Some Methods Determining Reasonable Royalty Rates for Patent Valuation - An Infringement Damages Model (특허가치평가를 위한 합리적 로열티율 산정 방안 - 손해액산정모형을 중심으로)

  • This paper deals with methods for determining the reasonable royalty rates in the valuation of patents. To calculate the reliable reasonable royalty rate of a patent, we review pros and cons of the 25% rule royalty calculating method and the recent trend of this method. We also review the game theory of Nash Bargaining equation and review the Investment of Rate of Return Method according to the financial analysis. Next, we refer to the reasonable royalty damage cases among the recent patent infringement cases in USA and analyze the corresponding patents. We extract the patent indicators from the patent bibliographic information. Finally, we obtain a regression model for calculating a reasonable royalty rate using the patent indicators and the reasonable royalty rates in the recent patent infringement cases.

  • This paper researched that consumers who lived in the local small cites have a restricted and insufficient problem to screening the animation film comparing with those of capital area and the other broader local cities. And these kinds of problems caused more serious problems like a infringement of copy right as a result. This paper calculated and evaluated that the rate possibilities of criminal infringement copy right in supposing that giving the opportunity screening the all of the first-run movies the most highest criminal group in Chuncheon where the worst benefit area in aspect of screening circumstances. As a result of this research, this paper could suggest that the possibility to reduce the criminal infringement of copy right and the necessity of structural reconstruction throughout rebuilding of animation distribution and consciousness of consumers. Thus this paper try find out the importance of reducing the rate of criminal infringement copy right by recontruction of structrual access of local animation business.

  • Technology and culture are converging with various industries to create added value of contents. In addition, the country is creating a foundation environment for grafting new technologies onto the cultural content. However, copyright infringement by voice demand and supply is continuously occurring for cultural contents with copyright, and more and more recently, there have been increasing cases of creating and operating sites with servers overseas to bypass monitoring on infringement sites. To prevent this, various copyright protection studies are under way in many areas, but the current detection and prevention technologies are largely reactive and therefore have problems of effectiveness. Accordingly, this paper proposes a model of the lifecycle of copyright infringement site to lay the foundation for preemptive response to the distribution of illegal copies through analysis of the lifecycle of copyright infringement site.

  • Recently, with the diversification of media services and the development of smart devices, users have more opportunities to use digital content, such as movies, dramas, and music; consequently, the size of the copyright market expands simultaneously. However, there are piracy sites that generate revenue by illegal use of copyrighted works. This has led to losses for copyright holders, and the scale of copyrighted works infringed due to the ever-increasing number of piracy sites has increased. To prevent this, government agencies respond to copyright infringement by monitoring piracy sites using online monitoring and countermeasure strategies for infringement. However, the detection and blocking process consumes a significant amount of time when compared to the rate of generating new piracy sites. Hence, online monitoring is less effective. Additionally, given that piracy sites are sophisticated and refined in the same way as legitimate sites, it is necessary to accurately distinguish and block a site that is involved in copyright infringement. Therefore, in this study, we analyze features of piracy sites and based on this analysis, we propose an intelligent detection technique for piracy sites that automatically classifies and detects whether a site is involved in infringement.

  • With the increase in copyright content exports to overseas markets due to the recent globalization of the Korean culture, the added value of the Korean digital content market is increasing at a significant rate. As such, as the size of the copyright market increases, different piracy sites have emerged that generate profits by illegally distributing works without the permission of the copyright holders, resulting in direct and indirect damage to these copyright holders. The existing copyright detection methods used in public institutions for solving this problem are limited, while the piracy sites are ever-changing. Methods are being continuously developed to achieve better detection results. To this end, it is possible to detect the latest infringement site domain by detecting the infringement site domain that is constantly changed through the search engine. This paper proposes an improved piracy site detection method using a search engine to prevent the damage caused by piracy sites.

Regression Models for Determining the Patent Royalty Rates using Infringement Damage Awards and Inter-Partes Review Cases (손해배상액과 무효심판 판례를 이용한 특허 로열티율 산정 회귀모형)

  • This study suggested quantitative models to calculate a royalty rate as an important input factor of the relief from royalty method which has the characteristics of income approach method and market approach method that are generally used in the valuation of intangible assets. This study built a royalty rate regression model by referring to the patent infringement damages cases based on royalties, i.e., by using the royalty rates as a dependent variable and the patent indexes of the corresponding patent right as independent variables. Then, a logistic regression model was constructed by referring to inter-partes review cases of patent rights, i.e. by using not-unpatentable results as a dependent variable and the patent indexes of the corresponding patent right as independent variables. A final royalty rate was calculated by matching the royalty rate from the royalty rate regression model with a not-unpatentable probability from the logistic regression model. The suggested royalty rate was compared with the royalty rate obtained by the traditional methods to check its reliability.

