A Study on software patent claim of computer related invention (컴퓨터 관련 발명의 소프트웨어의 특허 클레임에 관한 연구)

  • This paper relates to a software patent of a computer related invention, explains a describing method of software patent claim which can be registered software patent of computer related invention instead of computer program copyright which is the Intellectual Property about software since 1998 in the Korea Intellectual Patent Office(KIPO) by developing an information communication infrastructure technology and WWW technology. Also, it introduces an international and domestic trends of the software patent for computer related invention and related database for the software patent of the world and mentions advantage and disadvantage of software patent regime of each nation and the facing software patent problems as the Intellectual Property.

  • 애플이 소유한 '앱스토어' 상표권에 마이크로소프트(MS)가 제동을 걸었다. 애플리케이션의 부가가치가 높아지면서 앱스토어 개념이 애플에 종속되는 것을 막기 위해서다. MS가 미국 특허상표청(USPTO)에 앱스토어 상표권이 일반 명칭이며 경쟁자들이 이용할 수 있도록 허용돼야 한다는 취지의 소송을 제기했다고 PC월드 레지스터 등이 11일(현지시각) 전했다. 애플은 지난 2008년 앱스토어를 '인터넷, 컴퓨터 및 전자통신 네트워크를 통해 공급되는 컴퓨터 소프트웨어(SW)의 소매상점 서비스'로 규정해 상표권 등록을 마쳤다. 이후 '아이폰'을 위한 앱스토어를 열어 30만 개가 넘는 애플리케이션이 등록되는 등 큰 성공을 거두면서 애플리케이션 장터의 대명사로 자리매김했다. 애플은 이달 초 맥PC를 위한 '맥 앱스토어'도 선보였다. 이에 대해 MS는 '앱'은 앱스토어에서 판매되는 상품 및 서비스를 가리키는 일반적인 용어고, '스토어'는 소매상점 서비스를 나타내는 일반명사라고 주장했다. 또 애플 최고 경영자(CE) 스티브 잡스가 한 언론 인터뷰에서 "아마존, 버라이즌, 보다폰은 모두 안드로이드를 위한 자체 앱스토어를 구축하고 있다"고 언급한 부문을 들어 애플 자신도 앱스토어를 일반 명칭으로 사용하고 있다고 강조했다. MS는 "소비자와 업계, 미디어들이 모두 앱스토어를 애플리케이션이 판매되는 온라인 상점으로 여기고 있다"면서 "앱스토어라는 이름을 애플이 배타적으로 활용해서는 안 된다"고 밝혔다. MS는 지난해 말 윈도폰7 운영체계(OS)를 위한 온라인 스토어 '마켓플레이스'를 개설했다. IDC는 마켓플레이스에 두 달 만에 4,000여 개의 애플리케이션이 등록됐다고 집계했다.

The Effects of Patents on Firm Value;Venture vs. non-Venture (특허활동이 경영성과에 미치는 영향;벤처기업 대 일반기업)

  • Utilizing the patent application data between 1997 and 2002, this study focuses on analysing the impact of patents on firm value. Especially we attempt to examine the difference of patents between venture firms and general firms. This paper first shows that the number of the patent applications of general firms listed on the securities market are more than those of venture firms listed on KOSDAQ. It is thought that this result is originated from facts that the size of firms of the securities market is usually bigger than the firms of KOSDAQ and that these large firms could manage R&D more efficiently. Second, this paper reports that there is no difference in the ratio of patent maintenance between venture firms and general firms. Both venture firms and non-venture firms would do their best to keep their patents after patent regisration. Third, in the regression of patent index and firm growth, we find that the excellence of patent and the number of patents per employee would have an impact on the growth of firms. Fourth, the regression of patent index and profitability shows that the excellence and the number of patents per employee might have an effect on the profitability of firms.

국내 IT산업에서 전략적으로 특허를 확보하기 위한 방안

  • 본 연구는 IT산업에서 일반적으로 제품 수명이 짧은 반면, 특허출원부터 등록시 까지 기간이 많이 소요되기 때문에 과연 특허출원하는 것이 실효성이 있을 지에 대한 의구심에서 출발하여 IT산업에서 특허 보유의 필요성이 있는지 여부에 대해 여러 각도에서 집중 분석해 보았다. 본 연구에서는 IT산업에 대한 정의, 국내 IT산업의 세계 시장에서의 위치 및 특허 환경 분석을 통한 분석과 IT산업에서 실제 사용되었던 특허를 사례별로 분석해 봄으로써 전략적으로 특허를 창출하는 방안을 제시하고자 했다. 본 연구결과 우리나라 IT산업의 세계시장에서의 점유율이 높은 부분인 낸드플래시메모리, 평판패널, DRAM, 이동통신 단말 부분에 대한 국내 특허출원 건수를 조사한 바, DRAM, 낸드플래시메모리, 평판패널 그리고 이동통신 단말 순으로 특허출원 건수가 많음을 알 수 있었다. 또한 IT산업의 국내 특허분쟁 사례를 조사한 바, 총산업 대비 41%를 점하고 있다는 사실을 알 수 있었다. 이러한 특허 환경에 대처하기 위해서는 전략적으로 특허를 확보해야 하는 당위성에 입각하여 실제 기업에서 특허분쟁에서 사용되었던 강한특허를 벤치마킹하여 어떻게 특허를 창출해야할 지에 대한 답을 얻고자 했다. 그 결과로 연구개발을 통한 많은 실시 예 확보, 명세서 작성 시 한정적인 용어의 선택을 피하고, 발명의 내용을 확대할 수 있는 특허제도 활용, 마지막으로 의견서 제출 시 균등해석을 제한하는 표현 삼가 등이 전략적으로 특허를 창출하는 핵심 요소로 분석되었다.

