적응형 복합 분류 알고리즘을 이용한 초소형 전자소자 탐지 향상 기법 (Improved Detecting Schemes for Micro-Electronic Devices Based on Adaptive Hybrid Classification Algorithms)

  • 본 논문은 지적재산권 보호를 위한 방안으로 적응형 알고리즘 기반의 초소형 전자소자 탐지 기법을 제안한다. 전자소자를 탐지하는 기본 원리는 분류기의 송신기에서 특정 기본 주파수의 전파가 은닉된 물체로 전파되면, 물체로부터 반사되어 수신기로 들어오는 2차 및 3차 고조파의 크기를 분류기가 비교함으로써 판별하게 된다. 하지만, 측정 과정에서 발생하는 잡음 및 전자파의 간섭으로 인해 분류의 성능이 저하되므로, 이러한 환경에서도 은닉된 전자소자를 적응적으로 판별하기 위해 Fuzzy c-Means 클러스터링 알고리즘과 ${\kappa}$-Nearest Neighbor 분류 알고리즘을 복합적으로 이용하는 방안을 제시한다. 모의실험 결과, 제안 기법이 잡음 및 전자파 간섭 환경에서도 적응적으로 전자소자 잘 탐지할 수 있었으며, 이에 따라 지적재산권을 효율적으로 보호할 수 있을 것으로 기대된다.

  • 최근 COVID-19 팬데믹은 인류의 생명과 안녕을 위협하면서 이전에 경험하지 못했던 고통을 안겨주고 있다. COVID-19 팬데믹을 계기로 인간안보는 다시 소환되었다. 그러나 태생적 한계와 권위주의 통제모델에 의해 역설적으로 인간안보의 위협요인이 되고 있다. 먼저 이 논문은 먼저 COVID-19를 중심으로 인간안보 개념의 분석적 엄격성을 제고한다. 이를 토대로 현실적으로 제기된 인간안보 이슈들을 반영한 실천모델을 재구성함으로써 인간안보의 실천적 유용성을 향상시키고자 한다. 특히 COVID-19 팬데믹이 자연재해가 아닌 국제사회의 부도덕과 분열에 기인한 인위적 대재난이라는 관점에서 접근한다. 동시에 인간안보의 근본적 가치인 인권과 현실적 과제인 방역을 균형적으로 실현하기 위하여 신흥안보(emerging security) 관점을 반영한 다자주의 거버넌스모델(Multilateralism Governance Model)을 제안한다.

  • Land is the only immovable property that can be used, as a means for agricultural production as well as a means for mortgage for financing industrial or commercial enterprises. Spatial technologies play a key role in managing our land, water and natural resources. Cadastral data is a major component for the development of Land Information System. Therefore, systematic land registration system based on accurate and scientific cadastral map are found inevitable for poverty alleviation, good governance and women empowerment through security of their rights on property, as well as the planning and development of a sustainable environmental protection within Metropolitan city. Digital cadastral parcel is the fundamental spatial unit on which database is designed, created, maintained and operated. Availability of accurate and updated cadastral maps is a primary requisite for successful planning, policy formulating and maintenance of city utility services, which need cadastral and utility information together. Flawed cadastral maps can put land, revenue and taxation system at stake. Kathmandu the capital city of Nepal still is lacking utility maps combining cadastral information with the utility. There is an urgent need to have an effective, accurate and easy to access land revenue and utility services system within the urban areas which could be achieved after the production of reliable base maps and land registration system to guarantee land allocation and property rights which can well be achieved by digital conversion and correction of base cadastral maps. This paper highlights the drawbacks of the conventional cadastral maps and the possible advantages of digital cadastral maps over these. Also the problems, issues and implications during digital conversion and creating database of the same will be discussed.

  • 2012. 2. 1. 의료법이 개정되며 의료인은 2개 이상의 의료기관을 개설할 수 없을 뿐 아니라 운영에도 관여할 수 없게 되었다. 그러나 이러한 개정 법률의 입법목적이 무엇인지 불분명할 뿐 아니라 여러 제반사정을 기초로 입법목적을 확정하더라도 개정 법률이 그러한 목적을 달성하기에 적합한 수단이 되기 어렵다. 이 글에서는 의료법 개정 경과와 의료기관 1인 1개설주의의 연혁, 개정 의료법의 입법목적을 확정 검토하는 한편, 개정 의료법이 제한하는 기본권과 명확성의 원칙, 과잉금지원칙을 토대로 동 법률의 위헌성을 살펴보기로 한다.

