국제해양법상 인공섬, 시설 및 구조물 제도의 쟁점과 우리나라의 입법태도에 관한 고찰 -배타적 경제수역 및 대륙붕을 중심으로 (Legal Issues Relating to Artificial Islands, Installations and Structures in the Exclusive Economic Zone or on the Continental Shelf and Korea's Practice)

  • Artificial islands, installations and structures have been used as a major means for ocean development and management since the early 20th century. The International legal regime to regulate the man-made offshore structures also have evolved and the UN Convention on the Law of the Sea (UNCLOS) acts as a basic international instrument for that purpose. Although the Convention includes more detailed provisions on man-made offshore structures, there are some legal issues regarding jurisdiction of coastal State on the man-made offshore structures in the Exclusive Economic Zone (EEZ) or on the Continental shelf. For this reason, this article begins by reviewing the 1958 Convention on the Continental shelf and the UNCLOS by focusing on the EEZ and the Continental shelf regime governing the man-made offshore structures. It next examines some controversial international legal issues that have emerged from the regulation of man-made offshore structures in the EEZ or on the Continental shelf. This is followed by a review of the Korean domestic laws regulating artificial islands, installations and structures in the EEZ or on the continental shelf. Finally, it closes by summarizing the findings of the above examinations, and suggests some recommendations for future works.

  • The Continental shelf is important part of the coastal states' jurisdiction at sea, because there are many natural resources in continental shelf. This paper examines the concept and legal status of the continental shelf, the limit of the continental shelf, and expecially the rights and duties of the coastal state relating to its continental shelf.

해양경계획정제도에 대한 중국의 입장과 통킹만 사례고찰 (Maritime Boundary Delimitation Regime for the Gulf of Tonkin Dispute and China's Position)

  • Coastal states are adopting maritime boundary delimitation as their primary maritime policy because maritime jurisdiction directly relates to vast economic interest. This becomes specially important and sensitive when complex maritime boundary issues are involved between neighboring coastal states. China has not actively carried out nor declared maritime boundary delimitation until recently with any country except Agreement between China and Viet Nam on the demarcation of the territorial water, the exclusive economic zones and the continental shelf of China and Vet Nam in the Gulf of Tonkin on 25 December 2000 (hereinafter, the Gulf of Tonkin Agreement). The principles that governs maritime boundary delimitation are to consider primarily an agreement between States concerned, however, if no agreement can be reached, all relevant circumstances are considered to achieve an equity between concerned States. Relevant circumstances are length of coastline, form of coastline, existence and position of island or islands, speciality of geology/topography, and factor of economy and deffnce. Factors which sinologists are considering in regard to continental shelf delimitation of the Yellow Sea are as follows; i) geographical factor, ii) geological factor, iii) topographical factor, iv) environment and ecological (factor, v) historic interest, and vi) social and economic interest. The 'Gulf of Tonkin Agreement' is completed by basically applying the principle of delimitation according to median line which seems that China has adopted the maritime boundary delimitation principle of 'half and half' which was the intention of chinese government. At the same time, China recognized Viet Nam's dominion and sovereign right over the partial exclusive economic zone and the continental shelf of Dao Bach Long Vi in Gulf of Tonkin. This case can be considered as an example of mutual concession or compromise in delimiting maritime boundary for states of concerned.

  • 추적권은 추적국의 영해, 접속수역 기타 관할수역내에서 외국선박이 추적국의 법령을 위반한 경우 동 선박을 나포하기 위하여 공해상까지 계속하여 추적할 수 있는 권리로서 연안국이 영해나 기타 일정수역내에서 위법행위를 한 외국선박을 공해로 도주하기 전에 나포하는 것 이 용이하지 않으므로 도주하는 범법외국선박을 공해상까지 추적하여 나포하고 동선박을 연안국에 인도하여 연안국의 재판관할권을 행사하는 제도가 인정되어 왔으며 이러한 권리를 해양법상의 추적권 (the Right of hot pursuit) 라고 한다. 이에 우리나라의 해양관할권의 현황과 불법행위의 특성 등을 연구하여 해상집행력을 고찰해 보고 추적권에 관한 연구를 기술해 보았다.

