This paper reviews the problems on the arbitral awards enforcement in the 2016 Korean Arbitration Act. In order to get easy and rapid enforcement of the arbitral awards, the new arbitration act changed the enforcement procedure from an enforcement judgement procedure to an enforcement decision procedure. However, like the old arbitration act, the new act is still not arbitration friendly. First of all, there are various problems in the new act because it does not approve that an arbitral award can be a schuldtitel (title of enforcement) of which the arbitral award can be enforced. In this paper, several problems of the new act are discussed: effect of arbitral award, approval to res judicata of enforcement decision, different trial process and result for same ground, possibility of abuse of litigation for setting aside arbitral awards and delay of enforcement caused by setting aside, infringement of arbitration customer's right to be informed, and non-internationality of enforcement of interim measures of protection, inter alia. The new arbitration act added a proviso on article 35 (Effect of Arbitral Awards). According to article 35 of the old arbitration act, arbitral awards shall have the same effect on the parties as the final and conclusive judgement of the court. The proviso of article 35 in the new act can be interpret two ways: if arbitral awards have any ground of refusal of recognition or enforcement according to article 38, the arbitral awards do not have the same effect on the parties as the final and conclusive judgement of the court; if arbitral awards have not recognised or been enforced according to article 38, the arbitral awards do not have the same effect on the parties as the final and conclusive judgement of the court. In the case of the former, the parties cannot file action for setting aside arbitral awards in article 36 to the court, and this is one of the important problems of the new act. In the new act, same ground of setting aside arbitral awards can be tried in different trial process with or without plead according to article 35 and 37. Therefore, progress of enforcement decision of arbitral awards can be blocked by the action of setting aside arbitral awards. If so, parties have to spend their time and money to go on unexpected litigation. In order to simplify enforcement procedure of arbitral awards, the new act changed enforcement judgement procedure to enforcement decision procedure. However, there is still room for the court to hear a case in the same way of enforcement judgement procedure. Although the new act simplifies enforcement procedure by changing enforcement judgement procedure to enforcement decision procedure, there still remains action of setting aside arbitral awards, so that enforcement of arbitral awards still can be delayed by it. Moreover, another problem exists in that the parties could have to wait until a seventh trial (maximum) for a final decision. This result in not good for the arbitration system itself in the respect of confidence as well as cost. If the arbitration institution promotes to use arbitration by emphasizing single-trial system of arbitration without enough improvement of enforcement procedure in the arbitration system, it would infringe the arbitration customer's right to be informed, and further raise a problem of legal responsibility of arbitration institution. With reference to enforcement procedure of interim measures of protection, the new act did not provide preliminary orders, and moreover limit the court not to recognize interim measures of protection done in a foreign country. These have a bad effect on the internationalization of the Korean arbitration system.
Landslides on hillside slopes with shallow soil cover over a sloping bedrock are frequently caused by increases in porewater pressures following of heavy rainfall and it is one of the most important factors of assessing the risk of landslide to predict the groundwater level fluctuations in hillslopes. This paper presents the comparative study of three unsaturated flow models developed by Sloan et al., Reddi, L.N., and Thomas, H.A., Jr., respectively, which are used to predict the increase of groundwater levels in hillside slopes. The parametric study for each of models is also presented. The Kinematic Storage Model(KSM) developed by Sloan et at. is utilized to predict the saturated groundwater flow. They are applied to the two sites in Korea so as to examine the possibility of use in the groundwater flow model. The results show that two unsaturated models developed by Sloan et al. and Reddi, L. N. are largely affected by the uncertain parameters like saturated permeability and saturated water content : the abed model has the potential of use in unsaturated flow model with the optimal estimates of model parameters utilizing available optimization techniques. And it is also found that the KSM must be modified to account for the time delay effect in the saturated zone. The results of this paper are able to be utilized in developing the predictive model of groan dwater level fluctuations in a hillslope.
To establish the dual-purpose barley cultivation for forage by clipping before overwintering and grain next year, an experiment was conducted to clarify the effect of clipping times and cultivars haying different winter habits in rice-barley cropping system at paddy field in southern Korea. Barley showed more forage yield by clipping once only on December 10 than that of twice-clipping on November 10 and December 10. Among experimented cultivars, Saegangbori (winter habit II) and Keunalbori (winter habit IV) produced higher forage yield in one time clipping than the others. On the contrary, higher total digestive nutrients(TDN) was gained from twice-cut plants. Barley clipped once or twice headed and matured without serious delay as compared to the conventionally sown barley. In spite of clipping in November and/or December, barley produced grain yield similar to that of the conventional. Conclusively, it was regarded that cultivars having II-III winter habit were suitable for dual-purpose barley cultivation for forage in winter season and grain harvest next year.
