A Study on the Ways of Disputes Resolution Against Indian Company through ADR system (ADR을 통한 인도기업과 분쟁해결 방안에 관한 연구)

  • India is a gigantic market with a population of 1.2 billion and an economy that is growing at the second-fastest pace in the world. The volume of trade between India and Korea has been sharply increased with the increase of dispute since 2000. Although avoidance of disputes is always a priority, it is also important to prepare methods of dispute resolution which are efficient and economical. So, understanding of Indian dispute resolution system is a necessary requirement for successful business operation with Indian companies. This article analyzed and compared with the various ways of Indian ADR such as negotiation, mediation, conciliation, Lok Adalat and arbitration in order to help the Korean traders who enter into business with the Indian companies to settle their disputes efficiently. In conclusion, this article suggests the following ways to overcome problems of dispute with Indian companies: First, the Korean companies should recognize the characteristics of Indian ADR Ways respectively. Second, the Korean companies should utilize the conciliation or the mediation in small claim but arbitration in large claim. Third, Write a contract and insert the KCAB's standard arbitration clause in their contract.

  • The incidents of massive personal information being leaked are occurring continuously over recent years. Personal information leaked outside is used for an illegal use of other's name and account theft. Especially it is happening on online games whose virtual goods, online game money and game items can be exchanged with real cash. When we research the real identity theft cases that happened in an online game, we can see that they happen massively in a short time. In this study, we define the characteristics of the mass attacks of the automated identity theft cases that occur in online games. Also we suggest a system to detect and prevent identity theft attacks in real time.

  • In retail industry, it has been a major focus of marketing to identify and manage loyal customers effectively. Being established as a mature distribution channel, Internet retailing has launched various one-to-one marketing efforts and enjoyed much more fruitful outcome because it is founded on digitally enabled infrastructure. As more complicated and crowded transactions are expected, Internet retailing is in need of electronically available customer management services. This research presents architectural design of Web services for loyal customer management in Internet retailing. The fundamental models of the services are based on traditional RFM analysis. The Web services provide various agents that automate complicated loyal customer management tasks. beadily available Web services are expected to easily integrate into existing applications of any electronic retailers.

Volatilities in the Won-Dollar Exchange Markets and GARCH Option Valuation (원-달러 변동성 및 옵션 모형의 설명력에 대한 고찰)

  • The Korean Won-Dollar exchange markets showed radical price movements in the late 1990s and 2008. Therefore it provides good sources for studying volatility phenomena. Using the GARCH option models, I analysed how the prices of foreign exchange options react volatilities in the foreign exchange spot prices. For this I compared the explanatory power of three option models(Black and Scholes, Duan, Heston and Nandi), using the Won-Dollar OTC option markets data from 2006 to 2013. I estimated the parameters using MLE and calculated the mean square pricing errors. According to the my empirical studies, the pricing errors of Duan, Black and Scholes models are 0.1%. And the pricing errors of the Heston and Nandi model is greatest among the three models. So I would like to recommend using Duan or Black and Scholes model for hedging the foreign exchange risks. Finally, the historical average of spot volatilities is about 14%, so trading the options around 5% may lead to serious losses to sellers.

  • The purpose of this study is to analyze whether asset sales contributed to increase of the shareholder value of the seller and the buyer in Japan. The period of analysis is 2000-2007. As a result of event study, Although the stockholder of the seller earn positive abnormal returns at the announcement of a asset sales, most stockholders of the buyer were break even. However, the buyer which purchase related asset get positive abnormal returns. Furthermore, when using a matched seller-buyer, we find that asset sales are firm value enhancing for the seller and buyer. Furthermore, we verify whether the excess return depends on the financial condition, and the managerial performance. we find that seller gains are related to the seller's managerial performance, leverage ratio, and buyer gains are related to the leverage ratio, foreigner holdings ratio. we conclude that lender and outside monitoring lead to increase of firm value.

  • 한국은 2050년까지 주요 선진국 중에서 고령화가 가장 심각한 사회로 전환되게 될 것으로 예상된다. 기대여명의 증가와 저 출산은 고령화를 더욱 악화시키며, 이는 심각한 사회문제로 발전하게 될 것이다. 이와 같은 문제를 해결하기 위해 한국정부는 2008년에 도시지역에는 주택연금제도를 도입하였으며, 2011년에는 세계 최초로 농촌지역을 대상으로 농지연금제도를 도입하였다. 그렇지만 이와 같은 제도는 설계 당시부터 복지상품이라기 보다는 장기적으로 손실과 수익의 균형에 초점을 둔 금융상품으로 개발되어 실질적으로 노인들에게 크게 인기를 얻지 못하였다. 따라서 본 연구는 농지연금제도를 활성화시켜, 농촌노인들에게 보다 더 많은 혜택을 주기 위해 지역 토지시장을 감안하여 지역별 농지가격상승률을 예측하고 연금액을 산출하였다. 또, 지금까지 사용한 년 혹은 분기별 감정가 대신에 월별, 지역별 실거래 가격을 모형에 적용하여 지역토지시장, 고령화 수준 등 지역 여건에 부합하는 연금액을 산출하였다. 할인율자료도 가장 안정적인 3년 만기 국고채 수익률을 활용하여 미래농지가격을 예측하고, 이를 유동화하여 월 생활자금으로 지급되도록 하였다. 특히 농지규모가 가장 많고, 고령화 정도가 심각하여 농지연금의 잠재적 수요가 가장 높을 것으로 예상되는 경상북도와 전라남도를 사례지역으로 선정하고, 이를 전국평균과 비교하여 지역적인 차이도 함께 분석하였다. 이를 위해 농지가격 및 이자율 시계열 자료의 안정성을 검정하고, 장기농지가격을 예측하였다. 이를 활용하여 경북, 전남, 전국의 노인들의 월평균 지급액을 추정하였다. 분석결과 정책의 잠재적 수요가 가장 높은 두 지역이 가장 낮은 금액이 지급되는 것으로 추정되어 이는 또 다른 지역불균형을 초래할 수 있는 것으로 평가되었다.

