국제항로표지협회(IALA)는 항로표지 국제표준을 개발하기 위해 항로표지의 설치 및 관리를 주관하는 기관으로 구성된 비 정부간 국제기구로서, e-Navigation을 고려하여 항로표지 분야의 정보 표준 개발을 위해 국제수로기구(IHO)의 S-100 표준을 적용하기로 결정하고, S-200의 이름으로 제품 표준(Product Specification)을 개발 중에 있다. 본 연구에서는 IALA의 S-200 표준 개발 배경에 대해 검토하고, S-200의 제품 표준의 대표적인 사례인 S-210 IVEF, S-201 AtoN, S-220 MSI 등의 표준개발 현황과 계획을 정리 하였다. S-200 표준은 IALA가 핵심적으로 개발하는 표준이며, e-Navigation 체계에서의 각 서비스에서도 활용될 것으로 예상되므로, VTS 서비스 및 연구 담당자는 IALA의 S-200 표준 개발 내역 참조가 필요할 것으로 사료된다.

국제거래에서 분쟁이 소송으로 발전될 경우 당해 사안에 적용될 준거법의 결정문제와 어느 나라의 법원에서 재판을 받을 것인가에 대한 국제재판관할권의 문제가 빈번히 대두되고 있다. 소송을 제기하는 당사자들로서는 자신에게 유리한 재판결과를 얻을 수 있는 법이 준거법으로 선택될 가능성이 있는 국가의 법원에 소송을 제기하는 소위 '포럼 쇼핑 (forum shopping)' 전략을 세우기도 한다. 이러한 포럼 쇼핑에 대응하기 위해 영미 판례법인 common law에서는 오래 전부터 forum non conveniens를 확립하였다. 본 논문에서는 forum non conveniens를 심리한 미국 대법원의 판단기준을 살펴보면 먼저, 적절한 대체관할지의 존재여부이며, 둘째 사적이익 부분에서 자국민이 현저하기 불리한 위치에 처하는지를 확인하고, 셋째 공적이익 부분에서 미국의 이익이 심각하게 침해되지는 않는지를 검토하여 판단하게 된다. 이러한 법리적 판단근거를 제시하고 이에 대한 적용사례를 분석하여 향후 무역거래를 포함한 일련의 국제계약에 있어 분쟁시 국내기업들이 미국법정에 재판받지 않고 국내법원으로 재판관할지를 선택할 수 있는 전략을 제시함으로써 패소가능성 등의 계약위험을 줄일 수 있을 것으로 판단된다.

국제공동연구는 공동연구를 실시하기 전에 연구가 필요한 기술을 우선 정하고 기술을 보유한 국가나 기관을 선정하여 도입하고자 하는 기술이나 서로 보완관계로 공동연구가 가능한지 아니면 도입방식의 공동연구를 추진해야 하는지를 검토하여 세부적인 기술을 정하여 국제공동연구를 추진할 필요가 있다. 본 논문에서는 독일 등 우리나라의 국제공동연구 사례를 분석하면서 바람직한 국제공동연구 추진방안을 제시하였다. 즉, 외국과 공동 연구개발을 추진하는 경우에는 공동연구 대상기관이 어떠한 원천기술을 보유하고 있는데 그 기술의 가치가 무엇인지 따져보고 국내나 다른 나라들은 없는지 확인하여 필요한 기술이라면 도입여건을 검토하여 추진하여야 한다. 기술의 포괄적인 포장이나 애매한 협력은 불필요한 예산과 인력 투입등 비용을 유발하고 관련기관간의 신뢰를 심각하게 저해할 우려가 있다. 따라서 기술내용과 역할 등에 대해서 세분화하여 명확히 하는 것이 필요하다.

동북아시아지역에서 인천국제공항이 최고의 허브공항으로서 역할을 위해서는 무엇보다도 환승율에 대한 연구가 필요하다고 판단된다. 인천국제공항은 2005년도에 3,054,485만명의 환승여객을 처리하여 환승율은 11.9% 를 기록하였는데 이는 동북아시아의 경쟁허브공항의 환승율인 30-40%와 비교해보면 공항경쟁력이 상당히 뒤쳐진다고 할 수 있다. 이러한 약점을 보완하기 위하여 여러 가지 관련 인자들을 검토하는 것이 중요하다고 판단되어지는데 그중에서 인천국제공항의 비행편최소연결시간(MCT)을 개선하는 것이 필요하다. 이러한 문제를 개선하기 위해서는 항공기 스케줄, 항공사 배치, 게이트 배정방법, 수하물처리, 여객 동선 등이 함께 검토되어야 할 것이다. 그러나 이러한 인자들에 대한 세부적인 분석이 단기간에 걸쳐 해결되는 문제가 아니기 때문에 본 연구에서는 외국 허브공항의 MCT 수준, 관리방법, 국외사례 등을 고찰해 보고 동북아시아에서 허브공항을 향한 인천국제공항의 환승율 제고차원에서 정책적 방안을 제시하고자 한다.