국제사회 힘의 변화와 해양레짐 출현에 관한 소고 -유엔 해양법협약을 중심으로- (The Emergence of International Ocean Regime and the Change of Power Concept in International Society -The Case of United Nations Convention on the Law of the Sea-)

  • As the political arguments on international power concept has gradually been deepened, the role of international regimes, defined as principles, norms, rules, and decision-making procedures around which nation-actors' expectations converge in a given issue-area, has also been reinforced. There are many ways of understanding about international regimes. In terms of realistic theories, international regimes are one of methods of maintaining hegemonic power order of hegemonic nation and in terms of liberalistic theories, international regimes are understood as the products of mutual inter-dependence of nations in changing international society. As a matter of fact, if we take structural causes and regime consequences into severe consideration, we can find not a few characteristics of international regimes, such as security regime, world trade and fiance regime, ocean regime, environmental regime, human right regime, etc. This paper will examine the changing concept of power after World War II in three categories of hard power (military power), meta power (regime creating power), and soft power (advanced in cultural, diplomatical, and technological power). This paper will provide the evidence of why the changing power concepts will be strongly related with the emergence of international regimes. The UN convention on the law of the sea will chosen as a standard case of the ocean regime and it's regime structure and role will also be analysed in both realistic :md liberalistic theories. Futhermore, the nations' interests involved in the UN convention on the law of the sea will be analytically classified and finally a future prospectus of the UN convention on the law of the sea as an ocean regime will be tested.

국제법상 공해에서의 우리나라 해양경찰권에 관한 연구 (A Study on the Maritime Police Authority of Korea Coast Guard on the High Seas of International Law)

  • 우리나라의 해양경찰권이 미치는 해역은 크게 내수, 영해, 접속수역, 배타적 경제수역, 대륙붕(이하 "국내해역"이라 한다) 및 공해로 구분하고 있으며, 이 중 국내해역에서의 해양경찰권은 국제법인 "해양법에 관한 국제연합 협약"을 수용한 국내법을 따른다. 그 밖에 공해에서는 이 협약을 따르도록 하고 있다. 한편, 국내해역을 벗어난 공해에서는 자국 선박이외 외국선박에 있어서는 해적행위 등 이 협약에서 금지하고 있는 반인류적 범죄행위에 한해 제한적으로 관할권을 허용하고 있다. 하지만 공해상에서 연안국의 해양안보와 선박의 안전을 위협하는 외국선박의 불법행위는 반인류적 범죄 이외 여러 유형의 범죄(case)가 발생할 수 있고 명확한 명문규정 없이 이에 행사된 연안국의 관할권은 국가 간 분쟁을 가져올 수 있는 개연성이 높다 할 것이다. 따라서 본 논문에서는 공해상에서 국제 해양질서를 유지하고, 연안국의 해양경찰권을 안정적으로 확보하기 위한 제도적 개선방안에 대해 제시하고자 한다.

중국의 방공식별구역(ADIZ) 선포와 역내 안보적 함의 (China's recent establishment of its ADIZ and its implications for regional security)

  • The regional security and stability in Northeast Asia has become more complicated because of a sudden establishment of China's Air Defense Identification Zone (ADIZ) on 23 November 2013. One dimensional conflicts on the territorial sovereignty over the islands between the regional States has developed into the two dimensional conflicts like maritime delimitations among the States concerned since they have all ratified the 1982 United Nations Convention on the Law of the Sea which adopts the 200 nautical mile Exclusive Economic Zone regime. Moreover, due to the notion of the outer limit of the continental shelf, the conflicts have developed into three dimensional ones in order to acquire more natural resources even in the seabed. To make matters worse, such three dimensional conflicts have expanded to the airspace as well. The paper will analyze what implications the sudden declaration of China's ADIZ have for the regional security in Northeast Asia from the perspectives of public international law. To this end, the paper 1) starts with the debates on the legal nature of the ADIZ, 2) identifies the Chinese government's political motives for the establishment of the ADIZ over the East China Sea, 3) assesses the responses of the regional States and the USA to the China's establishment of the ADIZ, and then 4) discuss what implications the overlapped ADIZ of the three key States in the region have for the regional security and stability.

해양법상 섬제도와 독도 (A Study on the Regime of Island and Dokdo on the UNCLOS)

  • Article 121 of the UNCLOS stipulates the regime of islands and grants different jurisdictions to islands and rocks. Especially, paragraph 3 gives different definitions and distinguishes the legal status of between islands and rocks. That is, rocks, which cannot sustain human habitation or economic life cannot have their own EEZ, continental shelf or the great-sphere maritime jurisdiction. In this paper various theories and state practicess on islands and rocks are examined with reference to Article 121 of UNCLOS. Also, the status of Dokdo as a rock or an island is examined in accordance with the interpretation of Article 121 of UNCLOS. National legislations, practices, and many scientific opinions are often contradictory and controversial with respect to the interpretation of Article 121 of the UNCLOS. However, it is believed that Article 121 of UNCLOS, particularly paragraph 3 has to be interpreted more strictly. That is because the highly developed modem scientific technology can be meaningless when the criteria of Article 121 of UNCLOS are to be inappropriately applied. Insular figures like ${\ulcorner}rocks{\lrcorner}$ could bring the inequitable effects disadvantageous toward the other party when the maritime delimitation is applied. Claiming and Intentionally extending maritime zone of a coastal states by assigning EEZ for small insular figures like ${\ulcorner}rocks{\lrcorner}$ is over-zealous nationalism which is illegal, and such practices must be recognized as actions bringing great harm to the neighboring nations and demise of the sprit of all mankind.

