Water Governance and Basic Water Law (물거버넌스와 물관리기본법)

  • 본 연구의 목적은 물거버넌스 개념과 1997년, 2006년 물관리기본법안 분석을 통해 한국의 새로운 물관리 체제를 모색하는 것이다. 물거버넌스는 물관리정책과 계획의 수립, 시행, 평가에 있어 정부뿐만 아니라 일반 기업, 시민, 환경단체, 전문가 등 여러 이해당사자를 참여시키는 것을 핵심으로 한다. 거버넌스란 기존의 정부 주도의 정책 계획, 수립, 시행이 아닌 비정부 조직과의 타협, 협의, 논의를 통한 양방향 정책결정 과정을 뜻한다. 따라서 물거버넌스의 가장 중요한 원칙은 다양한 이해당사자 참여를 통한 정책결정의 복수화 과정이다. 한국의 물거버넌스를 시행하기 위해 가장 필요한 요건은 이해당사자 참여를 우선 중앙, 지방정부에서 그 필요성을 인식하고 법, 제도 등을 통해 제도화하는 것이다. 환경부 주도로 입안된 1997년 물관리기본법안은 물관리일원화, 적정사용, 유역관리, 비용부담, 균형배분의 5원칙을, 2006년 물관리기본법안은 물관리일원화 대신 통합물관리, 적정사용 대신 수요관리를 삽입하여 5원칙을 제시하였지만 이해당사자 참여는 원칙에 포함시키지 않았다. 이해당사자 참여 원칙의 제도화가 없이는 위의 두 법안이 제시한 원칙의 적용과 시행이 어려움에 봉착할 가능성이 높다. 왜냐하면 다른 원칙은 다양한 이해당사자 참여를 통한 사회적 합의 없이는 시행이 쉽지 않은 정치적으로 민감한 사항들이기 때문이다. 예를 들어 물의 균형배분 원칙 관련, 만약 상류와 하류 주민 간의 합의가 없이 어느 한 이해당사자의 일방적 행위가 있을 경우 큰 갈등을 유발할 수 있다. 물거버넌스을 실행하기 위해 중앙에 필요한 조직은 물이용 관련 물분쟁 발생 시 이를 조정하고 국가물관리계획을 수립하며 물관리 문제 전반을 총괄하는 조직이다. 1997년, 2006년 기본법안은 국가물관리위원회 설치를 제시하였고 2006년 기본법안에서 보다 구체적으로 위상, 운영, 역할 등에 대해 언급하였다. 하지만 국가물관리위원회는 물관련 중앙부처의 장, 지방행정조직의 장만을 포함하여 유역관리를 책임질 유역관리조직의 장에 대한 언급이 없다. 물거버넌스 실현을 위한 유역관리 시행이 바람직하기에 유역관리조직의 장도 국가물관리위원회에 참여하는 것이 바람직하다. 또한 두 기본법안 모두 국무총리실 산하에 위원회를 속하게 하였는데 이를 수정하여 대통령 직속기구로 규정하는 것이 국가물관리위원회가 정치, 행정, 재정적 압력에서 벗어나 일관성 있는 정책을 펼 수 있는 지름길이 될 것이다. 또한 지방의 물문제를 물관리계획에 적절히 반영하고 대응방안을 수립, 시행하기 위해서는 정부 관료뿐만 아니라 지방의회 의원, 환경단체, 기업, 시민, 전문가 등의 다양한 이해당사자가 참여하는 유역위원회가 필수적이다. 또한 유역 관련 물관리계획을 수립하고 사업을 추진하는 유역관리청도 필요하다. 유역위원회와 유역관리청은 유역 내 여러 이해당사자들이 물관리에 대해 다양한 의견을 개진하고 토론하며 합의점에 이르는 거버넌스를 수립할 수 있는 중요한 조직이다. 두 기본법안은 유역관리 원칙을 제시하긴 하였지만 유역관리 시행 관련 조직, 역할, 운영 등에 대해서는 언급이 없었다. 한국의 물관리는 소득, 문화 수준 향상으로 인한 양질의 물공급에 대한 요구, 시민사회의 발전, 지방분권화 등 정치, 경제, 사회의 변화를 수용하고 발전해 나가기 위해서는 여러 이해당사자의 참여와 합의에 바탕을 둔 물거버넌스 수립이 무엇보다 중요하다. 또한 이를 시행하기 위해서는 물관리기본법을 하루 속히 제정하여 제도적 기반을 갖춰 보다 효율적인 물관리시스템을 수립해야 한다.

