불법유해정보 법.제도 동향 분석

  • 기존 불법유해정보 분류체계를 비교 분석하여 재정립하고, 국내외 불법유해정보 법 제도 현황을 살펴 보았다. 이와 함께 불법유해정보 접근 차단 방안에 대한 이용자 설문 결과를 기초로 불법유해정보 차단에 대한 정책적 제언을 다음과 같이 제시하고자 한다. 먼저 기존 유해정보차단 프로그램의 문제점인 메모리 사용량 증가에 따른 컴퓨터 성능 저하현상을 개선할 수 있는 기술적인 대책이 마련되어야 하며, 청소년 이용자의 보호자 또는 학부모가 사이트별로 제한할 수 있는 기능을 추가하여 다중 필터링 시스템 환경을 조성해야 한다. 또한 기존의 불법유해정보 신고 프로그램은 신고주소, 신고제목, 증거자료 입력 등 복잡한 구성으로 인해 효율성이 떨어지므로, 신고를 원하는 사이트를 이미지화 하여 바로 저장 및 전송이 가능한 형태로 신고 프로그램을 제작하여 신고완료까지의 시간을 단축해야 할 것이다. 기존의 주민등록번호 입력 방식에서 개인식별번호를 이용한 i-PIN 도입을 의무화하고, 기존 i-PIN 사용자의 전환사용을 통해 불편함을 최소화하여 개인정보유출 방지를 위한 i-PIN 사용을 의무화해야 한다. 마지막으로 '자율 등급 서비스' 이외에도 제3의 기관을 통한 '제3자 등급 서비스'를 동시에 사용하여 정보제공자의 부정확한 등급 표시의 문제점을 보완하도록 해야 한다.

A Study on the Adoption of Discovery in Copyright Litigation (저작권 소송 절차에서 디스커버리 도입에 관한 소고)

  • In the Korean litigation system, structural maldistribution of evidence still remains a conundrum. Numerous solutions have been discussed so far and, today, few people deny the need for adopting a system similar to the discovery procedure in the United States. In the intellectual property (IP) domain, a wide range of legislative attempts have been made to improve the litigation system, especially for patent litigation. However, the adoption of discovery in copyright litigation is seldom discussed, despite the fact that copyright infringement lawsuits increasingly involve highly technical issues, especially in case of copyrightable computer programs. The lack of discussion on discovery adoption forms a stark contrast with the active attempts to adapt and adopt discovery procedure for patent litigation. In copyright infringement lawsuits, especially for copyrighted computer programs, securing evidence takes on crucial importance. However, in reality, there are numerous obstacles. Some lawsuits proceed even without properly securing the infringed work. To address this issue, the current litigation system needs to be improved by adopting a procedure similar to discovery. This paper reviews what solutions are being utilized today, and how we should approach the issue.

Selection of Fungicides for the Control of Soybean Black Root Rot Caused by Calonectria ilicicola (콩 검은뿌리썩음병 방제를 위한 살균제 선발)

  • Fungicidal screening was performed to control soybean black root rot caused by Calonectria ilicicola through in vitro and greenhouse assays. In in vitro assay, 25 fungicides were assessed by an agar dilution method and a 96-well microtiter plate method. While protective fungicides including dithianon, dichlofluanid, mancozeb, and captan showed a very low activity against the mycelial growth C. ilicicola SC03-15 in the agar dilution method, they displayed potent inhibitory activity against spore germination in a 96-well microtiter plate method with $EC_{50}$ values of 4.65, 0.61, 4.64, and $0.29{\mu}g\;mL^{-1}$, respectively. Ergosterol biosynthesis-inhibiting (EBI) fungicides showed different antifungal activity against mycelial growth and spore germination according to molecules. Difenconazole displayed higher antifungal activity against spore germination rather than mycelial growth, and prochloraz inhibited potently both mycelial growth and spore germination with EC50 values less than $1.8{\mu}g\;ml^{-1}$. In contrast, the other EBI fungicides inhibited more highly mycelial growth than spore germination. Carbendazim+diethofencarb and dazomet also inhibited both mycelial growth and spore germination of C. ilicicola SC03-15 at very low concentrations. In greenhouse assay, carbendazim+diethofencarb effectively controlled a soybean black root rot by drenching 2 days before or after inoculation. In addition, tebuconazole showed potent curative activity against soybean black root rot.

