  • Through the new round DDA(Doha Development Agenda) negotiations which started in Doha/Qatar conference in November, 2001, service industries have been included in the category of international trades. An electronic commerce cannot be exceptional in this field. The 21st century is largely recognized as the era of globalization, knowledge, and information. To make effective and competitive strategy in this century, it is essentially required to organize Network. OPEN, and FU-PLEX. That is why our government also has been promoting this field since years before, now 10,000,000 people in Korea have joined superhighway internet networks. Korea became the top internet-developed country in the world. As a side-effect of this internet spread into our life, however, there is serious problem we are now faced against. That is the outflow of private information through electronic commerce and other cyber transactions. It has caused many social problems to be rapidly on the rise these days. We are now desperately required to struggle continuously to make a solution for that. Taking the precedent case of Germany and United States which are currently recognized as high-leveled country in protection of private information, we have to come up with legal and technical measures and at the same time, to escalate the social consciousness about private information protection.

A Study on the Investor Protection Principle as a Legal Basis of Investor - State Dispute Settlement(ISDS) (투자자-국가 분쟁해결(ISDS)의 대상이 된 투자자 보호원칙에 관한 연구)

  • South Korea has investment agreements such as FTAs, BITs with several countries. Up to now, no single case has been registered against the Korean government on breach of investment agreements, but it is likely that the number of such cases would increase. Therefore, an investor-state dispute settlement system, an arbitral procedure by which a foreign investor may seek compensation of damage against the host country, is gaining its importance. The provision of the ISDS has been one of the hottest issues in Korea while the Kor-US FTA was being signed. In this respect, with the growing number of regional agreements such as BITs and FTAs, a careful scrutiny on the ISDS is necessary for Korea. I have therefore studied theoretically subjects including the National Treatment(NT), the Most-Favored Nation(MFN), Fair and Equitable Treatment and Expropriation - those that have been the objects of protection on investors. And I have analyzed ICSID arbitral awards and provided implications. In the ICSID arbitral awards, the Fair and Equitable Treatment turned out to be the most recognized violation on investors by the host State in terms of investor protection. On the other hand, Indirect Expropriation - a matter of which public anxiety was shown led by civic groups - was not generally recognized in arbitral awards. This study is written for sake of governments, local autonomous entities and public enterprises that are in charge of FTAs and BITs.

  • Environmental problems such as global climate change, depletion, ocean and air pollution, and resource degradation-compounded by an expanding world population-respect no border and threaten the health, prosperity and jobs of all mankind. Our efforts to promote democracy, free trade, and stability in the world will fall short unless people have a livable environment. We have an enormous stake in the management of the world's resources. By increasing demand for timber, natural gas, coal and consumer's goods have destroyed the grounds for living. Greenhouse gas emissions anywhere in the world have threatened coastal communities, and then changed the Earth's climate system. The burning of coal, oil, and other fossil fuels is increasing substantially the concentration of heat-trapping gasses such as carbon dioxide, methane, and nitrous oxide in our air. The earth's temperature and sea levels are rising as a result. Since 1972 there has been a marked growth in the number and scope of environmental treaties. In particular, after the 1992 Rio Conference, international legal instruments became more concentrated on addressing environment within the context of sustainable development and incorporated a number of new concepts and innovative approaches. A preliminary analysis of recent conventions and in particular those associated with the Rio Conference indicates various ideas, concepts and principles which have come to the fore including sustainable development, equity, common concern of humankind, common but differentiated responsibilities and global partnership. However, international trade also has an environmental impact which must be minimized or countered. Positive measures are to be preferred to achieve environmental goals, but where trade provisions are necessary, they should be appropriately used within environmental conventions to facilitate the reduction and limitation of the negative impacts of trade and to enhance the complementarity of the multilateral trade regime with the imperatives of environmental protection, in the interests of environmental protection and sustainable development generally. The international community has to recognize and endorse this need to achieve complementarity between trade and environment issues.