  • The number of Multi-cultural Background Adolescent increases every year. It is necessary to show their growing environment in which they are brought up. So this study tries to have a questionnaire research with 588 adolescents and an focus group-interview with 8 service professionals In conclusion, this study suggests developing supplemental programs, supporting systems such as the person participation in the step of the program planning, the community organization networking, professional placement, providing integration service and training program in a family unit.

A Case Study on Persons with Developmental Disabilities Participating in Personalized Support Service (개별유연화서포트서비스에 참여한 발달장애인의 경험에 대한 사례연구)

  • The purpose of this study was to understand the experience of persons with developmental disabilities participating in the Personalized Support Services. For case study, we conducted in-depth interviews with the persons with developmental disabilities and with the active supporters for them who were using the community welfare centers for the disabled. Through this, we have come up with three core categories: 'coming out into the community', 'experimenting with various choices in life', and 'living a subjective life'. This suggests the followings; First, it can be seen that persons with developmental disabilities who have limited communication and self-determination should be allowed to participate in the service through the participation process, and active support for the parties is needed in the process. Second, it is necessary to plan and support for them, centering on the parties, away from institution-centered services. Third, sufficient budget support should be provided for the self-determination, selection and control of the parties. Fourth, we should be able to enjoy everyday life by participating together in the local community, and change the perception of local residents to participate in the community. Fifth, continuous support is needed rather than temporary support. Finally it will be needed for us to listen to the voices of both parties and to represent their rights with all our efforts.

Study on the Consolidated Arbitration of Multi-party Dispute (다수당사자분쟁의 해결방안으로서 중재병합에 관한 고찰)

  • International commercial arbitration is an inseparable part of today's international commerce. International transactions are becoming increasingly complex. Problems brought by multi-party and multi-contract arbitration pose problems for traditional arbitration systems. The Korean Commercial Arbitration Board(KCAB) has released updated International Arbitration Rules(2016 Rules) and has adopted innovations similar to those introduced in the rules of major international arbitration institutions in recent years. The changes in the 2016 Rules are intended to increase the efficiency of the arbitral process, and introduce the process for consolidation of claims. For international commerce contracts, it would be appropriate, and necessary, to adopt a multi-party arbitration clause, as consolidated arbitration provides effective resolutions for multi-party disputes.

ITU-T SG17 국제표준화 동향 및 향후 전망

  • 정보보호 분야의 국제표준화는 기술들의 특성 및 참여하는 사용자들의 관점에 따라 다양한 국제표준화기구에서 국제표준개발 및 관련 연구가 진행되고 있다. 즉, ITU-T SG17(보안)에서는 전기통신(Telecommunication) 관점에서 통신망에 적용 가능한 응용기술들을 중심으로 국제표준화가 추진되고 있으며, ISO/IEC JTC1/SC27(정보보호)에서는 정보보호 원천기술들에 대한 국제표준화를 다루며, IETF Security Area에서는 인터넷 서비스의 품질 보장 및 향상된 인터넷 환경 구축을 위한 산업체 중심의 사실표준을 추진하고 있다. 그리고 유럽 및 아시아 지역에서 국가간에 정보통신 표준화와 국제표준화 기구들에 대한 공동 대응을 위한 ETSI, ASTAP, CJK Security WG 등에서도 지역 내 정보보호 표준화 활동들이 이루어지고 있다. 또한, 이러한 국제표준기구는 참여하는 이해 당사자가 국가(National Body)인지 혹은 산업체 등의 이해당사자들 간에 참여인지에 따라 특성 또한 달라지며, 표준을 개발하는 절차가 공식적인 방법에 따른 것인지 이해 당사자들 간에 합의에 의한 것인지에 따라 구분될 수도 있다. 본 논문에서는 2011년 11월, 두바이에서 개최된 ITU-T WTSA-12(세계정보통신표준총회) 국제회의 결과를 바탕으로 향후 4년간의 ITU-T SG17 국제표준화 활동 방향에 대한 정보를 제공하고자 한다.

