FIDIC의 EPC/Turnkey 프로젝트용 표준약관(標準約款)에 관한 연구(硏究) (A Study on the FIDIC's Conditions of Contract for EPC/Turnkey Projects)

  • The EPC/Turnkey Contract goes to the extreme in allocating risks to the contractor and depending on the types of project, this may be regarded as unacceptable. It has also gone to the extreme in the extent to which the contractor is responsible for the specification and design of the Works. The employer is not responsible for correctness of any information provided by him nor for correctness of any specification or other matter included in the Employer's Requirements, except the definition of the intended purpose and criteria for testing and performance. With such conditions it is surprising that the employer is entitled to interfere in the contractors performance to an extent that is close to what is norm for a construction contract with employer design and with normal risk allocation. The combination of risk allocation and inappropriate administrative provisions makes the EPC/Turnkey Contract a document that will meet severe resistance from contractors. It is also likely that employers will see the risks and difficulties from their own perspective. It is a fiction that the EPC/Turnkey Contract will give the employer a contact with a certainty of final price and completion date. It is not a fiction that the EPC/Turnkey Contract carries many seeds for disputes between the parties. The Orange Book has become an accepted document even if it clearly contains some weaknesses. Some of these have been corrected in the Plant Contract. In my opinion FIDIC should let users become more familiar with the Plant Contract as a follow up to the Orange Book.

시공책임형 CM의 국내 공공부문 도입을 위한 제도적 기반 수립 연구 (Institutional Research for the Introduction of Construction Management at Risk in the Public Sector)

  • 국내 건설산업은 시공자 중심의 일방적인 생산방식에서 발주자와 시공자의 협업이 가능한 생산방식으로 변화하는 과정에 있다. 발주 방식에 따라 입·낙찰 방식, 계약 방식, 그리고 발주자의 사업 관여 정도도 달라질 수 있다. 본 논문에서는 국내 환경에 적합한 '시공책임형 건설사업관리' 도입을 위해서 국·내외 제도 분석과 입·낙찰 프로세스 분석, 계약이행 및 관리 분석, 사후관리 분석을 하고, 법제화를 위한 관련 법령 조문화와 제도의 효율적 운영을 위한 방안을 제시하고자 국·내외 시공책임형 건설사업관리의 제도 및 사례분석을 실시하였다. 건설산업기본법에 정의된 '시공책임형 건설사업관리'는 Pre-Con 업무를 수행하는 용역계약인 본 계약 이전 계약과 건설사업관리 및 공사계약인 본 계약으로 구분된다. 그러므로 '시공책임형 건설사업관리'는 해외의 사례와 같이 낙찰제도가 아니라 발주 방식의 하나로 보아야 하며, 도입을 위해서 설계/시공 일괄입찰, 기술제안 입찰과 동등한 입찰제도로서의 법제화가 필요하다. 국내 환경에 적합한 '시공책임형 건설사업관리' 도입을 위해서 국·내외 제도 분석과 입·낙찰 프로세스 분석, 계약이행 및 관리분석, 사후관리 분석을 하고, 법제화를 위한 관련 법령 조문의 개정과 제도의 효율적인 운영을 위한 방법을 본 제도의 본래 장점은 유지하면서 국내 시장에서 적용이 가능하도록 제시하였다.

Finding Significant Factors to Affect Cost Contingency on Construction Projects Using ANOVA Statistical Method -Focused on Transportation Construction Projects in the US-

  • Risks, uncertainties, and associated cost overruns are critical problems for construction projects. Cost contingency is an important funding source for these unforeseen events and is included in the base estimate to help perform financially successful projects. In order to predict more accurate contingency, many empirical models using regression analysis and artificial neural network method have been proposed and showed its viability to minimize prediction errors. However, categorical factors on contingency cannot have been treated and thus considered in these empirical models since those models are able to treat only numerical factors. This paper identified potential factors on contingency in transportation construction projects and evaluated categorical factors using the one-way ANOVA statistical method. Among factors including project work type, delivery method type, contract agreement type, bid award type, letting type, and geographical location, two factors of project work type and contract agreement type were found to be statistically important on allocating cost contingency.

  • A general practice in software ordering behavior in public sector has been an enormous obstacle standing in development path of Korea's software industry. Standard on software development cost estimation is supposedly based on Function Point, but in general, it is on headcounting (a number of people involved in a project). Moreover, it is difficult to change a contract in an on-going project, since statement of work is not precisely and carefully described. But it has a simple solution. Design and Implementation should be a separate project, as in construction industry, and both power and responsibility for design should be given to an expert with a national-level qualification. Here, there is a simple way for Korea to reborn as one of the strongest software country.

