Determinants of Success in Ex-parte and Inter-parte Patent Litigation (발명의 특허성 및 특허의 유효성 분쟁결과에 영향을 미치는 요인분석)

  • This paper investigates determinants of litigation success in the two distinctive types of patent litigations, ex-parte and inter-parte cases, which are brought in the process where a filed application becomes a valid patent right. We regress winning rates of patent applicants on the characteristics of firms, trials, patent lawyer, and patent itself, using a probit model with sample selections. The paper finds that the relative suit rate of a firm, time to be sued, changes of patent agents by applicants, and multiple agents among explanatory variables affect ex-parte reexamination and in-parte post-grant patent trials differently in the point of average marginal effects. These variables lower the probability of applicant's victory in the ex-parte cases, while they raise the probability in the inter-parte trials. However, the experience that agents represent applicants is a winning rate-increasing factor both in inter-parte and ex-parte reexamination, unexpectedly. This result cannot be applied to the entire domain of the variable, since sample selection effects are reflected in the result. The number of claim increases the winning probability of the applicant in the both types of patent litigations. This study has some limitations because it ignores the information on the legal person to which a patent agent belongs, and confined agent's experience to patent filing. We leave it future studies to investigate the effects of lawsuit experience of patent agent, and those of characteristics of the law firm to which individual patent lawyer is affiliated.

How Do Research Capabilities and Financial Resources Affect Professors' Entrepreneurship?: Using the Speed of University Spin-off Formations (교수의 연구역량과 연구비 수혜가 대학스핀오프 기업 형성 속도에 미치는 영향)

  • University-to-industry technology transfer has become an increasingly important issue in recent years. Studies on technology transfer and commercialization evolved to diverse knowledge transfer channels. Among them, university spin-off is not only known as the most direct and tangible method but also suitable for effectively transferring tacit knowledge. Much of the studies on university spin-offs are mostly focused on macro-level but studies using the individual professors as their unit of analysis need better understanding as well. This paper investigates why the speed of university spin-off formations differ among individual professors drawing on the resource-based view. Utilizing data of 149 professors in 25 universities who formed spin-offs, Cox regression results suggest that professors' technological research capabilities, academic research capabilities and financial resources promote university spin-off formations.

  • As the complexity and uncertainty of social and economic systems increase, the strategic foresight that actively and effectively responds to the environmental changes becomes important. A wide range of future forecasting methods are available for strategic foresight. Selecting one of the methods depends on several factors such as availability of time and financial resources and the objectives of the exercise. Although trend extrapolation analysis has been used for many years, scenario planning is being widely used by government and corporate as a tool for strategic decision making in recent years. Generally, scenario planning is carried out through workshop, in which experts with diverse backgrounds exchange information, views, and insights and integrate the diverse viewpoints. However, only a small number of experts can participate in a workshop and citizen opinion is not easily transformed into the policy for the scenario exercise due to the limitation of budget and short duration of a project. It is also much harder to develop creative ideas in the workshop because of the limited time and space. In this study, a new scenario process combining scenario workshop and wiki is proposed to overcome the limitation of scenario workshop. This combined approach can be more productive than using scenario workshop alone when developing new ideas. In this study, we applied the combined approach to develop scenarios for the strategic foresight of future media and present suggestions for improving the process.

  • Climate change and low-carbon consumer movement is demanding proper response around the world while rising oil price increases consumers' needs for green car. As a preliminary study to establish an industrial platform for green car and bring out corporate strategies, this article aims to propose an academic research framework by using various methodologies including conceptual/mathematical modeling, system dynamics, and ABM from different angles. First, an analysis framework for the industrial platform was introduced to analyze green car cases, required elements were proposed, and econometrics was applied to build a basic model related to green platform (two-sided market). Also, to analyze from a dynamic perspective, a system dynamics model was applied to green car environment to build a system dynamics analysis model that is applicable to particular green car industry analysis. Lastly, an agent based model was used to study the way to activate the hybrid car market in Korea from individual consumers' perspective. Based on the result, vehicle policies that are either being enforced or planned to be enforced in the Korean HEV market can be analyzed.

A Study on the Technology Valuation Using Patent Information (컨조인트 기법을 활용한 기술 가치 평가모형: 전기·전자 분야 특허거래 실증 분석)

  • In the era of fierce global competition and short product life cycle, firms have been interested in the technology valuation to improve their competitiveness. As the technology valuation may become a key issue for countries and industries, the development of technology valuation method has become increasingly important. Thus, this study aims to suggest a novel method to assess technology value by applying conjoint analysis to bibilographic information of patent. For this purpose, we firstly identified nine patent indexes categorized in three attributes - technological superiority, marketability and legal rights. Then, we collected actual data on patent transactions including their patent attributes and market prices. Based on the data, we could obtain the patent index values. Finally, we applied conjoint analysis to the prices and patent index values as a basis for technology valuation. The suggested method is expected to be an effective tool for technology valuation by using real transaction data rather than relying heavily on experts assessment.

