A Study on the Concepts of Legal Competence Concerning Adults Guardianship Acts (성년후견법률에 나타난 의사결정능력의 개념에 관한 연구 - 영국 정신능력법(Mental Capacity Act, 2005)을 중심으로 -)

  • The purpose of this study is to examine the arguments about the conceptualization and the assessment of mental capacity and legal competence concerning the adult guardianship. Based on these literature reviews, the author analysed Mental Capacity Act 2005 of United Kingdom. The act conceptualizes legal competence as a concept dependent on a specific decision, time, and environmental support or convenience. According to the act, the assessment of the legal competence shall be made with ensuring the person all the viable supports and environmental conveniences. And it appears that the hierarchical assessment system of the act assures that the more the decision is important the more professional and more formal assessment shall be used. Based on these findings the author suggested several implications for the legislation of a new adult guardianship act in Korea.

  • We confront incessant choices in life. A person or a group stands at a crossroad continuously and make decisions under limited conditions in each time in order to achieve a goal. These series of processions are referred to as decision making and dominates our actions. Based on this view, the decision making is crucial and it secures its own position in school education as well as in real life. The purpose of this study is to develop decision making skills instructional model that can be applied to improve decision making skills in technological subjects. The components of decision making skills in technological education was problem recognition, problem identification, alternative production, alternative assessment, optimum selection, optimum evaluate. An instructional models for improvement of decision making skills in technology education and examination was designed according to the components of decision making skills in technological education. Depending on the components of decision making skills developed a teaching material to experience each step. And in the teaching material was to verify the improved decision-making skill. Accordingly, a decision making instruction model in technology is expected to contribute to enhance students' decision making skills.

Impacts of Professional Autonomy and Role Conflict Clinical Decision-Making Ability of Nurses on Comprehensive Nursing Care Service Wards (간호간병통합병동 간호사의 전문직 자율성, 역할갈등이 임상적 의사결정능력에 미치는 영향)

  • This investigation was a descriptive study that examined the relationship among factors including professional autonomy, role conflict, and clinical decision-making ability of nurses on comprehensive nursing service wards. To accomplish this, a survey of 234 nurses working at D city and G city who were selected based on convenience sampling was conducted. Data were collected using a self-reported questionnaire completed by 234 nurses at four clinical hospitals from October 12, 2017 to November 30, 2017. The collected data were evaluated by t-tests, ANOVA, Pearson's correlation and stepwise multiple regression analysis. The mean clinical decision-making ability score was $3.38{\pm}0.78$, which corresponded to an intermediate level of clinical decision-making ability. Clinical decision making ability was positively correlated with professional autonomy, but role conflict showed a negative correlation. The factors having the greatest impact on clinical decision-making ability were found to be, in order, length of work, education level, professional autonomy and role conflict, which together accounted for 38.7% of the total impact. To improve clinical decision making ability, it is important to improve autonomy and role conflict. Additionally, to improve clinical decision-making ability, it is necessary to improve clinical decision-making ability to determine nurses tasks through professional autonomy and role conflict. Overall, the results of this study can be utilized as baseline data when developing a program to enhance nurses' clinical decision making ability. Moreover, it is suggested that an interventional study analyzing validity and effectiveness of developed education programs be conducted.

Relations among the Decision Making Style, Self Leadership and Communication Competence of Visiting Nurses (경인지역 보건소 방문간호사의 의사결정유형에 따른 셀프리더십과 의사소통 능력)

  • The aim of this study was to explore relations among the decision making style, self leadership and communication competence of visiting nurses. The research design was a descriptive survey study, and 219 people were selected through convenience sampling among the visiting nurses who worked in the 28 community based health care centers. The most frequent decision making style of visiting nurses was a rational style. The scores of self leadership and communication competence of visiting nurses were also showed the highest score when the visiting nurse had a rational decision making style. The statistical significant correlations were found among the decision making style, self leadership and communication competence. The results of this study were useful to develop jop-training programs for visiting nurses to enhance their problem-solving abilities. We suggest more various education programs to increase the visiting nurse's self leadership and communication competence will be implemented and refined protocols according to situations will be developed, too.