  • Recently, distribution transfer velocity was extremely lowered by high supply rate of vehicle and low road rate. In the meantime, while elevated structures construct, they go through the civilian residential section, agriculture land, etc. The consequence is that it raises a vibration, noise, dust, an infringement of the right to a view and an infringement of the right to a sunshine. In this study, we analyzed Quantitatively sunshine quantity with building 3D simulation model of civil structure. Therefore, we present as planning data to reduce a civilian appeal for dispute of the right to sunshine and an economic and time loss between the government and construction company In addition to that, for the standard of the standard plan of usable sunshine quantity program in the practical business, the building of convenient user interface will be the project to be done.

Efficient Illegal Contents Detection and Attacker Profiling in Real Environments

  • With the development of over-the-top (OTT) services, the demand for content is increasing, and you can easily and conveniently acquire various content in the online environment. As a result, copyrighted content can be easily copied and distributed, resulting in serious copyright infringement. Some special forms of online service providers (OSP) use filtering-based technologies to protect copyrights, but illegal uploaders use methods that bypass traditional filters. Uploading with a title that bypasses the filter cannot use a similar search method to detect illegal content. In this paper, we propose a technique for profiling the Heavy Uploader by normalizing the bypassed content title and efficiently detecting illegal content. First, the word is extracted from the normalized title and converted into a bit-array to detect illegal works. This Bloom Filter method has a characteristic that there are false positives but no false negatives. The false positive rate has a trade-off relationship with processing performance. As the false positive rate increases, the processing performance increases, and when the false positive rate decreases, the processing performance increases. We increased the detection rate by directly comparing the word to the result of increasing the false positive rate of the Bloom Filter. The processing time was also as fast as when the false positive rate was increased. Afterwards, we create a function that includes information about overall piracy and identify clustering-based heavy uploaders. Analyze the behavior of heavy uploaders to find the first uploader and detect the source site.

A Study on Correlation Analysis of Smart Phone Addiction and Age Groups in Korea

  • As information and communication technology develops, it brings various benefits to our lives. However, information and communication technology has had various side effects in our lives. Representative side effects include internet addiction, smartphone addiction, copyright violation, personal information infringement, cyber bullying and hacking. Recently, smart phone addiction rate is increasing with the spread of smart devices in Korea. In this study, we analyze the correlation between age group and smartphone addiction. In order to obtain fair and objective results, statistical analysis was performed based on the national statistical data of the National Information Society Agency. The results showed that the infant group and the adult group were correlated with the smartphone addiction rate. In this study, we analyzed the causes of smartphone addiction for different age groups. We also discuss dangers of smartphone addiction for different age groups. In additions, we proposed various ways to prevent and cure smartphone addiction for infants, adults, and senior citizen group. The results of this study are expected to be widely used as a remedy for smartphone addiction and future smartphone addiction research works.

The Effect of Alliance Activity on Patent Litigation : In the Case of Printed Electronics (기업의 제휴활동이 특허 소송 관계에 미치는 영향 : 인쇄전자 산업 중심으로)

  • Patent litigation has been considered as a tool to protect and facilitate innovation. Ironically, yet, the misguided uses of patent litigation as a strategic tool for vigilance against competitors are acting as a hindrance for innovation. Previous studies show that the better the quality of a patent, the higher the chance of the patent being litigated. Therefore, it is particularly important for the innovating firms to take strategic precautions to minimize the risk of patent litigation. This study investigates the moderating role of firms' past alliance experiences on the relationship between patent quality and patent litigation from the perspective of a defendant. A unique dataset on patents, infringement lawsuits, and firm performances in the printed electronics industry confirms that firms' previous alliance experiences mitigate the impact of patent quality on infringement litigation. For instance, the results confirm that the presence of past alliance experience reduces the litigation rate by 33% for firms with median-quality patents. This paper makes two major contributions. First, it contributes to the literature on alliance experience by confirming its role as a reputation in mitigating future litigations. Second, this paper contributes to the literature on patent litigation by identifying a unique moderator, i.e., alliance experience, on the linkage between patent quality and litigation. An innovating firm is likely to become an alleged infringer under a false accusation. Therefore, this paper focuses on firms that partake in infringement lawsuits unwillingly. Despite the importance, to the best of our knowledge, this is the first study to investigate patent litigations from the perspective of defendants.
