Some Practical Issues on the International Construction Contract (국제건설계약(國際建設契約) 실무상(實務上) 유의점(有意點))

  • Many Korean construction companies have been performing a variety of overseas construction projects since the 1970s. It is unfortunate that in many cases they have had to suffer big losses caused by errors and defects in the design and construction of the projects. In the author's opinion, however, there were losses that could have been avoided if they had understood better the feature and content of the particular construction contract. Few lawyers and scholars in Korea have been interested in the research and study of international construction contracts. This is mainly because they do not have access to practical sources outside of Korea for them to research and study since the contracts undertaken have been dealt with by law firms in other jurisdictions to which the disputes apply. This article is aiming primarily at the introduction of the issues which the practitioners are likely to confront in the process of reviewing and performing the international construction contract. In some cases solutions are sought about these issues based upon the FIDIC standard terms and conditions, the actual experience of practice, and UNIDROIT Principles, etc. It is reasonable to say that all the issues related to the international construction contract cannot be covered in a short article like this. The author wishes this article could induce subsequent studies on international construction contracts for further research. It has to be noted that from time to time Korean construction practices have been compared to the international ones for better understanding. This article mostly includes cases where the Korean construction companies go overseas for their projects, while there are some cases where foreign developers and financial investors participated in domestic projects in which international construction contracts forms were adopted. A few precedent domestic writings about international construction contracts seems to lack emphasis on the points that there are several standard construction contract forms and that they are different. The differences are mainly in accordance with who bears the design responsibility, how the owner has to make progress payments to the contractor and who the funding source for the project is. This article tries to make it clear that there are significant differences between the standard contract forms, e.g. a simple construction form, a design-build form and an EPC/turnkey form of contract. Again, the author hopes that this article can arouse the interest in the international construction contracts from both academic and practical fields, so that many subsequent advanced articles can help our construction industry become much more competitive in the world through awareness of the methods of procurement and administration of the contracts.

Clinical Analysis of the Chest Trauma (흉부 손상의 임상적 고찰)

  • A clinical evaluation was performed on 305 cases of chest trauma experienced at the department of the Thoracic and Cardiovascular Surgery, Dae Jeon Eul Ji Hospital, during the period from March 1991 to November 1994. Age distribution was from 4 to 85 years, the mosts common age groups were 4-th, 5th and 6th decades. The ratio of male to female was 229:76(3:1), the ratio showed male predominance, the most common cause of trauma was traffic accidents in nonpenetrating trauma and stab wounds in penetrating trauma. Hemothorax, pneumothorax, and hemopneumothorax were observed in 159 cases (52.1 %) of total cases, Rib fracture was observed in 236 cases (77.4%) of total cases, location distribution was right : left : Both (102 : 142 : 45), with left predominant, rib fracture commonly involved from the 3th to 8th rib. Lag period from accident to admission was 155 cases (50.8%) under 6hr The principles of therapy for early complications of chest trauma were rapid r expansion of the lungs by thoracentesis 5 cases(1.6%) and closed thoracostomy 1-42 cases(46.6%), but open thoracotomy had to be done on 17 cases (5.6%) because of massive bleeding 13 cases or ruptured diaphragm, foreign body. Conservative nonoperative treatment was 140 cases (45.9%). Overall mortality rate was Bcases (2.6%) and common causes of the death were respiratory insufficiency and shock.

