300억원 이상의 국가 및 공공기관 발주공사에 대해 최저가낙찰제를 대신하여 종합심사낙찰제 전면 실시 등의 내용을 담은 국가계약법 시행령이 개정되어 2016년 1월 1일부터 시행에 들어갔다. 종합심사낙찰제는 가격 뿐만 아니라 공사수행능력, 사회적책임을 종합 평가하여 낙찰자를 선정하는 제도로 기존의 최저가낙찰제에서 발생한 덤핑낙찰 및 이로 인한 잦은 계약변경, 부실시공, 저가하도급, 임금체불, 산업재해 증가 등의 문제점을 해소하기 위해 도입된 제도이다. 종합심사낙찰제 도입에 따라 공사 품질이 제고됨으로써 생애주기(lifecycle, 유지보수비용 등을 포함) 측면에서의 재정효율성 제고를 비롯하여 불공정 하도급 관행 개선 등 건설산업의 생태계 개선과 함께 시공결과에 책임짐으로써 기술경쟁 촉진 등 건설산업의 경쟁력 강화 효과도 기대된다. 또한 국가계약예규도 개정되어 주계약자관리방식에 의한 공동계약(주계약자 공동도급)이 최저가낙찰제에서 종합심사낙찰제로 전환됐다.

Subcontracting of construction is essential to carry out public construction projects. Subcontractor of the construction work shall enter into a contract with the original contractor without directly entering into a contract with the owner. Subcontracts are therefore greatly affected by the original contract with the owner. To protect subcontractors, the Fair Trade Act is enacted and the construction company's standard subcontracting contract is in operation. However, subcontracts are not properly reflected in the Government contract system, which deals with the relationships between the owner and the original contractor. In particular, the subcontractor may complain of difficulties at the public construction site as such procedures are not properly reflected in the construction work standard subcontract, although various procedures shall be carried out depending on the amount when change order occurs in subcontracts. Thus, the direction of improvement of subcontracting systems was proposed in the case of change order at public construction project sites as follows: First, the rights of subcontractors should be strengthened. Second, in order to resolve the information non-identity, subcontractors should have access to information related to subcontracts. Third, the status of subcontractor shall be guaranteed by reflecting the characteristics of the subcontract when the original contract for public works is concluded. Fourth, the dispute settlement method should be prioritized over litigation in order to fair subcontracting.

건설교통부는 지난 7월 24일 일반 · 전문건설업간 겸업제한 제도를 폐지하고, 하수급인과 건설근로자에 대한 보호강화 등 건설산업의 경쟁력 강화와 건전한 발전에 필요한 제도적 기반을 구축하기 위한 건설산업기본법개정안을 입법예고 했다. 개정안의 주요 내용은 △일반 · 전문건설업간 겸업제한 폐지△시공참여자제도 개선△ 건설업체 부도시 하도급 대금을 발주처에서 직접 지급△건설산업 부조리 해소를 위한 규정 보완△ 발주자에게 하도급계획서 제출 등이다. 건교부는 그동안 "기업 · 학계 · 연구원 · 정부"합동으로 포럼을 구성하여 10여 차례 토의하였고, 공청회, 관련업계 간담회 등을 통하여 폭넓은 의견수렴을 거쳤으며, 입법 예고를 통한 추가적인 의견수렴(7.25~8.14)과 규제심사등 정부입법과정을 거쳐 금년 10월중 국회에 제출할 예정이다.

내역입찰제도 개선, 적격심사항목 보완, 적격심사 이행관리계획 미준수 업체 제재사유 추가, 정정공고 근거규정 마련 등을 주요 골자로 하는 국가계약법 시행령 및 시행규칙이 제.개정되어 지난 10월 10부터 시행에 들어갔다. 개정된 시행규칙은 1억원 미만 소규모 공사는 물량내역서가 계약서에 포함되지 않아 발주기관의 물량산정 오류시 설계변경이 불가능해 소규모 공사에서 경제적 피해가 많이 발생되어 민원이 제기됨에 따라 우리협회는 재정경제부에 "1억원 미만 소규모 공사도 계약서에 물량내역서가 포함되도록" 건의한 결과 우리협회의 의견이 반영되었다.

