Current Status and Improvement Measures for the Port State Control of Foreign Vessels in Domestic Port Calls (국내 기항 외국적 외항선 항만국통제 현황 및 개선방안)

  • As the revitalization of the global maritime industry continues, the number of foreign ships navigating the maritime territories of maritime neighboring countries has rapidly increased. However, large-scale marine accidents have occurred, caused by the insufficient establishment of a system for management and operation relative to vessels' safety-condition. To address that, the IMO has granted the right to exercise port state control, especially for foreign vessels, to countries with jurisdiction over maritime territories with strengthening regulations and guidelines. In particular, the Republic of Korea, as a member of the TOKYO MOU, is conducting PSC, but as of 2020, the proportion of foreign ships was three times higher than that of national ships that called in domestic ports. However, the inspection rate was low at 9% which has not met the recommended level by the TOKYO MOU. Thus, this study conducted an IPA analysis as well as content analysis, by collecting the practical opinions and views of PSCO through objective questionnaires and written expert interviews, for improving the efficiency and effectiveness of domestic PSC. As a result, it was derived that the importance and performance related to human factors such as life on board, working environment, and response to safety accidents should be improved in to raise the quality of PSC inspection. Additionally, the work environment and performance of PSC in domestic ports for foreign vessels could be improved, if multifaceted support bases are established, for administrative unification of related tests for PSC, recruitment of PSCO, activation of the defection-reporting system, reorganization of the PSC execution group, etc.

A Study on the Improvement for the Criminal Jurisdiction of the Flag Ship of Convenience and the Mutual Assistance in Maritime Criminal Matters (편의치적선에 대한 형사관할 및 국제공조 개선방안 연구)

  • UNCLOS recognizes the right of innocent passage in the ocean but grants jurisdiction and governance to the state of the flag the vessel flies. However, by granting the right to determine vessel's nationality to each country in UNCLOS and by practically consenting inconsistency with the ownership and the state of flag has made the keeping of maritime order quite difficult. Especially, acknowledging the exclusive rights of the flag state on criminal jurisdiction hinders the owner state from exercising its rights and exposes the problem of not taking into account the opinion of the affected state party. This study addresses these issues and examines international regulations on vessels and flag states, mainly UNCLOS, and provides case studies on how criminal jurisdiction is determined when accidents occur at sea. Furthermore, it takes a deeper look into the mutual assistance system in criminal matters and proposes some alternatives on how to overcome these issues.

A Study on the Preparedness of Port State Control for the Enforcement of NIR (NIR의 도입에 따른 항만국통제 대응방안에 관한 소고)

  • NIR(New Inspection Regime, hereinafter NIR) relating to the PSC(Port State Contorl, hereinafter PSC) has implemented in Asia-Pacific region under Tokyo-MOU from last January 2014. The most noticable difference between NIR and existing TF(Target Factor, hereinafter TF) is to evaluate company performance and to conduct PSC with flexible inspection interval on the basis of Ship Risk Profile; High Risk Ship, Standard Risk Ship and Low Risk Ship. Particularly deficiencies related to ISM Code, more than 5 deficiencies and detention record have a serious effect on the evaluation of Ship Risk Profile. Therefore ship and company are requested to ensure proper implementation of Safety Management System for the changed PSC tendency. Also RO(Recognized Organization, hereinafter RO) and Administration respectively should take suitable actions different to previous measures, such as implementation of cooperation and support system between vessel and company, changing subject and object for avoiding Mannerism in SMS audit, strengthening supervision on RO by Administration and establishment of private-public Partnership network.

  • Canada British Columbia 주의 Prince Rupert 와 Port Hardy(503km) 를 1주일에 2회 왕복하던 Queen of the North 호가 2006년 3월 22일 Gill Island 북쪽 해상에서 좌초되었다. 사고 후, 선박에 탑재된 Electronic Chart System(ECS)을 수거하여 선박의 항해자료를 회수키로하고, 2006년 6월 15일 해양탐사로봇을 이용하여 해저 약 453m 지점에 착저된 선박으로부터 ECS 컴퓨터를 수거하였고 Maker인 Transas사는 수거된 ECS의 Data를 복원하여 선주사에 재공하였다. 이에 따라 캐나다 교통안전국 (Transportation Safety Board of Canada)는 재현 결과물을 통하여 사고원인을 규명한 사건이다.

한국 첨단 지상파항법시스템(eLoran) 시범서비스의 LDC 메시지 변조기법 별 수신 성능 분석

  • eLoran 시스템에서 보다 높은 정확도로 시각 및 위치 정보를 제공하기 위해 별도의 데이터 채널인 Loran Data Channel (LDC)를 사용한다. LDC 메시지는 기존의 8개의 Loran 펄스 중 항법에 사용하지 않는 3-8번째 펄스의 전송시각을 변조하여 송출하는 Eurofix 방식과 9번째 추가 펄스를 이용해 데이터를 변조하는 9th 펄스 방식으로 변조될 수 있다. 본 논문에서는 eLoran 송신국에서 송출하는 LDC 메시지의 변조방법에 따른 수신 성능을 분석한다. 인천에서 운영 중인 eLoran 시험 송신국에서 9th 펄스 변조방법과 Eurofix 변조방법으로 동시에 LDC 메시지를 송출할 수 있도록 설정하고, 인천과 평택의 eLoran 보정기준국의 데이터베이스 내 저장된 LDC 메시지를 분석해 변조방법에 따른 LDC 메시지 수신률을 분석한다. 또한 항로표지 관리선 인성 1호를 이용해 인천항 인근에서 실제 사용자의 LDC 메시지 수신률을 분석하였다. 본 연구결과는 eLoran 시범서비스 이후 본격적인 서비스 과정에서 중요하게 활용될 것으로 기대된다.

항만국통제의 법적 근거와 국내시행상의 문제

  • The flag State is primarily responsible for implementing international maritime conventions(IMO conventions) and national laws and other standards as far as its own vessels are concerned, on the other hand the port State exercise its rights for the safety and marine environment under international law especially UNCLOS within port and territorial sea. In particular, the port State may take appropriate measures including detention of ships identified as sub-standard vessels which are considered as port State's supplementary role aiming for implementing international and national and regulations. But in the course of implementing port state control, international disputes may happen between port state, coastal state and flag state in spite of making all possible efforts to avoid these disputes. This paper aims to consider legal grounds on port state control(PSC) in international conventions and national laws concerned and deals with contradictions between international and national law arising from exercising PSC by port state control officers(PSCOs).
