Remediation of Contaminated Sites in Canada

  • Hundreds of contaminated sites have been generated due to the past mismagement of toxic substances, the lack of adequate environmental controls and ignorance of the potential environmental impacts of general activities in Canada. The general public, industry and governments have been addressing the contaminated sites with a number of cleanup responses. Environmental protection and remediation have become top priorities for the public and private sectors alike in Canada. Between the late 1980s and the early 1990s, the Canadian Environmental Protection Act and Canada's Green Plan were followed by provincial and territorial laws and policies to regulate contaminated sites. The National Contaminated Site Remediation Program(NCSRP) was initiated in 1989. It has been administered through bilateral agreements between the federal and participating provincial/territorial governments. They have committed a total of $250 million toward orphan site cleanup and technology development/demonstration over a five year period. The federal government has committed an additional $25 million to assess contaminated sites on federal crown land. Over 40 orphan high-risk contaminated sites, over 230 federal sites and over 35 technology development/demonstration projects have been addressed. The Canadian Council of Ministers of the Environment has developed a series of guidance documents to ensure a consistent and successful implementation of the Program. The management/regulation scheme of contaminated sites generally consists of: 1) identifying and investigating sites, 2) determining site contamination, 3) recognizing responsibility and liability, 4) assessing priority for remediation, 5) activation, evaluation and implementing remediation options, and 6) documenting remediation completion. The NCSRP supported the successful development/demonstration of a wide range of innovative remedial technologies. They are related to stabilization/solidification, thermal washing/flushing, advanced oxidation, sonics, and groundwater contaminated with hydrocarbons, PAHS, PCBs, heavy metals, and other hazardous pollutants in a variety of site environments.

자원순환사회 형성을 위한 "자원순환기본법"이 나아가야 할 방향 (A Review on the Direction of the Framework Act on Resource Circulation for Establishing a Resource Circulation Society)

  • 2016년 5월, 제19대의 마지막 정기 국회에서 "자원순환기본법"이 제정되었다. 본 법은 향후 우리나라의 자원순환 정책의 큰 방향성을 제시하여야 할 최상위의 기본법이므로 그 파급력을 고려하였을 때 법의 취지, 주요 내용, 정책적 방향성을 심도있게 분석하고 이해할 필요가 있다. 특히, 2018년 1월부터 본 법이 시행될 예정이므로 이 법의 원래 취지인 자원순환사회로의 전환을 효율적으로 지원할 수 있도록 법률 체계 및 내용을 제대로 갖추고 있는지 살펴볼 필요가 있다. 또한, 하위법령 제정 시 그 내용이 편향되지 않도록 이해관계자들의 적극적 참여를 통한 심도있는 협의가 이루어져야 할 것이며, 조항별 구체화된 법안들이 도출되어야 할 것이다. 따라서 본 연구에서는 자원순환기본법의 체계 및 주요내용 검토를 통해 문제점을 파악하고, 법률의 실효성을 극대화하기 위해 하위법령 제정과정에서의 주요 조항별 논점과 구체적 시행방향에 대해 검토, 제시하고자 한다.

온라인 플랫폼의 규제에 따른 이해관계 분석과 정책적 시사점 (Analyzing stakeholders and policy implications of online platform regulations)

  • 온라인플랫폼들의 영향력은 더할 나위 없이 커지며 이들의 막강해진 시장지배력에 대한 규제가 필요하다는 목소리가 높아지고 있다. 국내에서도 플랫폼의 시장지배적 지위 남용과 관련된 다양한 이슈들이 논의되고 있으며 현재 온라인플랫폼 공정화법이 국무회의를 통과한 상황이다. 이에 본 연구에서는 온라인플랫폼 규제를 다양한 이해관계자의 관점으로 바라보고 정책적 방향성을 짚어보고자 한다. 먼저 플랫폼기업이 채택하고 있는 경쟁전략들과 기업결합으로 야기될 수 있는 문제들을 살펴본 후, 온라인플랫폼에 대한 규제가 이해관계자에게 미치는 영향을 플랫폼사업자, 입점업체, 소비자의 관점에서 분석하였다. 본 연구는 온라인플랫폼 규제를 제정함에 있어서 자국플랫폼을 통한 국가경쟁력 향상이라는 경쟁적 이점이 고려되어야함을 강조하고 입점업체 및 소비자 보호를 대변하고자 하는 현재의 온라인플랫폼규제를 보다 균형잡힌 시각으로 바라볼 기회를 제공하고자 한다.

