This paper aims to analyze the recent progress(current situation) and tasks of arms control in North and South Korea. To this end the paper is composed of 5 chapters titled instruction; recent progress(current situation) of arms control in South and North Korea; constraints and tasks of arms control on the Korean peninsula; and conclusion. One of the most important tasks for the establishment of a peace structure for the coexistence of the Korean people in the 21st century is the realization of military control in order to resolve the acute military confrontation situation and mutual threats. With the 2018 PyeongChang Winter Olympics, the North-South summit and the subsequent talks for peace and denuclearization on the Korean Peninsula, the North Korea-US summit, and subsequent talks are creating conditions for trust building and arms control between the two Koreas. The military trust between the two Koreas and operational arms control are being achieved through the declaration of the April 27 Panmunjom and the 'Military Agreement for the Implementation of the Panmunjom Declaration.' However, since there are constraints on the control of arms control, such as the persistence of hostility and distrust of the two Koreas, the defense treaty between the two Koreas and neighboring countries, the competition of neighboring countries and the complex interests of the Korean peninsula, Trust Building is important. We should resolve the issue of arms control between the two Koreas, taking into account the trend of international arms control over the internal and external dynamics of the Korean peninsula gradually and carefully, with a vision of long-term unification security.
In scenarios involving inspections and verifications of nuclear facilities, ensuring the proper functioning of on-site safeguards equipment is crucial. There have been precedents in Kazakhstan where equipment failed to operate properly due to extremly cold temperatures, and the year-round minimum temperature at North Korea's Punggye-ri nuclear test site is approximately minus 30 degrees Celsius. To ensure the proper functioning of equipment in extreme environments for on-site verification of nuclear activities on the Korean Peninsula, relevant research is necessary. This includes confirming the functionality of equipment used in inspections and verifications, as well as analyzing factors that may disrupt their normal operation. This study aims to conduct a risk analysis for the normal operation of equipment in extreme environments and develop criteria and procedures for environmental-based performance testing. To achieve this, we conducted a risk analysis based on IAEA safeguards, analyzed the utilization of equipment, and performed a risk analysis associated with transportation for on-site verification considering the environmental characteristics of the Korean Peninsula. Furthermore, we provided performance testing criteria and procedures. The research results can be utilized as reference material in the verification and monitoring processes of nuclear activities.
Together with the development of space science outer space law has become one of the most rapidly developing branches of international law. This reflects a general realization that these new activities must be subject to reasonable legal regulation if they are to serve the peaceful purposes of mankind without undue confusion and disorder. The exploration and use of outer space introduces many novel opportunities and dilemmas, and inspired insights are needed in the development of this new resource. In particular, the settlement of space law disputes is a relatively new discussion in international law. However, the significance of the settlement of space law disputes was acknowledged in various colloquia organized by legal academicians and practitioners around the world. Analysis of the dispute settlement provisions in space agreements plainly reveals the degree to which States persist to be mistrustful of any impingement to their sovereignty. They are reluctant to submit disputes to adjudication and binding arbitration, particularly when these provisions are negotiated between States which have dissimilar political, economic and social interests and demography. However, there is a slow but clear shift in this attitude as States realize the contemporary political, economic and technical pressures necessitating the lifting of the veil of State sovereignty. The development of an effective mechanism for the settlement of disputes arising in relation to the development of the exploration and exploitation of outer space has been the subject of global study by highly qualified publicists and international institutions. The 1972 Liability Convention is the space treaty with the most elaborate provisions for dispute settlement. However, it fails to ensure binding decisions. In this point, the 1998 Taipei Final Draft Convention may be a useful instrument for further consideration on whether an independent sectorialized dispute settlement mechanism should be established. Considering these circumstances it seemed essential to take legislative action to implement a system as comprehensive as the relevant legal framework are in the Law of the Sea and International Criminal Law mechanisms for dispute settlement and conflict avoidance from outer space activities.
