Adjudication in Australia: A Study of Adjudication Activity in New South Wales for 2013/14

  • The Building and Construction Industry Security of Payment Act 1999 (NSW) (the NSW Act) is a unique form of statutory regulation for the building and construction industry, which gives virtually all industry participants a statutory right to, and a means of recovering, payments for work done under a construction contract. The research aim is to examine current trends in adjudication applications and determinations under the NSW Act. The data used for this study was the collected by the NSW Office of Finance & Services as part of a regular reporting regime for the period from 1 July 2013 and ending on 30 June 2014. With just over 817 adjudication applications having been made over the 2013/14 period, the data indicates that adjudication is being frequently utilized by stakeholders in the NSW building and construction industry as a means of progress payment recovery. Adjudication is proving to be a popular choice for those making claims of less than AU$250,000. Claimants were awarded about 36% of the total of claimed amounts and claimants are generally successful at adjudication in terms of the proportion of the claimed amounts determined in their favour. This is particularly so in relation to claims of less than $100,000, which represents about 70% of the total applications made over the reporting period. The data indicates that adjudication fees are generally modest enough to conclude that adjudication provides claimants across all claim ranges with a relatively inexpensive means of having disputed progress payments determined by an independent adjudicator.

  • Occasionally an owner of public construction work pays financial costs in addition to progress payments. However, the overall scale of financial costs are not known. This research examines, based on a case study, the financial cost incurred in public construction works and the following issues: the overall scale of financial costs, the impact on financial costs on the owner, and the impact of timing on the overall sum of the financial costs. Annually, more than 2.3 trillion KRW are paid as progress payments for public construction work; yet, there is no research data showing the scale of financial costs thus incurred. The purpose of this research is to illustrate the scale of financial costs incurred due to progress payments for public construction works, and to suggest alternatives that would improve relevant regulations.

  • The purpose of this study is to analyze th especificity of landscape construction progress in order to develop the model of landscape construction schedule management. Nine case study area in housing complex was selected and the graphic curve of the accumulative payment by landscape construction schedule was analyzed. And the results are as follows: The graphic curve of common construction progress is S-curve but that of landscape construction progress is parabolic-curve, because landscape construction concentrally progress in last period of construction schedule. And particularly parabolic-curve seems to rise up suddenly in the last period when landscape construction amount is small.

  • Owing to the digital revolution, Internet Commerce and Electronic commerce, revolutionize the way of doing business and making payment. The entrance of the Internet has a prominent for spread of Electronic Commerce and those phenomenons will result in paperless trading and cashless trade. By virtue of Internet, an increasing share of business transactions occurs online. Electronic payment is essential for the smooth progress of the electronic commerce as electronic payment plays the important role in the electronic commerce, that is, the value transfer restyling from the electronic commerce. Traditionally international settlement systems such as letters of credits, remittance and documentary collections operated as important and poplar method of payment, Now, information technology has made it possible to pay for the sale of goods and services over the internet. In international trade, there are service providers (bolero, TradeCard, BeXcom) to settle payment electronically through the Internet. The purpose of this study is to Conduct comparative analysis with approach manner functional respect systematic respect, role. It is shown which the Electronic payment system is better. In this study, the author attempts to find the problems is (bolero, TradeCard, BeXcom) and solutions in switching from the documentary payment system to the electronic one. This conclusion of this study can be summarized as followings. In resoect of the law, bolero should seek to prevert the users from being treated unfairly due to multilateral agreement on Rulebook. TradeCard, BeXcom do not have the proper law that users are governed. so far as the practice problems concerned, stability of computer's operation and security of message interchange should be warranted and improved continuously. Through the standardization of the electronic document and the development of software, the examination of the shipping occuments must be done automatically. Bolero should induce more banks to take part in Bolero, and make the carrier the cost and time in managing the traditional document which will be used for the time being. In respect of information technology and security, to deduce the risk in the electronic settlement system and positively uses the global authentication guideline(Identrus).

  • While researches and studies on short distance wireless communications have been actively carried out, studies on many applications of short distance wireless communications focusing on user-oriented Mobile device are also in progress. Since Bluetooth has several advantages that existing short distance communication does not have, studies on standardization have been carried out focusing on SIG, and IEEE has also jointly studied on this. Bluetooth is a short distance wireless communication technology that can be usefully applied to various kinds of applications. In this regard, this thesis presents payment system using Bluetooth, out of several application technologies of Bluetooth. This payment system is based on the scenario in which secure piconet is formed focusing on the user, the user gets in the car, fill up the gas at the gas station using his own Mobile device and pay The secure payment system presented in this thesis is designed to complement the weakness of existing Bluetooth in terms of security and to secure several requirements of security required for payment using short distance wireless communication.

  • The demands of IC card payment system has been increased according to the rapid advancement of the IT convergence application technologies. Recently IC card payment systems are in demands of the usage space at anytime and anywhere by developing the wireless communication technology and its related multimedia processing technology. Therefore the security of IC card payment system becomes more important and necessary. There are many fault analysis methods to evaluate the security and safety of information systems according to their characteristics and usages. However, the only assessment method to evaluate the security of information systems is not enough to analyse properly on account of the various types and characteristics of information systems by the progress of IT convergence and their applications. Therefore, this paper proposes an integrative method of the Fault Tree Analysis (FTA) and Fault Modes and Effect Analysis/Criticality (FMEA/C) based on criticality to evaluate and improve the security of IC card payment system as an illustration.