An Analysis of Application Performance of Defense R&D Technologies Acquired by Offset Programs (절충교역을 통해 획득한 연구개발 기술의 활용성과 분석)

  • Offset trade has been applied in Republic of Korea's defense acquisition programs since early 1980s and used for national economic development as well as enhancement of military capabilities. The accumulated offset trade value amounts to over 10 billion dollars by 2010. However, questions in regards to the effectiveness of offset trade have been constantly raised. As it is a quite difficult task to analyze and calculate the application performance of defense technologies acquired by offsets objectively, limited level of quantitative analysis of application performance have been conducted so far. Hence, in this paper, we came to understand the overall status of application of those technologies through in-depth performance analysis and suggested some specific policies for the further development of offset trade based on the analysis results. To begin with, we developed a questionnaire based on performance indicator deducted through literature review of relevant researches, and conducted survey of major offset recipients. Also, another survey of offset experts belonged to the army, government organization, research institute and companies was conducted to evaluate the performance and effectiveness of offsets qualitatively. And we analyzed the efficiency of application performance using DEA. The results of all surveys are showing that there is positive accomplishment in the technological aspect, but in economic aspect, it shows relatively inactive outcome. Based on these results, policy direction is considered to be changed from the emphasis on the acquisition of core technology to revitalization of domestic defense industry in line with new government's policy orientation.

  • To enhance the competitiveness of the engineering college through cultivating market-oriented engineering students and to overcome the current 'science/engineering evasion' phenomena, this study proposes an engineering-management course and a strategy for its design and operation. Management ability and leadership is now a necessity for engineering students who will lead the society with their innovative science technology, yet such capacities can only be enhanced by providing a well organized engineering-management program. This study intends to introduce and propose development plans for Yonsei University College of Engineering's 'Techno-Yonsei' undergraduate engineering-management program. CEO's with an engineering background are increasing and in a society where cutting-edge technology is regarded as an invaluable asset, and where development and application of such technology is recognized as the key to securing competitiveness, the roles of 'engineering minded' CEO's are becoming indispensable. This study is significant in that it presents both the need and solution for a market-oriented engineering-management program in accordance to the social demands.

The Plan for Future-Oriented Assessment of Engineering Education (공학 교육의 미래 지향적 평가 방안)

  • According to the acceleration of informationalization and technological renovation in new coming $21^c$, the material production elements like labor and capital as well as others which have been the resources of a country's competitive power are changing into formless knowledge-based assets like knowledge and technology. In order to meet these demands of this time, companies in developed countries are concentrating on competition and cooperation to obtain higher technology as a strategy towards becoming first-class countries in the world. Thus, the development program of human resources should focus on providing creative technical application ability. Especially, universities should develop knowledge, technology, creative problem-solving ability and realism acquired by various fields in industry where engineering is used and make it possible to perform practical tasks. As a plan for enforcement and management of this program, a certification program which evaluates the ability and accomplishments of the study of graduate students in order to manage the quality of education should be applied as soon as possible at the institute which trains engineers. In this study, among the accomplishment assessment which have been suggested as an alternative assessment method, portfolio assessment is introduced into the educational situation of engineering technological human resources to find a method of application.

