최근 정부계약제도는 하루가 다르게 변해가고 있습니다. 행정자치부에서는 지방정부출범 10년 맞이하여 지방자치단체의 특수성과 성격을 반영한 「지방자치단체를 위한 계약에 관한 법률」을 제정하여 올해부터 본격적인 시행에 들어갔으며, 국가계약제도 역시 정부가 추진하는 건설산업 경쟁력 강화 및 선진화 사업과 맞물려 최저가낙찰제도 확대, PQ 및 적격심사 제도의 개편, 각종 계약관련 하위 규정 통폐합 등 계약 및 입 · 낙찰제도 전반에 걸친 개편작업이 추진되고 있습니다. 본지는 이러한 정부계약제도의 급격한 변화의 흐름과 발맞추어 평소 회원사들로부터 자주 질의를 받았던 내용을 중심으로 정부시설공사입찰실무에(전문공사 50억 미만 적격심사 중심) 대한 내용을 3회에 걸쳐 게재 할 예정이오니 업무에 많은 활용 있으시기 바랍니다.

After several collapse accidents of large structures in the early 1990s in Korea, the government enacted a law that architectural, engineering and construction firms are obliged to have insurance for projects over a certain size. Particularly, with regard to insurance in design and construction supervision works (i.e. engineering insurance), although several operation-based problems were pointed out from practitioners, still little research has been done on analyzing current regnlartory and operational state and suggesting policy alternatives. Hence, this study applies Delphi technique to solicit current operational problems and propose a series of improvements on engineering insurance based on interview surveys targeting major market participants: municipalities, engineering firms, and insurance companies. Key findings culminate in adopting guarantee limits based on credit evaluation, abrogating joint surety, covering a loss of life, increasing insurance entrance fee, extending time covered, and etc. Reaching a consensus on the proposed alternatives between the market participants will form the foundation for sound developments of construction design and engineering industry.

Purpose: This study was designed to draw up problems with the safety and health diagnosis system, and designed a hierarchical survey model of the clauses prescribed by the Occupational Safety and Health Act. The purpose of the survey is to derive the effectiveness of the safety and health diagnosis system at the construction site by targeting three groups of experts. Method: This paper set up the legal status analysis and overseas related system analysis and AHP hierarchy analysis survey model. In addition, the validity of the analysis results was verified by a survey. Results: The analysis of the survey items showed a high importance on items included in the human utilization and the precision of the pre-plan. In particular, mid-sized construction companies showed the highest importance for their active activities after the safety and health diagnosis. Conclusion: Through this study, we should recognize problems for improving the safety and health system of construction industry and prepare policy and institutional improvement measures for experts.

기획재정부가 모든 공사에 하도급지급확인제 실시 등 국가계약 회계예규를 개정하고 지난 9월 8일부터 시행에 들어갔다. 개정된 회계예규의 주요 내용은 $\Delta$하도급대금 지급 확인제도 도입 $\Delta$최저가낙찰제공사 PQ시 지역업체 참여도 반영 $\Delta$국가계약법 시행령 시행규칙 개정에 따른 후속 조치 등이다. 대한설비건설협회는 회원사의 원활한 하도급 공사대금의 확보와 부당한 공사대금의 수령을 막기 위해 그동안 관련 제도 마련을 관계기관에 지속적으로 건의한 결과, 기획재정부가 회계예규를 개정하여 국가기관이 발주하는 모든 공공공사에서 원도급자의 하도급대금 지급내역 및 하도급자의 하도급 대금 수령내역을 발주기관 및 공사감독관이 직접 대조·확인토록 하는 하도급대금지급 확인제도를 도입한 것이다. 이 제도의 도입으로 앞으로 발주기관이 원도급자의 하도급공사대금의 공정한 지급여부를 직접 확인함으로써 하도급자의 공사대금 적기수령에 도움이 될 것으로 기대된다.

해외건설사업을 수행할 경우 해외건설촉진법에 의한 제반 보고제도를 준수해야 한다. 동법상 보고제도로는 $\Delta$수주활동상황보고 $\Delta$계약체결결과보고 $\Delta$시공상황보고 $\Delta$공사내용변경보고 $\Delta$준공보고 등이 있다. 또한 해외건설업체가 가장 중요시해야 하는 것은 수주활동상황보고 이다. 이 보고는 도급형 공사의 경우 입찰 예정일 10일전까지, 개발형공사의 경우 공사시행 개시일 20일전까지 제출해야 한다. 국내외 건설공사로 부터 하도급 형태의 수주활동도 마찬가지다. 현행법상 이 기일을 준수하지 않을 경우 해외건설촉진법에 의거 국토해양부는 과태료(200만원)을 부과하게 된다. 최근 신규등록업체 가운데 이 절차를 생략해 과태료 부과문제가 종종 발생하고 있다. 한편 보고를 생략하는 경우 추후 동 공사에 대한 실적을 인정받을 수 없게 된다. 현재 해외공사 상황보고 업무처리는 국토해양부의 위탁을 받아 해외건설협회가 수행하고 있다.

To help a owner selecting proper contractors about the specified contract, the Evaluation and Public Announcing System of the Contractor's Construction Capacity has been introduced since 1997. But, the system has been done violence to its original meaning and purpose as time went on. When annually announcing the Contractor's Construction Capacity, especially, there was frequently a large range of opinion on the issues. On that account, MLTM(Ministry of Land, Transport and Maritime Affairs) has had to make a alteration to improve those and is making efforts for a constructive policy now. The purpose of this paper is to conduct a basis study on the Integrated System after reflecting points to be considered about improvements and the current of the times.

Even though the construction management (CM) system was introduced for the purpose of increasing the efficiency of the domestic construction industry along with the establishment of construction industry fundamental laws in December of 1996, now it is very difficult that the public institutions can judge their application of construction management methods due to the lack of clear guidelines or directions to select construction management methods when the public institutions were executing public construction projects. Therefore, this study was executed to prepare for the selection criteria which could be referred in reviewing the application of construction management ordering methods according to public institution's competences and project characteristics. It is expected that future domestic demand of construction management will be gradually increasing both in public and private construction sectors. However under the current construction management systems, it is judged to be difficult that the construction projects that apply the construction management methods will be activated with full-scale. Therefore, it could be said that active efforts in domestic sectors are required in order that the construction management systems of developed countries levels could be activated. Additionally in order to vitalize the construction management systems, it is expected that public institutions could use this study results as the review data for feasibility of construction projects for the consignment of construction management in selecting the ordering methods.
