해군 초급장교의 해기능력에 관한 연구 (A Study on the Navigational Competence of Junior Naval Officers)

  • 본 논문에서는 국제협약인 STCW(International Convention on Standards of Training, Certification and Watchkeeping for Seafarers)에 명시된 항해당직을 담당하는 해기사의 자격증명에 관한 강제적 최저요건을 분석하고, 해군 초급장교들의 해기능력과 관계되는 전반적인 교육과정 및 평가 시스템을 비교 분석하였다. 그 결과, 해군사관생도 출신의 초급장교는 교육과정 및 내용, 엄격한 기숙생활, 단계별 체계적인 함정실습체계, 함정근무 장교 능력평가제도 등 모든 내용이 STCW 협약에 근거하여 부족함이 없다고 판단된다. 그리고 일반대학을 졸업한 사관후보생 및 학군사관후보생 출신의 초급장교는 교육과정이 STCW 협약에는 다소 부족하지만 항해안전을 위한 기초능력은 배양되었다고 판단된다.

Synergizing Climate Change and Ocean Regimes: A Comprehensive International Legal Approach for Ocean Acidification Governance

  • Ocean acidification poses a myriad of challenges, particularly to marine environments and ecosystems. Its negative repercussions are equally obvious from a human-centric perspective. Despite efforts to address ocean acidification through various international legal frameworks, current international legal frameworks, such as the United Nations Convention on the Law of the Sea and the United Nations Convention on Climate Change, which represent the climate change regime and the ocean regime, respectively, fall short of adequately addressing ocean acidification challenges. Because of the climate change regime's atmospheric-centered perspective and the ocean regime's pollution-oriented perspective, ocean acidification falls between the cracks and is not a priority for either regime. To adequately address the issues posed by ocean acidification, a concerted effort between the the legal regime addressing climate change and the legal regime regulating maritime affairs is crucial. This effort might be realized by developing a robust governance system that encompasses both of these regimes, which are specifically tailored to tackle ocean acidification. Given the complexity of ocean acidification governance, the distribution of roles for both regimes should be thoroughly examined. Due to its broad reach, the ocean regime might take the lead in directing the trajectory of ocean acidification, while the climate change regime might provide assistance within the context of ocean acidification governance. Active mutual reference and due diligence obligations could be employed in this scenario to bridge the gaps created by both the climate change regime and the ocean regime regarding ocean acidification. The active interaction between these regimes might pave the way for proper ocean acidification governance in order to meet the challenges posed by ocean acidification.

선교자원관리의 효과적인 교육방법에 관한 연구 (A Study on the Effective Teaching Method for Bridge Resource Management in Korea)

  • 2010년 STCW 마닐라 수정안은 항해사에게 선교자원관리에 대한 지식 및 기능에 관한 해기능력을 강제적인 사항으로 포함하고 있다. 본 연구는 선교자원관리의 관점에서 STCW 2010 개정안에 토대를 둔 국내 교육 프로그램의 적절한 방향을 제안한다. 선교자원관리 프로그램과 관련하여 그 내용 및 교육방법이 국내 교육프로그램에 대한 설문조사를 통하여 분석되었다. 그 결과로서 본 연구는 현재의 선교자원관리 교육 프로그램을 개선하기 위한 몇 가지 제안을 한다.

동아시아 해양안보 : 해군력인가 해양법인가? (East Asian Maritime Security: Naval Power vs. Normative Power)

  • The security environment surrounding the East Asian seas is rapidly changing due to the naval arms race among coastal states. The arms race is likely to worsen the security dilemma of the countries involved, thus increasing the chances for armed conflicts. It is too early to tell how the contemporary naval arms race in the region will evolve. But, for sure, the level of uncertainty is increasingly becoming high and intense. At the same time, there is emerging a legal warfare or lawfare among the rival countries. In particular, the United States and China have been involved in a serious debate about the nature and scope of the right of innocent passage and freedom of navigation in other countries' maritime zones. In collaboration with its regional allies, the United States has also put normative pressures on China with its excessive claims in the South China Sea. The latest arbitral tribunal case between the Philippines and China illustrates the point. With both arms race and normative competition in play, the future of East Asian maritime security will remain very complex and uncertain.

중국의 방공식별구역(ADIZ) 선포와 역내 안보적 함의 (China's recent establishment of its ADIZ and its implications for regional security)

  • The regional security and stability in Northeast Asia has become more complicated because of a sudden establishment of China's Air Defense Identification Zone (ADIZ) on 23 November 2013. One dimensional conflicts on the territorial sovereignty over the islands between the regional States has developed into the two dimensional conflicts like maritime delimitations among the States concerned since they have all ratified the 1982 United Nations Convention on the Law of the Sea which adopts the 200 nautical mile Exclusive Economic Zone regime. Moreover, due to the notion of the outer limit of the continental shelf, the conflicts have developed into three dimensional ones in order to acquire more natural resources even in the seabed. To make matters worse, such three dimensional conflicts have expanded to the airspace as well. The paper will analyze what implications the sudden declaration of China's ADIZ have for the regional security in Northeast Asia from the perspectives of public international law. To this end, the paper 1) starts with the debates on the legal nature of the ADIZ, 2) identifies the Chinese government's political motives for the establishment of the ADIZ over the East China Sea, 3) assesses the responses of the regional States and the USA to the China's establishment of the ADIZ, and then 4) discuss what implications the overlapped ADIZ of the three key States in the region have for the regional security and stability.