A Qualitative Study on the Mental Crisis Occurence and Self-Help Support Process of People with Mental Disabilities - Focused on the Experience of Participating in Self-Study and Mutual Help of Bethel's House (정신장애인의 정신적 위기 발생과 자조적 지원과정에 관한 질적 연구 - 베델의 집 당사자연구 참여경험을 중심으로 -)

  • The purpose of this study is to analyze the records of 8 people with mental disabilities who had participated in Research and Mutual Help of Bethel's House and to investigate the occurrence of mental crisis and process of self-help by using the grounded theory method. As a result of axial coding, the central phenomenon of crisis experience of the people with mental disabilities was derived as 'being overwhelmed by hardships in the life related to their symptoms'. In the self-help process of overcoming the crisis, Action-interaction strategies were derived as 'talking about the hardships', 'researching and practicing with peers', 'participating in various groups', etc. through the intervening conditions such as 'understanding patterns and meanings of hardships led by the person' and 'finding ways to overcome the hardships with the person'. These strategies were analyzed as a process in which the person with mental disabilities leads his/her life reassuming control over his/her crisis. The result of this study shows that it is necessary to expand the political crisis concept in the support system for the mental crisis of people with mental disabilities, and the self-help approach in which the persons participate autonomously can be useful.

Development of Peer-Leadership Program focused on Recovery of People with Mental Illness (정신장애인 회복에 초점을 둔 당사자 리더십 프로그램 개발 연구)

  • The purpose of this study was to develop and explore the effectiveness of a peer-leadership program on the recovery of people with mental illness. To develop the program, a literature review and an analysis of developed programs were performed.Brown's recovery framework was applied, including an understanding of mental illness, self-leadership, empowerment, and self-directed action plans. A program was developed (6 sessions over 3 days) including peer-led activities, disability awareness and perception, and recovery action plans. The program consisted of education, understanding, planning, and implementation. Its focus was on recovery-oriented activities for empowering people with mental illness. Twenty people with mental illness and using mental rehabilitation centers participated in the program. Four scales (i.e., stigma, empowerment, leadership, and disability awareness) were used for the pre-post analysis. The study results showed statistically significant differences in the participants' levels of stigma (p< .05), empowerment (p < .05), leadership (p< .01), and disability awareness (p< .05) after completing the program. These findings suggest that the peer-leadership program is a recovery program that includes increased understanding of mental illness, empowerment, and leadership capability. Discussions and suggestions were provided for a future study based on the results.

A Consensus-Building Support System for Water Environment Governance Based on Multi-Criteria Decision Making (물환경 거버넌스를 위한 다기준의사결정 기반 합의형성 지원시스템)

  • In this study, we propose a consensus-building support system to engage various stakeholders, transparently disseminate information, ensure objective decision-making, and reflect the view of each stakeholder as a methodology or tool for resolving conflicts that may arise in the process of implementing water environment policies and plans. The system suggests ways to resolve issues by engaging all interested actors and not just a few influential groups of stakeholders imposing their solutions upon local users. The system provides an environment where stakeholders can find solutions to conflicts through their own efforts, mediating competing interests through the interactions such as negotiations and conciliation to reach a consensus. To verify the applicability of the proposed consensus-building support system, simulated role-playing albeit restricted was conducted on the case of the Hantangang Dam construction. The simulation validated that open discussions and negotiations with the local community or NGO by the government increased the efficacy of negotiations.

A Study on Deliberative type of citizen participation: The case of The case of A Food Waste Recycling Facility in Ulsan City, Korea (숙의적 시민참여 모델 연구: 울산시 북구 음식물자원화시설 건립 사례)

  • This paper is to analyse the case of citizen participation employed in the local government, Buk-gu (Northern District) in the city of Ulsan, Korea. A kind of deliberative type of citizen participation named' citizen jury' was exercised to resolve an environmental conflict between Buk-gu government and its residents. The conflict was caused by the construction of a food waste recycling facility near by some residential areas in Buk-gu. Theoretically this paper makes a typology of citizen participation methods. Two criteria are employed. First of all, lay citizens are the primary participant or not? Secondly, interactive communication is feasible or not among participants in the process of citizen participation. Four generic types of citizen participation are sorted out: technocratic, pluralist, direct/participatory, and deliberative type. Especially deliberative type of citizen participation is based on an idea of deliberative democracy. This paper argues that the case of citizen participation employed in Buk-gu belongs to deliberative type of citizen participation. The argument is based on the following reasons. Firstly, primary participants in deliberation process can be considered as lay citizens though they are selected form local NGOs and religious groups. According to a survey, most of participants said that they would participate in the process of deliberation in the capacity of lay citizens though they were selected by their own groups. Secondly, the citizen participation process was deliberately designed and implemented to facilitate competence of primary participants and fairness in the deliberation. Viewed from this analysis, this Buk-gu case can be safely considered an innovative method of citizen participation which is also very successful in resolving intractable environmental conflict in the local government.
