The Law of Aircraft Leasing in the People's Republic of China : Achievements and Challenges

  • Leasing is one of the main methods for Chinese airlines to introduce aircraft from overseas manufactures, and this method has been used for more than 30 years by Chinese airlines. Aircraft leasing in essence is a kind of financial transaction, through which lessors provide finance to lessees by means of the delivery of possession of the leased aircraft. At the time when China started to introduce aircraft through leasing some 30 years ago, the Chinese domestic laws were very insufficient to regulate these activities. Therefore, a construction process for the law of aircraft leasing was triggered then, and some fruit has been gained. By far, there are rules to adjust the aircraft activities in the aspects of contract, real right, default and bankruptcy remedies. However, as the improvement of any system must undergo a process of exploration, the law of aircraft leasing in China is still faced up with many challenges. Especially with the emergence and prosperous of domestic leasing industry, new transaction structures and models of aircraft leasing have emerged, which leaves new challenges to current legal system. On the basis of introducing the history and main contents of Chinese legal regime of aircraft leasing, this paper offers an analysis of achievements and challenges on present Chinese laws in the aspects of contract, real right and remedies.

  • It is settled in the economic arena that electronic commerce which used the Internet is new recently by explosive increase of the rapid development and Internet use of the information and communication technology. The problem that is legitimate at a point called the business of the form that the electronic transactions to set together if I drift are new of the times is the situation caused a lot. However, the use custom of construction and electronic transactions of the maintenance that is the legislation thief who can do rules of electronic transactions is the fact that it was not able to be still established It may not be just applied to the Internet electronic transactions that an exchange promise between our characters does against unspecified number of the general public person in the property even if I say that the conclusion of the purchase agreement is concluded in Internet electronic transactions by EDI method. That can have the approval of contract in the main legal problem of such an Internet electronic transactions contract. We civil law sorts it by a contract between the talks characters and a contract between the remote area people and all the adopted children are equal and must decide the formation of contract time in a principle of Empfangstheorie because it may be said that the rule of the civil law that it be heated and decides to be able to be available is irrational.

  • With the development of e-Commerce and the proliferation of easily accessible information, information filtering systems such as recommender and SDI systems have become popular to prune large information spaces so that users are directed toward those items that best meet their needs and preferences. Until now, many information filtering methods have been proposed to support filtering systems. XML is emerging as a new standard for information. Recently, filtering systems need new approaches in dealing with XML documents. So, in this paper our system suggests a method to create multiform user profiles with XML's ability to represent structure. This system consists of two parts; one is an administrator profile definition part that an administrator defines to analyze users purchase pattern before a transaction such as purchase happens directly. an other is a user profile creation part module which is applied by the defined profile. Administrator profiles are made from DTD information and it is supposed to point the specific part of a document conforming to the DTD. Proposed system builds user's profile more accurately to get adaptability for user's behavior of buying and provide useful product information without inefficient searching based on such user's profile.

  • Recently, the number of occurrences of inundation and the severity of flood damage has increased rapidly as the frequency of localized heavy rainfall and the ratio of impervious area increased in urban areas. Most local governments focus on employing structural measures (e.g., the construction of detention reservoirs/pump stations, rehabilitation of drainage and sewer pipes) to prevent urban inundation. On the other hand, the effectiveness of implementing such structural measures is being dimished because there are already many inundation prevention facilities. The limitation of structural measures can be overcoming by employing non-structure measures, such as flood alerts and the operation of drainage facilities. This study suggests the pump operation rule (i.e., suggesting pump stop level) for a new detention reservoir operating method, which triggers the operation of a pump based on the water level at the monitoring node in urban drainage system. In the new reservoir operation, a total of 48 rainfall events are generated by the Huff distribution for determining the proper pump stop level. First, the generated rainfall events are distributed as frequencies, quartiles, and durations. The averaged system resilience value was determined to range from 1.2 m to 1.5 m is based on the rainfall-runoff simulation with rainfall generated by the Huff distribution. In this range, 1.2 m was identified considering the safety factor of 1.25 by the Standard on sewer facilities in 2011.

Is judged that need examination about wide area rapid-transit railway combined application operation that take advantage of rail track reserve capacity of High-speed railway for utilization efficiency elevation of country and efficient investment of national finance according as High-speed railway and Gangnam rapid-transit railway route that is suggested in Kyonggi Province are overlaped. Therefore, in this research, I wish to quote investment efficiency plan of railroad business by that different kind's train is run in uniformity track by presenting combined application operation plan and working expenses curtailment effect etc. that is optimized through analysis of roadbed and E & M technology condition, intermediate station plan, train operation planning etc. in case of wide area rapid-transit railway and high-speed railway run combined application.