사서 배치 학교의 학교도서관운영위원회 운영 현황에 대한 연구 (A Study on the Operation of the Library Committee of the School Library that Employs Librarians)

  • 이 연구는 학교도서관운영위원회의 운영현황을 조사한 기초연구이다. 학교도서관 사서를 대상으로 학교도서관운영위원회 일반 현황 및 필요성, 운영위원의 구성, 역할, 역할 수행 능력, 운영상의 어려움 등에 대하여 설문조사를 실시하였다. 59명이 설문에 응답하였고, 주요 결과는 첫째, 응답자의 소속학교 중 94.9%가 학교도서관운영위원회를 운영하고 있고 필수위원인 위원장, 부위원장, 교사위원, 학부모위원의 구성율은 80% 이상이었으며, 둘째, 교사위원은 역할 수행에서 소극적인 것으로 나타났지만 학교도서관 사서는 교사위원에 대한 기대감과 협조를 바라는 것으로 조사되었고, 셋째, 학교도서관운영위원회는 학교도서관의 서비스와 운영을 위하여 필요한 기구이지만, 교사진의 협력과 참여가 적극적이지 않다는 점에서 어려움을 갖고 있다는 것이다. 주요 결과를 바탕으로, 교육청 단위의 학교도서관운영위원회 운영방침이나 규정의 성문화 및 정교화, 학교도서관운영위원회의 역할과 사명을 내용으로 하는 교육연수의 정례화, 외부위원 위촉이 원활할 수 있는 교육청 단위별 공공도서관-학교도서관 협력체계 마련 등을 제안하였다.

장애인생산품 우선구매제도 활성화를 위한 지방자치단체 조례분석 (Analysis of Ordinance in a Local Government for the Improvement of the Preferential Purchasing System of Products Manufactured by Disabled)

  • 본 연구는 지방자치단체 조례분석을 통해 장애인생산품 우선구매 활성화방향을 제시하는데 목적이 있으며, 2015년 7월 현재 지방자치단체가 제정 또는 입법예고한 조례 44건을 조례의 각 항목을 분석하였다. 분석결과를 살펴보면 첫째, 전국 지자체 중 44개 지자체에만 조례가 제정되어(18.1%) 더 많은 지자체의 조례제정이 필요하다. 둘째, 조례의 구성내용 분석결과 조례의 목적 및 적용대상기관, 이행계획, 구매 협조 요청, 구매촉진 의무는 대부분의 지방차지단체에서 제시되고 있었다. 반면에 그 외 항목은 명시되지 않은 곳이 많았고 특히, 지자체장의 책무는 30개만 명시되어(68.1%) 있었다. 셋째, 상위 법령 위반(불일치) 조항이 있었다. 넷째, 이행계획 수립을 위한 위원회 설치에 관한 조항은 한 곳도 명시되지 않았다. 우선구매 확대를 위해 계획단계에서부터 학계, 현장, 장애인당사자가 포함된 위원회 설치의 검토가 필요하다. 다섯째, 적극적인 우선구매를 위한 조례 항목의 신설이 필요하며, 효과적인 생산 유통 판매 기반마련을 위한 규정이 필요하다. 마지막으로, 중앙정부가 지자체의 장애인생산품 우선구매 관련 조례와 실적 등을 모니터링하고 이를 개선해 나가기 위한 노력이 요구된다.