  • This paper presents a system called a Cash-flow based Construction Scheduling Optimization (CfSO). The existing CPM is biased on schedule and cost management. For a profitable and successful project management, the cash-flow which occurred actually by contractual conditions should be considered in the project scheduling. Therefore, this study provides a method to estimate the amount of a cash-flow occurred periodically by integrating the terms of contract into scheduling. The proposed methodology is implemented as a system prototype in Microsoft Excel. CfSO helps a site manager as a decision-maker to establish a optimized project scheduling and decide profitable contractual conditions against a construction owner.

A Basic Study on the Introduction of Professional Indemnity Insurance for Construction Project Managers

  • During the administration of a construction project, various types of participants are engaged in the project. From the design phase to the maintenance phase, these participants may confront many risks. To avoid these risks, participants should utilize an insurance company or a bond company. The types of risks and liability that a construction manager may face are listed in the construction law or contract. But there are some arguments related to risk transferring and the content of risks. For this reason, construction managers must carefully consider any possible risks in the contract and the construction law. Therefore, for construction managers to deal with risks appropriately, the introduction of a legal requirement to carry professional liability insurance, a defined compensation range for damages, a method of guarantee in the event of defects, a defined compensation claim period for damage, and a method of damage claim were suggested in this study.

해외 엔지니어링 사업의 리스크관리 성과분석 (A Performance Analysis of Risk Management for International Engineering Project)

  • 최근 들어 국내기업의 해외 엔지니어링 사업에 진출이 활발해지고 있다. 해외 엔지니어링 사업은 고부가가치 사업으로 EPC 건설사업에 비해 리스크가 적은 것으로 알려져 있지만, 국내기업의 해외 엔지니어링 매출수익은 그만큼 좋지는 않은 것으로 나타났다. 따라서, 본 연구에서는 해외엔지니어링 사업에서 많이 발생하는 리스크를 수주 전과 수주 후로 나누어서 분석하였다. 또한, 대상사업을 총액계약방식과 실비정산계약방식으로 나누어 계약방식에 따라 여러 가지 리스크의 차이점을 보여주었다. 마지막으로, 토목공종과 건축공종으로 나누어 리스크 차이를 분석하였다. 해외 엔지니어링 사업에서 발생하는 리스크를 다양한 각도로 분석한 본 연구는 산업체에게는 리스크 분석을 좀 더 실무적으로 참조할 수 있게 해주고, 학계에는 향후 좀 더 집중해서 연구해야할 엔지니어링 리스크 분야의 방향성을 제시해주는데 도움을 준다.

  • 최적 발주방식을 선정하는 것은 해당 사업의 성공적 수행을 위한 것이며, 이는 곧 사업의 목표를 달성시키는 것이다. 또한 사업특성에 적합한 발주방식의 선정과 사업의 성과는 밀접한 연관성을 갖는다. 이러한 취지에서 재정경제부는 2007년 10월 국가계약법시행령 개정을 통해 "기술제안입찰", "설계공모${\cdot}$기술제안입찰"이라는 발주제도를 새로이 도입하였다. 다양해진 발주제도를 효율적으로 운영할 수 있도록 하기 위해 본 연구는 공공건설사업의 특성을 정량적, 정성적으로 평가하여 해당 사업에 가장 적합한 발주방식을 선정할 수 있도록 하는 발주방식 선정모델을 제시하였다. 그리고 발주방식 성과평가 모델을 함께 제시하여 발주방식 선정 및 운영의 결과를 후속 사업의 피드백 할 수 있도록 하였다. 이와 같은 표준적인 모델은 공공발주기관의 의사결정을 지원하는 도구로 활용될 수 있을 것이다.

  • The construction industry has specific characteristics compared with manufacturing industry. This means that each construction project has it's own contract documents due to the difference of environment and time. Now, the construction market is opening according to the Government Procurement Agreement by WTO. Therefore to overcome the associated risks, domestic contract rules and acts should be reformed. FIDIC and domestic construction contract conditions is investigated and analyzed. Based on the research outcomes the direction of reformation is suggested.

Big data-based piping material analysis framework in offshore structure for contract design

  • The material analysis of an offshore structure is generally conducted in the contract design phase for the price quotation of a new offshore project. This analysis is conducted manually by an engineer, which is time-consuming and can lead to inaccurate results, because the data size from previous projects is too large, and there are so many materials to consider. In this study, the piping materials in an offshore structure are analyzed for contract design using a big data framework. The big data technologies used include HDFS (Hadoop Distributed File System) for data saving, Hive and HBase for the database to handle the saved data, Spark and Kylin for data processing, and Zeppelin for user interface and visualization. The analyzed results show that the proposed big data framework can reduce the efforts put toward contract design in the estimation of the piping material cost.
