Technological importance and breadth of standard essential patents: A comparison between practicing and non-practicing entities for mobile telecommunication technologies

  • Using 23 867 standard essential patents claimed for three different wireless telecommunication standards (GSM, WCDMA, and LTE), this research examined the difference in technological importance and breadth of patents between practicing and non-practicing entities. We discovered that compared to manufacturers and service providers, organizations who do not appropriate innovation-derived profits directly from product or service markets tended to have relatively low-quality but broadly scoped technologies for the claimed standard essential patents. These relationships between the characteristics of inventions and the organizational types were consistently held across different generations of wireless standards as indicated by regressions run for each sample split by generation. Furthermore, the theory and policy implications of our results and arguments are presented herein.

  • As Shapiro and Varian argue the open approach generates bandwagon effects and facilitates the diffusion of a standard thanks to network externalities. However, the open approach is not linked automatically to economic benefits as suggested by some famous cases as the IBM PC history. On the contrary, the closed approach enables a tight control over a technology and its development, and insures the appropriation of economic benefits. As Shapiro and Varian suggest, a firm can also decide to mix an open approach with tight control over improvement or extentions. Patent pool is to offer fair, reasonable, nondiscriminatory access under a single license to patents that are essential for the use of standards-based or other platform technologies. patent pool offers only one license to everyone, Since each patent is essential, the royalty rate and thus the value is the same whether a licensee uses one or more patents.

  • Patent information, which is generated under a specific, objective rule for a prolonged period of time, has the properties of technology, right, and management. Because of these characteristics of patents, patent analysis is used to identify R&D capacities and performances, and management strategies of a given nation or enterprise. In this paper, we analyze LTE essential patents which are key IPRs for implementing standardized LTE technology and major weapons in a global patent war. Also, we discuss the status of standard patent data, main applicants and standardization trends based on declared in ETSI standard patents. Especially, we analyzed 15,073 patents data which are possible to analyze patent information.

  • It is very essential issue in industrial advancement and company survival for international standard body to adopt standards including ICT that domestic company or our country owns. Also, advanced countries fiercely contest in order to include domestic technology in international standard and make every effort to secure essential patent relating to core and basic technology in international standard. In this circumstances, it is necessary to develop standardization strategies and take systematic approaches in an attempt to upgrade our country to strongly knowledge-based country in 21th century and achieve a leading position in ICT market. Therefore, this paper will suggest systematic and comprehensive approaches from planning of technology development to securing essential patent of international standard and have the purpose of making standardization base as well as promoting international standardization of domestic technology.

  • Intellectual property (IF) is essential to standards development although countervailing interests among stakeholders can sometimes undermine trust and inhibit progress. A consequence of slow or non-existent standards development is the loss of potential markets that can emerge only with an internationally recognized standard. Standards developing organizations (SDOs) can enable new markets by ensuring fairness and trust in their venues. The IEEE Standards Association (IEEE-SA) is an SDO that has defined specific steps to facilitate this outcome by means of its internationally recognized patent policy. This paper will describe the underlying principles that guided the creation of IEEE-SA' s policy; highlight five of the major elements of the policy; and suggest a process for integrating IF into standards so that IF stakeholders, in conjunction with standards developers, might agree to meet certain expectations in order for the standards-making process is to be successful and encourage market development.

  • 표준특허란 표준문서의 규격을 기술적으로 구현하는 과정에서 필수적으로 적용해야 하는 특허로서, 최근 선진국은 "R&D-특허-표준화의 연계"를 강화하고 있고 글로벌 기업 또한 표준과 연계한 특허 획득에 주력하고 있다. 우리나라 또한 기술선점, 시장지배력 및 경제적 파급효과 등의 표준특허 확보의 중요성을 인식하고 있고, 정부와 정부부처의 산하 연구기관을 중심으로 표준특허 관련 법 제도 등의 관련연구가 진행되고 있다. 그러나 표준특허 분석결과만이 연구결과로 공개되고 있을 뿐, 실제로 표준특허 선별을 위한 정형화된 기법은 전무한 상태이며 분석방법론 관련연구 또한 매우 미미한 상태이다. 따라서 본 논문은 형태학적 특성에 기반을 두어 표준과 특허문서 간 유사도를 측정하고, 측정된 유사도를 분석하여 신뢰성 있게 표준특허를 선별하는 방법을 제안하고 그 적용사례를 분석한다.

  • Recently, there is a growing interest in technical standardization all over industry, it is very important for survival in the global market to secure standard patent in almost all of company. Technology in construction industry is essential for quality of people's life and have large impact on national economy development. However, there is lack of investment and low interest in technical standardization in construction industry in comparison with another industries. Therefore this study aims at developing strategies for activating the standardization in construcion technology. Specially, this study carries market analysis and case study for domestic construction R&D Cases. Then, a structured survey and analysis is performed for standardization in construcion technology market to suggest alternative to secure national competitiveness.