국내·외 라돈 관련 제도 비교를 통한 산업안전보건법 개선방안 (Improvement of the Occupational Safety and Health Act by the Comparison of the Domestic and Foreign Radon-related Policies)

  • Objectives: Concerns have been raised about the possible health effects of radon on both workers and consumers with the spread of social attention to the impact of radon exposure. Thus, an entire raw material handling workshop was investigated, and standards for radon levels in the workplace were newly established at 600 Bq/m3. However, regulations on the management of workers exposed to radon are still insufficiently developed. Therefore, by comparative analysis of overseas and domestic radon-related regulations for workplaces, this study aims to suggest improvement plans of protection regulations under the Occupational Safety and Health Act (OSH Act) for the prevention of health disorders of radon-exposed workers. Methods: For overseas case studies, we consulted radon-related laws and reports officially published on the websites of the European Union (EU), the United States (U.S.) and the United Kingdom (UK) government agencies. Domestic law studies were conducted mainly on the Act on Protective Action Guidelines against Radiation in the Natural Environment and the OSH Act. Results: In Europe, the basic safety standards for protection against risks arising from radon (Council Directive 2013/59/EURATOM of 5 December 2013) was established by the EU. They recommend that the Member States manage radon level in workplaces based on this criterion. In the U.S., the standards for workplaces are controlled by the Occupational Safety and Health Administration (OSHA) and the Mine Safety and Health Administration (MSHA). Action on radon in the UK is specified in "Radon in the workplace" published by the Health and Safety Executive (HSE). Conclusions: The Act on Protective Action Guidelines against Radiation in the Natural Environment mainly refers to the management of workplaces that use or handle raw materials but does not have any provisions in terms of protecting naturally exposed workers. In the OSH Act, it is necessary to define whether radon is included in radiation for that reason that its current regulations have limitations in ensuring the safety workers who may be exposed to naturally occurring radon. The management standards are needed for workplaces that do not directly deal with radon but are likely to be exposed to radon. We propose that this could be specified in the regulations for the prevention of health damage caused by radiation, not in Article 125 of the OSH Act.

예비 교사들을 대상으로 한 과학적 자기 효능감 척도 타당도 검증과 배경 변인별 잠재평균분석 (Validation of Science Self-Efficacy Scale for Pre-Service Teachers and Latent Mean Analysis According to Background Variable)

  • 이 연구의 목적은 예비 교사들을 대상으로 과학적 자기 효능감 척도의 타당도 검증과 배경 변인에 따른 잠재평균분석을 통해 예비 교사 교육에서의 시사점을 도출하는 것이다. 이를 위하여 187명의 예비 교사들을 대상으로 과학적 자기 효능감 척도(Tark, 2011)를 활용한 사전 검사를 진행하였다. 그리고 탐색적 요인분석을 통해 도출한 결과를 바탕으로 전문가 협의회를 실시하여 문항을 보완한 후 354명의 예비 교사들에게 본 검사를 실시하였으며 탐색적 요인분석과 확인적 요인분석을 실시하였다. 분석 결과 사전 검사에는 과학적 자기 효능감 척도에 예비 교사들은 3개 요인으로 응답하였으나 2개 문항의 타당도가 낮게 나타났다. 수정한 척도를 활용하여 본 검사를 실시한 결과 29개 문항이 의도한 3개 요인에 적재되었음을 확인하였으며 각 요인별 신뢰도는 .882~.886으로 나타났다. 예비 교사들의 배경 변인에 따른 잠재평균분석을 실시하여 효과 크기를 도출한 결과, 성별에 따라서는 자기조절효능감(Cohen's d > .5)은 여성이 자신감(Cohen's d > .3)은 남성이 유의미하게 높은 결과를 보여주었다. 진로 계열과 과학에 대한 선호도 변인에서는 과제곤란도선호 요인과 자기조절효능감 요인에서 자연(이공)계열, 그리고 과학에 긍정적 선호를 선택한 예비 교사가 유의미하게 큰 효과크기 차이(Cohen's d > .8)를 보여주었다. 이 연구 결과를 토대로 수정된 과학적 자기 효능감 척도를 활용하면 예비 교사들의 과학 과목에 대한 자기 효능감을 정확히 진단하는데 큰 기여를 할 것이라 판단된다. 또한 과학적 자기 효능감 검사 결과를 바탕으로 예비 교사들의 과학적 자기 효능감을 효과적으로 향상시킬 수 있는 교육과정 및 교육 내용 개편에도 기여할 수 있을 것이다.

