화재와 관련된 국가배상 사례의 분석 (Analysis of Fire-Related State Compensation Cases)

  • 화재발생의 직접적인 원인 제공자들이 그 화재로 인한 피해자들에게 손해배상을 할 능력이 없으면 피해자들은 소방기관에 국가배상책임을 물어 피해구제를 받으려는 경향이 있다. 2가지 국가배상 사례 분석에서 화재로 인한 손해와 소방공무원의 화재예방 또는 소방특별조사 활동과 관련된 과실 사이에 인과관계가 있으면, 법원은 소방기관에서 피해자에게 손해를 배상하도록 판결함을 알 수 있었다. 2017년 12월 26일 「소방기본법」이 개정되어 '소방활동에 대한 면책' 조항이 마련되었지만 면책을 받으려면 그 활동의 불가피성이 입증되어야 하는데, 화재예방이나 소방검사 활동은 구조·구급활동과 달리 그 활동의 불가피성을 입증하기가 쉽지 않으므로 화재와 관련된 국가배상 청구 소송은 줄어들지 않을 것으로 예측된다.

  • Costal fisheries use small boat. The boats are frequently substituted with newly made boat or proper boat. When the boat which is substituted with another one after the fixed date for compensation is estimated for fisheries loss by public project, it is matter that which boat is the object for estimating average catch of fish. There are three ways in practical business. They are based on the date of spot probe, the date of conference for compensation and fixed date for compensation. In case of applying the first and the second ways, as the object of compensation is not fixed, there is problem that estimated result can be changed depending on changing boat tons even after the date of spot probe and the fixed date for compensation. Most of all, these ways are against Attached Form No.4 of the Enforcement Ordinance of Fisheries Law which regulate to calculate average catch of fish applying result of fishery for retroactively counted 3 years from the year before the year in which administrative measure day is. The other side, in applying boat tons based on the fixed date for compensation, estimated result of compensation will not change even boat substituted after the fixed date for compensation. Even though applying tons based on the fixed date for compensation, a problem still remains. If the boat get bigger after the fixed date for compensation, the then boat size must be applied for calculating average catch. But the boat get smaller, the changed boat size must be applied. Because changed small boat would be damaged less than the previous boat. And decrease in catch by changing boat into small one is not due to the project but due to the personal responsibility. This will help to increase objectivity and reliance on the compensation result. As the other objects are fixed based on the fixed date for compensation in the Act on Acquisition and Compensation of Land and Others for Public Project, it can be balanced with other object.

식품안전 피해구제제도의 도입방안에 관한 연구 (A Study on the Introduction of Food Safety Damage Relief System)

  • Currently, many punitive damages (or statutory damages) and class action laws are discussed in relation to the consumer damage relief system. It is in the background of the argument that the introduction of such a victim relief system will solve many small and large consumer damages. There are many cases in which the punitive damages compensation or the class action system are introduced in relation to the food safety damage naturally. Although the introduction of such a system can clearly help the consumer to relieve large-scale damage, it can not solve all the problems at once because the company can reject the system despite the introduction of such a system. In particular, class action lawsuits should have the same type of damage, but most of the damage caused by food safety is accompanied by physical harm, resulting in various complications such as the physical characteristics of the victim, the health environment. The class action system may not provide a solution in that the content and type of the damage may be different. In this regard, this study aims to investigate the introduction of the food safety damage relief system through the introduction of an administrative dispute settlement system by an administrative agency that occupies an absolute position in the existing consumer protection from this point of view. In reality, the Food and Drug Administration, which is the largest among government agencies related to food, operates a passive attitude consumer protection system such as function like guidance, supervision and surveillance. And it is necessary to make a complementary proposal. In the current law, there is only a small part of the consumer protection work that is positively legal, and even after the damage is scientifically identified, it is not possible to present the solution to the damage suffered by the consumer through legislation. This is a fact that has been raised. In this paper, we propose a reasonable and rapid disaster relief procedure through a separate mechanism within the administrative agency, which is the administration agency, that the dispute settlement procedure due to food safety damage is insufficient by solving the case through the court through counseling, dispute adjustment and civil proceedings. In order to solve the problem of food insecurity and the food industry, various ways of rational solution of the problem were considered. The possibility of (1) Establishment of a food safety dispute resolution committee; (2) Establishment of a food safety disaster relief committee; and (3) Establishment of a food safety disaster relief committee was discussed. In addition, a plan for the creation of a food damage compensation fund was also proposed.

