Development and Effects on a Program for Decreasing Violent Behaviors of the Spouse Abusers with Drinking Problems - Applying Motivational Enhancement Therapy - (음주문제를 가진 가정폭력가해자 폭력행동감소 프로그램의 개발과 효과 - 동기증진치료의 활용을 중심으로 -)

  • The court-mandated spouse abusers with drinking problems not only resist and complain about taking the court-mandate but also have the low motivation to change their problem drinking and violent behaviors. Therefore, in this study the program is developed to decrease violent behaviors of spouse abusers with drinking problems. Also, the usefulness of this program is examined by quantitative and qualitative methods. The results are as follows: The experimental group's pre-to-post variation is decreased by significant level statistically more than the comparison group's variation in drinking problems. Regarding violent behaviors among groups, the experimental group's pre-to-post and pre-to-followup variation are decreased significantly. It is assumed that Motivation Enhancement Therapy(MET) influences the differences of motivation to change violent behaviors in both groups. The reason is that MET is considered to have influences on the group's dynamics and interaction. Also, it is helpful to change the negative emotions to the positive emotions and to stimulate the group interaction and the participation. This study will be contributed to promote the speciality on providing services for family in a domestic violence in Korea. Through this study, I suggested future implications in research, practice, and political side on spouse abusers with drinking problems.

Penalty system for sexual crime against children: A qualitative comparative analysis of sentencing (아동대상 성범죄에 대한 형벌제도 : QCA방법론을 이용한 양형분석)

  • This study aims (1) to identify whether real terms of imprisonment for sexual offenders against children are different between the first trial and appeal trial in 16 cases and (2) to assess which sentencing factors such as history of sexual crime of perpetrator, forgiveness of children, regretfulness of perpetrator, power of perpetrator, and relationship of perpetrator and victim influence sentencing period of imprisonment in the first and appeal trials, respectively. This study used cases which were prosecuted for sexual crimes against children since the protection act on the children and juveniles from sexual abuse was enacted in 2000. The target cases of the study include 8 first trials and 8 appeal cases which were appealed to the Supreme Court between 2000 and 2015. Result condition is the real term of imprisonment. Cause conditions include sentencing factors such as history of sexual crime, regretfulness, and power of perpetrator, forgiveness of child, and relationship between offender and victim. We employed Qualitative Comparative Analysis (QCA) for data analysis. We found that there are sentences in the first trial with lower terms than appeal trial regarding child sexual crimes. In addition, we found that (1) power of perpetrator and forgiveness of victim significantly influenced sentencing periods of imprisonment at levels of courts; (2) cause condition considered as comparatively more important in the first trial was regretfulness of perpetrator(but not in the appeal trial); and (3) relationship of perpetrator and child was not important in sentencing for sexual crime at both levels of trials.

The Development of Moral Emotional Understanding in Preschool Children : The Influence of Offenders' Intentions and Victims' Reactions (유아의 도덕적 정서 이해의 발달 : 가해자 의도와 피해자 반응의 영향)

  • This study examined the influences of age, offenders' intention, victims' emotional reactions on the moral emotional understanding of preschool children. Eighty eight children aged 4, 5, and 6 participated in this study, and were interviewed using four moral transgression stories. The responses of the children were then analyzed in terms of the levels of moral emotional understanding, from error through to the understanding of secondary emotions. The results indicated that older children showed higher levels of moral emotional understanding than younger children. Additionally, children's moral emotional understanding was higher in situations in which offenders' behaviors were intentional, and in which the victims expressed sadness. The attribution of moral emotions was influenced by victims' emotional reactions only in 6-year-old children. Discussion of these results also included the development of intervention programs for children with aggressive behaviors, as well as a number of suggestions for future study.