Seasonal Sedimentary Characteristics and Depositional Environments after the Construction of seawall on the Iwon Macrotidal Flat (방조제 건설 후 이원 대조차 조간대의 계절별 퇴적학적 특성 및 퇴적환경)

  • In order to elucidate seasonal sedimentary characteristics and depositional environment after construction of seawall on macrotidal flat, a seasonal observations of surface sediments (total 450) and sedimentation rates on 4 transects have been investigated for 2 years. The eastern area of Iwon tidal flat, has been changed from semi-closed coast to open coast by construction of seawall, shows general seasonal changes similar to characteristics of open coast type, which represented both fining and bad sorted distribution due to deposition of fine sediments under low energy condition in the summer, and relatively coarser and better sorted distribution because of erosion of fine sediments in the winter. In considering angles of transects, distribution patterns of surface sediments, the northern and southern parts of eastern tidal flat are dominantly influenced by wave and tidal effects, respectively. As time goes by, the eastern tidal flat shows coarsening-trend of surface sediments caused by direct effect of tidal current, were and typhoon. Meanwhile the western area of seawall, which has been re-formed by construction seawall, is sheltered from northwesterly seasonal wind. The seasonal change pattern of western area of seawall is slightly different from that of eastern tidal flat. Mean grain size and sorting of surface sediments during spring is finer and worse than those during summer. This seasonal change pattern maybe influenced by topographic effects caused from the construction of seawall. In consideration of all result, the transport of fine sediments in the study area, which is supplied to limited sediments, shows clockwise circulation pattern that fine sediments are transported from the eastern tidal flat to the western area of seawall because of blocking of seawall in the winter and are transported reversed direction the summer. As a result, many changes have been observed in the study area after construction of seawall; however, this change is still in progress and is expected to need continuous monitoring.

Survey on Residue Level of Formaldehyde in Hygiene Products (위생용품 중 포름알데히드 잔류량 실태 조사)

  • In this study, we examined the residual amounts of formaldehyde in hygiene products to determine the safety of these products in Gyeonggi-do. Formaldehyde is among the harmful substances that may remain within certain hygiene products. On the basis of an analysis of formaldehyde in a total of 222 items (6 disposable paper straws, 9 disposable paper napkins, 21 toilet papers, 13 disposable dishcloths, 16 disposable paper towels, 32 wet wipes for food service restaurants, 25 disposable cotton swabs, and 100 disposable diapers), we detected traces in three wet wipes for food service restaurants (1.87 to 4.45 mg/kg), which is approximately 9% to 22% of the standard level (20 mg/kg). We established that all the hygiene products assessed in the study met the individual standards for formaldehyde, thereby confirming that safe products are being distributed. In the standards and specifications for hygiene products, the formaldehyde test method is regulated for application with respect to three categories based on the type of product. The samples used in this study were of types for which method 1 or method 2 is applied, and the limits of detection, limits of quantification, linearity, and recovery rates were reviewed to verify the validity of each test method. When method 2 was applied, we experienced interference when performing analysis at a wavelength of 412 nm, which was associated with the influence of impurities in some samples of disposable cotton swabs and disposable diapers. Consequently, in these cases, the results were compared after analysis using method 1. By comparing the results obtained using method 2 with those obtained using method 1, the latter of which were unaffected by the interference of impurities, we were able to detect formaldehyde at low concentrations. These findings accordingly highlight the necessity to standardize the formaldehyde test method for future analyses.
