  • 1990년대 중반부터 전자 자료의 이용 증가와 더불어 라이선스 계약이 증가하였으나 국내의 경우에는 저작권 및 계약에 관한 기초적인 지식과 협상 기술이 부족한 도서관 사서들이 라이선스 계약시에 지침으로 삼을 수 있는 자료가 아직 전무한 실정이다. 이에 본 연구에서는 라이선스의 기반이 되는 계약과 저작권과의 관계를 정립하고, 문헌조사와 설문지조사, 국내외의 사례 분석 조사 결과를 바탕으로 도서관 사서의 라이선스 계약에 지침이 될 수 있는 라이선스 모델을 개발하고자 한다.

입찰계약방식의 결정요인에 관한 연구

  • 입찰계약방식은 발주기업인 구매자가 최선의 공급자를 결정하기 위해 선택 가능한 하나의 전략적 도구로서 매우 중요한 의의를 지니고 있다. 본연구는 대리이론과 거래비용분석에 의해 발주기업의 입찰계약방식결정에 영향을 미치는 요인을 이론적으로 제시하고 있다. 본 연구는 입찰계약방식이 거래의 관계지향성과 계약의 명시성의 두가지 차원을 본질로 하고 있으며, 이들 두가지 차원에 영향을 미치는 요인으로 정보의 비대칭성, 지각된 위험의 크기, 성과측정 및 감시의 필요성, 응찰기업에 대한 신뢰와 몰입수준, 발주기업의 상대적 의존도의 다섯 가지 요인을 들고 있다. 본연구는 입찰계약방식이 이들 요인에 의해 어떻게 결정되는가를 명제의 형태로 제시하고 있으며, 실증분석을 위한 몇 가지 제언도 함께 제시하고 있다.

Study on Open Access Transformative Agreement (오픈액세스 전환계약서 분석 연구)

  • Since the introduction of the OA transformative agreement as a new way of licensing electronic resources, the number of OA transformative agreements has continued to grow. Despite the wide range of content that should be included in the agreement due to the nature of the OA transformative agreement, there is a lack of research on OA transformative agreements. As a basis for developing a standard for OA transformative agreements, this study examines the current status of OA transformative agreements and analyzes the differences between two types of OA transformative agreements and the subscription contract. It was found that the number of OA transformative agreements has increased significantly worldwide, but the disclosure of OA transformative agreements has not been universalized. The overall structure of two different types of OA transformative agreements and a subscription contract is similar, but there are differences in the detailed clauses. In the OA transformative agreement, the detailed clauses related to the characteristic of the transformative agreement were newly created, or the details of the transformative agreement were added to the existing clauses of the subscription agreement. There were also some differences between the two types of agreements, identifying clauses that differed in content regardless of the OA transformative agreement. The study concluded that it is important to standardize the OA transformative agreement, as the number of different clauses between agreement types may increase the burden on librarians. This study is significant in that it provides a basis for the development of standardized agreements by examining the overall status of OA transformative agreements and analyzing actual agreements.

  • Most of the conditions of contract applied in international construction contracts, including various conditions of contract published by FIDIC, include the provision for Retention Money which inevitably result in negative impact on cash-flow or financial burden to the contractors. In this study, fundamental reasons behind the application of Retention Money provisions are analysed and contractual mechanisms included in the FIDIC conditions of contract are searched, which include provisions for Performance Security and Defects as well as Termination, so that proper judgement can be derived on the application of Retention Money. In conclusion, considering the various contract provisions, performance security, termination of the contract by the Employer etc. included in the FIDIC conditions of contract, it is not necessary to include the provision for Retention Money.

  • Multiple parties-owners, engineering and construction contractors, and suppliers involve the delivery process of capital facility projects in the construction industry, and each party obtains or provides their workforce, material, equipment, or service tied into specific contracts. Considering that construction projects are based on the contracted relationship between the parties and that contract types are one of the significant factors determining project success. it is critical for project stakeholder to select appropriate contract types for successful deliveries of projects. With these considerations, this paper assesses impacts of different contract types on project cost, schedule, safety, change, or rework. Analyzing data from real construction projects, the differences in project performance between two contract types, Cost Reimbursable and Lump Sum are measured and statistically tested to investigate if the differences are significant. For this analysis, performance metrics developed by Benchmarking and Metrics program, the Construction Industry Institute are used.