  • Due to the development of Internet and the collection and usage of the individual information, the infringements of the personal data have been increased rapidly. Regarding the personal data protection in the medical industry, it is clearly described in 'Act on Promotion of Information and Communication Network Utilization and information Protection, etc.'. the law is ratified on the basis of the service provider, therefore, it has its own limitation to be applied to medical industry. Therefore, this paper is to set the security standard and to discuss the range of legal application and considerations on its basis for the domestic medical institution at the electronic medical record system. We exemplify specific applicable content of the electronic signature in the electronic medical record also, present a security assessment item in electronic medical system and set the criteria for the security standard in the medical industry.

Significance and Future Direction for Designation and Management of Landslide-Prone Zones (산사태 취약지역 지정·관리 제도의 의의와 향후 과제)

  • The legal basis for the systematic prevention and response to landslide hazards, and the rehabilitation of landslide-hit areas, was established through the amendment of the Forest Protection Act in August 2012. The most noticeable amendment to the Act is the inclusion of clauses associated with the designation and management of landslide-prone zones (including debris flow-prone zones). In this paper, we (1) introduce the clauses related to the designation and management of landslide-prone zones that were included in the amended Forest Protection Act, (2) examine their significance by reviewing the present status of related domestic laws and structural countermeasures such as sediment check dams for sediment-related disaster prevention, and (3) suggest the future directions of the procedure for the designation and cancellation of such zones, and their maintenance and institutional aspects. The establishment of an institutional device for the designation and management of landslide-prone zones has great significance in the aspect of (1) the establishment of a comprehensive management and prevention system for potential landslide-prone zones in forested areas where the hazard risk has been poorly recognized as compared with the flood risks in lowlands, and (2) the establishment of the basis for overcoming the limits of structural countermeasures according to limited budgets. To develop the designation and management system for landslide-prone zones, not only must present problems be addressed, but a cooperation system between the administration and local residents must also be established.

The Improvement and Problem about Housing Lease Protection Act Article 9 in the Information Society (정보사회에 있어서 주택임대차보호법 제9조의 문제점에 대한 개선방안)

  • In order to ensure the housing stability of homeless people who living in the information society, the Korean Housing Lease Protection Act was enacted as a special law of Civil Code in March 5, 1981, Law No. 3379. And until January 6, 2015 there were 15 times revisions. In the meantime, many issues have been resolved by legal revisions through several times however, it is true that many problems are exposed after enforcement because processing without sufficient review of legislation. Among them, at the 1st revision in 1983 the purpose of Article 9 for lease succession was admitting succession to a spouse who has no inheritance rights. Then it can protect common-law relationship and on the other hand protect the residential life of a spouse. But many questions have been raised. Therefore, in this paper, analyze the problem of lease succession carefully, proposes an improvement to contribute to the residential stable livelihood.

  • The technical standard is an important factor in the national economy, and its importance is gaining more attention due to the emergence of the convergence industry. This is an essential element for implementing fusion technology because it ensures interoperability. Since standardization activities are essential for the growth of domestic SMEs, this study aims to diagnose the status of standardization activities of SMEs and to suggest policy directions accordingly. And we sought to clarify the status of the standardization activities of domestic SMEs and to draw some implications for the domestic promotion plan by examining the major promotion policies for overseas standardization successfully. As a result, it was found that the investment cost for the standard activities is burdensome, the professional manpower is needed, and the participation of SMEs is low due to the complexity of the standard technology. In addition, standardization activities have weaknesses in terms of technology protection, and SMEs tend to avoid technology disclosure. Therefore, in order to solve the difficulties of standardization of companies, it is necessary to establish cooperation system of supporting organizations. In order to promote standardization activities, it is necessary to establish legal basis necessary for technology protection.