  • Most payments in domestic construction are issued in lumpsum unit price contracts according to the completed construction rate. This method generates problems in losing time and increased costs for the owner and contactor. In overseas projects, payments are issued in accordance to completed milestones. The milestones themselves base on the original schedule and allow effective schedule management on the tasks. In domestic construction, however, introduction of milestone payments requires enhanced management capability of owners and contractors. Hence, this study investigating how to activate schedule management devices to analyze progress payments in domestic construction.

  • The public construction industry in Korea involves a variety of stakeholders, encompassing multiple layers of contractual relationships that crisscross between the State as project client and the contractors, as well as subcontractors. In such a hierarchical landscape, managerial crises of contractors involving bankruptcy or insolvency can result in unexpected damages for both clients and subcontractors. Accordingly, the applicable legal framework requires project clients to act as patrons in relation to making payments to subcontractors, and stipulates provisions pertaining to direct payments to subcontractors in order to promote the balanced development of the national economy in terms of the public interest by protecting small and medium-sized businesses working as subcontractors for large businesses. However, the relevant legal documents provide for different payment criteria and procedures from document to document, and leave room for variations in the interpretation and construction of applicable provisions, which leads to disputes and discrepancies in court rulings. For this reason, it is necessary not only to compare and analyze statutory provisions pertaining to direct payment to subcontractors, but also to review issues of contention in actual cases. This study aims to analyze issues in cases involving payment to subcontractors from the perspective of the project client overseeing and supervising the construction business. The conclusions from such an analysis will help to effectively resolve subsequent cases of a similar nature by suggesting a strategy to improve the relevant statutory provisions pertaining to direct payment to subcontractors.

Current Issues and Rural Policies of Less-favored Areas in Japan

  • In Japan, the direct payment scheme for mountainous areas was introduced in order to enhance multifunctionality of less-favored areas in 2000. A comprehensive ex post assessment showed that the scheme effectively contributed to prevention of abandoned cultivated lands, maintenance and enhancement of multifunctionality of agriculture, continuous assistance for agricultural production, and revitalization of community. In 2005 a second round of the scheme started and urged encouraging core farmers, improving productivity, and reinforcing inter-village coalition as to promote autonomous and sustainable rural economies. A new different scheme such as 'measures to conserve and improve land, water and environment' was launched for strengthening conservation and management of rural resources over all areas in 2007. It covers one third of paddy fields with regards to maintenance of water facilities and practice of group eco-farming beyond less-favored area. A lot of public programs have been developed for rural revitalization recently. Additionally some have a complementary role to enlarging cultural multifunctionality in rural societies. We could interpret the institutional progress as an evolutionary path of rural development and environmental schemes for the past decade. Much experience of community works through the direct payment scheme for mountainous areas may have resulted in accumulation of social competence for elaboration of rural management..

Analysis of the Landscape Conservation Direct Payment System Based on Spatial Information Data and Utilization of Rural Area Regeneration (공간정보데이터 기반의 경관보전직불제도 실태분석과 농촌공간 재생의 활용방안)

  • There is a clear need to enhance the attractiveness of rural areas by leveraging their core assets to respond to emerging mega-trends. This paper analyzes the progress of the direct payment program that has been implemented to preserve agricultural landscapes in rural areas, using spatial information data. The study identified the planting characteristics of landscape crops, spatial utilization characteristics of the system, and utilization characteristics of the system by the beneficiaries. According to the analysis, the spatial utilization characteristics of the system could be classified into eight types: tourism resources and nearby agricultural areas, designation across the entire rural area, agricultural areas around villages, large-scale agricultural areas, small-scale agricultural areas, scattered and dispersed areas, independent parcels of land, and ranches. Based on the characteristics and limitations of the landscape preservation direct payment system, this study provides directions for future rural specialized zones. The landscape preservation direct payment system focuses on income support for farmers and providing agricultural benefits in terms of public interest. Meanwhile, the landscape agricultural zone serves as a rural specialized zone, highlighting the need to explore the direction of integrated rural landscape management. It is important for farmers, as the key stakeholders, to preserve the agricultural landscape in rural areas. Forming community-level cooperatives and engaging in relevant activities are crucial for achieving this goal. In order to actively preserve the agricultural landscape, it is necessary to consider the resumption of financial support for village landscape preservation activities, along with the designation of landscape agricultural zones. There is a need to conduct a specific review and explore measures to accommodate the designated landscape complexes at the local government level. The higher the ratio of designated landscape complexes, the more agricultural landscape management based on public value has been carried out. The designation of such landscape complexes can be seen as a demand for voluntary utilization of agricultural landscapes in the region. Moreover, as the ratio of designated landscape complexes increases, it becomes evident that farmers at the village level actively participate in agricultural landscape preservation and contribute to providing public value or utilize it as a tourism resource. This highlights the need for managing agricultural landscapes at the village level within the appropriate context.
