전자상거래와 전자무역은 시간과 공간을 초월하는 사이버세계에서 수행되기 때문에 전통적인 상거래방식에 의하여 적용되는 법률과 제도만으로는 새로운 형태의 e-비즈니스 환경에 적용하기 어렵다. 따라서 전자게약, 운송서류의 전자문서화, 전자결제 등에 이용하기에는 많은 문제점을 해결하기 위하여 WTO, OECD, UNCITRAL, APEC, 국제상업회의소(ICC) 등과 같은 국제기구에서 전자상거래 활성화를 위한 방안을 모색하고 있다. 그 중에서 대표적인 것이 전자상거래에 관한 UNCITRAL모델법과 미국의 통일전자거래법(UETA) 및 통일컴퓨터정보거래법(UCITA) 등이 있다. 이와 같은 상황하에서 국제적으로 전자계약 관련 국제규범의 정립, 전자식 운송서류의 활성화 및 글로벌 전자결제시스템 개발 등이 이루어져야 하며, 국내적으로도 전자계약법제의 도입, 디지털재화와 관련된 거래법 제정, 전자유각증권의 발행과 유통과 관련된 법률제정 및 전자자금이체법의 제정 등이 이루어져야 할 것이다.
LNG 저장탱크는 초저온($-162^{\circ}C$)의 액화천연가스(LNG)를 저장하는 시설로서 안전성이 크게 요구되는 시설물이다. LNG를 저장하는 내조에 문제가 일어나 LNG 누출이 발생했을 경우를 대비하여 종래에는 LNG 저장탱크 외부에 방류둑을 설치하게 되어 있었다. 하지만 이는 부지 활용도를 떨어뜨리고 저장탱크 건설비를 증가시키는 등의 문제점이 있어 근래 들어 저장탱크 벽체를 초저온에 견딜 수 있는 구조로 바꾸는 완전방호식 저장탱크를 제작함으로서 방류둑 설치를 하지 않고 있다. 탱크 벽체를 초저온에 견딜 수 있는 구조로 만드는 방법은 크게 두 가지가 있다. 하나는 초저온에 견딜 수 있는 철근을사용하여 LNG 탱크 벽체 콘크리트를 제작하는 방법이며 다른 하나는 LNG 탱크 벽체 콘크리트 내부 표면에 초저온에 견딜 수 있는 스프레이 폴리우레탄 폼 등의 제품을 적용하여 내조로부터 LNG의 누출이 발생하여도 콘크리트 표면온도가 정해진 기간 동안 일정 온도 이하로 낮아지지 않도록 하는 방법이다. 최근 국내에 서 건설하는 모든 LNG 저장탱크는 경제적이고 적용방법이 간단한 스프레이 폼을 사용하여 LNG 저장탱크 벽체의 저온 안전성을 강화하고 있다.
인터넷과 전자문서교환(EDI) 같은 각종 정보통신망을 기반으로 이루어지는 국제적인 전자상거래의 구현을 위하여 OECD, APEC, UNCITRAL, IEC, ITU, UN, UNCTAD 등의 여러 국제기구에서 활발한 움직임을 보이고 있다. 특히 최근에서는 다자간 무역체제인 WTO차원에서 전자상거래의 발전과정에 대한 논의가 활발하게 논의되고 있다 본 논문에서는 주요 국제기구와 WTO에서 논의되고 있는 전자상거래 관련 쟁점이슈들을 분석하고 향후 논의과제를 통하여 우리의 입장을 제시하는데 그 목적이 있다.
The increasing use of performance-based approaches in structural fire engineering design of multi-storey composite buildings has prompted the development of various tools to help quantify the influence of tensile membrane action in composite slabs at elevated temperatures. One simplified method which has emerged is the Bailey-BRE membrane action method. This method predicts slab capacities in fire by analysing rectangular slab panels supported on edges which resist vertical deflection. The task of providing the necessary vertical support, in practice, requires protecting a panel's perimeter beams to achieve temperatures of no more than $620^{\circ}C$ at the required fire resistance time. Hence, the integrity of this support becomes critical as the slab and the attached beams deflect, and large deflections of the perimeter beams may lead to a catastrophic failure of the structure. This paper presents a finite element investigation into the effects of vertical support along slab panel boundaries on the slab behaviour in fire. It examines the development of the membrane mechanism for various degrees of edge-beam protection, and makes comparisons with predictions of the membrane action design method and various acceptance criteria.