Background: The association of biomaterial combined with repair factor-like platelet-rich plasma (PRP) has prospective values. Bovine-derived xenograft has been identified as an osteoconductive and biocompatible grafting material that provides osseointegration ability. PRP has become a valuable adjunctive agent to promote healing in a lot of dental and oral surgery procedures. However, there are controversies with respect to the regenerative capacity of PRP and the real benefits of its use in bone grafts. The purpose of this study was to assess the influence of PRP combined with xenograft for the repair of peri-implant bone defects. Methods: Twelve rabbits were used in this study, and the experimental surgery with implant installation was performed simultaneously. Autologous PRP was prepared before the surgical procedure. An intrabony defect (7.0 mm in diameter and 3.0 mm deep) was created in the tibia of each rabbit; then, 24 titanium dental implants (3.0 mm in diameter and 8.5 mm long) were inserted into these osteotomy sites. Thus, a standardized gap (4.0 mm) was established between the surrounding bony walls and the implant surface. The gaps were treated with either xenograft alone (control group) or xenograft combined with PRP (experimental group). After healing for 1, 2, 3, 4, 5, and 6 weeks, the rabbits were sacrificed with an overdose of KCl solution. Two rabbits were killed at each time, and the samples including dental implants and surrounding bone were collected and processed for histological analysis. Results: More newly formed bone and a better bone healing process were observed in control group. The histomorphometric analysis revealed that the mean percentage of bone-to-implant contact in the control group was significantly higher than that of the experimental group (25.23 vs. 8.16 %; P < 0.05, independent-simple t test, analysis of variance [ANOVA]). Conclusions: The results indicate that in the addition of PRP to bovine-derived xenograft in the repair of bone defects around the implant, PRP may delay peri-implant bone healing.

This study empirically analyzes the relationships among the road and traffic experts' personal characteristics, the driving behavior and factors being expected to have an effect on the satisfaction about roundabout operation. The factors are drawn and grouped through the principle component analysis to clarify driving environment satisfaction on roundabout operation. Each group is named as personal attribute, driving behavior attribute, and satisfaction. After the variables are refined by confirmatory factor analysis, satisfaction model is developed with personal attribute and driving behavior attributes as exogenous variables and roundabout driving awareness and emotion attributes as endogenous variables. As a result, driving satisfaction of roundabout operation is directly influenced by delay reduction, safety improvement, capacity increase, sight improvement, severity accident reduction, and bicycle convenience and indirectly gender, age, driving time, and driving experience. Law obeyance, driving concession, traffic sign obeyance, and interposition do not statistically shows significant on satisfaction. As a result of Analytical Hierarchy Process (AHP), the turning radius of geometry and the driving behavior are important elements for roundabout safety.

The effect of increasing the elevation of an IHX (intermediate heat exchanger) on the transient performance of the KALIMER-600 reactor pool during the early phase of a loss of normal heat sink accident was investigated. Three reactors equipped with IHXs that were elevated to different heights were designed, and the thermal-hydraulic analyses were carried out for the steady and transient state by using the COMMIX-1AR/P code. In order to analyze the effects of the elevation of an IHX between reactors, various thermal-hydraulic properties such as mass flow rate, core peak temperature, RmfQ (ratio of mass flow over Q) and initiation time of decay heat removal via DHX (decay heat exchanger) were evaluated. It was found that with an increase in the IHX elevation, the circulation flow rate increases and a steep rise in the core peak temperature under the same coastdown flow condition is prevented without a delay in the initiation of the second stage of cooling. The available coastdown flow range in the reactor could be increased by increasing the elevation of the IHX.
Sugars play important roles in petal senescence of cut flowers. In the Expt. 1 of this study, the effects of different concentrations of glucose (60, 90, and $120g{\cdot}L^{-1}$) and sucrose (30, 60, and $90g{\cdot}L^{-1}$) application on the vase life, rate of flower diameter increase, rate of flower weight increase and ethylene production of cut tree peony (Paeonia suffruticosa 'Luoyang Hong') were evaluated. At the earlier stage, treatments of different concentrations of glucose and sucrose all retarded the process of flower opening and inhibited the increase of flower diameter and weight, while senescence of flowers fed with different concentrations of glucose was delayed at later stage. Flowers treated with $90g{\cdot}L^{-1}$ glucose displayed the longest vase life, which showed significant difference (P < 0.05) from those of flowers with the control and sucrose treatments. All treatments with glucose or sucrose not only retarded the decrease of flower diameter and weight, but also suppressed the ethylene production at the earlier stage and delayed the peak of ethylene evolution. In order to study the effect of exogenous sugar on the postharvest response of cut tree peony to ethylene, Expt. 2 was conducted. Cut flowers were treated with $90g{\cdot}L^{-1}$ glucose for 4 hours before (GE) or after (EG) exposed to $10{\mu}L{\cdot}L^{-1}$ ethylene for 4 hours. Generally, the opening process of flowers with GE and EG treatments was similar to that of the control, however GE treatment delayed flower senescence. Both GE and EG treatments improved flower diameter and weight, and GE treatment delayed the time of flower weight decrease. Besides, GE delayed climacteric ethylene evolution for 8 hours. All above suggest that exogenous sugars delay tree peony 'Luoyang Hong' cut flower senescence and extend flower vase life through their roles in the decrease of water loss and the suppression of sensitivity to ethylene and ethylene production.