강유위(康有爲)의 『대동서(大同書)』에 보이는 종교적 성향 (The religious perspective of Kang, You Wei in Da-tong-shu)

  • 강유위(康有爲)의 신관(神觀)은 유학과 불학의 만물동근(萬物同根)이라는 개념에서의 천(天) 및 상제(上帝)와 기독교의 신관을 아우르고 있다. 그는 신령들의 경중고하(輕重高下)를 인정하고 부인지심(不忍之心)의 근원은 바로 하늘과 땅을 낳은 지상신(至上神)으로서의 상제(上帝)이고, 극단적인 사회개혁을 추진해야만 한다는 당위성의 윤리적인 근거도 상제의 실존에서 찾았다. 그는 영혼불멸을 신봉하였고 사람의 인권은 하늘이 부여한 것이라는 관점에서 개개인이 평등하므로 남녀의 평등은 가장 기본적으로 준수해야 될 대동세의 윤리가 되도록 했다. 천부인권(天賦人權)과 남녀평등은 그의 사회개혁을 이끄는 중심으로서, 그것을 실현하는 것이 바로 하늘을 닮아 난 사람이 지향해야 될 가장 기본적인 도리라고 강조하였다. 하늘을 대신하여 '천민(天民)'을 돌보는 '공정부(公政府)'가 최선의 방책을 다하여 보장하도록 하는 사회개혁안도 이러한 종교적인 성향의 신념으로부터 출발된 것으로, 대동서에 나타난 그의 전체 사상 체계 중에서 종교적 성향은 일관되게 견지하는 바탕이 되었다.

베트남 법체계에 있어서 외국중재판정 승인 및 집행 (Recognition and Enforcement of Foreign Arbitral Awards in the Vietnamese Legal System)

  • Vietnam is an important country with many trade transactions with the Republic of Korea. Arbitration is a method of resolving disputes that can arise with the increase in trade transactions. It is essential to study the legal system and precedents of Vietnam on the approval and enforcement of foreign arbitral awards. Such is the case because the law in Vietnam and the court's position on the approval and enforcement of foreign arbitration awards issued by the courts depend on the possibility of realizing the parties' rights concerning their disputes. Therefore, it is of great value both theoretically and practically to analyze the exact differences between approval and the denial of approval. Vietnam has enacted the Commercial Arbitration Act, which replaces the previous Commercial Arbitration Decree and creates an arbitration-friendly environment that meets international arbitration standards. Regarding the approval and execution of foreign arbitration awards, the Commercial Arbitration Act, the Civil Procedure Act, the Civil Execution Act, and the Vietnam Foreign Arbitration Awards Approval and Enforcement Ordinance are regulated. Following these laws and regulations, the reasons for the approval, enforcement, and rejection of the arbitral award are specified. In accordance with these laws and inappropriate arbitration agreements, an arbitral award beyond the scope of its right of disposition, an arbitral tribunal, or the concerned parties could not be involved in a proceeding or an arbitral award if the involved party does not have an opportunity to exercise its rights lawfully. If the state agency in the forum does not recognize the arbitral award, the dispute is not subject to arbitration under Vietnamese law, or the arbitral award does not conform to the basic principles of Vietnamese law, the parties are not bound, and the foreign arbitration award is rejected for approval and execution.

원자력안전법에 대한 방사선학과 학생들의 학습권 보장에 관한 연구 (A Study on the Guarantee of Learning Rights of Radiology Students in Nuclear Safety Act)

  • The study developed a radiation dose measurement program in the radiology laboratory to measure how much exposure the students are exposed to during the radiology class, to request for the improvement and the revision of the current Nuclear Safety Act. The experimental program is shown in the following figure, and experiments were conducted to determine the degree of radiation exposure in the control room with a lead gown at a distance of 1 m, 2 m, and 1 m, and in a control room with a radiographic lead glass wall. The duration of the experiment was 3 months from April to June, when radiation imaging practice classes were conducted, and 128 hours of imaging practice per month were conducted. In order to find out the dose of radiation dose during radiology imaging practice class, the experiment was carried out from April to June for 3 months, and according to the program, the results of exposure dose were 0.34 mSv at 1 m distance, 0.01 mSv at shielding of lead gown at 1 m distance, 0.16 mSv at 2 m distance, and 0.01 mSv at control room with radiation lead glass wall. The exposure dose from the test results was much below the annual general public limit dose of 1 mSv. The restriction on the operation of the radiation equipment in the practice of the students is a regulation that infringes the right of students to learn, and amendments or exemptions of Nuclear Safety Act should be enacted to ensure that it does not violate the fundamental right to learn for students in radiology.