On the Inventive Thinking Principles in the Arts and Literature (문화예술 분야에 내재된 발명적 사고원리에 대한 소고)

  • The need for integrating the arts and literature into the engineering education has been emphasized to cultivate the creative talent in recent years. However, there have been few studies to investigate how the arts and literature can be linked with nurturing creative talent in the engineering fields. In this paper, it is examined that inventive thinking principles for creative ideation in the engineering fields can be applied to the arts and literature. For the purpose, creative works in the arts and literature, which can be explained by the five thinking tools of SIT(Systematic Inventive Thinking), are collected. The result shows that engineering and the arts share common thinking patterns.

  • Augmented reality is used in various fields such as culture, education, military, medical. This is a method of recognizing information of an augmented object on the camera. Exhibitions and educational contents for children are already produced in various ways. This research showed the developed contents deliver cultural property information using augmented reality. 'Galgibi AR' and 'Jang Young-sil's Invention AR' allow you to experience cultural assets up close. 'Galgibi AR' is the experience content in the form of 3D blocks. It makes to understand the structure of the zeolite, Galgibi. 'Jang Young-sil's Invention AR' make you to watch out four objects in detail by zooming in, zooming out and rotating. It can also take pictures with the inventions. Both contents implement what we want to deliver accurately through simple content. They increase the enjoyment of cultural heritage through experience contents. This research addressed to help the cultural property information spread to the public by using Augmented Reality.

A Study on the Classification of Income on University's Industrial Consultations (대학 산업자문료 소득 구분에 관한 연구)

  • Industrial consultation is a kind of personal service for companies. The Industry-Academic Cooperation Foundation sets up a consultation contract in which a professor performs the consultation as the person in charge. Recently, there is an issue regarding taxation of the consulting fee paid to the professor; in short, there is no standardized practice for the imposition of income tax. In this study, we examine the characteristics of industrial consultation and present an acceptable taxation rule based on related laws. First, it is not appropriate to regard consulting fees as wage income, considering that there is no employment relationship between the Industry-Academic Cooperation Foundation and the professor. Considering that the base consulting fee amount is the same as the invention compensation, according to accounting practices, and that an employee invention is apt to be derived in the consultation, it is reasonable that the consulting fee should be regarded as wage income similar to employee invention compensation. As treating the consulting fee as wage income could end up reducing industrial consultations, the government should amend the income tax law to include industrial consultation as a type of other income.

The Effect of the Youth perceived importance of Entrepreneurship Education on the self-leadership strategy (청년층의 창업교육 인지도가 셀프리더십 전략수준에 미치는 영향)

  • This study investigate the youth perceived importance of entrepreneurship education program on the self leadership strategy. The findings are as follows: First, the creativity category of entrepreneurship education were positively related with behavior focused self leadership, natural reward self leadership strategy and constructive thought self leadership. Second, the management category of entrepreneurship education were positively related with natural reward self leadership strategy. Third, the patent category of entrepreneurship education were positively related with behavior focused self leadership and constructive thought self leadership. Consequently, when the youth recognized the importance of management, creativity and patent category, the level of self control, self reward and self efficacy were increased.

A Study on the Impact of Patent Quality on the Firm's Market Value (특허의 질적 가치가 기업의 시장가치에 미치는 영향에 관한 연구)

  • As corporate management enters the era of informatization or knowledge management, the level of patent quality, which is the fruit of R&D and technical innovation, is an important element of corporate competitiveness in this age of unbridled competition. This study analyzes the relevance between R&D stocks and 6 types of knowledge stock (patent quality) and corporate market values in utilization of related research models. With Tobin Q model utilized, 108,851 U.S. patents (observed value per year: 2,795) registered by 402 domestic enterprises were analyzed. As the Hall model was analyzed, it turned out that the R&D stock/asset, claim stock/patent stock, and citation stock/patent stock had positive effect on corporate market values. The inventor stock/patent stock also show positive effect on corporate market values.

Patenting Dilemma for Startups: Number of Applied Patents, Patent Imitability, and Level of VC Funding (스타트업의 특허 딜레마: 특허수, 모방 가능성, 그리고 벤처 캐피털리스트 펀딩 수준)

  • Should a startup file for a patent subject to imitation in its quest to attract venture capital(VC) investors? Considering the US pharmaceutical biotechnology industry context, this paper attempts to answer this question by investigating the relations between the number of applied patents of startups, patent imitability, and the total amount of money the startups received as their first VC funding round. Data of 157 US-based pharmaceutical biotechnology startups founded in between 1995 and 2005 are analyzed. Empirical results from this study show that the number of applied patents is positively related to the total amount of money received at the time of the first funding round, and patent imitability is negatively related to the total amount of money received as first VC funding round. Nonetheless, the interaction term between the number of applied patents of startups and patent imitability came out as positive, raising interesting questions and implications for innovation-oriented startup entrepreneurs. The current study's empirical findings suggest that, in the pharmaceutical biotechnology sector, VC investors pay attention to the quantity and quality of the patents possessed by startups when they decide the level of funding. In particular, imitability of applied patents may not be a one-sided concept related to negative features such as the weak protectability of an invention. Rather, patent imitability may be a multi-facet element which also contains positive attractiveness of the startup's invention. Furthermore, it seems that the positive side of imitability can be augmented by the number of applied patents.