Mechanism on Bulb Formation of Compaction Pile Depending on Materials (재료에 따른 다짐말뚝 구근 형성 메커니즘)

  • In this paper, a small-scale model testing system was developed using a series of small-scale model tests to analyze the mechanism of compaction pile formation and evaluate the quality of controlled grading aggregates proposed as an alternative material to the sand compaction pile (SCP) method and granular compaction pile (GCP). These are the most typical ground improvement methods in field practice, particularly for soft grounds. However, the SCP has faced difficulties due to the supply shortage of natural sand and the corresponding price surge of sand. The GCP is limited in marine soft grounds because of the failure occurring at the pile tip caused by excessive expansion of the deeper bulbs, leading to uneven bulb formation. The uniformity of compacted pile bulbs is critical to ensuring the bearing capacity and quality of the compaction pile. This study aims to evaluate the performance of the new material and controlled grading aggregates using small-scale model tests simulating field compaction process to investigate its potential application in comparison with SCP. The compaction piles are examined in four cases according to different materials used for compaction pile and clay strength. The compaction pile materials, which are made of sand and controlled grading aggregates, used in this study were compared to reveal the mechanism of the bulb creation. The experimental data confirm that the bulb formation quality of the traditional sand and the new material, controlled grading aggregates are comparable. The compaction pile made of controlled grading aggregates presents higher bearing capacity than that of marine sand.

  • This study has the goal of analyzing the techniques and characteristics of urban development, after additionally constructing the high-speed railway in Japan's Kyushu district and building a new railway station to enable the existing traditional stations accommodate with the high-speed railway. Such analysis is made in order to draw the conclusion of its intended (designed) meaning and attributes and to further research on finding an applicable urban development method in the domestic railway station development. The object of this study includes examples of stations renewed within the five years when Shinkansen in the Kyushu district was extended or stations which are in process of development such as Hakata station, Kumamoto station, and Kagoshima-chuo station. From the analysis of this study, the strategies are as follows.; active connecting both geographical location and function of Station, re-establishment of relation with city center and Station, establishment of close linking system for both tourist spot development, methods of Shinkansen line construction and extension a development opposite site of railway, securing the living population from high density & Mixed use development of Station Building.

Quantitative Evaluation of Super-resolution Drone Images Generated Using Deep Learning (딥러닝을 이용하여 생성한 초해상화 드론 영상의 정량적 평가)

  • As the development of drones and sensors accelerates, new services and values are created by fusing data acquired from various sensors mounted on drone. However, the construction of spatial information through data fusion is mainly constructed depending on the image, and the quality of data is determined according to the specification and performance of the hardware. In addition, it is difficult to utilize it in the actual field because expensive equipment is required to construct spatial information of high-quality. In this study, super-resolution was performed by applying deep learning to low-resolution images acquired through RGB and THM cameras mounted on a drone, and quantitative evaluation and feature point extraction were performed on the generated high-resolution images. As a result of the experiment, the high-resolution image generated by super-resolution was maintained the characteristics of the original image, and as the resolution was improved, more features could be extracted compared to the original image. Therefore, when generating a high-resolution image by applying a low-resolution image to an super-resolution deep learning model, it is judged to be a new method to construct spatial information of high-quality without being restricted by hardware.

Nickel dust-induced occupational contact dermatitis by welding and grinding work in shipyard workers: a report of nine cases

  • Background: Occupational skin diseases are skin conditions that occur or worsen in relation to work and known to be the second most common type of occupational disease affecting individuals in the United States. In Korea, epidemiological reports related to occupational skin diseases are rare. But, no cases of occupational contact dermatitis caused by welding and grinding work have been reported previously. Case presentation: Nine male workers working in the production department for liquefied natural gas (LNG) ships in Ulsan complained of erythematous papules/patches and itching in various areas of the body after welding and grinding work. The work environment monitoring report revealed that the amount of nickel dust exceeded the time weighted average (TWA) and poor local ventilation status. Based on the symptoms and the overall results of surveys, several tests, and work environment monitoring report, the 2 workers who had positive patch-test reactions to nickel were diagnosed with nickel dust-induced allergic contact dermatitis. The other 7 workers were diagnosed that there was a high probability that they had nickel dust-induced irritant contact dermatitis. The 2 workers who had nickel dust-induced allergic contact dermatitis were recommended to switch their jobs. Conclusions: Nickel is one of the most common cause of allergic contact dermatitis. In this case, the dust was assumed to be created by welding work with a high nickel content new welding rod and subsequent grinding work, and the concentration of this dust exceeded the time weighted average. Thus, it is thought that the nickel dust may have caused contact dermatitis through continuous contact with the workers' exposed skin in a poorly ventilated space. Currently, several domestic shipbuilding companies are manufacturing LNG tankers using a new construction method. Consequently, it is highly likely that similar cases will occur in the future, which makes this case report meaningful.