An experiment was carried out to find out effective heading date and period of limited ripening in different regions of climatic conditions by sowing date and length of nursery stage of a new variety Milyang 23. Since varieties of Tongil line have a character of premature heading, these do not show the symptom of senescent even though length of nursey stage was delayed. And the delay of heading date is due to late transplanting date, on the other hand, length of nursery stage delayed.
Purpose: Most clavicular fractures can be healed by conservative treatment, although there are many factors that influence healing. The aim of the present study was to analyze factors that influence (i) bone union of midshaft fractures of the clavicle treated conservatively and (ii) bone functioning, after union. The long-term goal was to determine which treatments are adequate. Materials and Methods: We evaluated factors that have an effect on bone union and bone function after union. We evaluated age, fracture site, comminution, displacement, shortening and other factors. Among 523 clavicular midshaft fractures that presented between January 2004 and Jun 2009 at our Department of Orthopaedic Surgery, we identified 270 who had conservative treatment and 173 patients who had surgical treatment. Results: The period required for bone union increased with the degree of displacement. For the group below 12 years of age, and the group without comminution, it took half the time to achieve bone union compared with the other groups. Displacement mostly occurred within 2 weeks after conservative treatment. Conclusion: In patients with a comminuted clavicular midshaft fracture, we might, because of expected delays in bone union, delay the start of rehabilitation until patients are more than 13 years old. Because the degree of displacement may be increased within 2 weeks during conservative treatment, we can think about surgical treatments.

Knowledge of the degree of yield reduction due to water stress at different crop growth stages in rice production is important for rational scheduling of irrigation during periods of insufficient water supply. Previous studies to determine the degree of yield reduction duo to water stress suffered from interruptions by rain during experiment. Also the findings did rot relate the degree of water stress to the soil water potential and water deficit status of rice plants. In this study, two years experiments were conducted using the high yielding rice varieties, an Indica x Japonica (Nampoong) and a Japonica variety(Choochung). These were grown in 1/200$^{\circ}$ plastic pots placed under a rainfall autosensing, sliding clear plastic roof facility to control rainfall interruptions. The results obtained were as follows. 1.The two varieties differed in the growth stage most sensitive to water stress as well as the degree of yield reductions. When rice plants were stressed to the leaf rolling score 4 and soil water potential of about - 20 bar at major crop growth stages which included heading, booting, non-effective tillering, panicle initiation and early tillering stages, the yield reductions in the Indica x Japonica variety were 58%, 34%, 27%, 22%, and 21%, respectively, whereas in the Japonica vairety they were 23%, 36%, 1%, 13% and 22%, respectively. This result show that the recommended drainage during non-effective tillering is valid only for the Japonica variety. Sufficient irrigation at booting, heading and early tillering stages are necessary for both varieties. 2.The two varieties showed visible wilting symptoms when the soil water potential dropped to about - 3.0 bar. The Japonica variety showed more leaf rolling than the Indica X Japonica. However, it had a higher retention of leaf water content and greater stomatal diffusive resistance. When the soil water potential dropped, the Japonica variety showed leaf rolling score (LRS) 1 at 0 soil-5. 0 bar and LRS 2 at 0 soil -6.0 bar while the Indica X Japonica showed LRS 1 at 0 soil - 5.5 bar and LRS 2at 0 Soil - 9.0 bar. The stomatal diffusive resistance was maximum at the second top leaf blade in both varieties at intermediate water stress of 0 soil - 4.5 bar. 3.The number of days that was required for the soil water potential to drop to-3. 0 bar and to - 20.0 bar after drainage of irrigation water from the 20cm deep silty clay loam soil in the pots were 6 and 13 days, respectively for booting stage, and 7 and 11 days, respectively for heading stage, 9 and 12 days, respectively for panicle initiation stage, and 12 and 19 days, respectively for early tillering stage. 4.Water stress during the early tillering stage recorded the longest delay in beading time, the largest reduction in panicle numbers and a substantial yield decrease of 20%. This calls for better water management to ensure the availability of water at this stage, particularly during drought periods. In addition, a reexamination of the conventional inter-drainage practice during the non-effective tillering stage is necessary for the high yielding Indica X Japonica varieties.