로마조약의 현대화와 쟁점에 관한 고찰 - 최근 ICAO법률위원회의 논의를 중심으로 - (A Study on the Modernization of the Rome Convention and its Issues - Focusing on the recent ICAO Legal Committee's Discussion)

  • 비행중인 항공기에 의한 제3자의 손해는 피해자가 원인제공을 하지 않았다면 피해가 발생하지 않았을 상태로 충분히 보상 받아야 한다. 하지만, 관련 국제조약들은 항공산업 보호측면에서 운항자의 보상책임을 일정한 한도로 제한하고 있는데 이러한 미흡한 보상체계가 관련 국제조약들이 지금까지 항공선진국에서 비준을 받지 못한 주요 이유이기도 하다. 그러나, 9/11테러 후 국제사회에서는 테러에 의한 항공기 사고와 제3자 보호 문제를 보다 적극적으로 다루어야 하는 필요성에 공감하고 ICAO 주관으로 관련 국제조약의 현대화를 위한 특별위원회를 구성하여 조약초안을 마련하게 되었다. 본 논문에서는 ICAO 법률위원회에서 마련한 두 개의 초안 즉, 테러 제3자 배상조약안 및 일반 제3자 배상조약안과 관련하여 가장 최근에 논의된 주요 쟁점에 대해 살펴보았다. 국가 책임과 운항자책임 분담의 적정성에서부터 보충적 배상기금의 운용과 관련한 세부사항에 이르기 까지 여러 쟁점들이 합의되기까지는 상당한 시일의 소요가 예상된다. 항공운송 수요가 증가하고 또한 테러위협도 높아지는 현실에서 선의의 지상 제3자 보호와 항공운송인을 위시한 항공운송 산업의 보호가 균형있게 이루어지는 새로운 관련 국제조약이 조속히 마련되어야 한다. 이와 함께 우리나라도 예상되는 피해로부터 국민의 재산과 생명을 보호하기 위하여 관련 조약의 개정작업에 적극 참여하여야 할 것이다.

A Basic Study on the Introduction of Professional Indemnity Insurance for Construction Project Managers

  • During the administration of a construction project, various types of participants are engaged in the project. From the design phase to the maintenance phase, these participants may confront many risks. To avoid these risks, participants should utilize an insurance company or a bond company. The types of risks and liability that a construction manager may face are listed in the construction law or contract. But there are some arguments related to risk transferring and the content of risks. For this reason, construction managers must carefully consider any possible risks in the contract and the construction law. Therefore, for construction managers to deal with risks appropriately, the introduction of a legal requirement to carry professional liability insurance, a defined compensation range for damages, a method of guarantee in the event of defects, a defined compensation claim period for damage, and a method of damage claim were suggested in this study.

  • This paper tries to suggest one kind of estimation method of compensation for restriction in licenced fisheries caused by a large scale coastal reclamation under Code 62 of the Fisheries Act. To do so, the paper focuses on estimating the restriction rate of licenced fisheries through introducing several new factors for calculating the amount value of compensation, such as the restriction rate of fishing area, the decreasing rate of fishing time and the variation rate of fishing cost. Finally, the paper tries to apply the method to the case of compensation fer fisheries damage at the Incheon coastal area caused by the construction of the base of LNG of 1992.

바이오안전성의정서에서의 책임복구체제에 관한 법적 고찰 (A Legal Analysis on the Liability and Redress Regime under the Cartagena Protocol on Biosafety)

  • This study reviews the proposed liability and redress regime under the Cartagena Protocol on Biodiversity. Several core elements for the regime are discussed in comparison with those listed in the 1999 Basel Protocol on Liability and Compensation for Damage resulting from the Transboundary Movements of Hazardous Wastes and their Disposal. These are (1) scope of the rules and procedures; (2) channeling of liability; (3) legal standing; (4) definition of damage; (5) standard of care; (6) ancillary sources of compensation; (7) limitation of liability; (8) financial guarantees; and (9) mutual recognition and enforcement of judgments. Korea has given relatively little attention to the issue of liability and redress in the context of LMOs trade. As the Protocol is expected to enter into force soon, Korea needs to develop appropriate implementing domestic mechanisms for the Biosafety Protocol. Establishing an adequate domestic liability and compensation scheme will be one of the most important mechanisms not only to comply the Protocol but to ensure safety of LMOs in general. A further research is needed on the basis of a comparision of relevant legislations in different countries as well as analysis of current laws related to the accidents arising from LMOs trade, such as product liability laws, food safety laws, liability provisions in some environmental legislations.

