의료법 34조 개정(안)에 대한 소고 (Review of Medical Act Article 34 the Amendment)

  • 정부는 작년 10월 29일 의료법 34조 개정안을 입법 예고했다. 과거 2009년 7월 29일에도 정부는 "의료사각 계층 해소 및 의료서비스산업의 발전을 도모하기 위해 의료인과 환자간의 원격의료를 허용하는 내용을 포함한 의료법 개정안"을 입법예고 하였지만 의료계의 반발과 의료의 남용, 의료비의 상승을 가져올 수 있다는 반대여론에 밀려 결국 국회입법에 실패했었다. 그런데 또다시 의료법 34조 개정을 추진하려 하고 있다. 법률을 개정하고 입법하기 위해서는 법의 합리성, 타당성, 실현가능성 등 충분한 검토와 부작용을 면밀히 분석하고 시행해야 한다. 특히, 국민의 건강과 직결되는 의료법 개정은 반드시 국민의 생명과 건강권이 담보되어야만 입법 취지의 타당성이 인정된다. 현재 의료법 34조 개정안은 의료단체 및 시민단체 등의 거센 반발에 부딪쳐 아직까지도 표류상태이다. 이에 본 연구는 의료법 34조 개정안을 분석하고, 문제점 도출과 그에 따른 개선방안을 제시하고자 한다.

  • 정부 부처별로 제각각 시행되어온 국가연구개발사업들을 종합적으로 운영할 수 있는 법적 근거를 마련한다는 취지하에 (가칭)국가연구개발특별법의 제정이 최근 논의되고 있다. 본 논문은 이와 유사한 목적으로 2001년에 제정된 과학기술기본법의 입법 과정을 분석한다. 특히 제정 이전에 제안됐던 다양한 법안들이 경쟁하는 과정에서 주요 쟁점은 무엇이었으며, 반대로 논쟁없이 수용된 요소는 무엇이었는지를 주목함으로써, 본 논문은 다음과 같은 두 가지 주장을 제시할 것이다. 첫째, 각 부처별 국가연구개발사업들의 역사를 고려할 때, 범부처적으로 적용될 수 있는 단일 규정을 마련하고자 하는 시도는 자칫 정반대의 결과를 낳을 수 있다. 둘째, 과학기술기본법의 제정은 비록 범부처적 관리 규정의 마련으로 이어지지 못했지만, 제정 과정에서 논쟁없이 도입된 "국가경쟁력(national competitiveness)"과 "국가혁신체제(national innovation system)"라는 개념은 국가연구개발사업들에 어떤 일관적인 방향성을 부여하고 있다. 과학기술기본법의 입법 사례는 (가칭)국가연구개발특별법의 입법을 둘러싸고 진행 중인 현재의 논의들이 앞으로 어떻게 전개될지를 어렴풋하게나마 가늠하고, 더 나아가 우리가 간과했던 논점이 무엇이었는지를 성찰할 수 있는 창이 될 것이다.

1급응급구조사의 수급에 관한 연구 -응급의료에관한법률을 중심으로- (A Study on Projection of Demand and Supply for Paramedic in the Emergency Medical Services Act)

  • The purposes of this study which was conducted by applying three projection formulae to the data from admission quota for paramedic of the Ministry of Education & Human Resources Development the number of ambulances the number of emergency medical centers of the Ministry of Health & Welfare and rate of successful candidates of annual report of the National Health Personnel Licensing Examination Board were to find out demand and supply of paramedic from 2002 to 2045 and to expand scope of practice of paramedic in Korea. The conclusions from this study were summarized as follows; (1) The simple formulae derived from the projection formula of the Economic Planning Board were applied under the present Emergency Medical Services Act including qualifying over 3-years experienced EMT-Basic for paramedic examinee, stationing paramedic or EMT-Basic or physician or nurse per ambulance, stationing paramedic or EMT-Basic per emergency medical center and under the amended Emergency Medical Services Act including qualifying only paramedic graduate for paramedic examinee, stationing 4.5 paramedics per ambulance, stationing 10 to 2 paramedics per emergency medical center. (2) It was estimated that on the American basis of 5.6 EMTs per 10,000 in 1996, the number of paramedics under the present act will reach the basis before 2020, the number of paramedics under the amended act will reach the basis about 2040. (3) It was estimated that on the basis of 22,000 paramedics demanded from the number of ambulances, the number of emergency medical centers in 2001, the number of paramedics under the present act will reach the basis before 2015, the number of paramedics under the amended act will reach the basis about 2030. (4) There was relationship between requirements for emergency medical centers scope of practice of paramedic in the act and demand-supply of paramedic, this necessitates surveys, studies, amendment of the act, legalization for expanded scope of practice of paramedic including EMD, instructor, teacher of safety. (5) This study which includes only expanded scope of practice of paramedic and projection for paramedic in the act needs complementary studies such as decision-making process in health manpower policy and so on.

