Both competent authorities and private entrepreneurs face plenty of risks when negotiating BTO(Build Transfer Operation) methods of PPI(Private Participations in Infrastructures) projects. Also, success and failure of projects largely depend on the concession agreement contract. In this study, for more efficient negotiation, major issues are examined, and quantitatively analyzed to find out not only the relationship but also the characteristics of which these issues share. Questionnaire research was conducted through both research and by experts who were divided into an ordering agency, design company and constructor. Characteristics of major issues were quantitatively analyzed using the Likert index method, ANOVA(ANalysis of VAriance) and AHP(Analytic Hierarchy Process) analysis. Case studies were examined in order to estimate construction cost, rates of return, government finance support, level of operation-revenues guarantees, estimating operational costs and usage fees. With these 6 items, relative priority, relative impression which is sensible to risk and extent of difficulty in presenting data which is objective were quantitatively analyzed by the ordering agency, design company and constructor groups. From the analysis, there were some similarities between the design company and constructor groups while there was less of similarities between the ordering agency and design company or constructor. The government is diversifying the methods of project promotion, and PPI project from infrastructure-centered to public culture facilities are being expand. The current study will provide not only supporting efficient negotiation but also revitalizing PPI projects.

The core of subject matter education is determined by the choice of subject matter taught to students and by the organization of content according to educational objectives. The purpose of this research is to suggest ways to improve the present content of science education so as to prepare students and schools for a radically different future. We deduced the main issues the solution of which could lead to significant improvements in the contents of science education by analyzing previous studies and investigating the changes in content that were effected during curriculum revisions in the past. The main issues thus revealed through this study are as follows: the essence of the contents of subject matters in science education, the social and cultural background of change in the science curriculum, the rational steps on the way to choosing contents as part of the science curriculum, the processes of choosing the main contents of each subject, the international comparative study of contents, the updating of contents for the benefit of future society, and the reorganization of subject contents. In order to find a concrete improvement on the issues deduced, we organized an expert group. Then, we proceeded to collect and analyze the experts' opinions. A survey was administered to 19 science education experts working with universities and colleges of education. We examined their degree of agreement on the issues and problems, and on the steps that may be taken to us the improvements on these issues. we suggested that: collecting opinion and reaching an agreement on the essence of the contents of the subject matters in science education, the necessity to choose core contents within the scientific domain, developing a structure map in order to integrate and connect various subject domains, presenting explicitly the objective of inquiry by grades, moving toward integrating science contents, diversifying the construction of science textbooks.

산업제어시스템과 SCADA(Supervisory Control and Data Acquisition) 제어 시스템들이 기존의 고립적이고 폐쇄적인 시스템에서 점차 개방적이고 표준화된 시스템으로 전환되고 있으며, IT 망과의 통합이 이루어지고 있다. 따라서 주요 국가정보 인프라에 대한 사이버 위협 및 공격에 대한 우려가 증대되고 있다. 산업제어시스템의 정보보호 기술은 일반적인 IT 정보보호 기술과는 특성상 여러 가지 차이점이 존재한다. 국내에서의 산업제어시스템 정보보호 기술에 대한 연구는 아직 미약한 수준이다. 본 논문에서는 국가 주요 정보하부구조를 구성하고 있는 산업제어시스템 중에서 사물인터넷(IoT) 기반 스마트 그리드 시스템의 보안 특성에 대하여 분석하고 보안 쟁점 및 고려사항을 제시하고자 한다.

작년 12월에 마무리된 한미 FTA 5차 협상 이후 향후 협상에 대한 각종 전망과 예측이 난무하고 있지만 현재 어느 것도 확실한 것은 없다. 다만 보호무역주의 경향을 띠고 있는 민주당의 압승으로 끝난 미 중간 선거와 3차례나 반송 조치된 미국산 쇠고기의 무조건적인 수입을 원하는 미국의 억지를 보았을 때 앞으로의 한미 FTA 협상이 제대로 진행되기는 어렵다는 것이 대부분의 전망이다. 때문에 오는 1월 15일부터 19일까지 서울에서 개최되는 한미 FTA 6차 협상에서 쟁점이 되는 분야와 한미 양국이 가지고 있는 협상전략은 무엇인지 파악해보는 것 또한 앞으로 협상이 나아갈 방향을 예상해 보는 방법이 될 수 있다. 더불어 다시 한 번 협상 쟁점이 가지는 의미를 되새겨보는 계기도 될 수 있을 것이다.

