외국인 노동자의 이주 특성과 연구동향 (Migrant Characteristics of Foreign Workers and Research Trends in Korea)

  • 이 연구는 외국인 노동자에 대한 연구들을 주제와 방법론을 중심으로 메타분석적 차원에서 논의한다. 외국인 노동자들이 본격적으로 유입되기 시작한 1980년대말 이후 외국인 노동자 사회는 유입 인구의 급증, 불법체류자의 높은 비율, 개발도상국 출신 저숙련직 종사 젊은 남성층의 높은 비중, 외국인 노동자 지원단체의 성장 등의 변화를 겪으며 꾸준히 성장해왔다. 이와 더불어 외국인 노동자에 대한 연구들도 이 같은 외국인 노동자의 이주과정의 특성들을 반영하면서 주제들이 다양해졌고 방법론도 세련되어 왔다. 그럼에도 불구하고 이들 연구는 여전히 주제면에서 거시적 수준에 치중된 측면이 있고, 외국인 노동자 일부에 한정되어 있으며, 실태와 현황에 관한 기술적인 연구의 비중이 높은 문제점이 있다. 방법론적인 측면에서는 경험적이거나 양적인 자료보다는 이론적이거나 질적인 자료에 바탕을 둔 연구의 높은 비중, 표본의 대표성 결여, 언어소통의 중요성에 대한 인식부족의 문제점을 지니고 있다. 이상의 분석결과를 바탕으로 이 연구는 외국인 노동자들에 대한 연구를 보다 향상시키기 위한 방안을 제시한다.

외국인 노동자의 특성과 의료이용 실태 (The Characteristics and Medical Utilization of Migrant Workers)

  • This study deals with the current medical utilization for migrant workers and the characteristics of them. The purpose of this study is to provide the basic information to establish proper medical policy. For the study self-made questionnaire was used, which was answered by 453 migrant workers working in the area of manufacturing and non-technical work in 10 cities like Seoul, Inchon, Namyangju, Sungnam, Kwangju, Pyungchon, Kunpo, Kimpo, Masuk in Kyungki-do and Chunan in Chungchungnam-do. Besides, 303 medical records of those who had visited free medical check-up center were analyzed. The period of accumulating data is 6 months, from November 1st, 1996 to April 30th, 1997. The characteristics of migrant workers and current medical utilization are analyzed by percentage and the relation between characteristics and current medical utilization were analyzed using ${\chi}^2$-test, t-test, ANOVA. The finding of this study was as follows : 1) The number of nationality was 16. The first majority was Philippians as 32.0%. Among 16 nationalities Southeastern and Northern Asians were 48.9%, Southwestern Asian was 46.5%, the rest was 7.3%. Men were 81.0%, those who are aged from 26 to 30 were 39.0%, Graduatee from high school 92.7%, Christians 56.3%, unmarried 55.4% and salary from 600,000 Won to 800,000 Won 53.8% averaging monthly payment 669,810 Won. As for their residence, those who resided over 3 years were 31.9% and the illegal residence reached 77.4%. As for Korean language, those who speak in middle level were 5.6%. 2) As for kind of work and circumstances, manufacturing was 81.1%, 4 off-days per month 72.2% and 9-10 working hours per day 42.1%. As for accommodation, residence in fabric was 62.6% and one or two members as roommate 40.2%. 3) The characteristics of health behavior showed that 89.4% of migrant workers had 3 meals, 70.9% of them did not drink alcohol, 73.5% of them did not smoke. 4) As a characteristic of health status, 71.8% of them perceived of their health. 76.1% thought that they had no illness before coming Korea. Among them who recognized their illness, those who had problem in circulatory system was 35.3%, respiratory system ENT 19.1% and nervous system 19.1%.66.2% of those having illness had already had sickness when coming to Korea. 5) During last one month, 79.2% of them were known as ones having no illness. Among the sick, those who had problem in circulatory system was 31.6%, nervous system 23.7% and respiratory system 21.1%. 60.3% of the sick were not cured at that time. 6) Sorting the symptom of those who visited free medical check up, dental care was 24.2%, orthopedic 14.0% and digestive system 13.8%. Teethache was 34.4%, stomach problem 11.6%, upper respiratory inflammation 10.2% and back pain 5.9%. Averagely they visited free medical check up 1-2 times. According to symptom, epilepsy 25.5 times, heart and vascular disease 9 times, constipation 2.8%, neurosis 2.38 times and stomach problem 2.34 times. 7) The most frequently visited medical service by migrant workers was hospital. The most mentioned reason was good healing as 36.3%. The medical service satisfied migrant workers mostly was hospital as 64.3%. The reason of satisfaction was also good healing as 45.9%. 8) 77.2% of respondents did not spend money for medical check. Average monthly medical cost was 25,100 Won, 3.7% of income. Those who had no medical security was 73.4%. In their case, 67.7% got discount from hospital or support from working place and religious organization. 9) As for the difference of medical utilization according for the characteristics of migrant workers, legal workers and no-Korean speaker used hospital more frequently. 10) Those who were satisfied most of all with the service of hospital were female workers, hinduists and buddhists, legal workers or manufacture workers. 11) Christians, those who have 3 meals or recognize themselves as healthy ones mostly had no illness. As a result, the most of migrant workers in Korea are from Asia. They are good educated but are working in manufacturing and illegal. Their average income is under 700,000 Won which in not enough for medical cost. They have no medical security and medical fee is supported by religious organization or discounted. Considering these facts the medical policy by government is to be established.