  • In accordance with the revision of the Data 3 Act, such as the Personal Information Protection Act, it is possible to process pseudonym information without the consent of the information subject for statistical creation, scientific research, and preservation of public records, and unlike personal information, it is legal for personal information leakage notification and personal information destruction There are exceptions. It is necessary to revise the pseudonym information in that the standard for the pseudonym processing differs by country and the identification guidelines and anonymization are identified in the guidelines for non-identification of personal information in Korea. In this paper, we focus on the use of personal information in accordance with the 4th Industrial Revolution, examine the concept of pseudonym information for safe use of newly introduced pseudonym information, and generate / use / provide / destroy domestic and foreign non-identification measures standards and pseudonym information. At this stage, through the review of the main contents of the law or the enforcement ordinance (draft), I would like to make suggestions on future management / technical protection measures.

Transition from Diagnosis to Assessment System in Public Institution Personal Information Protection Management: Policy Approaches and Recommendations (공공기관 개인정보보호 관리 수준 진단에서 평가 체계로의 전환 : 정책적 접근 및 제언)

  • In the digital age, the importance of personal information has magnified, underscoring the need for enhanced personal information protection, especially within public institutions. Despite ongoing efforts since 2007, significant breaches in public sector information underline persistent vulnerabilities. This study advocates for a transition from a diagnostic to an assessment framework to fortify privacy management in public institutions, as mandated by recent legislative revisions. The amended Personal Information Protection Act introduces an assessment approach, aiming to comprehensively assess and mitigate risks by expanding the scope of evaluation and implementing robust regulatory measures. This study examines the limitations of the current diagnostic practices through literature review and case analysis and proposes a systematic approach to adopting the new assesment system. By enhancing the assessment framework, the study expects to improve the effectiveness of personal information management in public institutions, thereby restoring public trust and ensuring a stable progression into a more secure digital era. The transition to an assessment system is designed not only to address the gaps in the current framework but also to provide a methodical assessment that supports ongoing improvement and compliance with enhanced legal standards.

  • The Korean Society of Law and Medicine has faithfully played the role of professional academic organizations last 20 years in terms of academic activities, accumulated achievements, diversity, professionalism, and influence on academic circles. The Korean Society of Law and Medicine and the Journal of Medical Law serve as a platform for academic information and exchange of opinions on medical law. Medical law began in the midst of increasing conflicts and disputes caused by medical malpractice and the enactment and legal coercion of medical care as pressure on medical workers. It tried to find a way to coexist with each other through the encounter and convergence of medicine and law. Medical criminal law extends from traditional crimes in the realm of life and body protection to bioethics violations caused by the development of biomedical technology, corruption and economic crime in the medical field. Medical law has evolved into a comprehensive legal area dealing with legal issues raised in medical treatment, healthcare, bioethics, and life sciences technology. On the legal side, medical law is not independent legal areas. It is overlapping with traditional law areas such as civil law, administrative law, criminal law, social law, civil and criminal procedure law. However, it is now established as a convergence study in medicine, bioethics, life science, as well as in various fields of law. It has become an area where collaboration is needed with the field of law, medicine, ethics, sociology and economics. Medical criminal law has undergone a dynamic development over the last two decades. The development of medicine and medical technology provides new and innovative methods of diagnosis and treatment. The achievements and risks of revolutionary developments in biotechnology, genetic engineering and medicine coexist. While there is a dazzling achievement that mankind has hoped for: combating disease and improving health, it also creates unwanted side effects and risks to humans. There is a need to reconsider ethical and legal principles. The discovery and development of patient identity and autonomy has changed the medical doctor-patient relationship. Furthermore, it was complicated by the triangle relationship of patients, medical doctors and insurance. Legal matters are also complicated. This is why the necessity of legislation is emerging. Criminal punishment provisions are also required. The Medical Law and Biomedical Law are systematically and coherently deformed as mosaic-based legislation that takes place whenever there are social issues, citizens' needs, and medical organizations' interests, rather than sufficient enactment and revision procedures. It needs a complete overhaul, and this is possible through interdisciplinary collaboration which is the strength of The Korean Society of Law and Medicine.