  • With the distribution modernization policy advanced by the government and consumers preference toward it, the so called "modern market" has undergone rapid growth. Conversely, traditional market is losing popularity with consumers as a result of inadequate modern structures, small market size, convoluted relationships, inefficient operation and disordered transactions, among others. Therefore, this study seeks to utilize ubiquitous computing, that is, the upgrade of context aware information to 6W1H and promote the market through the interface with Smartphone and provide advanced information through the augmented reality technology. For the construction of context-aware system using user context, the results may significantly differ according to how reference rules are applied to and implemented on knowledge base. In light of above, through the use of RFID technology and 6W1H context awareness, we seek to promote traditional markets.

주류산업(酒類産業)에 대한 정부규제(政府規制)의 문제점(問題點)과 개선방향(改善方向)

  • 현재 우리나라 주류산업(酒類産業)이 안고 있는 문제점(問題點)들은 과다(過多)한 정부규제(政府規制)와 대기업(大企業)의 시장지배현상(市場支配現象)으로 요약될 수 있다. 원료배분(原料配分), 가격규제(價格規制), 제조(製造) 및 판매면허(販賣免許), 지역판매(地域販賣) 등 기업활동(企業活動)의 거의 전분야(全分野)에 걸쳐 각종 규제(規制)가 엄격히 적용되고 있어 자유로운 기업활동(企業活動)을 저해(沮害)하는 장애요인(障碍要因)이 되고 있다. 주류산업(酒類産業)에 대한 또 하나의 문제점(問題點)으로서 대기업(大企業)의 시장지배현상(市場支配現象)은 특히 유통업(流通業)에 대한 대제조사(大製造社)의 거래관행(去來慣行)에서 두드러지게 나타나는바 이는 기본적으로 유통업(流通業)의 규모(規模)가 영세(零細)한 데 기인하는 것으로 판단되며 덤핑행위(行爲) 등 유통질서문란(流通秩序紊亂)의 원인이 되고 있다. 본고(本稿)는 이와 같은 주류제조업(酒類製造業)과 유통업(流通業)의 구조적(構造的) 문제점(問題點)을 동시적(同詩的)으로 고찰(考察)하여 제도적(制度的)인 측면(側面)에서의 해결방안을 모색(摸索)하는 것을 그 목적(目的)으로 하고 있다. 본고(本稿)에서 제시하는 주류산업정책(酒類産業政策)의 개선방향(改善方向)을 요약하면 우선 시의(時宜)에 비추어 불필요(不必要)하거나 과도(過度)한 정부규제(政府規制)를 과감히 완화(緩和)하여 기업들이 장기적(長期的)으로 볼 때 소비자선택(消費者選擇)에 의한 상품경쟁(商品競爭)을 통해 환경변화에 자율적(自律的)으로 적용할 수 있도록 하는 것이 바람직하며 현행(現行)의 세제(稅制)에 대해서도 용기개발 및 재고처리 등에 상존하는 불합리한 세제(稅制) 및 주류별(酒類別) 세율(稅率)을 개선하여 여건변화에 따라 탄력적(彈力的)으로 적용(適用)하는 것이 세수위주(稅收爲主)의 조세행정(租稅行政)을 지양하고 주류산업(酒類産業)의 효율성증진(效率性增進)에 도움이 될 것으로 판단된다.

  • Considering the rapid process of media's breakthrough and diverse patterns of consumptions's analysis, a uniform analysis might be much rooms to be desired for interpretation of new phenomena. In special, the products happening intensive sails on around an anniversary or fresh food have the restricted marketing hours. Moreover, traditional association rule discovery algorithms might not be appropriate for analysis of sales pattern given in a specific time because existing approaches require iterative scan operation to find association rule in large scale transaction databases. in this paper, we propose an incremental candidate set management model based on twin-hashing technique to find association rule in special sales pattern using database trigger and stored procedure. We also prove performance of the proposed model through implementation and experiment.

A Study on the Consumers' Trust Factors in Internet Shopping Mall (인터넷 쇼핑몰에 대한 소비자의 신뢰 요인 연구)

  • This paper tried to analyse the factors influencing consumer trust and the relationships between cause variables and results in Internet Shopping Mall. In order to do so, this paper tried to analyse the trust factors in TV Home Shopping as well as Internet Shopping Mall in terms of cyber markets both. There found six factors : perceived factor before purchasing, perceived factor after purchasing, perceived and emotional factors in the course of purchasing, positive and negative emotional factors after purchasing. These factors are correlated with Internet shopping variables and we can measure how Internet shopping variables can affect trust to the shopping mall. We can compare the trust factors of TV home shopping with those of Internet shopping mall and then we can activate Internet Shopping Mall. More implications of this study and further researches should be discussed in the future research.