According to 1944 Chicago Convention aircraft are classified into public aircraft(or state aircraft) and private aircraft(or civil aircraft). However even if public aircraft owned by government are used as commercial flights, those are classified into private aircraft. But as far as space activities are concerned in the 1967 Outer Space Treaty, those are related to all activities and all space objects, thus there being no differentiation between the public spacecraft and private spacecraft. As for the institutions of air law there are ICAO, IATA, ECAC, AFCAC, ACAC, LACAC in the world. However in the field of space law there is no International Civil Space Organization like ICAO. There is only COPUOS in the United Nations. The particular institutions such as INTELSAT, INMARSAT, ITU, WIPO, ESA, ARABSAT would be helpful to space law field. In the near future there is a need to establish International Civil Space Organization to cover problems rising from all space activities. According to article 1 of the 1944 Chicago Convention the contracting States recognize that every State has complete and exclusive sovereignty over the airspace above its territory. It means that absolute airspace sovereignty is recognized by not only the treaty law and but also customary law which regulates non-contracting States to the treaty. However as for the space law in the article n of the 1967 Space Treaty outer space, including the moon and other celestial bodies, is not subject to national appropriation by claim of sovereignty, by means of use or occupation, or by any other means. It creates res extra commercium like the legal status of high seas in the law of the sea. However the 1979 Moon Agreement proclaimed Common Heritage of Mankind as far as the legal status of the outer space is concerned which is like the legal status of deep sea-bed in the 1982 United Nations Law of the Sea. As far as the liabilities of air transport system are concerned there are two kinds. One is the liabilities to passenger on board aircraft and the other is the liabilities to the third person or thing on the ground by the aircraft. The former is regulated by the Warsaw System, the latter by the Rome Convention. As for the liabilities of space law the 1972 Liability Convention applies. The Rome Convention and 1972 Liability Convention stipulate absolute liability. In the field of space transportation there would be new liability system to regulate the space passengers on board spacecraft like Warsaw System in the air transportation.
The Beijing Convention of 2010 taken together effectively establishes a new broader and stronger civil aviation security framework. This adoption would significantly advance cooperation in prevent of the full range of unlawful acting relation to civil aviation and the prosecution and punishment of offenders. First, the Beijing Convention of 2010 will require parties to criminalize a number of new and emerging threats to the safety of civil aviation, including using aircraft as a weapon and organizing, directing and financing acts of terrorism. These new treaties reflect the international community's shared effort to prevent acts of terrorism against civil aviation and to prosecute and punish those who would commit them. Second, this convention will also require States to criminalize the transport of biological, chemical, nuclear weapons and related material. These provisions reflect the nexus between non-proliferation and terrorism and ensure that the international community will act to combat both. Third, this Convention shall not apply to aircraft used in military, customs or police services. As a substitute, International Humanitarian Law will be applied in a case. Moreover, the National Jurisdiction and the application of the law will be extended farther. The treaty promotes cooperation between States while emphasizing the human rights and fair treatment of terrorist suspects.
This paper aims to apply the convergence theory into the minimum income guarantee which forms the moral foundation of the welfare state. The research question of this paper is if the level of minimum income guarantee among EU member states (EU-15) gradually converging into a certain level. For this purpose, Chapter 2 describes the convergence and diversion of welfare states since the Second World War, and chapter 3 explains the historical development of the EU social policies since the Rome Treaty (1957). Chapter 4, which is the main body of this paper, analyzes if the level of minimum income guarantees of EU member states is converging by the coefficient of variation analysis and regression analysis. However, converging trend of the level of basic income guarantee among EU member states has not been proved. In other words, social policy arena still remains strongly in the realm of national sovereign states, irrespective of growing pressure from the supra-national governing body like the EU. It is in line with the Abram de Swaan's argument that "welfare states is nation states" (1994: 110).