정박선과 항해선의 충돌사고 시 항법적용에 관한 쟁점 연구 - 중앙해양안전심판원 제2015-001호 재결 사례를 중심으로 - (A Study on the Legal Issue of the Application of Navigation Rule for a Collision between Sea-going Vessels and Vessels at Anchor -Focused on Central Maritime Safety Tribunal Decision 2015.1.23. Case No 2015-001-)

  • In respect of the existing relation between Sea-going Vessels and Vessels at anchor, Korean Maritime Safety Tribunal has applied 'Ordinary Practice of Seamen' that is regulated by the article No. 2 of COLREG. That is, general navigation rule is not applied between the two vessels, and the action to avoid collision of vessels by utilizing experience knowledge of the seamen. However, the content of the Ordinary Practice of Seamen included in the revised plan in the process of 2011 "Maritime affairs Safety Act" revision was deleted in the screening of the Office of Legislation due to the reason that it could not specified when the content of deed is not concertized. Furthermore, prior application regulation of international treaty included in the existing "Sea Traffic Safety Act"(Article 5) was deleted in the screening of the National Assembly. So, doubt about whether the Ordinary Practice of Seamen could be continuously applied according to the regulation of the international treaty, nevertheless not specified in domestic law, has been continuously raised. In this situation, recently Central Maritime Safety Tribunal changed precedent by applying of Article 96(3) of Maritime Safety Act without applying Ordinary Practice of Seamen in the Case No. 2015-001. Accordingly, this study intended to review propriety of precedent change and legal issue with the decision of Central Maritime Safety Tribunal excluding Ordinary Practice of Seamen for a collision between Sea-going Vessels and Vessels at anchor.

실제 이미지에서 현저성과 맥락 정보의 영향을 고려한 시각 탐색 모델 (Visual Search Model based on Saliency and Scene-Context in Real-World Images)

  • According to much research on cognitive science, the impact of the scene-context on human visual search in real-world images could be as important as the saliency. Therefore, this study proposed a method of Adaptive Control of Thought-Rational (ACT-R) modeling of visual search in real-world images, based on saliency and scene-context. The modeling method was developed by using the utility system of ACT-R to describe influences of saliency and scene-context in real-world images. Then, the validation of the model was performed, by comparing the data of the model and eye-tracking data from experiments in simple task in which subjects search some targets in indoor bedroom images. Results show that model data was quite well fit with eye-tracking data. In conclusion, the method of modeling human visual search proposed in this study should be used, in order to provide an accurate model of human performance in visual search tasks in real-world images.

아동권리관점에서 본 영유아보육법 제정법령 분석 및 평가 (An Analytical Study on the 1st Enacted 'Child Edu-care Act(1991)' - From the Perspective of Children's Rights)

  • The "Child Care and Education Policy(CCEP)" is important because it is responsible for providing 'care and education service' to young children in their 'most sensitive period' of human development. In reality, however, children's rights can only be sanctioned by adults and their rights are recognized at the level of abstraction. This study analyzes the 'Child Edu-care Act(CEA)' first enacted in 1991 from the 'perspective of children's rights', especially in terms of the rights of infants and preschoolers. In order to assess the CEA's "children's rights guarantee level", this study developed a number of standards based on the "UN Convention on the Rights of the Child(CRC)" and other documents. The results revealed that "children's rights guarantee level" was assessed against 4 categories ('Right to Survival and Development', 'Right to Welfare', 'Right to Education', and 'Right to Proper Care'), and the CEA(1991) was found to have a high guarantee level although it was enacted before Korea's ratification of the CRC. The results of this study can serve as a useful reference point for detailing children's rights and suggesting regulation standards for the CCEP.