독도해양과학기지 건설 관련 법적 쟁점에 관한 고찰 (Legal Issues Relating to Construction of the Dokdo Ocean Research Station)

  • The Korean Government is trying to construct an ocean research station in Dokdo's water. The station would be the third ocean research station following the Ieodo station and the Gageocho station. Although the new station would served as a scientific research base for peaceful and academic purposes, the construction of the station will almost certainly lead to a diplomatic dispute between Japan and Korea in the near future due to the disputed ownership of the island. In light of the diplomatic protests against the construction of the Ieodo station by the Chinese Government, various domestic and international legal issues which could be raised regarding the construction of the Dokdo station need to be reviewed. Therefore, this article reviews the international legal status of the station and the rights and duties pertaining to its construction, investigates the domestic legal grounds relating to the construction and operation of the marine scientific installation, evaluates the international legal impacts of the construction on the expansion of maritime jurisdiction, the effective control on Dokdo and the negotiations on maritime boundary delimitation, and finally draws conclusions on the future activities of the Korean Government for the construction and operation of the Dokdo Ocean Research Station.

기초·상급안전교육과정 개선방안에 대한 연구 -선원 소화교육 중심- (A Study on the improvement for Basic·Advance Safety Training Course - Focusing on the Crew's Fire Fighting Training -)

  • It is provided that the seaman should be educated and trained by basic fire-fighting to save the life and protect asset at sea by the STCW(The International Convention on Standard for Training, Certification and Watchkeeping). The designated seaman's safety educational institution which is specified in the nation has held a basic and advanced fire-fighting education for the seaman. The interest of safety at sea has been increasing due to recent huge maritime disaster and there is a tendency to strengthen the safety education for the seaman in the nation. For the effective fire-fighting education for the seaman, the appropriate educational content and facilities are required. Moreover, It is necessary to apply an effective education and training methods for achieving the goal. Unfortunately, this paper has not perfectly been conducted to improve effective safety training in the designated educational institutions which held the seaman's maritime safety educations. From now on, we should consider the effective educational ways for the seaman. The purpose of this paper is to develop the education and training model of STCW seaman's fire-fighting education through the reviewing the status of safety education in the nation.

해양환경관리 관련 각종 국제협약의 국내 수용 현황 (Domestic Status for Acceptance of Various International Conventions relating to Marine Environment Management)

  • 각종 국제협약의 채결 및 개정안에 따라서, 특히 73/78 국제해양오염방지협약에 의하여 제정되고 개정되어 온 해양오염방지 협약과 같은 국내법들을 살펴보고 국제협약들의 주요 내용과 비교하였다. 그리고 현존의 국제협약 또는 새로운 국제협약의 새로운 내용 및 최근의 개정내용에 따라서 해양오염방지법과 같은 현행 국내법을 개정하거나 새로운 국내법을 제정하는 몇 가지 대안을 제시하였다. 73/78 국제해양오염방지협약의 부속서 6장을 최근에 대기환경보전법으로 수용하지 않고 해양오염방지법으로 수용하였다. 선박 밸러스트수 배출을 통한 외래유해생물종의 침입을 방지하고 국내 해양생태계와 연안환경을 보호하기 위하여 선박밸러스트수침전물관리협약을 해양오염방지법으로 수용하거나 새로운 법을 제정하여 수용하여야 한다. 선박의 유해한 방오시스템 통제를 위한 국제협약을 유해화학물질관리법으로 수용하기보다는 해양오염방지법으로 수용하여야 한다. 선상 잔유 유성혼합물의 빌지수를 함유한 해철유조선을 선진국에서 개발도상국이나 후진국으로 국가 간 이동하는 것을 방지하기 위하여 유해화학물질의 국가간 이동을 규제하고 금지하는 바젤협약올 해양오염방지법으로 수용함으로써 종국적으로는 세계의 해양환경보전에 기여하여야 한다.

Prospects for Improved Marine Pollution Control

  • When considering marine pollution control procedures there are three general areas which demand close attention. These are: $\bullet$ oily bilge water $\bullet$ refuse $\bullet$ sewage All of these applications can be handled constantly changing to address the complexity of the waste management issues. The basic marine pollution regulations are covered by the International Maritime Organizations MARPOL 73/78 convention, with the various annexes and revisions. Of particular importance for equipment to deal with oily-water, sewage and plastic wastes.

해상에서 국제법 위반행위에 대한 법 집행권의 범위와 한계 (The Scope and Limits of Law Enforcement at Sea on International Law Violations)

  • 공해의 이용은 '항해의 자유'와 '기국주의'라는 관습법으로 형성되어온 원칙이 유엔해양법협약에서 명문화되어 공해 이용에 관한 두 개의 큰 축을 이루고 있다. 연안국의 해양에 대한 통제권이 확대되고 새로운 안보위협에 대처하기 위한 레짐이 생성되면서 공해의 자유에 관한 두 가지 기제를 축소하려는 유인과 시도가 있었다. '항해의 자유'와 '기국주의'는 인류가 바다에 진출한 이래 수 천 년에 걸쳐 형성된 관습법이고 오늘날 인류 공동의 유산인 바다를 평화롭고 질서 있게 이용하기 위한 법, 제도적 근간이 되고 있다. 따라서 공해상 타국 선박에 법 집행의 절차적 편리성과 집행국의 이익을 위해 이러한 원칙으로부터 예외를 만들거나 후퇴하기 시작하면 해양이용의 기본 틀 자체가 위협받을 수 있고 결국에는 해양질서는 강대국의 힘의 논리와 이익에 좌우 될 수 있다. 이러한 이유로 대북해상 제재와 같은 새로운 해양법 집행 레짐이나 조치는 무해통항제도, 공해이용의 자유와 같은 원칙을 존중하고 국제법의 틀 안에서 이루어져야 한다.
