항공운송산업 발전에 따른 중국 민용항공법의 문제점 및 개선방향에 대한 고찰 (A Study on the Development of Civil Aviation Industry and Civil Aviation Law of China)

  • In this paper we firstly review the developmental stages of the Chinese civil aviation industry since 1949 and the background history of the Chinese Civil Aviation Law of 1996. We secondly analyzed the main terms and conditions about the Chinese civil aviation law and pointed out several problematic issues in view of the development of the Chinese aviation industry. Current civil aviation law in China has been in effect for the last 12 years. In these periods, Chinese civil aviation industry has developed in a high speed and great changes have occurred in its market environments. Thus, some of the terms and conditions in current civil aviation law in China have become outdated and unsuitable for the current developmental stage of the Chinese civil aviation industry. Therefore, we proposed some directions of the future amending of the Chinese Civil Aviation Law.

  • The paper is to study and analyze the civil aviation industry of China and to present some cooperative and developing models between Korea and China in the fields of civil aviation on the basis of mutul benefit. In this study, civil aviation includes both the air transport industry and aircraft manufacturing industry. As it is not easy and realistic for us to conduct field survey on the civil aviation of China so far, this study has havily depended upon the literature data gathered from the ICAO and other published materials. This study includes the following major contents. 1. The historical development of China civil aviation 2. The present status and future prospect of Civil Aviation Adminstration of China(CAAC) 3. 한국의 민항공조종사 교육의 활성화 방안에 관한 연구 (A study on the enocouraging policies for civil aviation pilots training in Korea)

  • The air transportation industry in Korea has grown very fast in aspect of the transportation scale as much as entering within the tenth in the world. However, as compared with the air transportation industry, the civil aviation pilots training has been performed at very low level in quantity and quality because of the high cost of pilots training, nation security, limited airspace use and falling behind of the science technology in relation to the aviation industry. In result, the number of airline pilots became lower than actual demands of both airlines, KAL and ASIANA. This produced many foreign captains employed, airline pilots overloaded and finally affected flight safety. In this paper, it was studied the actual reality and problems of civil aviation pilots training and presented the encouraging policies for civil aviation pilots training in Korea.

중국 항공산업현황 및 전망에 관한 연구 (Study on the Current status and prospects of China aviation industry)

  • According to the prediction of Aviation Industry Corporation of China, in the next 20 years, China will have an increase of 4,583 civilian airliners, including 3,682 jumbo jets and 901 regional aircrafts. Chinese commercial aviation aircraft market will undoubtedly grow rapidly. until the year 2030, China's share of the global aircraft fleet will increase from 9% to 15%. In addition, the business jet market has a huge growing room in the global industry, the deliveries will reach 10,000 units in the next 10 years, and the Chinese market deliveries will reach 23,600 in the next 20 years. China's aviation market, is and will be enormous in the future. It is one of the main engines of economic growth in the field. China's civil aviation transportation is based on dazzling economic development. Air transport is the fastest growing power for the time being. China's aviation sector will have an average annual gross of about 10%, and more likely to continued growing and it is expected to be world's major aviation market around the world. As the result, since one of future the important industries will be emerged, Air policy enforcement and considering the reality of our future prospects for the airline industry presented.

中國通用航空立法若干問題研究 (Some Issues on China General Aviation Legislation)

  • General aviation and air transport are two wings of the civil aviation industry. Chinese air transport is developing rapidly, and has become the world second air transport system only second to US since 2005. However, Chinese civil aviation is far behind the world average level, and cannot meet requirements of economic construction and social development. The transition and structural adjustment of Chinese economy provide the general aviation with a unprecedented broad market. The prospect of general aviation is promising and anticipated. The development of general aviation industry needs the legislative supports, and the current legislative conditions of Chinese general aviation are undoubtedly far behind the realistic requirements. Accelerating the legislation in Chinese general aviation industry requires scientific legislation concept. First, Legislation must promote development of general aviation industry. The general aviation will serves as a Chinese emerging industry that boosts domestic demand, promotes employment and expedite domestic economic development. We should, based on both the concept of promoting the industrial development of general aviation and national industrial planning, enact and rectify relative laws and regulations. And we should also straighten out the relationship between aviation security and industrial development and promote the revolution of low-altitude airspace management in an all-round way, in order to improve the utilization rate of airspace resources, classify and establish airspace, simplify examination and approval procedure and intensify operation management. In addition, what we should do is to expedite the infrastructure layout construction, guide the differentiated but coordinated development of general aviation industries in various areas, establish a united supervision mechanism of general aviation, redistrict the responsibilities of Chinese Air Control Agency and set up legislation, law enforcement and judicial systems with clarified institutions, clear positioning and classified responsibilities, so as to usher in a new era of the legislative management of Chinese general aviation industry. Second, shift the focus from regulations to both regulations and services. Considering the particularity of the general aviation, we should use American practices for reference and take into account both regulation and service functions when enacting general aviation laws. For example, we should reduce administrative licensing and market supervision, and adopt "criteria" and "approval" management systems for non-commercial and commercial aviation. Furthermore, pay attention to social benefits. Complete social rescuing mechanism through legislation. It should be clarified in legislation that general aviation operators should take the responsibilities of, and ensure to realize social benefits of environmental protection and ecological balance .Finally, rise in line with international standards. Modify Chinese regulations which is inconsistent with international ones to remove barriers to international cooperation. Specify basic legislative principles. One is the principle of coordination. Realize coordination between the civil aviation and general aviation, between military aviation and civil aviation, and among departments. Two is the principle of pertinence. The general aviation has its own rules and specialties, needing to be standardized using specialized laws and regulations. Three is the principle of efficiency. To realize time and space values of general aviation, we should complete rules in aerospace openness, general aviation airport construction, general aviation operations, and regulation enforcement. Four is the principle of security. Balance the maximum use of resources of Chinese airspace and the according potential threats to Chinese national interests and social security, and establish a complete insurance system which functions as security defense and indemnificatory measure. Establish a unified legal system. Currently, the system of Chinese general aviation laws consists of national legislation, administrative laws and regulations and civil aviation regulations (CAR). Some problems exist in three components of the system, including too general content, unclear guarantee measures, incomplete implementation details, and lacking corresponding pertinence and flexibility required by general aviation regulations, stringency of operation management and standards, and uniformity of standards. A law and regulation system, centered on laws and consisting of administrative laws regulations, industrial regulations, implementation details, industrial policies and local laws and regulations, should be established. It is suggested to modify the Civil Aviation Law to make general aviation laws complete, enact the Regulations of General Aviation Development, and accelerate the establishment, modification and abolition of Chinese general aviation laws to intensify the coordination and uniformity of regulations.

