The Publicness of Public Institutions: Case Study on the Korea Medical Dispute Mediation and Arbitration Agency (공공기관의 공공성 이행 검토: 의료분쟁조정중재원 사례를 중심으로)

  • Background: Based on the fact that the Korea Medical Dispute Mediation and Arbitration Agency is a public institution established by social demands for medical disputes, this study reviews the publicness of public organization and discusses its policy implications. Methods: Through Moore's strategic triangle, which consists of legitimacy and support, public value and operational capacity, the process of creating public value is examined. For the analysis, case studies were conducted using related literature data from 2012, when the agency was established, to the present. Results: As a result of the analysis, first, the related law examined in the operational capability has been revised dozens of times, but the revised law has its own contradictions and limitations. The human resource system is also being improved, but there is a problem with the fairness and reliability of the arbitration process, especially due to the limitations of the appraiser system. Second, in terms of legitimacy and support, a regional gap occurred despite efforts to improve accessibility through the expansion of the organization. And the arbitration agency failed to reconcile conflicts caused by stakeholders' perception of each other as a trade-off relationship. Third, the public value result shows that, despite many explicit (statistical) achievements, citizens' use of the past dispute resolution means (litigation) has not decreased. Likewise, the perception of value makers (citizens) is important for creating public value as an invisible result, but it has not yet been formally investigated, so the performance can not be recognized. Conclusion: While the organization's efforts for continuous change and improvement are encouraging, it is not perceived as a better means of resolving disputes and improving quality of services. Therefore, it is necessary to reconsider the institutional design centered on value creators.

  • This paper attempts to examine the changes in China's naval strategy and to analyze the goal, range, and method of each strategy during the Xi Jinping's era. Since the founding of New China, the People's Liberation of Army Navy(PLAN) has made four changes in the naval strategy. Under Xi Jinping's administration, China's naval strategy is far seas operation combined with near seas active defense. Now, China's naval strateg y is shifting from a defensive to an aggressive one, increasing the proportion of offensive weapon systems and the number of state-of-the-art warships, and the scope of the naval strategy has been specified in the second island chain including the Indian Ocean. With the changes of naval strategy, the PLAN will set a new strategic goal to secure maritime dominance and implement an assertive strategy to actively respond to the intervention and intrusion of external forces. Moreover, the PLAN will also improve its sea-based deterrence force and the maneuver force to block other countries in the long-distance maritime conflict zones. The operation method of China's future naval strateg y will gradually shift from 'interdiction' to 'rapid-response.'

  • This study began with the question of obtaining human resources through the promotion of outstanding resources of the Special Forces Officer and studied the following four promotion strategies: First, it is Facebook's promotional strategy medium. Second, it is a promotional strategy medium of YouTube. Third, it is a promotional strategy medium for blogs. Fourth, it is a public relations strategy medium for Web site. Furthermore, we would like to consider this study through four promotional strategies and cases of acquiring excellent foreign personnel in order to acquire excellent non-commissioned officers. Therefore, it is necessary to obtain excellent resources through promotional activities by utilizing strategic intermediaries for obtaining excellent resources from special forces. Ultimately, this study can provide fundamental implications for recruiting special forces officers for obtaining excellent resources by utilizing strategic intermediaries.

A Study on the Reasonable Choice and Utilization of Incoterms 2020 Rules from the Perspective of Logistics and Supply Chain Management

  • Purpose - This paper has an objective to suggest reasonable criteria in choosing Incoterms 2020 rules for efficient and effective logistics management in that the Incoterms rules affect not only the rights and obligations of the parties to the sales contract but also the control and management of logistics system and transaction costs in the transaction. Design/methodology - An analysis of the various factors is needed to assess the positive or negative impact on global value chain in choosing Incoterms rules from a total logistics view. This study analyzes the impact of which the content of individual incoterms rules can have on the operation of international logistics systems under the global value chain from a strategic perspective to suggest reasonable criteria for selection of Incoterms rules depending on the transaction situation. Findings - Results of this study shows that consideration of various aspects which includes the characteristics of the products, logistics capabilities, infrastructure, transaction volume, operational cost, customs regulations, tax and accounting should be reflected in choosing the appropriate Incoterms rules. Therefore, in order to minimize the total cost and improve logistics performance, it may be helpful to develop a decision support model which allows users to select appropriate Incoterms rules based on various influencing factors. Originality/value - This Study is different from previous research which has mainly focused on the rights and obligations of the parties to the transaction regarding the transfer of risks and costs under the Incoterms. In addition, this study has significance in that it provides implications for export and import companies that can be able to use Incoterms as a strategic tool to efficiently manage the global value chain and improve supply chain performance.