이어도 쟁점과 중국 해군전략의 변화 (Ieodo Issue and the evolution of People's Liberation Army Navy Strategy)

  • Ieodo is a submerged rock within a Korea's Exclusive Economic Zone(EEZ) in the East China Sea with its most shallow part about 4.6m below the sea level which has no specific rights for the EEZ delimitation. The United Nations Convention on the Law of the Sea (UNCLOS) stipulates that any coastal state has the rights to claim an EEZ that stretches up to 200 nautical miles from its shore, except where there is an overlap with a neighboring country's claims. Korea claims that Ieodo is within its EEZ as it sits on the Korean side of the equidistant line and the reef is located on the Korea section of the continental shelf. China does not recognize Korea's application of the equidistance principle and insists that Ieodo lies on its continental shelf. According to UNCLOS, Ieodo is located in international waters, rather than one country's EEZ as the two countries have failed to reach a final agreement over the delimitation of the maritime border. This study seeks to understand the evolution of the People's Liberation Army Navy(PLAN) strategy as main obstacles for the EEZ delimitation between Korea and China. PLAN's Strategy evolves from "coastal defense" to "offshore defence", since the late 1980s from a "coastal defence" strategy to an "offshore defence" strategy which would extend the perimeter of defence to between 200 nm and 400 nm from the coast. China's economic power has increased It's dependence on open trade routes for energy supplies and for its own imports and exports. China want secure Sea Lane. PLAN's "offshore defence" strategy combines the concept of active defence with the deployment of its military forces beyond its borders. China's navy try to forward base its units and to achieve an ocean going capability. China's navy expects to have a 'Blue Water' capability by 2050. China insists that coastal states do have a right under UNCLOS to regulate the activities of foreign military forces in their EEZs. China protests several times against US military forces operating within It's EEZ. The U.S. position is that EEZs should be consistent with customary international law of the sea, as reflected in UNCLOS. U.S. has a national interest in the preservation of freedom of navigation as recognized in customary international law of the sea and reflected in UNCLOS. U.S. insists that coastal states under UNCLOS do not have the right to regulate foreign military activities in their EEZs. To be consistent with its demand that the U.S. cease performing military operations in china's EEZ, China would not be able to undertake any military operations in the waters of South Korea's EEZ. As such, to preserve its own security interests, China prefers a status quo policy and used strategic ambiguity on the Ieodo issue. PLAN's strategy of coastal defence has been transformed into offensive defence, Korea's EEZ can be a serious limitation to PLAN's operational plan of activities. Considering China'a view of EEZs, China do not want make EEZ delimitation agreement between Korea and China. China argues that the overlapping areas between EEZs should be handled through negotiations and neither side can take unilateral actions before an agreement is reached. China would prefer Ieodo sea zone as a international waters, rather than one country's EEZ.

이산화탄소 해저 지질 구조 격리: 기술 현황과 제도 예비검토 ([ $CO_2$ ] Sequestration in Geological Structures in the Maritime Area: A Preliminary Review)

  • 온실기체의 인위적 배출은 지구온난화를 유발하여 해수면 상승, 극 기상 등 전 세계에서 피해가 증가하고 있다. 특히, 지구온난화 기여도가 가장 높은 온실기체 중 이산화탄소($CO_2$)는 주로 화석연료의 사용 공정에서 발생하는 폐기물이다. 대기 중의 이산화탄소의 농도 증가는 표층 해양을 산성화시켜 표층해양 생태계, 나아가서는 지구 전체 생태계에 악영향을 미치게 될 것으로 보인다. 이산화탄소 배출량을 줄이기 위해서 에너지 효율을 높이거나 대체 에너지를 이용하는 등의 완화 기술이 동원 되고 있다. 그러나 현재 세계 에너지 수요의 약 85%가 화석연료로 충당되고 있기 때문에, 화석연료 이외의 대체 에너지원으로 급격히 전환한다면 세계 경제에 엄청난 충격이 올 것이다. 다행히도 최근 이산화탄소를 포집하여 지질구조에 격리하는 기술이 개발단계를 지나 실용화단계로 성숙하였다. 이 방안으로 단기간에 온실기체의 대기로의 배출량을 대규모로 줄일 수 있다(이상 2005년 런던협약 과학그룹회의록에서 발췌). 우리나라의 경우는 이산화탄소를 격리시킬 수 있는 장소는 육상면적이 작고 인구 밀도가 높아서 육상보다는 해양저지질구조가 선호될 수밖에 없을 것으로 보인다. 해양 이용은 해양의 특성상 런던협약 등의 국제적인 규제를 받게 된다. 본고는 해저 지질 구조에 대한 이산화탄소의 격리 관련 기술 및 제도의 국제동향을 우리나라 입장에서 예비적으로 검토하였다.