  • 이라크 전에서도 알 수 있듯이, 현대전에서 항공력은 신속성과 정확성이라는 특성으로 매우 큰 파괴력을 지니고 군사작전의 필수요소이다. 그러므로 향상된 공군 전력은 평시에 전쟁을 억지하는 핵심 전력이 된다. 또한 항공산업은 국가의 중추 미래산업으로서 그 중요성이 날로 증대하고 있다. 따라서 제한된 항공 자원을 국가 이익에 최대한으로 부합시키기 위해서 민간항공 정책 부서인 건교부와 국가 안보를 책임지는 국방부와의 유기적이고 상시적인 협력체계가 필요하다. 이는 평시에 국가 방위를 저해하지 않는 범위 내에서 민간항공 산업을 증진시킬 수 있는 방안을 모색 할 수 있고, 또한 유사시에 국가 항공 자원이 효과적으로 국가 방위 임무에 부합하도록 전활 될 수 있는 체계를 구축할 수 있다. 분단된 좁은 국토에서 북한과 대치하고 있는 우리로서 항공산업의 진흥을 통한 국가 경쟁력 강화와 군 작전의 효율성 보장 및 전력 강화라는 두가지 과제를 갈등과 상충이 아닌 조화와 태협을 통해 성취할 수 있는방안을 모색해야 한다.

Threats of MANPADS and Its Counter-Measures

  • The International air transportation industry provides a vital communication link which brings prosperity to many states in our modern age. This invaluable link has been threatened by terrorism. Airlines have been one of the most attractive targets in the eyes of terrorists for several reasons, including particularly the international and symbolic nature of aviation, and the potential of multigovernmental involvement which can inevitably generate wide publicity. Terrorist attacks against civil aviation have been committed since the earliest days of civil aviation history. The first attack against civil aircraft dates back to the early 1930s. Since then, aircraft hijacking and other forms of attack against air transport operations have become one of the most serious challenges to the safety of flying. In recent years, a new form of threats against civil aviation has appeared. Man-portable air defense systems (MANPADS) in the hands of criminals, terrorists, and other non-state actors pose a serious potential threat to passenger air travel, the commercial aviation industry, and military aircraft around the world. The purpose of this study is to provide some countermeasures against such attacks. In order to foster a better understanding of the problem, an introduction of MANPADS and a brief history of attacks using MANPADS are presented. It also examines the level of threats, trends of attacks using MANPADS and the possible countermeasures to be taken by the international community.

  • 항공 산업은 고용창출 효과가 크고 고부가 가치인 선진국 형 지식기반 산업으로 평가되는 대표적 산업이다. 이러한 시대흐름에 따라 전 세계가 잠재적 경제력의 한축인 항공 산업에 눈을 돌리고 있는 것도 어찌 보면 당연한 일이 아닐 수 없다. 이와 같은 배경 하에 본 연구는 국토해양부에서 범정부적으로 추진 중인 항공인력양성사업의 중요성을 인식하고 급속히 발전하는 항공기술에 대처할 수 있는 항공우주기술 인력 및 잠재적 경제력의 한 축인 항공시장의 전문지식과 실무능력을 겸비한 국제항공 전문가를 석사급 인력을 국내 특성화 대학을 선정 지원하여 항공인력을 양성하는 사업의 평가지표를 개발하는 데 그 필요성을 인식하고, 항공전문가의 검토를 통한 타당성 검증 결과를 도출하였다.

  • In order to enhance the safety of the international aviation industry, the International Civil Aviation Organization has recommended establishing an operational foundation for systematic and integrated collection, storage, analysis and sharing of aviation safety data. Accordingly, the Korea aviation industry also needs to comprehensively manage the safety data which generated and collected by various stakeholders related to aviation safety, and through this, it is necessary to previously identify and remove hazards that may cause accident. For more effective data management and utilization, a standard structure should be established to enable integrated management and sharing of safety data. Therefore, this study aims to propose the framework about how to manage and integrate the aviation safety data for big data-based aviation safety management and shared platform.
