewed and observed individuaily at 1 to 5 days after the delivery at the hospital, mid -wife's clinic, Maternal Child Health Center and their home throughout the country from remote area to big city, The observation data were recorded with symbolic letter on a recording sheet newly developed as a result of preliminary study. The interview data were taperecorded and then recorded in narrative form. Mother - infant interaction behaviors in early feeding period were analyzed based on 19 analytic sub-categories and their composing elements. Unit of analysis were mother, infant and mother -infant dyad. 8 analytic categories draw from the data. Each were preparation, instrument, interaction inducing, evaluation referred to mother's behavior, preparation, instrument, interaction inducing referred to infant's behavior and synchronic behaviors referred to mother - infant dyad. Frequencies of behavior items based on the categories were converted to percent. The result showed that in mother's preparation behavior, the breast condition of Korean mother can be an affecting factor for mother - infant interaction during feeding, and vocalization behavior was observed most frequently in interaction inducing behavior while the least frequent behavior observed was contacting. Subcultural characteristics of mother - infant interaction behaviors were analyzed for their relationships between groups of mothers who have lived in remote area vs urban area, and who were multipara vs primipara. Using a chi -square test, there were statistically significant relationships in the activity of psychological readiness in preparation behavior and the movement of extremities for the position of instrumental behavior in both groups. However, interaction inducing behaviors were not related with statistical significance in any set of groups. Accomplishment of marriage, bonding and emotional mediation of family members were the categories related to mother's cultural belief about the infant in aspect of functional values. Infant at birth is considered little more than a biological organism without social capabilities. Although the newborn infant is still be attached to his mother, he makes his mother extend her territoriality. The mother's interacting behavior toward her infant based on those beliefs appeared task oriented, separative behavioral series. On the other hand, it was seen that infant reacted independently to his mother's behavior by the in-nate perceptual abilities. Those independent behavioral series of mother and infant on the feeding situation were synchronized at any moment. Nurses are In a unique position to teach mothers about their infant's capabilities and help reducing some of uncertainty about infant's behaviors. Study results indicated that the informations infant's social capabilities and breast feeding should be given to the mothers. The results of this study have several implications for nursing. First, the study results will be used as fundamental resources for the development of the assessment tool about the early mother - infant interaction. Second, the results could be a relevant information in the fied. I of maternal child nursing education as real and useful data. Third, the behavioral patterns of early mother - infant interaction which were classified based on the qualitative analysis could be used for nursing theory development as very fundamental data.

University Students' Perception on the Flipped-learning-based Introductory Physics Course in which Class Hour are Divided into Lectures and Group Problem Solving (강의와 그룹문제풀이가 균형을 이루는 플립러닝 기반 일반물리학 강좌에 대한 대학생의 인식)

  • Recently, flipped learning has been paid much attention as one of the improvement methods of teaching and learning at university level. Few studies investigated the effects of flipped learning in general physics classes. However, in order to be successfully established and spread new attempts such as flipped learning, it is necessary to investigate in detail the effect of flipped learning and the way it is perceived by students in accordance with other variables such as student's background and characteristic. In this study, we investigated differences in students' perception on the flipped learning and their achievement according to their background and characteristic in flipped-learning-based introductory physics course in which class hours are divided into lecture and group problem solving equally. Students' achievement was more influenced by their readiness before the beginning of the semester than their time consuming for learning during the semester. Students generally had a very positive perception of the new way of flipped-learning-based physics teaching. However, students of insufficient prior learning, or relatively not-hard learner agreed with careful selection of subjects rather than the overall expansion of flipped learning.

  • Climate change and related policies and regulations influence the performance of the firms in various ways. Climate change influences corporate competitiveness through physical impacts, GHG regulations, changes in asset values, demand shift, etc. Therefore, corporate competitiveness could be maintained by reducing vulnerability to climate change and adapting to new circumstances. Without effective responses to the challenges, the firms would have difficulties in maintaining their competitiveness in the market and the cost of national economy will significantly increase as well. Even though it seems fairly easy to understand the meaning of competitiveness, deriving the driving forces of and measuring changes in competitiveness are complicated and disputable processes. A common way to overcome it is to develop a 'competitiveness index'. The objective of this study is to derive the main factors influencing corporate competitiveness related to climate change and develop 'competitiveness index' reflecting those factors. The index will make contribution to enhance the response capacity of the firms to climate change and increase the effectiveness of climate change policies for the industry by providing a quantitative tool to measure the changes in corporate competitiveness related to climate change.
