Cyber forensics is used the process and technology of digital forensics as a criminal investigation in cyber space. Cyber crime is classified into cyber terror and general cyber crime, and those two classes are connected with each other. The investigation of cyber terror requires high technology, system environment and experts, and general cyber crime is connected with general crime by evidence from digital data in cyber space. Accordingly, it is difficult to determine relational crime types, collect evidence and the legal admissibility of evidence. Therefore, we considered the classifications of cyber crime, the collection of evidence in cyber space and the application of laws to cyber crime. In order to efficiently investigate cyber crime, it is necessary to integrate those concepts for each cyber crime-case. In this paper, we constructed a cyber forensics domain ontology for cyber criminal investigation using the concepts, relations and properties, according to categories of cyber crime, laws, evidence, and information of criminals and crime-cases. This ontology can be used in the process of investigating of cyber crime-cases, and for data mining of cyber crime; classification, clustering, association and detection of crime types, crime cases, evidences and criminals.

인터넷 이용의 급증과 더불어 컴퓨터바이러스, 해킹 및 프라이버시 침해 등 각종 사이버범죄도 또한 날이 갈수록 크게 증가하고 있다. 또한 인터넷과 같이 글로벌한 네트워크 환경에서 발생하는 범죄는 많은 경우 필연적으로 '국제적' 성격을 띠며, 따라서 개별국가의 노력만으로는 범죄를 충분히 방지하기 어렵다. 따라서 다수 국가가 사이버범죄에 대한 수사와 처벌을 위한 협력의 틀을 마련하기 위해 만든 사이버범죄방지협약(Convention on Cyber-Crime)은 컴퓨터시스템, 네트워크 또는 데이터를 대상으로 하거나 이를 오용한 다양한 형태의 범죄행위의 방지 및 처벌과 관련하여 실체법적 측면과 절차법적 측면에서 그 중요성이 매우 높다. 이 글에서는 이 사이버범죄방지협약에 대해 그 제정과정 및 주요내용을 살펴보고, 다음으로 우리법과 비교$.$분석하였다.

Now we are facing with a possibility of having crimes, which have been only possible offline, in cyber spaces as well.Especially, a recent growth in the use of SNS, promoted by popularization of smart phones, also has led an abrupt increase in cyber crime. It would be important to have a understanding of cyber crime and its characteristics by type as well as factors associated with each type of cyber crime in order to devise appropriate preventive measures against cyber crime. However, most of the previous studies on cyber crimesolely made through literature review or indirect approaches. Therefore, this study has been designed to conduct the interview with actual suspects(criminals) of cyber crime to address factors of cyber crime and to devise specific preventive measures and countermeasures against cyber crime. Especially, among various types of cyber crime, this study aims at addressing the 'trades' and 'financial transaction' of crimes committed using the information and communication network and the 'cyber libel/insult'of crimes committed using unlicensed contents, which have been soared recently and become significant issues. The findings of this study could be beneficial for the society since it has managed to conduct the interview and reveal relationships among major factors of cyber crime. The findings of this study could be used for devising and developing proper preventive and countermeasures against cyber crime, in turn reducing and preventing its damage.

In this modern society, a main tendency of crime is to increase in the incidence frequency of cyber crime. Varied criminal techniques from simple crimes to highly specialized crimes appear through cyber space. With the expansion of Internet spread, ordinary people increasingly have an opportunity to have access to information media and their possibilities to be involuntary associated with crimes get higher. In this sense, its seriousness is great. This study examined the present state of cyber crimes that appear through their several types and characteristics and the problems of police response to cyber crimes, and suggest effective response of police officer.

With the spread of Personal Computers(PC) in the 1980's, many people started to deal businesses with PC. From late 1990's, the Internet age with PC have started and many people have showed keen interest in cyber-space and now they are utilizing it. Since 2000's the use of cyber-space have skyrocketed and it caused significant changes to humans' life. There was a huge prosperity to us but the new kind of crime, cyber-crime, was raised. Unlike past physical type of crimes, those cyber-crimes take place in the cyber-space and they have special features of non-facing, anonymity, specialty, technologic, repetition, continuation. Those cyber-crimes are continually growing since 2003 and in 2010 it almost doubled compared to 2003. General cyber-crimes like phishing-scam pornography circulation was most of them and notably perpetrators of them are younger generation. Recently cyber-crimes are showing the trend of advancing more and more and cyber-bullying, fraud like phishing scam are on the rise. The police are responding by making 'Cyber Terror Response Center', but it does not work effectively with the problems of breakup of prevention and investigation unit, procedure of investigation and the system itself. So, I suggest practical use of private security to remedy our police's weakness and to prevent cyber-crimes. Preventing solutions of cyber-crime with private security are physical defense of large-scale servers and vital computers, building of Back-up system to prevent vital data loss, and building of cyber-crime preventing system combining software and hardware.