Business Model Innovation in the R&D Service Sector: A Case Study of Automobile R&D-service Firms (연구개발서비스업에서의 비즈니스모델 혁신: 자동차 연구개발전문기업의 사례 연구)

  • The rates of technological innovation and environmental change as well as market competition have recently accelerated, which makes it difficult for firms to satisfy the needs of their customers through existing product innovation or limited services. Some firms have attempted to find the solutions to this problem by conducting business model (BM) innovation. This study reviews the theoretical discussion to BM innovation and suggests propositions concerning the necessity of BM innovation and conditions of successful BM innovation. Furthermore, the study examines the applicability of the propositions and draws strategic implications by analysing the cases of two world-wide leading firms, AVL and ETAS, in the automobile R&D service sector. In particular, the study investigates how the firms with technological competence in the R&D service sector obtain market performance through BM innovation. Results of this study show that the case firms recognize the necessity of BM innovation based on product (or technology)-service fusion to effectively propose customer value and create corporate profit. Also, the firms exploit firm-specific complementary assets for successful BM innovation. This paper contributes to the literature of innovation management by promoting academic discussion concerning BM innovation in Korea and suggesting strategic implications for further development of R&D service sector and related firms in Korea.

A Study on the international case studies for SEA follow-up (전략환경평가 사후관리 해외 사례 분석)

  • This study analyzed international case studies on Strategic Environmental Assessment (SEA) follow-up and suggested implications based on the study's findings to aid implementation of SEA follow-up in Korea. SEA requires follow-up in order to identify unforseen adverse effects and enable appropriate remedial action to be taken. Tool kits and methodological framework for effective SEA follow-up are only being researched recently. Based on the study's findings, following implications for implementing SEA follow-up in Korea were drawn. First, the system of carrying out SEA follow-up would be different depending on the PPP topic. During the scoping stage, significant impacts should be identified according to the PPP topic, and thus help determine the indicators to be developed in the later stage. Secondly, responsibility, method, time, intervals and actions from SEA follow-up may vary depending on the target SEA consultation. Thirdly, the indicators of SEA follow-up may be considered together with various environmental standards and current political, social and economic indicators which are a big issue in society. Fourthly, SEA follow-up can be used as an integration system of its target planning and environmental planning. Finally, SEA feedback system should be needed. The result of SEA follow-up should be used for target PPP. These would lead to improvements to the target PPP. If SEA follow up is successfully implemented and actively carried out for domestic PPPs, Korea can be a step closer to realization of sustainable development.

Case Study on Decision-Making Process for M&A in Small and Medium Companies (중소기업 M&A 의사결정 과정에 관한 연구)

  • Purpose - A rapidly changing business environment places great demands on small and medium-sized enterprises (SMEs). These SMEs need to find strategic alternatives for continued growth and, ultimately, survival. Thus, mergers and acquisitions (M&A) are deemed an acceptable solution. Research to date has dealt with M&A in major organizations and focused on post merger integration (PMI). Our study focuses on SMEs, as they are relatively new and unknown to the public. Therefore, this study highlights successful M&A and decision making for SMEs through a case study analysis. Research design, data, and methodology - For this study, we examined an M&A case between company S, which produces cell phone parts, and company P, which produces SSD cases. We reviewed theories and previous studies in M&A literature. We comprehensively examined the decision-making procedure at each M&A stage, describing the situation of the buying company and the selling company from the period of the M&A announcement through deal completion. In addition, we conducted interviews with both companies. The data regarding this case study were collected through interviews with managers of both companies who actively participated in the M&A process. When necessary, we asked them about additional relevant information during the interviews. Results - The result of the M&A between company S and company P was deemed acceptable with the exception of the long negotiation period. However, company S was not able to prepare for PMI after the acquisition due to a controversy over acquisition values. Moreover, the employees of the newly formed company, especially those who came from company P, complained about the M&A and attempted to leave. Thus, implications for successful M&As of SMEs are as follows: First, the procedural compliance of the M&A is needed. Second, support is needed from the CEO for the working group, rather than excessive intervention during due diligence. Third, the right, talented members of the organization should be part of the process of the M&A. Fourth, the use of various types of outside expert or business consultants is needed. Fifth, the strategic intervention by Human Resource managers is required. Last, sharing M&A information among employees is important as information dissemination will help employees be more receptive to such a change. However, this study has several limitations as a single case study; more varied SME M&A case studies are needed in order to generalize the results of the study. Conclusions - Most of the research dealing with M&As has focused on major companies and PMI and neglected SMEs. Thus, our study focuses on SMEs and the decision-making procedures for M&A. This study has significantly contributed to the literature in this area and has provided practical information around the implications of sound decision-making during M&As. Specifically, the results of the study contribute to the need for research on M&A among SMEs, which to date has often been neglected as a topic of choice.