블록 TTG를 이용한 교각국부세굴보호공의 적합성과 유효성을 확인하기 위해 수리모형실험을 통해 모형 블록의 조도계수를 확인하고 안전성을 검토하였다. 현장조건을 대표하는 수리학적 조건하에서 개별 블록과 블록을 연결하여 매트화한 경우의 한계 안전중량을 결정하였다. 사석, 돌망태, TTG의 세굴보수공 성능을 비교한 결과 TTG의 안전성이 가장 우수하였다. 하상재료의 유출을 막기 위해 블록의 중간 부분을 적정한 자갈로 채우고, 토목섬유의 설치 여부를 검토하여야 한다.
Since enactment of the Product Liability Act(PLA) on July 2002, Enterprises in Korea should be insured the Product Liability under the Act. Therefore they had to make a special team and organize it to match with the Act. However, some enterprises didn't follow and prepare the team for the dispute resolution. For example, in America, many enterprises had been attacked the PLA and in Japan, as well. but Korea is rare for the PLA. Thus, this is to research the PLA for protecting the disputes. Upon this study, 1 would like to suggest some issues and a revision of the PLA. Those are the purpose of my research. In this study, it consists of 5 chapters for achieving the purpose of the research. Introduction of this study is mentioned in Chapter 1, and Chapter 2 is for outline of the PLA in Korea. At Chapter 3, the cases are analyzed in the disputes of importers to address important things we have to check. After the analysis, resolution methods in general on import practices are suggested at Chapter 4. Also, this study is summarized at Chapter 5 including further research. In this research, 1 find out complex of Product Liability insurance and issues related with PLA. For protecting the issues and disputes; importers should prepare a agreement of arbitration during the preparation of contracts. Nothing can be better than prevention on any disputes, but they can be happened sometimes without any intentions or by mistake. Solving these issues, the resolution methods of this research are the most valuable. The mediation and the negotiation do not force any legal matters. So, the dispute through them does not have a positive resolution, and the effectiveness of them is very low. Due to the resolution of issues, arbitration is a desirable resolution. In Korea, most people do not know about the arbitration due to the lack of understanding of arbitration. Currently arbitration related with Product Liability has not been followed up promptly because procedures and judgement from a court take for a long time. In sum, in order to solve the disputes properly, they should be supported by the arbitration system to concrete essential objectives, so to speak, protection of the victim and the improvement of arbitration. In addition, the systematic arrangements would be required to carry out all the methods above mentioned. Those are for manufacturers, importers, and customers for the dispute resolution.
Through this research, the current state of naval coordination and guidance of shipping is reviewed whereupon which a suggestion is made for a novel role which satisfies the needs of the people and the country asked of the Navy. Taking into consideration the dynamic security environment, the developing relationship between the two nations on the Korean peninsula, and the influence that the Republic of Korea has on maritime security, it is made more urgent that the Navy takes a proactive course of action in terms of naval coordination and guidance of shipping. The current form of Korean naval coordination and guidance of shipping is adapted from the logical and flexible concepts of NCAPS and NCAGS and is one of many tasks that the Republic of Korea Navy must perform. However, when the Republic of Korea Navy develops blue-water capabilities with the ambitions of protecting its people and their way of life, naval coordination and guidance of shipping could potentially become one of the primary functions of the Republic of Korea Navy that the it must champion. Already, there are indications that foreign navies are, through many developments and commitment towards naval coordination and guidance of shipping, protecting its people and states' interests wherever is necessary. In the case of Chile, its Navy has taken the helm of naval coordination and guidance of shipping and has integrated various maritime organizations including the coast guard and the National Customs Service for the sake of maintaining regional maritime security, showing immediate force if necessary. Presently, as the Republic of Korea Navy looks to be a global naval power, it is important that a reprioritization of the Navy's mission is undertaken, all the while sustaining military readiness posture on the Northern Limit Line. It cannot be any more emphasized how crucial thorough military readiness posture is as a natural stance against the enemy. That being said, contributing towards international maritime security is consistent with the nation's standing. It is a fact that maritime security has been conceptualized and developed merely as a study within the Ministry of Maritime Affairs and Fisheries, the Republic of Korea Navy, and other governmental organizations, forces, and academia. Naval cooperation and guidance of shipping suggested by this research as a practical operational field is a concrete solution to what once was an abstract concept. To stand firm on its status as a maritime nation, the Republic of Korea must establish a Maritime Security Organization within its Navy and develop the appropriate doctrines. Attaining experts, developing doctrines, and cultivating the capability to deploy maritime forces will allow for the Republic of Korea to execute a primary role in keeping international maritime security and naval coordination and guidance of shipping. To fully achieve its latent potential necessitates the Republic of Korea Navy to expedite the introduction of naval coordination and guidance of shipping concepts and to establish the appropriate doctrines, operation plans, and organizations.