유럽주식회사법의 최근 동향에 관한 연구 (Current Development of Company Law in the European Union)

  • 유럽연합에서 회사법 통일의 노력은 리스본조약 이전부터 회사법과 관련한 규칙과 지침을 설정했다는 점에서 중요한 의미를 지닌다. 유럽연합 회사법의 법규범은 자체의 규칙을 통해 유럽주식회사라는 개념을 설정하였으며, 공개유한책임회사인 유럽주식회사와 더불어, 2008년 이후에는 중소기업을 위한 폐쇄유한책임회사에 대한 입법도 추진하고 있다. 최근 유럽주식회사법을 근거로 설립된 회사의 수가 증가되면서 발전된 형태의 회사법에 대한 논의가 활발히 진행되고 있으며, 이는 우리나라 회사법 분야에서도 흥미로운 주제가 된다. 기존의 유럽회사법에 관한 국내연구는 전반적인 유럽회사규칙 및 지침에 대한 내용을 소개하고 있으나, 근래에 이루어지고 있는 회원국 법률간 하향경쟁과 이를 통한 회원국의 입법에서의 변화, 그리고 유럽에서의 회사법연구에 대한 최근 논의에 대해서 다시 다루어 볼 필요가 있다. 따라서 이글에서는 유럽연합조약을 통한 설립의 자유와 이를 통한 각 회원국의 법률 간 경쟁과 유럽주식회사규칙의 제정 배경에 대해서 살펴보고 현재 유럽주식회사규칙의 내용을 평가한다.

항공기(航空機) 사고조사제도(事故調査制度)에 관한 연구(硏究) (A Study on the System of Aircraft Investigation)