형사소송의 목적은 사안의 진상을 밝혀 적정한 형벌권을 실현하는데 있다. 수사기관은 범죄사실을 명백히 밝히기 위하여 아직도 과학적인 수사보다는 자백에 의존하는 경향이 있다는 것은 주지의 사실이다. 수사를 함에 있어 자백에 의존하는 것은 고문 등 강압수사의 위험성이 크다. 이를 방지하기 위하여 형사소송법 제309조는 자백배제법칙을 채택하고 있다. 자백배제법칙을 검토함에 있어서는 무엇보다도 먼저 자백의 임의성에 대한 입증을 살펴보아야 할 것이다. 따라서 본고는 강압수사방지를 위하여 자백의 임의성에 대한 거증책임 문제, 임의성의 기초사실증명 등에 관하여 몇 가지 쟁점을 검토하고자 한다.

제주도에서 개최된 4차 협상이 27일 SPS(위생 및 검역조치) 분과를 끝으로 협상이 종료됐다. 금년 초 양측이 합의한 바에 따르면 다음달 미국에서 열리게 될 5차 협상 한 차례만 남겨두고 있는 셈이다. 그러나 이번 협상에서도 양측은 농산물 개방폭 입장차는 평행선을 달리고 있어 연내 타결은 사실상 불가능해졌다. 양측은 쟁점이 많은 농산물 등은 5차 협상 전 논의를 계속해 나가기로 했다. 양측은 쟁점 현안들을 그대로 남겨 남겨두어 금년 내 다섯차례 협상을 통해 FTA 협상을 체결한다는 애초 목표는 사실상 어렵게 됐다. 커틀러 대표 또한 "연내 타결을 목표로 두었지만, 내년 초 타결도 염두해 두고 있다" 면서 우리 정부를 압박하고 있다.

대리운전업체에 소속되어 있는 대리운전자가 대리운전 보험에 가입한 경우, 보험료는 대리운전자가 직접 부담하는 경우가 대부분이나 계약당사자인 보험계약자는 대부분 대리운전업체로 되어 있다 보니 약관내용에 대해 제대로 설명을 듣지 못했다는 이유로 보상범위 등을 둘러싼 분쟁이 발생하는 경우가 많다. 본고에서는 차주가 동승하지 않은 채 대리운전자가 차량을 운전하던 중 발생한 사고를 대리운전보험에서 담보하는 '대리운전 중 사고'로 볼 수 있는지 여부를 다룬 사건을 소개하고자 하는데, 쟁점 가운데 약관의 설명의무와 관련 사항을 일부 언급하고 있어 동 내용을 살펴보고 나아가 약관 설명의무의 법적 성격 및 유사 분쟁사례 등을 개관하고자 한다.

최근에 시행된 개정 상표법에서는 여러 가지 새로운 내용들이 추가 또는 변경되었다. 그 중에 해석상 실무적으로 혼란이 있을 수 있는 것으로서, 상표사용의사확인제도, 법정손해배상제도, 전용사용권등록의 효력발생요건 폐지 등을 거론해 볼 수 있겠다. 이와 같은 제도들은 실무상이나 그 해석에 있어서 일반 국민들과 기업관계자 등에게 낯선 제도들이고, 그 제도의 운용에 관한 이해도 분명하게 이루어져 있지 않은 상황이기도 하다. 따라서, 이하에서는 이와 같은 상표사용의사확인제도, 법정손해배상제도, 전용사용권등록의 효력발생요건 폐지에 관한 주요 내용과 해당 제도들의 쟁점이 될 수 있는 사항들에 대하여 구체적으로 살펴보고자 한다.