  • This study was taken to increase efficiency in reviewing documents of school facilities from the network of ERIV(Educational Resources and Information Center, USA). Outline of the ERIC network, and the structure, role, function of the ERIC thesaurus are introduced. A thesaurus have developed for information retrieval purpose provides the filing labels which permit information to be stored by one person and retrieved by another. As an information system grows, its thesaurus is systematically built and refined to the point where it represents, in a very special sense, the vocabulary of subject field. The Thesaurus of ERIC Descriptors represents such a vocabulary for the field education. An understanding of its origins, its function and its limitations, is just as important to the teacher, the student of education or the educational researcher as it is for the indexer or custodian of the information pool it represents. If the Thesaurus is understood and used in an appropriate way, it can give all educators not only insight into the ERIC system but also an increased awareness of the language of their field. A great many terms are necessary to describe the many aspects of education, and the task of relating them in even an approximately consistent way is an enormous one. The undertaking should be managed by people who not only know what they are talking about but who also should be able to predict what people in their field are lilely to be talking about in the near future. It should also enlist people who are willing to pay term to another within the system. To engage a large number of these two kinds of people over a long period of time is very likely to cost a great deal of money. There is very little proprietary value in producing such a list of terms, for it can very easily be copied, adapted, updated, etc. Thus, because of its high cost and low proprietary value, it becomes a task likely to be funded only by a government. A government has many ways of spending its money. However, after the decision has been made to spend money to produce an authority list, one must decide how this authority is to be delegated. The history of the development of the ERIC Thesaurus is the history of how this authority was delegated. Scientific research has thrived on efforts to define terms as precisely as possible. It is difficult to say with certainty, however, that solutions to social problems have thrived on a simple diet of scientific research. Contemporary crises demand new and imaginative ways of conceiving problems and talking about them. If this Thesaurus or any other scheme for normalizing or controlling language inhibits in the slightest measure the creative use of language, it is against it use. Only if the principles and details of the Thesaurus are misunderstood can it be used as a constraint on language in a negative sense. Students of education of every kind should see the The-saurus as an opportunity to become increasingly self-conscious about their language and thus about their assumptions and their approaches to educational problems.

  • The hardware of the human body is given the life force by the sentence which is the physiological software that the program for cell activation by the electrical signal enters. The aim of this study is to create a better therapeutic environment for the human body that groaned with errors in the physiological and cognitive systems that are transmitted to neurons and neurons. The sentence program of the rated sijo, which is the software of the human body which has the function as a conductor to connect the emotions of joy, anger, sadness, and enthusiasm to the human mental system, can be connected to the neuron system of the human body, we tried to identify the principle of operating the motherboard of mind in humanities. Once these principles are identified, we can figure out how to minimize side effects and lead the body to a therapeutic program. The research found that there is a strong energy source that can operate the motherboard of the heart very quickly in the rated Sijo. This is because it is confirmed that new coding and re-coding of a number of rated sijo, or a new syllable of one syllable followed by the original syllable of the original syllable, are formed quickly and therapeutically.This has led to the possibility of literary therapy for mankind to upgrade the human psychic system in abundance through the function of the interaction between the sentence as a conductor that is synaptically connected to the human body and the mainboard of the mind attached to the human body without side effects in the future.

Analysis Program for Diffusion Model: SNUDM (확산모형 분석도구: SNUDM)

  • This paper introduces SNUDM, an analysis program for Ratcliff's diffusion model, which has been one of the most important models in cognitive psychology over the past 35 years and which has come to occupy an important place in cognitive neuroscience in recent years. The analysis tool is designed with the basic principles of easy comprehension and simplicity in use. A diffusion process was programmed as the limit of a simple random walk in a manner resembling Ratcliff & Tuerlinckx(2002). The response time distribution of the model was constructed by simulating the time taken by a random walk until it reaches a threshold with small steps. The optimal parameter values in the model are found to be the smallest value of the chi-square values obtained by comparing the resulting distribution and the experimental data using Simplex method. For simplicity and ease of use, the input file used here is created as a file containing the quantile of the reaction time, the trials and other information. The number of participants and the number of conditions required for such work programs are given in a way that answers the question. Using this analysis tool, the experimental data of Ratcliff, Gomez, & McKoon(2004) were analyzed. We found the very similar pattern of parameter values to Ratcliff et al.(2004) found. When comparing DMAT, fast-dm and SNUDM with the generated data, we found that when the number of trials is small, SNUDM estimates the boundary parameter to a value similar to fast-dm and less than the DMAT. In addition, when the number of trials was large, it was confirmed that all three tools estimate parameters similarly.

Genetic Programming based Manufacutring Big Data Analytics (유전 프로그래밍을 활용한 제조 빅데이터 분석 방법 연구)

  • Currently, black-box-based machine learning algorithms are used to analyze big data in manufacturing. This algorithm has the advantage of having high analytical consistency, but has the disadvantage that it is difficult to interpret the analysis results. However, in the manufacturing industry, it is important to verify the basis of the results and the validity of deriving the analysis algorithms through analysis based on the manufacturing process principle. To overcome the limitation of explanatory power as a result of this machine learning algorithm, we propose a manufacturing big data analysis method using genetic programming. This algorithm is one of well-known evolutionary algorithms, which repeats evolutionary operators such as selection, crossover, mutation that mimic biological evolution to find the optimal solution. Then, the solution is expressed as a relationship between variables using mathematical symbols, and the solution with the highest explanatory power is finally selected. Through this, input and output variable relations are derived to formulate the results, so it is possible to interpret the intuitive manufacturing mechanism, and it is also possible to derive manufacturing principles that cannot be interpreted based on the relationship between variables represented by formulas. The proposed technique showed equal or superior performance as a result of comparing and analyzing performance with a typical machine learning algorithm. In the future, the possibility of using various manufacturing fields was verified through the technique.