지난해 등장한 정보보호 관련 사건의 특징 중 하나는 금전적 이익을 목적으로 한 사이버 범죄가 본격적으로 등장했다는 점이다. 이런 유형의 범죄는 비단 국내뿐만이 아니라, 미국, 유럽 등 전 세계적인 관심사로 떠올랐다. 이런 의미에서 지난 10월 경찰청 주최로 개최된 '국제 사이버테러 대응 공동심포지움' 참석차 한국을 방문한 독일 BKA소속 Mirko Manske로부터 독일 및 EU 지역의 사이버 범죄 현황에 대한 의견을 들어봤다. Mirko Manske는 독일 연방 범죄 경찰국(Bundeskr-iminalant, BKA) 소속으로 지난 2006년부터 국내 경찰청 사이버테러대응센터에 해당하는 BKA 내 National High Tech Crime Unit(NHTCU)의 정보분석 및 수집 전문가로 활동하고 있다

인터넷과 기타 휴대용 PC등이 발전하고 보편화됨에 따라 인터넷 이용이 편리해짐은 좋지만 비대면성, 비익명성, 비 국경성 등 인터넷의 이러한 특성상 사이버 범죄들이 나날이 다양해지고 증가하고 있는 추세이다. 특히 사이버 범죄 중에서도 스토킹, 원조교제의 수단, 몰래카메라, 사이버음란물 유통 등 각종 신종 성폭력이 심각해지고 있어 사회문제로 끈임 없이 등장하고 있다. 현실세계에서의 성폭력과 마찬가지로 피해자가 느끼는 성적 수치심이나 심적 고통은 피해자의 자아에 깊은 상처를 남기며 더 나아가 왜곡된 성문화를 정착 시키는 새로운 사회적 문제로 작용한다는 점에서 사이버성폭력의 심각성과 문제는 오프라인상의 성폭력범죄에 비해 결코 뒤지지 않을 것이다. 물론 이러한 범죄들에 대한 처벌 조항들은 있다. 그러나 이런 것들이 있음에도 사이버상의 성폭력은 근절되지 않고 있다. 이것은 법적인 조치의 강화를 요구하는 동시에 인터넷을 사용하는 네티즌 스스로의 적극적 대처를 요구하는 것이기도 하다.

A cyber crime has been evolving, as other crimes have. Beyond physical damages such as financial crimes in the cyber world, it has evolved into psychological forms like cyber-bullying. In today's crimes, measures that consider psychological effects of crimes are highly regarded in that fear of crime is considered as well as visible crimes. Accordingly, cyber bullying, which causes psychological damages, needs to be treated very importantly. Because the characteristics of cyber crime is caused by different circumstances from the real world, measures should be taken in different aspects. Rather than physical damages, which can be found in the conventional crimes, cyber crimes cause psychological damages, so the effect that has on inflicting should be specified. Especially, in the environment that virtual reality is ubiquitous through smart phones, it is very difficult to establish measures by considering all the causes of general cyber crimes. Therefore, this study estimated what affects cyber bullying by focusing on personalized faith factor among social bond theory, which can control cyber crimes. As a result, self-controling faith was verified to have a negative effect on cyber bullying, so faith is a very important factor in personalized environment. Thus, it is suggested that the characteristics of cyber space and education of humanism, which can affect individuals' faith should be emphasized.

본 논문에서는 딥웹 환경에서 사이버 범죄 활동에 대한 정보를 중심으로 분석한다. 분석된 정보는 사이버 수사기관에 범죄 분석을 위한 보조정보로 활용될 수 있도록 지원하는 것과 청소년들의 사이버 범죄에 대한 위중성 및 범법성을 인지시키기 위한 교육을 목적으로 활용될 수 있도록 연구되었다. 따라서 본 논문에서는 크롤링, 파싱, 시각화 3가지 과정을 기반으로 딥웹 환경에서 활동하고 있는 정보를 키워드를 중심으로 수집하고 분석하는 솔루션 환경을 구현하였다. 분석된 정보는 사이버에서 일어나는 많은 범죄활동 가운데 가장 일어나기 쉬운 범죄 유형과 주의 깊게 수사가 이루어져야 할 범죄들을 정리하며, 수사의 방향성을 캐치 할 수 있도록 지원하는 기능을 포함한다.

This study will show the digital forensic model which fights against cyber-crimes to prepare various cyber-crimes. The digital forensic model will be more useful about the investigation of cyber-crimes and arresting criminals after researching the uses of the digital forensic model and cyber-crime rates in South Korea. This model conduct the standardized data with various languages by the language support system through the digital forensic analyzer. This model will send the data to law enforcement reviewing whether or not we ought to prove criminal charges. Moreover, law enforcement can access the file system to find out admissibility of evidence. And this model simplifies lawful investigation about additional investigation. The data, which is conducted and saved by the digital forensic system, will be helpful to protect against the future crimes because of the data.