  • 공동주택 전기 요금제에는 호별 계약, 단일계약 및 종합계약으로 분류된다. 호별계약은 저압전력이 공급되는 공동 주택에 적용되며, 세대별 사용량에는 주택용 저압요금제가 적용되고 공동부 전기 사용량에는 일반용 저압 또는 주택용 저압 요금제가 적용된다. 단일계약과 종합계약은 고압전력이 공급되는 공동주택에 적용된다. 단일계약은 공동주택 세대별 사용량과 공용설비 전기 사용량을 합산하고 평균하여, 평균세대의 전기요금량을 기준으로 주택용 고압 요금을 적용하여 공동주택 전기 요금을 산정하는 방식이다. 종합계약은 공용설비 전기 사용량에는 일반용 고압요금을 적용하지만, 세대별 전기 사용량에 대해서는 주택용 저압 요금을 적용하여 공동주택 전기 요금을 산정하는 방식이다. 공동주택에서는 3가지 요금제중 하나를 선택하여 한국전력과 계약을 맺을 수 있다. 고압전기를 공급받는 공동주택은 상황에 따라 단일계약이 유리한 경우도 있고, 종합계약이 유리한 경우도 있다. 따라서 본 연구에서는 공동주택에서 전기요금을 시뮬레이션하여 각 공동 주택에 적절한 요금제를 선택하는 의사결정을 지원할 수 있는 공동주택 전기요금 시뮬레이터를 설계하고 개발하고자 한다. 이를 위해 본 연구에서는 공동주택 전기요금 시뮬레이터의 요구사항을 분석하고, 시뮬레이터를 설계하고, 공동주택 전기요금 시뮬레이터 프로토타입을 개발하였다.

A Structural Model Analysis of Psychological Contract Breach, Psychological Contract Violation, and Employee Outcomes - A Case of Five Star Deluxe Hotel Employees - (인지된 계약위반, 경험된 계약위반과 직원의 조직행동 간의 구조적 관계에 관한 연구 - 특 1급 호텔 종사원을 중심으로 -)

  • With a distinction made between contract breach and contract violation, this study develops a structural model that investigates whether each dimension of contract breach influences experience of a contract violation in the hotel industry. At the same time, the impact of such a violation on hotel employees' work outcomes has been studied. One hundred and seventy eight employees, who are employed in five star deluxe hotels participated in the study and a structural equation modeling(SEM) is employed. The result indicated that good working relationship, and training and development, a so called relational oriented breach, make positively significant impact on contract violation. Whereas, benefits and salary categorized as transactional oriented breach does not. Also, the suggested employee outcomes including high turnover intent, low job satisfaction, and person-organization fit have been influenced by contract violation. As a result, hotel practitioners need to clarify the contract items prior to employment and during employment and to prepare to react to unmet promises.

  • 그 동안 IT 아웃소싱에 관한 많은 연구성과에도 불구하고 아웃소싱 계약체결에 있어서 실무적으로 꼭 필요한 아웃소싱의 적정가격에 관한 연구는 매우 미진한 형편이다. 특히 아웃소싱 의뢰업체 입장에서의 적정가격결정 모형이나 사례를 찾아보기는 더욱 어려운 것이 현실이다. 아웃소싱 가격의 적정성은 공급업체 만이 아니 라 의뢰업체의 입장에서도 아웃소싱의 성패를 좌우하는 중요한 요건이다. 본 연구는 TCO 개념을 이용하여, IT 아웃소싱 의뢰업체의 입장에서, 적정 가격을 산정하는 모형을 실제 적용사례를 통해 제시한다. 본 연구는 아웃소싱을 하지 않을 경우의 총소요비용과 아웃소싱을 할 경우의 총소요비용을 비교하여 아웃소싱의 효과를 측정하고 계약가격의 적정성을 판단할 수 있도록 하고자 하였다. 본 연구를 통하여 제시한 TCO분석방법 및 결과는 아웃소싱을 준비하거나 계획중인 업체에게 자체적으로 아웃소싱 계약가격을 산출하고, 아웃소싱을 통한 비용절감항목을 판단하며, 계약가격을 비교할 수 있는 자료로 사용되어 지기를 기대한다.

A Study on the Court's Recognition and Improvement of the Standard Contract Issues in the Media Entertainment Industry (미디어 엔터테인먼트산업의 표준계약서 쟁점 사항에 대한 법원의 인식과 개선방안에 관한 연구)

  • The purpose of this study is to organize issues of exclusive contracts for celebrities, which have been a major part of the existing industry, in preparation for various contract disputes in the media entertainment industry, and disputes in the media entertainment industry. According to the law case analysis conducted to achieve the purpose of the study, the court judged that the exclusive contract that did not conform to society's conventional wisdom was not effective, and that it was difficult to maintain the contract because it was not a normal contract. In addition, the court believed that unreasonable contracts using unfair trading status and overly long contracts were all reasons for termination. According to the court's judgment, the current standard contract requires about four revisions. First, clarification of contract termination conditions, second, clarification of payment date of revenue allocation, third, diversification of contract periods, and fourth, realistic modification of penalty provisions. Standard contracts have been enacted after several discussions, but there are still many things to revise and supplement. It will not end up with the preparation and use of contracts, but it will be necessary to continuously revise them to suit the industry's situation.

A Basic Study on the Methodology to Introduce Warranty Contracting for Pavements in Korea (도로포장 성능보증(Warranty) 계약제도 도입방안에 관한 기초연구)

  • Warranty contracting for pavements construction has been widely used in Europeans countries, Japan, and the U.S. and the benefits of warranty contract has been proven. This research investigated the European, U.S., and Japanese warranty contract policies and compared pros and cons. The most appropriate warranty contract policy solution is developed to fit in the Korean construction industry culture. Three main conclusions have been developed in this study: (1) performance specifications should be developed; (2) the systematic method is required to estimate the appropriate costs of performance bond and warranty period, etc.; and (3) short and long term plans for adopting performance warranty contract in Korea are suggested.