For the restoration of construction industry, the government have offered the policy since the end of 1990. It has offered to develop the world-class technology and establish the effective production structure. In the government policy, the delivery and contracting method has improved so that construction industry could be recognized. Foreign countries have conducted the R&D and application of Innovative Contracting for improvement of facilities, reduction of LCC and innovation of contractor. Among the Innovative Contracting, 'Performance Warranty Contracting' is defined that A guarantee of the integrity of a product and of the makers responsibility for the replacement or repair of deficiencies. Performance Warranty Contracting is used for technology developments of contractor, improvement of quality, reduction of LCC, prevention of early deficiencies and reduction of owner's inspection works. This paper analyzes concept and effects of Performance Warranty Contracting and presents considerations according to the introduction.

As domestic construction investment has been gradually reduced, the issue of expanding overseas CM market has increased. Strengthening CM capability from the view point of project life-cycle is required in overseas CM market. However, current regulations institutionally force public CM services to focus on the construction phase. Therefore, Korean CM firms can hardly have the opportunities for accumulating technical competitiveness especially for pre-construction phase. Result of this study shows that the total efforts in terms of man-hours for the construction phase is found to be more than 78 percent in domestic public CM projects. In this context, this study proposes the policies and tasks for improving 'rigid man-hour placement', 'unreasonable CM fee standards', 'CM firm selection method', 'unreasonable business scope decision', and 'evaluation of owner's project management capability' in order to improve domestic CM Industry as well as to expand overseas CM market successfully.

The e-government project management consignment system to allow the public PMO has been introduced to resolve the quality management issue and the business risk, pointed out by the reorganized Software Industry Promotion Act. The additional regulation improvements are demanded because the public PMO system cannot settle down due to the different opinions among related parties: owner, operator and PMO. Therefore, to make balanced regulation improvements, the in-depth studies are necessary to analyze the fundamental causes of the disagreement between the related parties. This study analyses the each related party's cognitive structure to perform public PMO successfully and the fundamental reasons that cause the different opinions by applying the cognitive psychological Means-end chain theory, the laddering technique and the HVM, Hierarchical Value Map. In addition, this study analyses the regulations required for the related parties to obtain the expected benefits.

The construction supervisors of the public companies are usually responsible for process management, quality management, safety management, and many other various tasks that occur during construction project. Public companies such as Korea Highway Corporation have developed a framework and manual for management and supervision of construction projects. But, there has been the change of business environment such as increase of private investment project and the introduce of construction management system recently. It has been necessary for construction supervisor to streamline the current project management system in the owner's aspect in order to cope with the expected new challenges. Accordingly, this research has been investigated and analyzed the operation system between Korean supervisor and foreign supervisor in their public corporation. This research has suggested the advanced project management in their public corporation. Especially, this study has proposed the construction management manual for supervisors such as inspectors training, supervisors construction manual, and supervisors training road map.

As buildings are changing variously from the side of use, efficiency and size, the construction qualities are more importantly recognized. Supervision system was enacted in the Residential Building Law in 1990 and responsibility supervision system in the Construction Engineering Management Law in 1994, respectively. However, recently revised supervision system in 2003 has some limitations: the present problems of appointing supervisor, disposing the supervisors, supervisor's works. Therefore, the aim of this study is to improve the present supervision system for mix-use residential building. By implementing the proposed revised supervision system, it will be able to expect quality improvement, confidence of the owner and the user, development of construction technology, and increase international competitiveness of supervision company.

Construction Management tends to create a formal procurement resulted from recent legislative procedures system in domestic construction industry. However, the fact that construction Manager(CMr) has been chosen, in practice, under a poor circumstance in selecting and discriminating specialty requires the more optimal procedures. Therefore, in this research, we analyze the existing shortcomings. the various procedures, influence factors, and the criteria to be considered in selecting and evaluating CMr. Also. this study suggests the improved method based on the facts above. To accomplish the construction project successfully, it is one of the advanced schemes to choose an adequate CMr needed to the project through the precision in the formation and application of the procedure as well as the suggested criterion in selecting CM.