우주사고와 손해배상 (Study on the Insurance and Liability for Damage caused by Space Objects)

  • 우리나라는 1994년에 우주센터가 건설되어 1995년부터 본격적인 우주개발시대로 진입하게 되었으며 2002년 11월 28일 충남 해상의 한 기지에서 우리나라가 독자적으로 개발한 액체추진로켓인 KSR-III(3단형 과학로켓)가 성공적으로 발사됨에 따라 2005년까지 100kg급 소형위성 발사체를 개발하고 2010년까지는 저궤도 실용위성 및 발사체를 자력으로 개발하는 등 자력에 의한 우주발사체제를 갖추게 되었다. 그러므로 위성발사를 위한 로켓의 시험발사를 자주 하게 됨으로 발사사고에 대한 법적 처리를 대비하기 위하여 지금 추진 중인 우주개발진흥법안 제14조에서는 우주물체이용에 따른 손해배상책임을 규정하여 입법적으로 해결하고 있다. 그러나 동법 안 제15조에서는 보험 가입을 강제성을 띠어 의무적으로 하여야 하는데 이에 대하여 명백히 규정하고 있는 것이 아니라 우주물체를 대한민국 영토, 영해 및 영공 내에서 발사할때 과학기술부 장관의 허가를 받도록 하면서, 필요한 경우에 당해장관이 손해배상을 목적으로 하는 보험부보를 허가요건으로 정할 수 있다고 규정하고 있을 뿐이다. 피해자를 확실히 보호하고 책임의 분산을 위해서도 강제성을 띤 의무조항으로 규정하여야 한다. 더 나아가 정부는, 우주산업은 지식 및 노동집약산업으로 그 부가가치가 높고 에너지가 덜 들고 다른 산업에 미치는 기술 파급효과가 대단히 큰 산업이므로 우주개발중장기 기본 계획을 보완하여 우주산업 분야에 집중 투자할 필요가 있다고 생각한다.

자율협력주행 상용화촉진을 위한 법제개선 과제 (Tasks to Improve the Legal System in Response to Deployment of Connected Autonomous Vehicles)

  • Last year, the Autonomous Vehicle Act was enacted to respond to deployment of autonomous vehicles. But the Act stipulates the operation of autonomous vehicle pilot zones, In addition, in order to analyze autonomous vehicle accidents and establish a reasonable damage compensation system, the Automobile Damage Compensation Guarantee Act was revised. But, It is necessary to seek plans for institutional development such as detailed concepts of self-driving cars and driving, a security certification system for securing safety of autonomous cooperative driving, and enhancement of the effectiveness of special cases related to personal information processing. I would like to seek ways to improve the legal system to respond reasonably to the deployment of autonomous vehicles.

Damage detction and characterization using EMI technique under varying axial load

  • Recently, researchers in the field of structural health monitoring (SHM) have been rigorously striving to replace the conventional NDE techniques with the smart material based SHM techniques, employing smart materials such as piezoelectric materials. For instance, the electromechanical impedance (EMI) technique employing piezo-impedance (lead zirconate titanate, PZT) transducer is known for its sensitivity in detecting local damage. For practical applications, various external factors such as fluctuations of temperature and loading, affecting the effectiveness of the EMI technique ought to be understood and compensated. This paper aims at investigating the damage monitoring capability of EMI technique in the presence of axial stress with fixed boundary condition. A compensation technique using effective frequency shift (EFS) by cross-correlation analysis was incorporated to compensate the effect of loading and boundary stiffening. Experimental tests were conducted by inducing damages on lab-sized aluminium beams in the presence of tensile and compressive forces. Two types of damages, crack propagation and bolts loosening were simulated. With EFS for compensation, both cross-correlation coefficient (CC) index and reduction in peak frequency were found to be efficient in characterizing damages in the presence of varying axial loading.