Current Status of Systems Biology in Traditional Chinese medicine - in regards to influences to Korean Medicine (최근 중의학에서 시스템생물학의 발전 현황 - 한의학에 미치는 영향 및 시사점을 중심으로 -)

  • Objectives : This paper serves to explore current trends of systems biology in Traditional Chinese Medicine (TCM) and examine how it may influence the Traditional Korean medicine. Methods : Literature review method was collectively used to classify Introduction to systems biology, diagnosis and syndrome classification of systems biology in TCM perspective, physiotherapy including acupuncture, herbs and formula functions, TCM systems biology, and directions of academic development. Results : The term 'Systems biology' is coined as a combination of systems science and biology. It is a field of study that tries to understand living organism by establishing a theory based on an ideal model that analyzes and predicts the desired output with understanding of interrelationships and dynamics between variables. Systems biology has an integrated and multi-dimensional nature that observes the interaction among the elements constructing the network. The current state of systems biology in TCM is categorized into 4 parts: diagnosis and syndrome, physical therapy, herbs and formulas and academic development of TCM systems biology and its technology. Diagnosis and syndrome field is focusing on developing TCM into personalized medicine by clarifying Kidney yin deficiency patterns and metabolic differences among five patterns of diabetes and analyzing plasma metabolism and biomarkers of coronary heart disease patients. In the field of physical therapy such as acupuncture and moxibustion, researchers discovered the effect of stimulating acupoint ST40 on gene expression and the effects of acupuncture on treating functional dyspepsia and acute ischemic stroke. Herbs and formulas were analyzed with TCM network pharmacology. The therapeutic mechanisms of Si Wu Tang and its series formulas are explained by identifying potential active substances, targets and mechanism of action, including metabolic pathways of amino acid and fatty acid. For the academic development of TCM systems biology and its technology, it is necessary to integrate massive database, integrate pharmacokinetics and pharmacodynamics, as well as systems biology. It is also essential to establish a platform to maximize herbal treatment through accumulation of research data and diseases-specific, or drug-specific network combined with clinical experiences, and identify functions and roles of molecules in herbs and conduct animal-based studies within TCM frame. So far, few literature reviews exist for systems biology in traditional Korean medicine and they merely re-examine known efficacies of simple substances, herbs and formulas. For the future, it is necessary to identify specific mechanisms of working agents and targets to maximize the effects of traditional medicine modalities. Conclusions : Systems biology is widely accepted and studied in TCM and already advanced into a field known as 'TCM systems biology', which calls for the study of incorporating TCM and systems biology. It is time for traditional Korean medicine to acknowledge the importance of systems biology and present scientific basis of traditional medicine and establish the principles of diagnosis, prevention and treatment of diseases. By doing so, traditional Korean medicine would be innovated and further developed into a personalized medicine.

A Study on the Actual Utilization Korean Traditional Remedies -About foods used on geriatric disease- (한국(韓國)의 전통적(傳統的) 민간요법(民間療法)의 이용실태(利用實態) 조사연구(調査硏究) -성인병(成人病)에 이용(利用)되는 식품(食品)을 중심(中心)으로-)