기록연구사의 정보공개청구업무 및 업무 환경 분석 (Understanding the Freedom of Information (FOI) Work Process of Records Managers)

  • 본 연구는 기록연구사의 정보공개청구 업무과정을 밝히고 이와 관련된 문제점을 살펴보고자 하였다. 이를 위해 11명의 현직 기록연구사들과 직접 심층 면담을 시도하여 담당자의 의견과 고충을 들었다. 이들은 주로 정보공개 처리 현황 관리자로서 역할을 이행하고 있었는데 이로 인해 외부 정보공개청구인과 기관 내 구성인 양자로부터 압력을 받는 상황에 놓이게 되는 경우가 빈번하였다. 또한 행정 소송으로 인한 업무 스트레스도 상당한 것으로 밝혀졌는데, 이러한 정보공개 업무의 스트레스는 주업무인 기록관리 업무 수행에 심각한 영향을 미치는 것으로 드러났다.

ASEAN 국가들의 외국중재판정에 관한 승인 및 집행 - 말레이시아·싱가포르·인도네시아의 법제 및 판례를 중심으로 - (Recognition and Enforcement of Foreign Arbitration Awards in ASEAN)

  • International arbitration is an increasingly popular means of alternative dispute resolution for cross-border commercial transactions. The primary advantage of international arbitration over court litigation is enforceability. An international arbitration award is enforceable in most countries in the world. Especially, statistics indicate of ASEAN such as Malaysia and Singapore that the vast majority of defeated companies comply with the terms of international arbitral awards against them or settle soon after the award is rendered. Unlike Malaysia and Singapore, in Indonesia, there are several grounds for refusal of enforcement of an award including where both the nature of the dispute and the agreement to arbitrate do not meet the requirements set out in the Arbitration Law. Because Indonesia does not acknowledge decisions of foreign courts, theoretically they could enforce an international arbitral award which was set aside by the court in the seat of arbitration. This paper introduces the legal system and cases of recognition and enforcement of foreign arbitration awards in ASEAN, especially Malaysia, Singapore, and Indonesia. Secondly, by comparing their law and cases, the paper emphasized the international suitability and global fitness in involved in recognition and enforcement of foreign arbitration awards.

Removal of acetaminophen from wastewater by constructed wetlands with Scirpus validus

  • Since most of the existing wastewater treatment options lack the ability to treat micro-contaminants, the increased use of pharmaceuticals and personal care products (PPCPs) and release as human waste have become a serious concern in recent years. Constructed wetlands (CWs) are a low-cost technology for wastewater treatment, however, its performance in term of PPCPs removal has not yet been fully investigated. This study aimed to characterize the removal factors and efficiency of acetaminophen (ACT) removal by CWs. The results revealed the decreased concentrations of ACT with increasing hydraulic retention times (HRT) of 0, 3, 5 days. The contribution of removal factors was found to be varied with initial ACT concentration. At the low ACT concentration (i.e. 1 ppb), plant uptake was the dominant, followed by microbial and photolytic removal. In contrast, at the high ACT concentration (i.e. 100 ppb), microbial and photolytic removal were found as dominant factors. On the other hand, hydrogen peroxide ($H_2O_2$) concentration was found at higher level in the plant shoot than in the root probably due to occurrence of the Fenton reaction resulting in PPCPs removal.

전자금융거래 시 보안 통제 사항의 개선 연구 (A Study on Improving Security Controls in the Electronic Financial Transaction)

  • 금융분야에서 개인신용정보 유출사고로 인하여 금융당국은 전자금융거래법등에 통제사항을 강화하여 왔다. 이에 따라 정보보호 수준이 한 단계 향상이 되었지만 추가로 개선할 사항이 더 없는지 연구해볼 필요가 있게 되었다. 본 논문은 정보보호 분야에서 통제사항을 총 망라하는 정보보호관리체계인증의 통제사항과 비교하여 추가로 개선할 통제사항을 전문가들의 의견을 모아 일정 중요도 이상이 되는 19개를 도출하였다.