한강하류지형면의 분류와 지형발달에 대한 연구 (양수리에서 능곡까지)

  • Purpose of study; The purpose of this study is specifically classified as two parts. The one is to attempt the chronological annals of Quaternary topographic surface through the study over the formation process of alluvial surfaces in our country, setting forth the alluvial surfaces lower-parts of Han River area, as the basic deposit, and comparing it to the marginal landform surfaces. The other is to attempt the classification of micro morphology based on the and condition premising the land use as a link for the regional development in the lower-parts of Han river area. Reasons why selected the Lower-parts of Han river area as study objects: 1. The change of river course in this area is very serve both in vertical and horizontal sides. With a situation it is very easy to know about the old geography related to the formation process of topography. 2. The component materials of gravel, sand, silt and clay are deposited in this area. Making it the available data, it is possible to consider about not oかy the formation process of topography but alsoon the development history to some extent. 3. The earthen vessel, a fossil shell fish, bone, cnarcoal and sea-weed are included in the alluvial deposition in this area. These can be also valuable data related to the chronological annals. 4. The bottom set conglometate beds is also included in the alluvial deposits. This can be also valuable data related to the research of geomorphological development. 5. Around of this area the medium landform surface, lower landform surface, pediment and basin, are existed, and these enable the comparison between the erosion surfaces and the alluvial surfaces. Approach : 1. Referring to the change of river beds, I have calculated the vertical and horizontal differences comparing the topographic map published in 1916 with that published in 1966 and through the field work 2. In classifying the landform, I have applied the method of micro morphological classification in accordance with the synthetic index based upon the land conditions, and furthermore used the classification method comparing the topographic map published in 1916 and in that of 1966. 3. I have accorded this classification with the classification by mapping through appliying the method of classification in the development history for the field work making the component materials as the available data. 4. I have used the component materials, which were picked up form the outcrop of 10 places and bored at 5 places, as the available data. 5. I have referred to Hydrological survey data of the ministry of Construction (since 1916) on the overflow of Han-river, and used geologic map of Seoul metropolitan area. Survey Data, and general map published in 1916 by the Japanese Army Survbey Dept., and map published in 1966 by the Construction Research Laboratory and ROK Army Survey Dept., respectively. Conclusion: 1. Classification of Morphology: I have added the historical consideration for development, making the component materials and fossil as the data, to the typical consideration in accordance with the map of summit level, reliefe and slope distribution. In connection with the erosion surface, I have divided into three classification such as high, medium and low-,level landform surfaces which were classified as high and low level landform surfaces in past. furthermore I have divided the low level landform surface two parts, namely upper-parts(200-300m) and bellow-parts(${\pm}100m$). Accordingly, we can recognize the three-parts of erosion surface including the medium level landform surface (500-600m) in this area. (see table 22). In condition with the alluvial surfaces I have classified as two landform surfaces (old and new) which was regarded as one face in past. Meamwhile, under the premise of land use, the synthetic, micro morphological classification based upon the land condition is as per the draw No. 19-1. This is the quite new method of classification which was at first attempted in this country. 2. I have learned that the change of river was most severe at seeing the river meandering rate from Dangjung-ni to Nanjido. As you seee the table and the vertical and horizontal change of river beds is justly proportionable to the river meandering rate. 3. It can be learned at seeing the analysis of component materials of alluvial deposits that the component from each other by areas, however, in the deposits relationship upper stream, and between upper parts and below parts I couldn't always find out the regular ones. 4. Having earthern vessel, shell bone, fossil charcoal and and seaweeds includen in the component materials such as gravel, clay, sand and silt in Dukso and Songpa deposits area. I have become to attempt the compilation of chronicle as yon see in the table 22. 5. In according to hearing of basemen excavation, the bottom set conglomerate beds of Dukso beds of Dukso-beds is 7m and Songpa-beds is 10m. In according to information of dredger it is approx. 20m in the down stream. 6. Making these two beds as the standard beds, I have compared it to other beds. 7 The coarse sand beds which is covering the clay-beds of Dukso-beds and Nanjidobeds is shown the existence of so-called erosion period which formed the gap among the alluvial deposits of stratum. The former has been proved by the sorting, bedding and roundness which was supplied by the main stream and later by the branch stream, respectively. 8. If the clay-beds of Dukeo-bed and Songpa-bed is called as being transgressive overlap, by the Eustatic movement after glacial age, the bottom set conglomerate beds shall be called as being regressive overlap at the holocene. This has the closest relationship with the basin formation movement of Seoul besides the Eustatic movement. 9. The silt-beds which is the main component of deposits of flood plain, is regarded as being deposited at the Holocene in the comb ceramic and plain pottery ages. This has the closest relationship with the change of river course and river beds.