  • This study was designed under the purpose to analyze the Korean Traditional Folk Remedies on food, to submit the basic statistical data, and to utilize them by examining how much they know about the Korean Traditional Folk Remedies and also by examining how frequently they used them. The sample was consisted of 312 housewives living in Daegu, Kyungsan city and Kyungsan-eup, the survey was made by use of questionaires from July 15 to August 1 1989. The results are as follows 1. Analysis of Folk Remedical Contents 1) The method of the Folk Remedies used in this area was mainly food, which can be easily found around their house and easy to use, it was possible to apply scientific principles in some cases. 2) The major popular method was shown to feed boiled barley or brown rice which are known as the Folk Remedy for Diabetes. 3) The ANOVA of variable shows the significant influence on each object which age, religion, the level of education, job, monthly income, and the area except family formation. 2. The Frequency of Folk Remedies and additional analysis 1) The most frequently used Folk Remedy was Arterio-sclerosis(1.44), which is followed by the loss of Eyesight(1.40), Hang over(1.28), Couth(1.27), Cold(1.26) etc. 2) In the analysis of Pearson Correlation between frequencies of Folk Remedies used, and demographic variables such as age(p<.05), the monthly income(p<.01), in that area, total number of response items showed a positive correlation. 3. The source to learn about Folk Remedy. 1) It is acknoledged that they are mostly instructed by their forefathers, friends, neighbors, professional textbooks, mass communications, herb doctors, other medical sources or education at school etc. 2) The ANOVA of Variables shows the big differences between each group by age. Based on the above findings, the following suggestions are made ; Most of Korean Traditional Folk Remedies are recognized scientific and reasonable which are based on the scientific research and herb medicine therefore it should be made good use of for our life in good health additionally. I hereby insist that the importance of our Folk Remedies should be reviewed and focused for maintenance our health.

A Systematic Review on Sensory Integration Intervention in Korea: Focusing on Ayres Sensory Integration (ASI) (국내 감각통합치료 중재에 관한 체계적 고찰 - Ayres의 감각통합중재(ASI)를 중심으로)

  • Objective : The aim of this study was to investigate how many studies for sensory integration intervention in Korea reflect the principle of Ayers' sensory integration through a systemic review. Methods : The systemic review was executes using RISS, NDSL, KISS, DBpia. The key words for search were 'sensory integration therapy', 'sensory integration intervention', 'sensory integration program', 'sensory integration training' to search the articles, published in 2000-2012. To analyze ASI fidelity of 49 studies included in the present study, the numbers of items were calculated if the study describe the ASI principle. Results : The IV was the most levels of evidence, and the subjects for the studies were mental intellectual disability (15), developmental disability (14) and autism spectrum disorders (13) etc. It was described the most that presenting sensory opportunities (43), challenging postural, ocular, oral and/or bilateral motor control (37) of ASI fidelity. The studies using more than 4 ASI principle were 26.5%(13), and 7 studies using 8 or more than 8 were studied in OT. Conclusion : In OT, 34 of 49 studies performed, and they used several principles of ASI. To have unity for sensory integration principle and to improve therapy professionalism the study using various data and systematic review study will be needed in the future.

A Study of a Relapse Prevention Program for Alcoholics focused on Action Methods (행위기법을 중심으로 한 알코올의존 재발방지 프로그램 개발에 관한 연구)

  • Relapse is one of the most series problems in alcoholics treatment. Previous studies have shown that significant proportions of treated alcoholics show an early relapse and go through a chronic phase. It is necessity to find more effective relapse prevention program. The Purpose of this study was to develop a relapse prevention program that emphasis on group activities using various action methods. Previous studies revealed that there was no effective therapeutic strategy to prevent relapse and proposed that action methods were more practical ways to be able ti cope with high-risk situation than verbal methods such as discussions and lectures. The special attempt of this program was the application of various actions methods and the integration of many psychosocial therapeutic strategies as compared with many relapse prevention programs. The theoretical framework of this relapse prevention program was based on mainly the Marlatt's Relapse Prevention model and Prochescha and DiClemente's Transtheoretical model. This Program consists of eight structure sessions. Every session has three phase: Warm-up phase, action phase, and sharing phase as sociodrama structure. Sociodrama is based on many of the principles of adult learning. And sociodrama looks at how groups work through an understanding of systems and role theory. Therefore, in working with a group a therapist might explore with them the roles that people play, roles that are missing at present such a visionary and how people can develop new roles or new ways of playing existing roles. The researchers explained the purpose of this study to all participants after their agreement to participate. Voluntary informed consent was obtained from all participants. Every session allows participants to recognize personal specific high-risk situation and to examine possible coping behaviors creatively. Multiple solutions can be proposed, tested and evaluated dramatically, giving new insights or breakthroughs in thinking. This is vital for the initiation of change, and if appropriate, expanding new role development. The first two sessions aim at understanding of relapse process and recognize of high-risk situations focused on orientation about action methods. The next four sessions deal with high-risk situations. The last two sessions give participants opportunities to venture new life-styles. The methods and approaches used in this program utilized as a tool to explore and practice possible coping strategies. and this program can contribute to prevent relapse episode if tune with the particular high-risk situation by using active practices in safe environment.