The latest slogan put forth by the international space community is the safety, security, and sustainability of outer space activities. The security of outer space activities, in particular, would be defined as the secure state from space-based threats. The latter comprises passive threats (such as collision with other satellites and space debris) and aggressive threats (such as electromagnetic interference, arms race on the earth or in outer space, and military attacks). Has outer space been used for military purposes in practice? If so, does international law regulate the military space activities it? The use of outer space for military purposes is referred to as space militarization and space weaponisation. Satellites has been used in Gulf War, Kosovo War, and Afghan War, recently, and research and development on space weapons are under way. Since only the placement of weapons of mass destruction on orbit around the earth is prohibited in accordance with 1967 Outer Space Treaty, it may be asked whether other weapons may be placed on orbit. It will be necessary to analyze the stance of on the above question, by studying UN space-related treaties including UN Charter. New international space norms represented by PPWT, ICoC, and UN GGE Report are at the center of progressive development of international law. In conclusion, the author will signpost the various points on international norms to be codified on the use of outer space for military purposes.

This paper focuses on finding the way of aerospace industry promotion in Korea compatible with fair trade system under international rules by considering and analysing the WTO subsidy rules and WTO dispute settlement cases. As for subsidy rules in WTO, the paper deals with two matters such as financial contribution and benefit and further studies provisions on the prohibited subsidies and actionable subsidies. And as for the dispute settlement matters, it reviews the Brazil-Canada case and the US-EC case on civil aircraft export subsidies. While aerospace industry in Korea is not yet internationally competitive still requiring government's continuous supports, it must not be in conflict with subsidy rules under WTO mechanism. This paper makes several suggestions to meet these conditions.

This paper analyzes comparatively the effects of changes in real effective exchange rates on the business fluctuations of the cases of Korea and Japan employing structural vector auto-regression(S-VAR) model which uses quarterly data for the five variables of real effective exchange rates, GDP gap, real interest rates, oil prices, inflation rates for the period of 1980-2006. The paper employes impulse-response analysis and variance decompositions. The paper finds that real exchange rate depreciations are contractionay for the case of Korea while they are expansionary for the case of Japan. These results are consistent with the prevailing empirical results that real exchange rate depreciations are contractionary for developing countries while expansionary for advanced countries.

This study analyzes the dispute settlement of between arbitration and litigation using a game theoretical approach. Many studies on arbitration have so far focused on the relevant institutions. However, there are few theoretical studies that have focused on the demand side of arbitration. The model presented here suggests conditions under which arbitration form a perfect Bayesian Nash equilibrium, provided that the players strategically choose a dispute settlement tool. Furthermore, the suggested model is used to analyze simple cases of international commercial dispute cases.

부산북항을 국내에서는 체류형 해양관광과 동남해안 관광벨트 중심의 해양관광 거점으로, 또한, 국제적으로는 해륙교통의 요충지 여건을 활용하여 교통인프라를 구축하여 유라시아 관광의 전초기지로 하기위한 친환경 워터프런트 및 시민참여형 항만재개발사업이 추진되고 있다. 본 연구에서는 부산북항 재개발지구의 친수공간 배치계획에 따라 반영된 마리나 시설을 대상으로 국제해양관광의 거점조성 개발컨셉에 부합하는 마리나시설 개발을 정립하기 위하여 국내 및 해외 선진국의 마리나시설 개발사례에 대하여 국가별, 시설별로 현황 및 문제점을 분석하였다. 이는 추후 국내 마리나 개발시 시사점으로 활용할 수 있을 것으로 본다. 아울러, 부산북항 마리나항만의 효율적인 개발과 운영의 활성화를 위한 법적인 절차, 정부의 지원정책, 개발방향, 사업시행방안, 관리운영방안 등에 대한 구체적인 검토를 통하여 향후 국내 마리나 개발과 운영시 사례로 활용하고자 한다.

인천국제공항의 수많은 사업을 수행하면서 축적된 지식정보자원들을 web기반의 자료구조의 규격 언어인 XML을 이용한 전자적 공유체계인 전자메뉴얼시스템을 구축한 사례를 소개함으로써 XML에 대한 이해와 지식정보화 사업추진에 대한 이해에 도움이 되고자 한다. 또한, 앞으로 XML이 자리를 잡아감에 따라 XML은 점차 더많은 기업에 의해 도입될 것이고, 아울러 B2B, CRM 외에 e-비즈니스 전분야로 조만간 시장이 확대해 나갈 수 있을 것이다. 또한 지식정보 공유체계기반이 기업경쟁력의 극적인 제고와 개인의 지식창출에 기여함으로써 지식사회가 창조사회로 발전하는 기폭제가 되길 기대한다.