Biodiversity Conservation and Its Social Implications: The Case of Indigenous and Community Conserved Areas in Sabah, Malaysia

  • With natural resources-terrestrial or coastal-fastly diminishing, governments are now resorting to biodiversity conservation, fast-tracking the introduction of new legislations, as well as the amendment of existing ones, and laying out programs that interpret existing practices and research agendas. This paper examines how biodiversity conservation-in addition to eco-tourism-has become an important symbol of the modernizing state of Sabah, Malaysia. It further examines the effects of biodiversity conservation on state and community management of natural resources, with particular reference to the management of natural resources by the indigenous peoples of Sabah. Citing case studies and focusing on a forest community at Kiau Nuluh, in the district of Kota Belud, Sabah, this paper evaluates strategies used by indigenous groups to maintain access and control over the management of natural resources-and by implication to livelihoods-via ecotourism, making creative alliances with non-government organisations as well as forging cooperation with government agencies which act as custodians of these resources. For a majority of indigenous groups however, the practice of biodiversity conservation has meant reduced and controlled access to natural resources, considering the fundamental issue of the lack of security of tenure to the land claimed under customary rights. New initiatives at recognizing Indigenous and Community Conserved Areas (ICCAs) by international conservation groups provide a means for tenure recognition, for a price, of course. The recognition of ICCAs also faces obstacles arising from developmentalist ideology which upholds that forests are valuable only when converted to other land use, and not left to stand for their intrinsic value.

천안함·연평도 도발 이후 국민의식 변화와 대책 (Cheonan Frigate Incident and Yeonpyeongdo Shelling by North Korea: Changing Public Opinion; Strategic Consideration)

  • During the four years following the sinking of the Cheonan frigate in 2010, the South Korean public opinion has seen changes in four basic ways. First, public polls with respect to the cause of the sinking show that 70% of the people consider North Korea as the culprit, while 20% maintain that it was not an act carried out by North Korea. Second, the opinions relative to the cause of the incident seem to vary according to age difference, generational difference, and educational difference. From 2011, people in their 20s showed 10% increase in regarding North Korea as the responsible party. People in their 30s and 40s still have a tendency not to believe the result of the investigation carried out by the combined military and civilian group. Third, the most prominent issue that arose aftermath of the Cheonan incident is the fact that political inclination and policy preference are influencing the scientific determination of the cause. In other words, scientific and logical approach is lacking in the process of determining the factual basis for the cause. This process is compromised by the inability of the parties concerned in sorting out what is objective and what is personal opinion. This confused state of affairs makes it difficult to carry on a healthy, productive debate. Fourth, rumors, propaganda, and disinformation generated by pro-North Korea Labor Party groups in the internet and SNS are causing considerable impact in forming the public opinion. Proposed Strategy 1. The administration can ascertain public trust by accurately determining the nature of the provocation based on accurate information in the early stages of the incident. 2. Education in scientific, logical, rational methodologyis needed at home, school, and workplace in order toenhance the people's ability to seek factual truths. 3. In secondary education, the values of freedom, human rights, democracy, and market economy must be reinforced. 4. It is necessary for the educational system to teach the facts of North Korea just as they are. 5. Fundamental strength of free democratic system must be reinforced. The conservative, mainstream powers must recognize the importance of self-sacrifice and societal duties. The progressive political parties must sever themselves from those groups that take instructions from North Korea's Labor Party. The progressives must pursue values that are based on fundamental human rights for all. 6. Korean unification led by South Korea is the genuine means to achieve peace in a nuclear-free Korean peninsula. The administration must recognize that this unification initiative is the beginning of the common peace and prosperity in the Far East Asia, and must actively pursue international cooperation in this regard.

의료인의 면허제한 범위 확대와 기본권 제한 -의료법 개정안을 중심으로- (Extending the Scope of License Restrictions for Medical Personnel and Limiting Fundamental Rights - Focusing on the Revision of the Medical Law -)

  • 의료인의 면허를 제한하기 위해서는 기능적인 측면과 도덕적·윤리적인 측면이 함께 검토되어야 한다. 현재 「의료법」에 규정된 의료인의 결격사유를 '금고 이상의 실형'을 선고받은 모든 범죄로 확대하는 것에 대한 논란이 있다. 그러나 국가 공동체의 질서유지를 위해 법률로 금지한 행위를 한 의료인에 대한 제재가 미흡할 경우, 의료인 전체에 대한 신뢰 저해를 불러올 수 있다. 또한 금고형의 선고는 비난가능성이 높다는 것을 의미한다. 따라서 의료인의 범죄 유형과 관계없이 비난가능성이 높은 형벌을 받을 경우, 해당 의료인에 대한 신뢰뿐만 아니라 전체 의료인, 나아가 국가 보건의료체계에 대한 신뢰확보가 어렵게 된다. 결국 공익의 측면에서도 면허제한 범위 확대는 과잉금지원칙에 위배된다고 볼 수 없다. 그러나 의료행위는 불완전하고 예측 불가능하기 때문에 언제나 악결과가 발생할 개연성이 높다. 따라서 의료행위 중 업무상과실이 발생한 경우, 면허제한은 형사책임과 별개로 해당 의료인의 의료행위 수행 가능성·적정성 등, 기능적인 측면을 세심하게 검토하여 면허제한 정도를 결정해야 한다. 이처럼 의료인의 면허제한에는 다양한 변수에 대한 고려와 전문적인 판단이 필요하기 때문에 독립적인 면허심의 기구를 설치하여 면허관리의 전문성을 확립할 필요가 있다.
