근래의 국내 건설 산업은 IMF 이후로 악화된 수주여건과 발주자와 시공자의 입장 차이 등으로 인한 클레임과 분쟁이 늘어나고 있다. 이에 본 연구는 이들의 원활한 해결을 위한 방안과 전략 연구의 기초연구로 수행되었으며, 이를 위한 방법론으로 해외의 FIDIC, AIA, ECC 등의 계약문서와 국내 공사계약 일반조건과 서울특별시 공사계약 특수조건의 클레임과 분쟁관련 조항에 대한 벤치마킹을 수행하였다. 연구 결과, 국내의 계약 문건 상의 클레임과 분쟁관린 조항이 해외의 사례들과 비교해 클레임 및 분쟁의 정의, 제기와 해결절차 등의 명확한 제시 부분이 부족한 것으로 나타나 개선이 필요한 것으로 나타났다.

최근 건설공사는 대형화, 복잡화됨에 따라 도면과 시방서만으로는 모든 정보를 표현하는 것이 어려우며, 불확정적인 요소를 계약서에 명문화 하는 것의 한계성으로 인해 분쟁이 발생하게 된다. 또한 우리나라 건설공사는 상호평등 원칙보다는 발주자 위주의 계약관행이 존재하고 있어서 비합리적인 조항을 계약관련 서류에 포함시키는 등의 일이 발생하고 있다. 이렇듯 겉으로 표현하지 못한 잠재적인 분쟁의 요인들이 존재하게 된다. 이에 본 연구에서는 조달청의 민원상담사례를 분석하여 사전분쟁 단계에서의 잠재적인 분쟁요인을 도출하고, 영향도 분석을 실시하였다. 분석된 결과는 차후 건설공사 추진과정에서 분쟁예방을 위한 체크리스트로 활용이 가능할 것으로 사료된다.

This paper is to analyze business activities of approval/permission (A/P) and to describe its problems. To conduct the A/P business activities currently, there are many problems such as complex business process and different business policies among the each organization. In order to solve the problems, this paper suggests the A/P system of highway construction CALS (Commerce at Light Speed). CALS, a top down vision of complete computing integration, promises to support electronic data exchange. The A/P system is designed to classified documents based on CALS standard and store them to database. The data register to the A/P system by the Internet, and each construction company can use the A/P system by Internet also. Benefits of the A/P system is reduction in junk documents for approval/permission actives, improvement in conduct and services life cycle support.

In construction projects, it is common to exchange documents using email because of convenience. In this study, a method extracting and organizing block information automatically based on email was developed. This method is composed of document exchange and archiving processes, which are difficult to manage and vulnerable to loss. Therefore, this study aims to develop a solution that can automatically link email and block information. The block data components are designed to derive from email exchange and user-additional input information. Also, automatically generating blocks process including extraction and conversion of information was proposed. This solution can lead to promote the convenience of project document management in terms of identifying the document flow and preventing loss of information.

It is very important to estimate accurate construction total cost needed early in the project. In the initial phase of the design, the project cost estimates are determined by total quantity from design documents and the variables that affect the calculation of the total cost of the project. In order to determine accurate total construction cost, the contractor has to produce detailed quantity information based on the drawings and specifications. The process of preparing quantification and cost estimation documents is still being worked out manually, and a lot of errors have been occurred in many cases. Recent advances in information technology have led to the BIM based quantity takeoff and cost estimation. However, there are some limits to the extent to which the current specifications for BoQ documents are computed from BIM model. This research analyze the current BoQ cases and analyze how to make quantity takeoff possible through BIM. The study defined five levels of quantity category that could be produced by BIM. Only about 40% or indirectly usable items can be used when information is extracted to BIM modelling. This is very insufficient to fill out the BoQ. The BoQ document structure quantity takeoff specifications should be simplified in order to BIM based cost estimation more efficiently.

본 연구에서는 문서에 나타나는 용어의 통계값을 이용하여 구술문서자료에 포함되어있는 용어들간의 의미 네트워크를 자동으로 구축하는 시스템을 제안하였다. 본 연구를 위하여 전북 새만금지역에서 채록한 186개의 구술생애사 문서자료를 사용하였으며, 구축된 용어네트워크에서 용어들 사이의 관계는 용어들을 백터화하여 결정하였다. 새만금 구술문서에서 중요단어로 선택된 단어의 수는 약 1700여 개이다. 단어들 사이의 용어네트워크는 구축 시스템을 통해서 실시간 내에 표현할 수 있었다. 이 용어네트워크는 앞으로 전개될 시멘틱 검색시스템 구축에 새로운 장을 열 것이며, 구술문서 분석에 크게 기여할 것으로 기대한다.

건설프로젝트에서 발생되는 리스크는 공기지연 및 비용증가에 큰 영향을 끼치기 때문에 다양한 리스크를 파악하기 위한 노력이 이루어지고 있다. 그러나 시공단계의 리스크 분석은 공종 및 수행단계에 국한되거나, 경험 의존적 의사결정이 주로 수행되고 있다. 데이터 기반의 분석도 일부 사례에 적용되고 있을 뿐이다. 따라서 본 연구에서는 시공사 또는 발주처에 중요한 요인들이 포함되어 있을 것으로 판단되는 수발신공문을 대상으로 군집분석과 Word2Vec 알고리즘을 적용하였다. 군집분석을 통해 6개 유형으로 1차 분류를 수행하였으며, Word2Vec을 통해 157개의 공문 발생 유형을 도출하였다. 도출된 연관어의 속성별 분석을 위하여 새로운 5개의 범주를 적용하였으며, 이를 통해 공문 발생 유형이 잠재적인 건설 리스크 요인으로 발전 가능한지 검토하였다. 텍스트 마이닝을 통한 3단계의 공문 발생 유형 분석 결과는 건설현장의 공정관리를 위한 기초 자료로써 도움 될 것으로 판단된다.

This paper discusses the components of a guaranteed maximum price (GMP) and proposes a framework for the development of GMPs as contract payment provisions for construction manager-at-risk (CMR) and design-build (DB) contracts for transportation projects. The framework is the synthesis of a comprehensive literature review, a content analysis of CMR and DB solicitation documents and contracts, and case study project output from twelve projects in nine states worth $3.1 billion. The research also discusses the development of three common types of contingencies that are often utilized in projects with GMPs. The study concludes that owners should specify the structure of the GMP and its components to enhance clarity and understanding of the GMP's composition. It recommends that this structure be included in the CMR and DB solicitation documents so that pricing proposals can be formulated in a manner that is consistent with the contract payment provisions that will be useful to practitioners that need to implement GMP-based contracts.

Conflicts of interest and independent agenda of the parties brought together for implementation of a construction project often leads to dispute in Contract and claim situations. Construction Industry is notorious for claim that is managed on its arising and there lacks an endeavor to minimize the breeding grounds through efficient planning and alignment to purpose, of all contract-documents. There failure of a concerted effort entails wastage of resources, delayed completion of facilities and stained relationships of parties when collide in mistrust in contract to win over the other. There needs a focus on the claim breeding issue and establish an effective mechanism to deal with disputes in urgency. Claim occurs mostly during the construction phase. But the seeds of claim and nutrients essential for development are contained in the contract documentation and the information supplied or not in pre-contract phase. Opportunity to prevent nutrients for seed of Claim comes to an end once tender-documents are finalized, the contract is awarded and established or not a mechanism for dealing with claim situation. The processes presented here would help in minimizing the breeding grounds and emergence of disputes during progression of works and dealing with eventualities in forceful manners for finding a resolution most effectively in relevant time.