급성메탄올중독사고, 왜 발생했으며, 그 대책은 무엇인가? (What Caused Acute Methanol Poisoning and What is the Countermeasure?)

  • Objectives: Acute methanol poisonings known to be typical occupational diseases occurring in developing countries broke out in sub-contract manufacturers in the early 2016. The present paper attempted to identify underlying causes which hide under apparent findings, and suggest alternative policies to prevent recurrence of similar intoxication Methods: We evaluated occupational health and safety characteristics of workers in micro-enterprises similar to workplaces with methanol poisoning by in depth-interview of employers, workers, and labor inspectors, and literature review. Results: The common findings of workplaces with methanol poisoning were addressed; First, the victims were illegal agency workers. Second, the workplaces were sub-contract micro-manufacturers with less than 5 employees. Investigators found that local ventilations did not work, while most of workers did not wear any proper personal respiratory protective equipment in the workplace. In addition, periodic environmental monitoring and medical check-ups were not done. However, these apparent findings do not appear to be root causes of methanol poisoning. Our in depth-analysis clarified a root cause; micro-enterprises with less than 5 employees are exempted with essential regulations of OSH Act, and employers do not know about OSH Act. Conclusions: We suggest occupational health policies to prevent recurrence of similar intoxication; First, government should introduce programs so that all employers should know about employers' responsibilities in OSH Act from the start of business. Second, even manufacturers with less than 5 employees should not be exempted with essential regulations of OSH Act. Finally, employers should take responsibilities for health and safety of all the workers including agency workers working in workplaces.

적정임금제 도입을 통한 산업재해 감축 필요성 고찰 (Need to Reduce Industrial Accidents through the Introduction of an Prevailing Wage System)

  • 건설업의 적정임금제 도입 필요성은 건설공사를 수행하기 위해서는 치열한 경쟁 수준을 넘어 다수의 Project가 저가입찰에 바탕을 둔 원청사 들의 출혈경쟁으로 낙찰된 프로젝트의 원가부담은 하청업체로 고스란히 넘어가고, 다시 일용 근로자의 임금삭감으로 이어지는 악순환을 끊기 위해서는 최소한의 임금이 보장될 수 있도록 적정임금제 도입이 시급하다. 연구 목적:불법 다단계 산업구조를 가지고 있는 건설업은 발주자(100%)→원 도급사(80%) →하도급사 (65%)→재하도급(65% 이하)로 이어지는 임금삭감의 환경을 개선해야 할 필요가 있으며, 미국의 적정임금제 사례조사와 같은 우리에게 맞는 적정임금제도를 시행하므로 말단 근로자들의 임금이 보장 되도록 만드는데 목적이 있다. 연구방법 : 건설업의 노무비 적정 지급방안의 현황을 조사하고, 미국의 적정임금제(P.W) 사례를 조사한다. 그리고 적정임금제의 효과 및 추진방향을 제시한다. 연구결과: 헌법에도 개인의 최저 임금보장이 언급되었으며, 다수의 연구자들은 적정임금제 도입만이 근로자 노임이 삭감되는 문제를 해결하고, 품질과 안전이 확보될 수 있다는 의견을 제시하였다. 결론: 건설업의 적정 임금제 시행은 불법 다단계와 불법외국인 근로를 차단하고, 건설시장의 노동환경을 개선하여 청년근로자를 유입을 만들어 낼 것이며, 건설업 수주경쟁구조 개선, 안전, 품질에도 많은 영향을 미칠 것이다.