Implications on the Technical Level of Industries and Industry-Academia Cooperation in Chungbuk Province (충북지역 산업체 기술수준과 산학협력에 관한 시사점)

  • In this study, the technical level and competence of Chungbuk region manufactures were diagnosed and implications for efficiency improvement of cooperation with local universities were derived. The results are as follow. First, in Chungbuk area, 75% of the skilled workers are medium-skilled and high skilled workers. And the life cycle of production products was found to have entered middle/old age. In addition, the industries were overestimating its technology capabilities, including marketing and sales technology, and management technology. Therefore, local universities should develop differentiated program such as technology transfer and commercialization support so that companies can nurture new industries and it is necessary to improve understanding of reality and future prediction ability through various education and seminars. Second, universities in Chungbuk province have failed to meet the practical demands of industry by providing general educational programs such as lifelong education curriculum, rather than the practical training required by industry. First of all, industries needed the practical training programs such as human resource empowerment, technical education and workers' retraining for local industry development. In addition, industries were expected to provide relevant knowledge and infrastructure such as testing, analysis, participation in technology development such as commissioning and joint research. Therefore, universities should prepare customized Industry-Academia Cooperation Programs through industry demand survey in planning. Also, it is necessary to establish various connection points with industry to ensure that industry-academia cooperation will continue and achieve results. Third, the technology of the industries in Chungbuk province was found to be very unrelated to the next generation regional strategic industries. This is not shared vision between industry and local government, Industry-Academia Cooperation Programs will serve as a platform to organize various community entities. Universities will be able to play a key role in between industries and local governments.

Strategic implication of an injunctive relief in global IP lawsuits: based on the Samsung vs. Apple litigation in the US (창조경제시대 글로벌 지식재산소송의 기업 전략적 함의에 관한 소고: 삼성-애플 미국 소송의 침해금지명령을 중심으로)

  • As creative economy gets attention, the capabilities of transforming creative ideas into intellectual property and utilizing it commercially have become important than ever before. Korea is lack of the capabilities of utilizing intellectual property compared to those of accumulating it. This paper focuses on the strategic implication of an injunctive relief, which has a far-reaching impact on firms' business strategies as well as national industrial competitiveness because losers in lawsuits are expelled from markets. It analyzes the Samsung-Apple global IP lawsuits about smartphones and tablet PCs, which have expanded into 9 countries since 2011 when the Apple filed the IP lawsuit against Samsung in the US for the first time. In particular, this paper analyzes the requirements to get the permanent injunctive relief in the lawsuits of intellectual property from reviewing the ruling in the court of the US in 2012 and draws some implications from the perspective of business/industrial strategies. This paper has some limitations in that the lawsuit are still ongoing and it is the first attempt to find out the clue that connects legal and strategic issues in the rulings. Regardless of the limitations, however, this paper expects to contribute to raising the issues as to the importance of harmonizing the capabilities of managing technology with law, in order to survive under the era of creative economy.

  • In order to create a successful regional development model, there should be an effort to foster a strategic industry which boosts a geographical features of rural areas. Because, It must be clear that the strategic industry chosen between choice and concentration of the development of the local industry development which boosts the local economy revitalization. The local government should have continual concern and roles to fulfil political subjects and keep estimating about the possibility that there could be the sustainable development by Task Ahead of the local industry. This study's indicators were established for the adequacy evaluation of the industrial policy by focusing on domestic regional development's success example. Next, Conjoint analysis was conducted on the Experts. On the basis of this analysis, the weights of indicators are derived. And this study suggest the reasonable evaluation system to take Sustainable industry plan of regional strategic. Consequently, 'Regional development' sector separate 3 categories which are 'Local economy', 'Human Resource Development', 'local marketing' and 9 indicators were derived. 'Industrial development' sector derived 9 indicators about 'Construction of infrastructure', 'Technical development' and 'business support'. Looking through the implications of this study. First, the problem needed to be supplemented based on the Diversity and concreteness of Evaluation system when government assesses regional industry development policy. Second, local government have to strategically consider the possibility of convergence between industries and easiness of network in a broad region. Finally, Foundation and support of the professional manpower and companies for the regional industries must be established.