셀레늄 급여원에 따른 쇠고기의 육색 안정성 비교 연구

  • 유기셀레늄급원을 달리하여 쇠고기 육색 안정성에 미치는 영향을 분석한 결과는 다음과 같다. Myoglobin의 함량은 대조구와 시험구에서 각각 6.39%, 14.18%로 대조구가 시험구에 비하여 낮은 결과를 보였으며, Oxy-Myoglobin의 함량은 반대로 대조구 89.07%, 시험구 83.47%로 시험구가 대조구에 비하여 낮은 결과를 보였다(p<0.05). 그러나 Met-myoglobin 함량은 대조구가 4.56%이였고 시험구가 2.35%로 대조구가 높은 결과를 보였다. 보다 정확한 결과를 평가하기 위해서는 시료를 Met화 시킨 후 측정해 볼 필요성이 대두되어 도축후 $4^{\circ}C$에서 14일 및 21일간 숙성한 시료를 $20^{\circ}C$에서 48시간 산화시킨 후 측정 육색소 화학적 조성을 비교한 결과, 육색소 화학적 조성을 비교한 결과로 Myoglobin 함량은 저장 14일차와 21일차에서 유의적인 차이를 보이지 않았으나, Oxy- myoglobin은 저장 14일차와 21일차 모두 유기셀레늄 강화 버섯 폐배지 급여구가 대조구와 무기셀레늄 급여구에 비하여 높은 결과를 보였다. Met-myoglobin함량에 있어서는 대조구와 무기셀레늄구가 유기 셀레늄구와 유기셀레늄강화 버섯 폐배지 급여구에 비하여 높은 결과를 보였다(p<0.05). 유기셀레늄 강화 버섯 폐배지 급여구가 대조구나 유기셀레늄구에 비하여 Oxy-myoglobin production이 유의적으로 높았으며, Met-myoglobin Activity는 유기 셀레늄 급여구가 가장 높았으며, 그 다음으로는 유기셀레늄강화 버섯폐배지 급여구가 높았다(p<0.05). 이러한 결과는 소매상품 으로 제조 판매시 Oxy-Mb이 Met-Mb으로의 전환을 억제하여 이상적인 육색을 장시간 유지할 수있을 것으로 판단된다.조직감과 염도에서 매우 좋게 평가되었다. 이러한 결과는 제조 가능한 식염첨가최저수준은 0.5%이상임을 보여주었다. 따라서 로인 햄의 제조에 필요로 되는 식염의 첨가량은 0.5${\sim}$1.5% 범위로 평가된다. 차후의 연구로는 저염 로인 햄의 경우 품질의 저하를 보완할 수 있는 기능성 첨가물이나 가공기법이 필요할 것으로 보인다.97.22로 가장 낮았고, 기타 처리구는 1.19${\sim}$1.59의 처리를 보이고 있는데 비하여, 대조구(100) 대비 증체율에서는 생봉독 처리 2구에서 103.30으로 3.30%가 높았다.양성이 무엇보다 중요하다. 특히 지역자원 활용 소스 중심의 문화관린 산업의 seeds 발굴과 향토상품의 상품화와 네트워크 조직망 구축을 위한 지역중심의 복합 생활문화 공간이 필요할 것이며, 이를 촉진키 위한 mentor academy시스템 접근을 통해 점점 고령화되어 가고 있는 재래시장에 대해 차별적 특성이 반영된 종합적이고 체계적 접근 방법연구가 필요하다./TEX> 자체기술개발, 선진기술 도입, 산업간 및 산업내 기술확산, 국제기술협력 ${\rightarrow}$ 기술혁신의 촉진 ${\rightarrow}$ 총요소생산성과 기업경쟁력(자원 및 역량, 프로세스 경쟁력, 품질경쟁력, 시장경쟁력, 고객성과, 시장성과, 재무성과)의 제고 ${\rightarrow}$ 가격경쟁력(임금, 금리, 물류비용, 환율 등)과 비(非)가격경쟁력(디자인, 에프터서비스, 품질, 운송 등)의 제고 ${\rightarrow}$ 국가경쟁력의 제고 ${\rightarrow}$ 국제수지 흑자 ${\rightarrow}$ 성장 ${\rightarrow}$ 물가 및

The Effect of Managerial Coaching Behavior on Employees' Creativity in IT field: Focused on the Moderating Effect of Creative Self-efficacy and the Mediating Effect of Unlearning (IT분야 관리자의 코칭행동이 조직구성원들의 창의성에 미치는 영향: 폐기학습의 매개효과와 창의적 자기효능감의 조절효과 중심으로)

  • In the era of the fourth industrial revolution, IT workers' use of creativity has become more important than workers' in other fields in that they should apply new digital technologies to their companies for organizational innovation. In this regard, this study is to verify the effect of managerial coaching behavior on the creativity of employees in the IT field and identify the mediating effect of unlearning and the moderating effect of creative self-efficacy. A survey was conducted on IT workers in Seoul and the metropolitan area and a total of 439 copies of the questionnaire survey were used for confirmatory factor analysis on SPSS 25.0 and AMOS 25.0 and for mediating and moderating effect analysis on SPSS Process Macro 3.0. The results suggested that managerial coaching behavior has a positive effect on the creativity and unlearning ability of employees. They also showed that unlearning has a significant effect on one's creativity, mediating the relationship between managerial coaching behavior and the creativity of employees. Also, they identified that creative self-efficacy moderates the relationship between managerial coaching behavior and unlearning. This study has theoretical and practical significance in that it makes a timely contribution to expand the research area for coaching effect and identifies the influential mechanism behind managerial coaching by verifying the direct effects of managerial coaching behavior on the creativity of the IT sector workers and finding indirect influential factors.