This study investigated changes in the youth smoking rate and smoking cessation rates before and after a cigarette price increase in 2015. Specifically, the changes in smoking rate, smoking cessation attempt rate, selection rate and amount of smoking were investigated using primary data pertaining to Korean Youth Risk Behavior obtained from a web-based survey of youth general characteristics, mental health, subjective grade, drinking and smoking related characteristics before and after a cigarette price increase. To accomplish this, 800 middle school and high school students in 9th (2013), 10th (2014), 11th (2015) were surveyed. The current youth smoking rate was slightly decreased from 9.7% in 2013 to 9.2% in 2014, while the smoking rate in 2015 decreased significantly by 15.2% after the cigarette price increased to 7.8%. These results confirmed that increasing cigarette price is very effective at decreasing youth smoking rate, providing motivation to stop smoking and preventing smoking. The prevention of smoking and inducement to stop smoking during adolescence is very important because the majority of teenage smokers continue smoking into their adulthood. In addition to expanding a completely non-smoking area and a comprehensive ban on tobacco advertising, promotion and sponsorship should be urgently sought, and the effect can be maximized when the WHO FCTC faithfully implements the already-founded treaty.
This paper investigates the process of change in the meaning of the term gongye (工藝) (nowadays it means craft) during Korea's transition to the modern era. The Annals of the Joseon Dynasty (朝鮮王朝實錄) will serve as the basis for the examination of pre-modern usage, and the Korea-United States Treaty of 1882 for the changes that occurred between the translation from Chinese and from Japanese following the opening of the port . After the port opened, the meaning of gongye, which once broadly referred to the wide range of work of people from different fields, was narrowed down to singularly represent the manufacturing industry. Following the example of Japan, the first East Asian country to succeed in modernization, this new meaning of gongye was generally used in the context of embracing Western culture and creating industry. As industrialization emerged as a national mission, and new terminology was needed to express these new concepts, the Chinese characters used by the Japanese to translate Western concepts were directly imported and used without making any changes. Gongye was similar in meaning to gongeop (工業) (nowadays it means industry) at the time, and the two terms were used interchangeably. However, following the Japanese annexation of Korea, the cultural administration of the Governor-General imbued the term with artistic concepts, and gongye was differentiated from gongeop, As such, examining the establishment of terminology and concepts can be helpful for understanding the contradictions and problems of the Korean crafts scene, which were derived from a period in the past called the modern era.
Until Montreal Convention was established in 1999, the Warsaw System is undoubtedly accepted private international air law treaty and has played major role on the carrier's liability in international aviation transport industry. But the whole Warsaw System, though it was revised many times to meet the rapid developments of the aviation transport industry, is so complicated, tangled and outdated. This thesis, therefore, aim to introduce the Montreal Convention by interpreting it as a new legal instrument on the air carrier's liability, specially on the passenger's, and analyzing all the issues relating to it. The Montreal Convention markedly changed the rules governing international carriage by air. The Montreal Convention has modernized and consolidated the old Warsaw System of international instruments of private international air law into one legal instrument. One of the most significant features of the Montreal Convention is that it sifted its priority to the protection of the interest of the consumers from the protection of the carrier which originally the Warsaw Convention intended to protect the fledgling international air transport business. Two major features of the Montreal Convention adopts are the Two-tier Liability System and the Fifth Jurisdiction. In case of death or bodily injury to passengers, the Montreal Convention introduces a two-tier liability system. The first tier includes strict liability up to 100,000SDR, irrespective of carriers' fault. The second tier is based on presumption of fault of carrier and has no limit of liability. Regarding Jurisdiction, the Montreal Convention expands upon the four jurisdiction in which the carrier could be sued by adding a fifth jurisdiction, i.e., a passenger can bring suit in a country in which he or she has their permanent and principal residence and in which the carrier provides a services for the carriage of passengers by either its own aircraft or through a commercial agreement. Other features are introducing the advance payment, electronic ticketing, compulsory insurance and regulation on the contracting and actual carrier etc. As we see some major features of the Montreal Convention, the Convention heralds the single biggest change in the international aviation liability and there can be no doubt it will prevail the international aviation transport world in the future. Our government signed this Convention on 20th Sep. 2007 and it came into effect on 29th Dec. 2007 domestically. Thus, it was recognized that domestic carriers can adequately and independently manage the change of risks of liability. I, therefore, would like to suggest our country's aviation industry including newly-born low cost carrier prepare some countermeasures domestically that are necessary to the enforcement of the Convention.
