A Study on the Interpretation for Change Order Clause of USA Government Contract (미국의 공공공사 설계변경조항 해석동향 연구)

  • A construction project consists of a variety of contracts for the completion of work. The large number of contracts involved in a single project increases the likelihood that disputes will arise between the parties involved regarding the terms of service. Actually, there are many disputes that are caused by a change 0 order. While such disputes should be settled by interpreting the terms stipulated in the agreement entered between the two parties, the process of dispute settlement is often restricted to arbitration and lawsuit, and as a result the parties tend to avoid it due to its inefficiency. For this reason, in Korea it is hard to find cases of interpreting terms of service, while in the U.S. it is easy to find diverse cases of interpreting terms of service, since there is a process of dispute settlement by each stage by the party who has placed an order. Therefore, this study presents analysis of case studies of contract changes, looking specifically at changes in the scope of the work, changes in quantity, changes in the period of implementation, changes in the method of implementation or attitude, changes in items provided by the government or the delivery place, and the acceptance of such change procedure by a contractor, and the adjustment of a reduction.

  • 최근 해상교량의 건설이 증가하면서 해상교량의 건설로 인한 여러 가지 문제점들이 보도되고 있다. 인천 제2연륙교의 건설지연을 비롯한 여러 가지 문제점은 이러한 분쟁의 대표적인 예라고 할 수 있다. 특히 해상교량 건설 이전에 이미 그 해역을 항행하고 있던 선박과 그 선박을 이용해 이루어지던 물류의 흐름을 저해하는 해상교량의 건설은 장기간의 국가경제라는 측면에서 보면 커다란 손실을 입히게 될 것이라는 것을 누구라도 예측할 수 있다. 이 연구에서는 해상교량이 건설될 경우 선박교통의 흐름과 항만 운영에 미치게 되는 영향에 대하여 조사함과 동시에 실제 선박을 조선하여 해상교량 하부의 항로를 통과하여야 하는 도선사들의 의견을 수렴하여 문제점을 분석하고, 그 결과를 정리하여 향후 해상교량 건설의 표준안을 세우는데 기초 자료로 활용하고자 한다.

  • Recently, the construction wastes rapidly increase because of redevelopment, the development of new urbanization of large housing development, the expansion of social infrastructure. With increase of the construction noise, vibration, and dust caused by these developments, environmental conflicts and civil appeals increase. Moreover, the Government will reduce environmental level in the near future. Therefore, it will be expected to increase environmental conflicts and civil appels related to construction noise, vibration, and dust. To minimize environmental conflicts and civil appels, this study suggest the plan of prevention of environmental confliction and civil appeal by analyzing and measuring vibration, noise level, and dust of in-site crusher facilities at large and development district.

  • The disputes in construction projects are very important issue for stakeholders. However, many of presented claims have not received the compensation money required, and frequently turned down. The most cause is that the claims are not managed systemically on construction. Therefore, it is important to identify which management works are conducted on construction and how significantly do they relevant to construction claim. This research derives key claim management factors through analyzing causes for claim success and failure, and then presents management works relevant to them. This research also proposes the method for effective claim management and its expected effect through expert interview.

  • Claims in the construction industry can have a serious impact on the profitability of the project or can even result in project failure if it fails to take appropriate prevention. In order to properly prevent and respond to the potential claims and legal disputes throughout the project execution, it is necessary to continuously accumulate informations and clearly define the roles and responsibilities of the important activities systematically. Based on these needs, this study develops and verifies the project information management system(PMIS) that can prevent and respond possible claims for construction projects. Developed system includes such management modules as schedule, cost, PM/CM, design, collaboration, and claims. The system was validated by adopting it to the practical projects. The results showed that information systems tailored to the construction claim need to elevate users' familiarity to be more useful. Besides, the system can be more functional when used by both owners and contractors.

  • 수리권은 물을 소유할 수 있는 권리가 아닌 지속적이고 배타적으로 물을 사용할 수 있는 권리를 의미한다. 국내 수리권은 공유하천용수권, 관행수리권, 허가수리권, 댐사용권 및 농어촌용수 수리권으로 구분되어 있다. 미국의 경우 연안주의 수리권 (Riparian Rights), 유용한 사용의 원칙 (Beneficial Use Doctorin)에 근거한 우선전용 수리권 (Prior Appropriation Rights)으로 구분되어 있으며 물 분쟁이 발생할 경우 동등배분원칙에 따라 해결방안을 제시하고 있다. 일본 수리권의 경우 댐 건설할 경우 건설 주체 및 비용 분담이 명확하게 규정되어 있어 별도의 수리권 규정 절차가 없으며 농업용수에 대한 관행수리권 또는 기득수리권이 존재할뿐 그 외의 생활용수 등에 대한 수리권은 존재하지 않는다. 이렇듯 본 연구에서 검토된 국내외 수리권 법률 및 해결 방안에 대한 비교 및 검토 결과는 향후 국내의 수리권 법률 규정에 기초 자료로 활용 될 수 있을 것이다.

Analysis of Defect Risk by Work Types based on Warranty Liability Period in Apartments (공동주택 하자보수보증기간에 기초한 공종별 하자위험 분석)

  • Apartment is a typical type of housing preferred by the majority of people. However, and defect disputes occur because various defects such as cracks, subsidence, breakage, water leakage, dew condensation and dropout are confirmed with numerous structures and finishing materials. From this point of view, this paper analyzes defect frequency and costs of each warranty period by work types, and estimates defect risks by using defect dispute cases. It examined about 5,337 defect items for 32 apartment over ten years old. In this paper, there are 10 types of work types and the warranty liability period is divided into 6 categories. Based on these categories, defect frequency and costs are investigated, and finally defect risk of the warranty liability period by work types confirmed. As a result of this analysis, it was found that defect risk in RC and finishing work is very high. Especially the RC work revealed that there is a high risk of trying from the third year onwards and it was found that the defect risk up to the second year is high in the finishing work. Due to aging of RC structure, the defect risk gradually increases, and finishing work initially cause defect disputes because of the housing environment.

  • 근로계약 체결 시 사용자는 법적 의무를 준수하기 위해 반드시 명시하여야 할 사항은 근로계약서에 기재하고, 기타 개별 근로자와의 특별한 계약내용 및 기업의 인사관리정책상 계약서에 반드시 명시하여야 할 내용이 있다면 계약서에 서면으로 명시하는 것이 계약당사자간 신뢰를 확보하고 분쟁을 예방하는 방안이라 하겠으며 취업규칙에 위임하는 통일적인 근로조건 사항에 대해서는 취업규칙을 열람하게 하는 것이 바람직합니다.

  • 본 연구는 건설현장에서 일어날 수 있는 민사적 분쟁 중 공중권 침범여부를 사진과 영상으로 해석한 사례로 공중권은 일조권 마찬가지로 지상권을 획득한 다음 부수적으로 얻어지는 권리이지만, 이를 침해당하였을 경우 이것을 어떻게 입증하고 증명할 것인가에 대한 사진적 해석방법에 대한 연구이다.