Factors Influencing on Clinical Decision Making Ability of Nurses in Long-term Care Hospitals (요양병원 간호사의 임상의사결정능력에 미치는 영향요인)

  • The purpose of this study was to identify factors influencing the clinical decision making ability of nurses in long-term care hospitals. Data were collected from 174 nurses working in long-term care hospitals in G-do from October 11 to December 10, 2021. The data were analyzed by descriptive statistics, t-test, ANOVA, Pearson's correlation and stepwise multiple regression through the SPSS 23.0. As a result of the study, the clinical decision making ability was positively correlated with critical thinking disposition(r=.494, p<.001) and nursing work environment(r=.451, p<.001). Critical thinking disposition and nursing work environment explained 33.1% of clinical decision making ability. In order to improve the clinical decision making ability, which is the core competency of nurses, education to increase critical thinking disposition and the creation of a desirable nursing work environment are necessary. In future research, research to identify various variables affecting the clinical decision making ability of nursing hospital nurses, and research for the development and effectiveness of programs to improve clinical decision making ability are suggested.

Analysis Relationship of Critical Thinking, Clinical Decision Making and Job Satisfaction of Dental Hygienists (치과위생사의 비판적 사고성향, 임상적 의사결정능력과 직무만족도 간의 관계)

  • The purpose of this study was to examine the influence of critical thinking, clinical decision making and job satisfaction of 132 dental hygienists. The data was collected from 1st May to 31th October, 2012 in Ulsan, Pusan and Gyeongsangnam-do areas. The majority participants were female, 30.6 years old, graduate diploma course of dental hygienist, and working in dental clinics. In critical thinking, truth-seeking was highest score, 3.36 but maturity was lowest score, 3.00. In clinical decision making, canvassing of objectives & values was highest score 3.39, but search for alternatives or options was lowest score, 3.10. In job satisfaction, professional status was highest score 3.20, but incomes & promotion was lowest score 2.84. In correlation between general characteristics and critical thinking, there was significantly different in religion, education status, total working period and working areas. There was significantly different with religion and education status in clinical decision making, And There was significantly different with religion and education status, total working period, and working areas in job satisfaction. Critical thinking, clinical decision making and job satisfaction was positive relationship. To improve professional competence and job satisfaction of dental hygienist it need to use actively the critical thinking and clinical decision making. And it need to prepare the education and strategy to increase the job satisfaction of dental hygienist.

구조최적설계법과 재래식설계법의 문제점

  • 최적설계법에 의한 설계는 종래의 설계법에 의한 설게보다도 중량이 가볍거나 비용이 적을 것으로 생각되었기 때문에 중량이 가볍거나 비용이 적지 않으면 최적설계로는 의미가 없는 것으로 이해된 시대도 있었다. 그러나 구조설계분야 뿐만 아니라 일반 공업설계는 대단히 많은 의사결정이 직렬, 병렬의 관계로 구성되어 있다. 그중 어떤 의사결정은 인간의 경험, 직감, 도는 상상력에 의한 것이 유효할 수도 있을 것이다. 그러나 결정해야 할 변수의 수가 많을 경우는 각 의사결정간의 관계가 복잡할 때에는 전자계산기의 이용이 유효하여 최적설계는 의사결정의 유효한 수단으로써 위치를 굳히게 되었다. 의사결정이 어느 부분은 전자계산기가 분담하므로써 양질의 최적설계가 가능하게 되고 또는 기술자는 그가 가지고 있는 능력 중 가장 잘 이용해야 할 창의력이 요구되는 의사결정문제에 보다 많은 시간을 할애할 수 있다. 이와 같이 인간의 능력과 계산기의 능력을 총합하여 최상의 의사결정을 하기 위한 시스템을 구축할 수 있다. 이러한 배경 때문에 최적설계를 구조총합이라 한다.

