The Impact of the Foreign Investment Law on the Tax Decisions of Korean Companies Operating in China (외상투자법이 재중 한국기업의 세무적 선택에 미치는 영향)

  • This study provides an in-depth analysis of the impact of the deepening reform and opening-up policies announced at the 20th CPC Central Committee's Plenary Session, particularly focusing on the <Foreign Investment Law> and its effects on the tax decisions and organizational restructuring of Korean companies operating in China. Using a comprehensive literature review and policy analysis, the study compares the dual legal structure and tax differences before and after the implementation of the law, assessing how legal unification has influenced the organizational forms and tax strategies of Korean companies. The findings indicate that the <Foreign Investment Law> has played a crucial role in enhancing legal consistency and tax equity between foreign-invested enterprises and domestic enterprises, thereby enabling Korean companies to manage their operations in the Chinese market more stably and efficiently. Additionally, in the context of the ongoing U.S.-China trade conflict, the law's provision of national treatment and tax benefits has proven to be a significant factor in the survival strategy of Korean companies in China. Future research should focus on empirically examining the long-term effects of this law and its impact on actual corporate performance.

  • 정보기술분야의 국제 표준화 기구인 ISO/IEC JTC1에서 주도하여 추진하고 있는 MPEG 표준화가 성공적으로 진행되면서 이의 원활한 시장 적용을 위하여 복잡한 체계로 구성되어 있는 MPEG 기술표준과 연관된 다수의 특허권 처리를 위한 구체적인 조화 방안이 필요하게 되었다. 이는 또한 MPEG 기술의 특허권자가 많기 때문에 다자간의 협상이 요구되는 사안이었다. 이러한 문제 해결을 위하여 MPEG-2 표준의 경우 1990년대 초반부터 이 기술의 주요 개발 업체들간에 표준화의 추진과는 별개의 활동으로서 협의체를 구성하여 복잡한 특허권 관리를 위한 전문적인 기구의 설립을 검토하기 시작하였다. 이를 위한 기반으로 라이센싱의 일원화를 실현하는 특허 POOL을 구축하여 1996년 5월에 MPEG LA를 설립하기에 이르렀다. 이러한 MPEG LA는 공정경쟁에 위배되지 않는다는 법적인 승인을 거쳐 1997년 포트폴리오 라이센스를 공표함으로써 그 본격적인 활동을 펼쳐나가고 있다. 본 고는 표준화와 관련된 특허권 활용의 관점에서 획기적 사건이 되고 있는 MPEG LA의 활동 현황을 분석한 것으로서 특히 그 특허 POOL의 내역과 로열티 구조를 중점적으로 하여 포트폴리오 라이센스의 체계를 소개한다.

  • 법적인 정의를 차치하고 나면 하천유지유량의 정의는 사람과 자연이 한정된 수자원을 바람직하게 공유하기 위한 유량 측면의 범위로 나타낼 수 있다. 하천유지유량의 산정과 관리는 사람의 물이용과 배치되면서 동시에 진행해야 하는 하천수 관리의 핵심요소이다. 물관리 일원화 이전에 물관리 업무가 분산되어있는 상황에서 당시 환경부는 환경생태유량이라는 건강한 생태계유지에 주 목적이 있는 개념을 생산하였고, 시범사업을 거쳐 고시를 추진하고 있다. 하천유지유량과 환경생태유량은 다루는 범위와 공간적 차이가 있을 뿐이며 근본적인 개념과 생성의 원인은 같은 것이다. 따라서 본 연구에서는 하천유지유량과 환경생태유량의 개념과 본질을 살펴보고 효율적인 제도적 장치 마련의 방향성, 기술적 방향성에 대해 논하였다.

  • The purpose of this study is to comply with the operation and management of medical image information in PACS, the necessity of anonymizing the patient's personal information and the management status of the medical image information related to the personal The purpose of this study was to raise, discuss, and suggest the need for unification and coherence of the law by studying the content of the issues related to information related laws. In order to utilize information related to medical image information, it is necessary to unify the "Medical Act" or the "Bioethics Act" for clear legal application and consider the legal system's consistency. Since there is a possibility of conflict due to issues that are not yet established, systematic coherence of the law is required to find the basic common denominator for the utilization and use of medical image information and to harmonize the law. In addition, the necessity of enacting the "Medical Information Protection Act" that can be practically applied and easily practiced by medical personnel and managers in the clinical field so that sensitive matters of medical image information and personal information can be protected and managed in a specific and systematic way.

  • This study looks at plans for the efficient functions of the current terror response system in Korea. The results are derived from by comparing and analyzing American, British, German, Japanese, and Korean terror response systems. It focuses especially on addressing some problems with Korea's terror response system and how to operate it effectively. The study will systematically compare and analyze each nation's terror countermeasure studying organizational, functional, and legal aspects as standards. This study shows that there is not an exclusive terror response center in Korea compared with other nations such as America, the United Kingdom, Germany, and Japan. Also it is difficult to expect effective and vigorous operations due to weak cooperation across the relevant organizations. The presidential directive of the state's anti-terrorism action guidelines is legally ineffective. This means that on legal grounds, it is difficult to take actions to prevent the terrorism. Therefore, keys to counteracting terrorism derived from this study are summarized below. In the first place, an integrated terror response system should be set up for expansion of information sharing which leads to emergence effect. In the second place, the superior legislative systems should be made for the cleardefinition and extent of what the terror is, rigid enforcement of investigation, immigration, and keeping an eye on the funds raised by terrorists and tracking down the terrorists, the plan for eco-terrorism. In the third place, to augment security of vital facilities and peoples' awareness of terrorism safety should be emphasized and a cooperative system between civil and government organizations need to be built. In the fourth place, system for crisis management must be provided in an effort to maximize management system of terrorism and unify a decentralized emergency countermeasures effectively.