Cognitive Behavioral Therapy of Paraphilia or Sexual Offenders (성도착증 혹은 성적 가해자의 인지행동치료)

  • Non-pharmacological treatments have long been used for paraphilia or sexual offenders, but few clinical studies were conducted. However, recently there were issued cognitive behavioral therapy of paraphilia or sexual offenders based on the research findings obtained so far. In addition, there were the changes of Diagnostic and Statistical Manual of Mental Disorder by American Psychiatric Association at 2014. The methods of cognitive behavioral therapy for paraphilia or sexual offenders were electric aversion therapy, olfactory aversion therapy, ammonia aversion therapy, covert sensitization, masturbatory reconditioning, directed masturbation, verbal satiation, social skill training, assertiveness training etc. By synthesizing the newly reported foreign guidelines for treatment and review articles, the aim of this study is to investigate the non-pharmacologic therapies used for treatment of paraphilia or sexual offenders.

  • 2014년 9월 29일부터 아동학대 가해자에게 무기징역까지 처벌을 강화하고, 친권 제한도 가능케 한 '아동학대범죄의 처벌 등에 관한 특례법(아동학대처벌법)'이 시행되고 있다. 동법의 내용으로는 기존 형법상 '3년 이상의 유기징역'에 집행유예가 가능한 학대치사죄에 대해 법정형을 '무기 또는 5년 이상의 징역'으로 높이고 별도의 감경사유가 없는 한 집행유예가 불가능하도록 했다. 아동학대 가해자가 친권자라는 이유로 피해아동을 격리시키기 힘들었던 점을 개선하기 위해 친권을 제한할 수 있는 길을 터놓았다. 부모(친권자)가 중상해를 입히거나 상습적으로 학대한 경우엔 검사가 법원에 친권상실을 청구해야 하며, 검사가 하지 않으면 아동보호전문기관의 장이 청구를 요청할 수 있도록 했다. 본고에서는 아동학대의 실태를 기초로 하여, 아동학대처벌법의 내용과 문제점을 살펴보기로 한다.

Analysis of Precedents Related to Child Abuse Cases in Child Care Centers and Its Implications (어린이집 아동학대 사건의 판례분석과 시사점 : 아동학대범죄의 처벌 등에 관한 특례법을 중심으로)

  • In Korea, child abuse in child care centers occurs continuously, and it is becoming a social problem. The government has intensified the supervision of management in child care centers, and through strong countermeasures and prevention against child abuse, it enacted the special act on child abuse in oder to enable children to become healthy members of society. In this study, this researcher gasped the legal application on child abusers, and analysed how the punishment for abusers changed according to the application of the special act on child abuse, through examining precedents of child abuse in child care centers. 21 cases related to child abuse cases were collected by searching homepage of the supreme court and each district court in this study. As a result of analyzing the precedents, the sentence of the defendant did not increase greatly, and it differed from the criminal identification of the people in cases of child abuse on which the special act on child abuse was applied. Therefore, it can be seen that there is a demand for more rigorous legal application for abusers in order to prevent child abuse in child care centers.

The Effect of Different Types of Bullying Defenders on Bullying Behavior: Verification of the Moderating Effect of Empathy (집단따돌림 동조유형이 집단따돌림 가해행위에 미치는 영향: 공감능력의 조절효과 검증)

  • This study was designed to test whether middle school students have moderating effect of empathy ability on group bullying behavior. The subjects were 488 middle school students in Busan area, The mean difference test and regression analysis were performed using the SPSS 20 program and the related variables were standardized to show the characteristics of the control effect. The results of this study are as follows: First, as the experiences of the perpetrator and the experience of the autonomous group, the group bullying behaviors were higher, and it was confirmed that the perpetrators were important variables for predicting the bullying behaviors. As a predictor of bullying behavior, it was identified as an important variable. Second, empathy ability has a moderating effect of alleviating the relationship between perpetrator's harmony and bullying behavior, and the relationship between onlooker and bullying behavior. Third, according to gender analysis, male students were more exposed to bullying behaviors than female students. Through these discussions, practical suggestions for social welfare, academic suggestions, and suggestions for follow-up studies were made.