The Influence of Moral Behavior, Moral Anguish, and Critical Thinking Tendency on Clinical Decision-making Ability in Nurse (간호사의 도덕적 행동, 도덕적 고뇌, 비판적 사고성향이 임상적 의사결정능력에 미치는 영향)

  • This study was attemted to grasp the factors affecting the clinical decision-making ability of nurse. Data were collected from 156 nurse working in hospital in G-do. Analysis was done using t-test, ANOVA, Pearson correlation coefficient, and Multiple regression with IBM SPSS WIN/25.0. The most influential factor on the subjects' clinical decision-making ability was nursing Research 'very interest', critical thinking tendency, 'master/doctor', clinical experience 'more than 20 years and 1 month', moral behavior, nursing research 'important', 'single', clinical work experience '5 years, 1 month-10 years', department work experience '3 years 1 month-5 years'. The explanatory power was 51.4%. It was significant in that it was confirmed that interest and importance, moral behavior, academic background, and career are variables that influence clinical decision-making ability. The results of this study can be utilized as basic data for the development of intervention plans and programs that can increase clinical decision-making ability in the context of an ethical dilemma. In addition, developing and verifying educational programs that can increase clinical decision-making abilities in ethical dilemmas is needed.

  • This study evaluates empirically differences of performance in the two types of the decision-making. There exist implied noises in the information but consensus mitigates or clears noises from available information in the decision-making process. Decision-making peformance depends on information quality. Therefore the higher quality information are used, the more peformance decision-makers have. The results of this study shows that group decision-making is better than individual in decision making performance. It indicates that consensus mitigates or clears noises in the information. As variant individuals, however, have different performance, individual decision-makers also have different ability in analyzing information.

  • 사람들은 누구나 시간과 장소를 구분하지 아니하고 의사결정을 내려야 할 상황에 처하게 된다. 특히 조종사의 경우에는 의사결정을 하여야 할 상황이 보다 시간적으로 제한되어 있고, 또 다른 어떤 경우보다 그 내용이 더 복잡하다는 특성을 가지고 있다. 특히 항공기 운항중 발생하는 조종사의 의사결정은 그 방법에 따라 결과는 아주 다른 양상으로 나타나게 되는데 합리적인 의사결정이 이루어졌다면 그 결과는 안전성과 경제성이 동시에 실현되지만 합리적으로 의사결정이 이루어지지 못하였다면 항공기 사고라는 최악의 사태로 이어지게 된다. 그러나 현실적으로는 조종사들이 사회, 문화적 특성과 개인적인 태도 및 성격에 따라 집단내 구성원들의 의사를 종합하여 의사결정을 얻지 못하고 경우에 따라서는 기장 개인의 능력에 따라 의사결정이 이루어지고 있는 실정이다. 이러한 점에 착안하여 본 연구에서는 조종사의 합리적인 의사결정에 영향을 미치는 요인들을 분야별로 내용을 분석하고 의사결정의 이론적 고찰을 통해 조종사의 합리적인 의사결정을 위한 방안을 제시하고자 하였다. 특히 조종사 자격 관리 및 능력개발 프로그램시 태도 변화를 위한 교육이 우선해야 한다는 것과 그리고 미국의 여러 기관에서 연구 수행한 결과를 인용하여 조종사의 태도분석방법을 소개함으로써 조종사 자신들이 직접 지니고 있는 위험한 태도 요소를 자각할 수 있도록 하였으며 이에 대한 행동상 지켜야 할 원칙을 제시하여 자신이 의사결정을 해야하는 경우 적용할 수 있도록 하였다. 앞으로 이와 관련하는 지속적인 연구를 함으로서 합리적인 의사결정을 위한 요인들의 상관관계를 분석하고 항공기 운항분야중에서 부분적이나마 정형적인 의사결정모델이 개발될 때 항공기 안전운항에 크게 기여할 것으로 기대된다.