Problems of the Act and Subordinate Statutes Related to the Regulation of Radiation Safety for Diagnosis (진단용 방사선 안전관리 법령의 문제점에 관한 연구)

  • The use of diagnostic radiation in medical institutions is rapidly increasing. Accordingly, the collective effective dose is on the rise every year. Therefore, it is necessary to reduce the radiation exposure of the person undergoing the radiation examination as low as reasonably achievable. And we must establish a legal system to perform the safe management of radiation for diagnosis efficiently. In this way, I went over the problems of the Act and Subordinate Statutes regarding radiation safety management for diagnosis. As a result, the main contents are as follows. First, in the 「Medical Service Act」, there is no basis for the Safety Inspection Institute of Radiation and Radiation Exposure Measuring Institutes. And there are no provisions concerning delegation of administrative disposition. Therefore, it is necessary to secure legal justification by providing the basis for the Safety Inspection Institute of Radiation along with Radiation Exposure Measuring Institutes and the basis for administrative dispositions against these institutions in the 「Medical Service Act」. Second, the 「Rules on the Installation and Operation of Special Medical Equipment 」 should be integrated with the 「Rules on the Safety Management of Radiation Generators for Diagnostics」 to unify administrative procedures such as reporting for radiation special medical equipment for diagnosis. Third, in the case of violating the diagnostic radiation safety management standards in the 「Rules on the Safety Management of Radiation Generators for Diagnostics」, it is necessary to supplement the insufficient sanctions such as administrative disposition. Fourth, regulating diagnostic radiation and therapeutic radiation used in medical institutions with the dual legal system of the 「Medical Act」 and the 「Nuclear Safety Act」 is not efficient in the safety management of diagnostic radiation. Therefore, it is necessary to uniformly regulate diagnostic radiation and all medical radiation, including therapeutic radiation and nuclear medicine, in the 「Medical Service Act」 system.

Research on the Direction of Building an Integrated Smart Platform at Construction Sites (건설현장 통합 스마트플랫폼 구축방향에 대한 연구)

  • Purpose: This study aims to strengthen the linkage between the construction site and the headquarters, suggest the direction of building an integrated smart platform that can actually be operated and utilized in the field, and effectively implement safety management. Method: Agile methodologies were applied to build a flexible and scalable system through cloud-based and three-tier architectures. Functional requirements were set through an on-site survey, and design and construction were carried out by reflecting personal information protection and legal requirements. Result: The integrated smart platform proposed in this study strengthens the connection between the site and the headquarters to maximize the effect of safety accident prevention and safety management. This system has improved the safety awareness of workers and managers, and has realized more efficient safety management through a unified communication system. Conclusion: In the establishment of an integrated smart platform, it is essential to reflect the characteristics of the site when selecting the development method and establishing the function plan. In the basic design and detailed design stages, it is necessary to establish security measures, design mobile functions, and review device expansion, and consider enterprise-wide safety management, user convenience, and scalability. It is also important to maintain and improve the system, reflect legal requirements, and support the elderly and foreign workers. By strengthening personal information and CCTV security and continuously improving it by reflecting user opinions, it can be expected to activate an integrated smart platform.

A Study on Systematic Management of Civilian Forces for Efficient Search and Rescue Mission in the Ocean (수난구호 업무의 효율화를 위한 민간해양구조세력의 체계적 관리에 관한 연구)

  • In this study, I researched, analysed and compared the examples of civilian maritime search and rescue auxiliaries of world leading countries' such as Japan and America, and the Korean volunteer fire fighting team. Through this, I suggest that the decentralized civilian maritime search and rescue forces of Maritime Rescue and Salvage Association and KCG Civilian Auxiliary should be united into unified search and rescue system and establish legal basis for stabilized support and development. It seem that we should organize laws and regulations for the government to have centralized control of rescue mission as in the cases of America and Canada and elivate rescue mission capability with systemized education and training entrusted to specialized external training organization. I proposed to establish financial support such as fund for the stabilized status of civilian auxiliary, domestic and overseas training session for the civilian auxiliary to inspire integrity and sense of duty as a part of maritime search and rescue forces.

  • Libraries' functions include not only being a treasure house for cultural heritage and cultural development but also comprehensive functions such as lifelong learning and human resources development. At the present time, the Ministry of Education and Human Resources Development(MOE) has legal infrastructure and leadership which can develop and manage the nation's overall human and intellectual resources unlike previous Ministry of Education. For library to evolve as a stronghold for developing human resources and lifelong education, library policies must be unified into MOE which can provide the needed leadership. With direct management of libraries by MOE, which is currently overseeing and coordinating the nation's human resources development policies, library policies can be implemented systematically, mutual cooperation between libraries will be easier, and the link between library policies and the national and regional human resources development policies can be made.