건설업 재해처리에 대한 환경 및 인식변화 고찰 (A Study about Circumstances and Perception of Construction Accident Compensation)

  • 건설현장에서 발생하는 재해는 산업재해보상보험으로 보상되는 것이 정상적인 방법이나 일부 재해는 발생사실을 은폐하여 건설업체나 현장에서 직접 보상하는 음성적인 방법인 ‘공상처리’를 하는 경우도 있다. 이러한 음성적인 방법은 공공 공사 입찰에 반영되는 PQ점수에서 가점을 받기위한 목적도 있으며, 향후 수주활동에 불이익을 당하지 않으려는 협력업체의 입장도 반영된 것으로 볼 수 있다. 일부는 재해율에 대한 건설업체의 약점을 알고 이를 이용하여 부당한 산재보상을 요구하는 경우도 있다고 한다. 본 연구는 건설현장의 재해가 미치는 영향과 환경을 알아보고, 이에 대한 건설공사 참여자의 인식을 조사하여 문제점 파악 및 대안 도출의 기초자료를 제공하는 것이다.

해방 직후 남한 귀환자의 해외 재이주 현상에 관한 연구 -만주 '재이민'과 일본 '재밀항' 실태의 원인과 전개과정을 중심으로, 1946~1947- (A Study on the Migration Phenomena of Korean Repatriates just after Liberation -Focus on Illegal Moving Back to Manchuria and Japan, 1946~1947-)

  • The liberated korea has the estimated population 16 million in 1945, and added 2.5 million just after an year. The korean repatriates returned by way of 2 main routes. The returnees, Wol-Nam-Min(former residents in north korea), and repatriates from Manchuria came into south korea over the 38th division line. The other repatriates from japanese islands and pacific areas came into Busan port and the vicinity. The repatriates who returned from the China and the Japanese islands made up about 80% of the total added population. However, the influx of overseas repatriates who explosively increased between 1945 and 1946, declined abruptly in April of 1946, and at last illegal re-emigration group to Manchuria and Japan Appeared, who had repatriated from those areas. This study deals with the "re-migration phenomenon of 1946" in korea, mainly focuses on 1) the motivation for those who decided to remigrate, their prospects of resettlement in Manchuria and post war japan after re-migration, 2) the structural problems of the Korean society in 1946-1947, and 3) the social recognition for the people who letf for Manchuria and Japan. This study proved the cause and background of re-migration phenomenon. The Manchuria case, the local authorities wanted farmers and peasants who could cultivate the abandoned land which had been originally pioneered and reclaimed by korean poor peasants, who repatriated to korean peninsula. On the other hand, the korean repatriates had a hard time in tenanting farmland, and so much difficulty in getting farming tools including fertilizer. That's why they left korea for Manchuria again. The Japanese case, the korean repatriates had a tough life owing to the restriction of properties left in japan, while the inflation and food shortage in korea got worse and worst. Accordingly, many koreans tried illegal entrance into post war japan. This study is a part of clarifying the universality and specificity of post war repatriation and migration issues developed in the south Korea. Through this study, we can find how difficult it is for newly liberated areas to accommodate repatriates and make them ordinary nationals in harmonic way with successful social integration. and we can observe the social aspect and administrative ability of newly liberated south korea in detail, Because the present korea has faced with so many problems connected with immigration workers and re-setting with korean communities abroad, we should introspect these historical experience of our own.

현장 안전관리 감독자의 smartmaker 를 활용한 건설현장 근로자 정보 관리의 관한 연구 (A Study on the Information Management of Construction Workers Using Smartmaker of Site Safety Management Supervisor)

  • 본 연구의 목적은 건설현장 근로자의 데이터 공유 시스템를 기반으로 건설재해 예방을 위한 근로자 정보 관리 모델을 구축하는 것이다. 이를 위해 첫째, 행연구 고찰을 통해 국내 건설현장의 외국인 근로자 현황을 파악하고, 정보 관리 애플리케이션에 대한 정보를 수집한다. 둘째, 스마트메이커 시스템을 활용하여 Brain storming을 실시하고, Aws를 통해 구축된 서버와 Family tree를 기반으로 개발된 애플리케이션의 기능을 분석한다. 셋째, 전문가 의견조사를 통해 개발된 정보 관리 모델의 경제성 및 효용성을 평가하고, 추가적인 기능 고찰 및 개선방안을 도출한다. 넷째, 개발된 정보 관리 모델의 국내 건설현장에서의 적용성에 대해 종합적으로 검토한다. 그 결과, 노무관리자와 현장 관리자 간의 보고체계가 단순화되어 노무자의 성실성 및 안전관리의 편리성이 있는 것으로 평가되었으며, 기능 추가 관련 사항으로는 자동 로그인 기능을 추가하여 편리성을 보완한다면 더욱 효과적일 것이라는 결론을 도출할 수 있었다. 본 연구의 결과는 향후 건설현장의 안전관리 시스템 구축연구의 기초자료로 활용될 것이다.