이 연구에서는 화학적 열화 및 생물학적 열화에 노출된 콘크리트의 보호를 위해 개발된 글라이코 캘릭스(glycocalix) 코팅재의 응결속도 및 압축강도 발현에 대한 실리케이트계 급결제 혼입의 영향을 검토하였다. 글라이코 캘릭스 코팅재의 적용처에 따라 제안된 단면 뿜어 붙이기용 및 라이닝 공법용 코팅재 배합에서 실리케이트계 급결제의 첨가량을 10mL/L, 25mL/L 및 40mL/L로 변화하였다. 글라이코 캘릭스 코팅재의 경화속도는 박테리아 고정화 재료 양에 의해서도 영향을 받았는데, 40mL/L의 급결제를 첨가한 단면 뿜어 붙이기 및 라이닝 공법용 배합의 종결시간은 각각 80분 및 318분이었다. 급결제를 첨가한 글라이코 캘릭스 코팅재의 강도 발현은 급결제 첨가량이 증가함에 따라 일반 코팅재에 비해 낮은 결과를 보였다.
Seven male Himalayan tahrs were strongly assumed to have accidently fed on foreign bodies in 2007. At the time, zoo caretakers witnessed missing fence padding, such as carpet, plastic awning, and ropes. The incident occurred the morning after the items had been set up to protect indigenous, wild long-tailed gorals from self injury caused by head butting the steel fence. Adult male Himalayan tahrs were obviously suspected of mostly eating the paddings mainly composed of carpet, thin and long plastic awning, and ropes. Even though they had not shown digestive problems, surgery was determined necessary in order to remove any indigestible foreign bodies. Left flank rumenotomy was conducted on seven male Himalayan tahrs from April to May, 2011. After anesthesia with xylazine, rumenotomy was performed on a concrete floor, with legs and head secured by ropes. No access to water and hay prior to operation for two days was needed to make the surgical procedure done quickly. Two sheets of small hand towels protecting against inflow of ruminal contents were beneficial during surgery. Antibiotics were administered intramuscularly for seven days. No abscesses at the surgical site were found after surgery. Like domestic ruminants, wild ruminants also ingest metalic or non-metalic, indigestible foreign bodies by accident. Therefore, simplified rumenotomy must be developed to apply to those wild animals to lengthen their longevity and to advance the quality of life in captivity. This case report is the first showing how to perform rumenotomy of Himalayan tahr, a wild ruminant, in Korea.
This thesis has studied about the legal characteristic of injection of the trial drug, the position of the pharmaceutical firm as a contractor of the clinical trial, the possibility of compulsory performance of consistent injection of the trial drug, and the damage claim caused in the process of the clinical trial from the viewpoint of protecting the trial subject in the clinical trial. According to court's judgement in the United States, the lawsuit of the trial subject, although the trial subject had expected consistent injections, was dismissed because there was no direct contract between pharmaceutical and trial subject. However, Helsinki Declaration prescribe the medical research as follows. 'All patients who participated in the research should be able to use the best precaution, diagnosis, and treatment proved by the final outcome of the research'. The trial subject is entitled to demand only the pharmaceutical firm which developed and provided the trial drug, and the pharmaceutical firm has the obligation to supply the trial drug to the trial subject. Therefore, it would be not enough to protect the trial subject if the pharmaceutical firm which makes the trial drug is ruled out. In addition, especially, in case the trial drug has a constant effect with the aim of treatment, if the injection of the trial drug is suddenly stopped, the trial subject would not have the benefit of treatment by the trial drug. In this case, the best remedy against the damage is to urge a constant injection of the trial drug. Thus, in certain case, it is reasonable to consider that the pharmaceutical firm has the obligation to supply the trial drug to the trial subject constantly, and it is also necessary to compel it through effective means in case the pharmaceutical firm do not fulfill its obligation to supply the trial drug. However, as an essential prerequisite for the assertion mentioned above, it should be judged under the principle of good faith considering the concrete situation, that is, what roles the pharmaceutical firm has played.
