A Study on the Improvement of Total Cost Change Control in Private Investment Projects (민간투자시설사업에 있어 총사업비 변경관리의 개선방안 연구 - 고속도로 민간투자시설사업을 중심으로)

  • This paper analyzes problems related to total cost changes in private investment projects, and then proposes an improvement measure for the control of cost changes within the framework of the project management, contract, human resource, project communication, cost, and time management. From the viewpoint of contract management, the basis of cost change ought to be cleared up with standardization of related provisions in the concession agreement, and potentiality of change ought to be excluded with prescription of the private investor's leading role from the design phase. Regarding human resource management, this paper proposes a standard work flow granting much sovereign rights to private parts by putting restriction on work scopes of the entrusted authority of government, and transferring the rights of assignment, contract, and control about the responsible supervisor to the concessionaire. With regard to project communication management the notification of changes on drawings and technical documents ought to be automated and the realtime database ought to be established with DMIS (Drawings & Documents Management Information System). From the cost management point of view, this thesis integrates the control of cost-change-approved items and disapproved items to one cost breakdown system, and then harmonizes the actual progress with EVMS in time management.

  • 공정거래위원회가 지난 해 12월 31일 건설업종 표준하도급계약서 개정을 공포하고 시행에 들어갔다. 개정된 건설업종 표준하도급계약서는 ${triangle}$부당특약 무효 ${triangle}$하도급대금지급보증제도 강화 ${triangle}$계약변경 시 하도급자의 권리 보호 강화 ${triangle}$선급금 사용제한 금지 등의 조항을 신설하고 ${triangle}$하도급자의 공사 중지 요청 권한과 계약해제 해지 요건 등의 확대 ${triangle}$하도급대금 지급 규정과 대물변제 금지 규정 등의 조항을 명확히 했다. 이러한 개정은 대한설비건설협회가 불공정 하도급 거래관행 개선과 회원사의 권익을 보호하기 위해 공정거래위원회에 건설공사 하도급계약에 사용되는 표준하도급계약서 개선을 지속적으로 건의한 결과 우리협회의 의견이 반영된 것이다.

  • Article 64 of the Enforcement Decree of the National Contract Act The requirement of the pre-amendment statute related to the adjustment of the contract price was 5% or more of the price fluctuation rate from the date of the contract. However, the meeting requirement was changed from 5% or more to 3% or more from the date of signing of the Presidential Decree No. 19035 to 2005. 9. 8. The method of adjusting the contract amount was also changed to determine the contractor's desired adjustment method at the time of contract. Alleviating these requirements and revising the empowerment of contract partners is intended to prevent difficulties in achieving smooth objectives by applying to public construction contractors without unfairly benefiting or unfavorable to contract partners. Even if the standards are relaxed and the rights are secured as described above, if the existing provisions for the adjustment of price fluctuation are applied, unlike the original purpose of the government system, the Korea Bank's price economic statistics classification method and the contract construction classification criteria applied in public construction work Due to the inconsistency, it can be seen that the amount of adjustment for price fluctuation by construction type is excessive and underestimated. Therefore, the purpose of this study is to analyze problems through cases and to make appropriate construction cost adjustment through improvement measures.

  • Currently, TK(Turn-key) projects have been implemented, the projects on TK basis still have shown several problems rather than its own merits as a bidding method. Increasing the number of claims being occurred during construction process of the projects is reality because of unclear notice of tender documents and conditions of the contract, design review system, and decision process of the qualified bidder. To establish desirable TK projects in domestic market, not only should resonable alternatives for carrying out design review system and selecting the bid winner be set up, but also proper standards for reforming irrational system of contract, bid, and notice of tender related to TK projects. This study is intended to reduce the number of claims and implement efficient projects of apartment construction on TK basis by identifying potential problems through analysis of claim examples of TK projects which have difficulties of revising contract agreement such as drawings and suggesting improvement methods for contract conditions and notice of tender docuements.

  • Construction work has character which claim or dispute is frequently raised. This means that each construction project has it's own contract documents due to the difference of environment and time. Therefore to overcome the associated risks, domestic contract rules and acts should be reformed. Several well-recognized contract documents developed by FIDIC, AlA, CMAA and general conditions of the contract is investigated and analyzed. Based on the research outcomes the direction of reformation is suggested.

  • Many contractors have overlooked the construction contract general conditions and it was a bad construction practice. Today, construction project is very complex and complicated. This requires a networked contract document and results in a complicated contract conflict hardly to be solved. Therefore, to reduce the construction dispute and to enhance construction practice, clarification of definition of Owner, several conditions to be revised, insertion of design supervision were suggested in this paper.

  • 공정거래위원회는 지난해 12월 30일 건설업종 표준하도급계약서를 개정하고 시행에 들어갔다. 개정된 건설업종 표준하도급계약서는 추가 변경공사 서면 발급 및 대금 지급의무, 하도급자 공사 중지 권한 및 공기연장 요청권, 부당특약 무효 및 하도급자 부당특약 비용부담 시 청구원 등 하도급업체의 권익 증진 조항이 포함되어 있다. 이는 대한기계설비건설협회가 회원사 권익보호를 위해 불공정 하도급 거래관행 개선을 지속적으로 건의한 결과이다. 개정전문은 협회 홈페이지(www.kmcca.or.kr) 에서 다운받을 수 있다.

법령과 고시 ② - 최저가낙찰제가 종합심사낙찰제로 개정

  • 300억원 이상의 국가 및 공공기관 발주공사에 대해 최저가낙찰제를 대신하여 종합심사낙찰제 전면 실시 등의 내용을 담은 국가계약법 시행령이 개정되어 2016년 1월 1일부터 시행에 들어갔다. 종합심사낙찰제는 가격 뿐만 아니라 공사수행능력, 사회적책임을 종합 평가하여 낙찰자를 선정하는 제도로 기존의 최저가낙찰제에서 발생한 덤핑낙찰 및 이로 인한 잦은 계약변경, 부실시공, 저가하도급, 임금체불, 산업재해 증가 등의 문제점을 해소하기 위해 도입된 제도이다. 종합심사낙찰제 도입에 따라 공사 품질이 제고됨으로써 생애주기(lifecycle, 유지보수비용 등을 포함) 측면에서의 재정효율성 제고를 비롯하여 불공정 하도급 관행 개선 등 건설산업의 생태계 개선과 함께 시공결과에 책임짐으로써 기술경쟁 촉진 등 건설산업의 경쟁력 강화 효과도 기대된다. 또한 국가계약예규도 개정되어 주계약자관리방식에 의한 공동계약(주계약자 공동도급)이 최저가낙찰제에서 종합심사낙찰제로 전환됐다.