Barriers to Health Service Utilization Among Iranian Female Sex Workers: A Qualitative Study

  • Objectives: In most countries around the world, sex work is an illegal activity. Female sex workers (FSWs) in Iran hide their identities, and they are known to be a hard-to-reach population. Despite free access to HIV testing, fewer than half of FSWs receive HIV testing. The purpose of this study was to characterize the reasons for which FSWs do not seek testing at drop-in centers (DICs) and voluntary counseling and testing (VCT) centers in Iran. Methods: A qualitative study was conducted in 2016. The participants were 24 FSWs who received services at VCT centers and DICs for vulnerable females in the north of Iran and 9 males who were the clients of FSWs. In this study, we made use of purposive sampling and carried out a thematic analysis. Results: We found 4 major and 6 minor themes. The major themes were: fear of being infected (with HIV), stigma, indifference, and knowledge. Conclusions: Despite the significant efforts made by the government of Iran to establish and expand DICs for vulnerable females, the number of FSWs receiving services at these centers has not been very considerable. Consequently, by introducing and implementing training programs for peer groups, it may be possible to take steps toward establishing strategic programs for the control and prevention of HIV/AIDS.

우리나라 어선감척사업 현황과 개선방향 (Present Status and Direction of Improvements in Fishing Vessels Buyback Program in Korea)

  • The fishing vessel buyback program, that is, the project of fishing vessel reduction is a complex challenge that needs to take into consideration for both fishing resource protection and industrial restructuring. By the way, the fishing vessel buyback program in Korea is still poorly fruitful and there are few applications for the project in the country. For example, the buyback program of this nation has some problems like uncertainly set goals, conflicts among targets, no flexibility in the program implementation, low participation in the project and lack in follow-up actions. To solve these problems, this study offers the following alternatives. First, it is setting up detailed targets for fishing vessel buyback. Those targets should be what can be actually driven under policy support, such as reduction in illegal fishing, decrease in an exact number of fishing vessels and decline in fishing capacity rather than what seem to be comprehensive such as protection of coastal or offshore fishery and industrial restructuring. Second, it is taking measures for the livelihood of those who would face disadvantages due to fishing vessel reduction. Those measures providing or supporting the re-education and re-employment of fishery workers and building up systems that help the workers transfer fishing to another job. Third, it is adopting the governance system that overcomes lacks in communications between the fishing vessel buyback program and improves the performance effectiveness of that program. Here, governance means that businesses and authorities concerned in the program interact and cooperate with one another in making and implementing policies related to the project of fishing vessel reduction and assessing the results of that project. Fourth, it is taking actions for fishery reorganization after the fishing vessel buyback program. Factors that can be considered as those actions include supporting fishery workers' cost of fishing vessel reduction, decreasing and modernizing fishing fleets and improving the quality of fishing equipment. In conclusion, the fishing vessel buyback program should be prepared with comprehensive actions or measures that can cope well with a variety of problems that may be arisen from it while keeping itself on the track of its original goals.

항만배후부지개발시 단지 내 주차난 해소를 위한 법률적.실무적 시사점 - 부산항 신항 배후부지의 사례를 중심으로 - (Legal and Practical Issues in Parking Space Problems at the Port Hinterland(Distripark): A Case Study of Busan New Port)

  • 부산항 신항 및 배후지를 포함한 관련 분야의 개발이 점진적으로 추진되어 정착 단계로 진입하고 있으나 항만 지원시설 및 물류센터의 운영 등은 아직도 정상수준에 크게 미치지 못하고 있다. 특히 부산항 신항 주차 시설 부족 문제의 경우 단지 내 충분한 주차공간의 부족 때문에 항만 간선도로까지 승용차들이 주차하고 있을 뿐 아니라 이에 따른 교통사고 위험에 대한 특별한 대책이 없어 대응책 마련이 절실한 실정이다. 부산신항의 사례에서 보듯이 배후부지 전체를 임대용으로 처리하는 것은 바람직하지 않다. 따라서 향후 항만 배후부지 임대시 샤시 보관소용 일부 공공용지를 추가로 남겨둘 것을 권고한다. 또 향후 입주업체 선정 시 주차부문에 대해서는 승용차용 주차공간과 함께 트레일러 주차계획에 대해서도 철저히 검증해야 평가에 반영해야 한다. 아울러 지자체 및 경찰은 주차단속의 실질적인 주체이기 때문에 부산항만공사, 지자체, 경찰청 등 관련기관의 원활한 협력체제 확립이 필수적인 선결요건이다. 특히 지자체는 동 구역이 항만 배후부지라고 해서 무관심한 태도를 보여서는 안된다. 지자체 및 경찰은 자신들의 행정구역내에서 발생하는 주차 무질서를 해소하는데 보다 적극적인 자세를 보여야 한다.