  • The main purpose of the investigation of an accident caused by aircraft is to be prevented the sudden and casual accidents caused by wilful misconduct and fault from pilots, air traffic controllers, hijack, trouble of engine and machinery of aircraft, turbulence during the bad weather, collision between birds and aircraft, near miss flight by aircrafts etc. It is not the purpose of this activity to apportion blame or liability for offender of aircraft accidents. Accidents to aircraft, especially those involving the general public and their property, are a matter of great concern to the aviation community. The system of international regulation exists to improve safety and minimize, as far as possible, the risk of accidents but when they do occur there is a web of systems and procedures to investigate and respond to them. I would like to trace the general line of regulation from an international source in the Chicago Convention of 1944. Article 26 of the Convention lays down the basic principle for the investigation of the aircraft accident. Where there has been an accident to an aircraft of a contracting state which occurs in the territory of another contracting state and which involves death or serious injury or indicates serious technical defect in the aircraft or air navigation facilities, the state in which the accident occurs must institute an inquiry into the circumstances of the accident. That inquiry will be in accordance, in so far as its law permits, with the procedure which may be recommended from time to time by the International Civil Aviation Organization ICAO). There are very general provisions but they state two essential principles: first, in certain circumstances there must be an investigation, and second, who is to be responsible for undertaking that investigation. The latter is an important point to establish otherwise there could be at least two states claiming jurisdiction on the inquiry. The Chicago Convention also provides that the state where the aircraft is registered is to be given the opportunity to appoint observers to be present at the inquiry and the state holding the inquiry must communicate the report and findings in the matter to that other state. It is worth noting that the Chicago Convention (Article 25) also makes provision for assisting aircraft in distress. Each contracting state undertakes to provide such measures of assistance to aircraft in distress in its territory as it may find practicable and to permit (subject to control by its own authorities) the owner of the aircraft or authorities of the state in which the aircraft is registered, to provide such measures of assistance as may be necessitated by circumstances. Significantly, the undertaking can only be given by contracting state but the duty to provide assistance is not limited to aircraft registered in another contracting state, but presumably any aircraft in distress in the territory of the contracting state. Finally, the Convention envisages further regulations (normally to be produced under the auspices of ICAO). In this case the Convention provides that each contracting state, when undertaking a search for missing aircraft, will collaborate in co-ordinated measures which may be recommended from time to time pursuant to the Convention. Since 1944 further international regulations relating to safety and investigation of accidents have been made, both pursuant to Chicago Convention and, in particular, through the vehicle of the ICAO which has, for example, set up an accident and reporting system. By requiring the reporting of certain accidents and incidents it is building up an information service for the benefit of member states. However, Chicago Convention provides that each contracting state undertakes collaborate in securing the highest practicable degree of uniformity in regulations, standards, procedures and organization in relation to aircraft, personnel, airways and auxiliary services in all matters in which such uniformity will facilitate and improve air navigation. To this end, ICAO is to adopt and amend from time to time, as may be necessary, international standards and recommended practices and procedures dealing with, among other things, aircraft in distress and investigation of accidents. Standards and Recommended Practices for Aircraft Accident Injuries were first adopted by the ICAO Council on 11 April 1951 pursuant to Article 37 of the Chicago Convention on International Civil Aviation and were designated as Annex 13 to the Convention. The Standards Recommended Practices were based on Recommendations of the Accident Investigation Division at its first Session in February 1946 which were further developed at the Second Session of the Division in February 1947. The 2nd Edition (1966), 3rd Edition, (1973), 4th Edition (1976), 5th Edition (1979), 6th Edition (1981), 7th Edition (1988), 8th Edition (1992) of the Annex 13 (Aircraft Accident and Incident Investigation) of the Chicago Convention was amended eight times by the ICAO Council since 1966. Annex 13 sets out in detail the international standards and recommended practices to be adopted by contracting states in dealing with a serious accident to an aircraft of a contracting state occurring in the territory of another contracting state, known as the state of occurrence. It provides, principally, that the state in which the aircraft is registered is to be given the opportunity to appoint an accredited representative to be present at the inquiry conducted by the state in which the serious aircraft accident occurs. Article 26 of the Chicago Convention does not indicate what the accredited representative is to do but Annex 13 amplifies his rights and duties. In particular, the accredited representative participates in the inquiry by visiting the scene of the accident, examining the wreckage, questioning witnesses, having full access to all relevant evidence, receiving copies of all pertinent documents and making submissions in respect of the various elements of the inquiry. The main shortcomings of the present system for aircraft accident investigation are that some contracting sates are not applying Annex 13 within its express terms, although they are contracting states. Further, and much more important in practice, there are many countries which apply the letter of Annex 13 in such a way as to sterilise its spirit. This appears to be due to a number of causes often found in combination. Firstly, the requirements of the local law and of the local procedures are interpreted and applied so as preclude a more efficient investigation under Annex 13 in favour of a legalistic and sterile interpretation of its terms. Sometimes this results from a distrust of the motives of persons and bodies wishing to participate or from commercial or related to matters of liability and bodies. These may be political, commercial or related to matters of liability and insurance. Secondly, there is said to be a conscious desire to conduct the investigation in some contracting states in such a way as to absolve from any possibility of blame the authorities or nationals, whether manufacturers, operators or air traffic controllers, of the country in which the inquiry is held. The EEC has also had an input into accidents and investigations. In particular, a directive was issued in December 1980 encouraging the uniformity of standards within the EEC by means of joint co-operation of accident investigation. The sharing of and assisting with technical facilities and information was considered an important means of achieving these goals. It has since been proposed that a European accident investigation committee should be set up by the EEC (Council Directive 80/1266 of 1 December 1980). After I would like to introduce the summary of the legislation examples and system for aircraft accidents investigation of the United States, the United Kingdom, Canada, Germany, The Netherlands, Sweden, Swiss, New Zealand and Japan, and I am going to mention the present system, regulations and aviation act for the aircraft accident investigation in Korea. Furthermore I would like to point out the shortcomings of the present system and regulations and aviation act for the aircraft accident investigation and then I will suggest my personal opinion on the new and dramatic innovation on the system for aircraft accident investigation in Korea. I propose that it is necessary and desirable for us to make a new legislation or to revise the existing aviation act in order to establish the standing and independent Committee of Aircraft Accident Investigation under the Korean Government.

양호겸직교사의 학교보건간호 업무활동에 관한 조사연구 (A Study of School Health Nursing Activity Performed Teachers Holding Additonal school Health)

  • The purpose of this study is to provide the basic data for the development of school health nursing activities by surveying realities of school health nursing activities in schools lacking in a school nurse performed by teachers holding additional school health. The subjects for the study was selected from teachers holding additional school health who participated in the annual training course for teachers holding additional school health in 1988 organized by Province Education Council. 105 teachers holding additonal school health from Kyung-gi Province, 85 from Chung-buk province, 50 from Chun-buk Province, answered the questionaire. The results can be epitomized as follows. 1. General characteristics of Teachers Holding Additional School Health. The majority of the subjects are female (94.3%) and 64.1% of the subjects are in their twenties, 79.5% of them graduated from four-year teacher's college, 54.5% of them are unmarried, 74.5% has less than one-year experience as a teacher holding additional school health. 2. General characteristics of schools 92.4% of schools are national, of public schools, and 91.9% are located in country, elementary schools are 64%, junior high schools are 35.4%. The annual school nursing budget is unknow to 89.2% of them. The school nursing organization is non- existent to 85.6%. 82.4% of the school nursing clinics occupy their place solely, or jointly. 3. Status of School Health Nursing Activities In the questionaire, School Health Nursing Activities arc divided into Health Program planning and Evaluation (4 items), Clinic Management (4 items), Health Education (4 items), Management of School Environment 98 items), Operating of School Health Organization (1 item) and Health Care Service (25 items). The answers to each item measured by the Likert-type scale reveals that in the activities of techcrs holding additional school health the practice rate in Management of School Environment is 55%, 47% in Health Education, 45% in Health Program Planning and Evaluation, 32% in Health Care Service, 27% in Operating of School Health Organization, and 27% in Clinic Management. 4. The Relation between Influencing variables and School Health Nursing Activities. The results are as follows. (1) Health Program Planning and Evaluation: religion, marital status ($P<0.05^{**}$) (2) Clinic Management: age, school health organization ($P<0.05^{**}$) (3) Health Education: age ($P<0.01^*$), religion ($P<0.05^{**}$), business except for school nursing ($P<0.05^{**}$), form of operation ($P<0.05^{**}$), the number of clinic client a month ($P<0.05^{**}$). (4) Management of School Health Environment: age, marital status, business except for school nursing ($P<0.05^{**}$), presence of the annual school health nursing budget ($P<0.01^*$), school health organization ($P<0.05^{**}$). (5) Operating of School Health Organization: There is a statistical significance in Education, Interest in School Nursing ($P<0.05^{**}$). 5. The Regional Relationship of School Health Nursing Activity. There is a statistically significal difference in Health Education ($P<0.05^{**}$) and Health Care Service ($P<0.01^*$) of elementary school located in Kyung-gi, Chung-buk, Chun-buk Province. There is a statistically significant difference Health Program Planning and Evaluation of junior high Schools located in Kyung-gi, Chung-buk, Province ($P<0.05^{**}$). 6. The Correlation in School Health Nursing Activities. The analysis of the correlation in the 6 fields of school Health Nursng Activities shows that there is a statistically significant difference between Clinic Management and health Education, Clinic Management and Operating of School Health Organization, and between management of School Environment and operating of School Health Organization ($P<0.05^{**}$). The conclusions are as follows The 40.5 percent of schools should arrange nurse teachers by regulation 38, relative to the application of the Law of Education. But, in reality, teachers who have nothing to do with nursing, hold school health as an additional job. And also, persons in charge of pracitcal affairs perform the school health activity without any knowledge about annual school health nursing budget. In the school health nursing activity of teacheres holding additional school health, operating of school, health organization and clinic management are the most difficult to get the cooperation from the persons relate to school and communities. There are a lot of problems in performing the school health nursing activity without any disposition of school health teachers, therefore, it is necessary to supplement school health teachers who had a professional training in order to make efficient the school health nursing management for children who are about to attend a school.
