  • A bonded warehouse is the warehouse located in bonded area. It functions not only as a general warehouse but also as a place for managing the work related to import and export bonded goods. As a general warehouse, it uses the rack system to store the goods and the folk lift truck to move the unitized goods. The operation of the storing system closely related to the efficiency of space uses in a warehouse and vehicle working. Thus, vehicle performance measured in distance units in the ware-house could be used as one of the key performance measure in warehouse system. This paper focuses on the operation efficiency of the bonded warehouse which uses rack system for the storing and the folk lift truck for moving goods. The method of load allocation for balancing the rack uses and vehicle operation for maximizing efficiency are the specific concerns in this paper. The simulation study is conducted to find a policy for efficient vehicle operation based on balanced rack utilization, and the favorable result for the system operation would lead the usable proposal in vehicle operation.

A Study on the Time of Delivery of Goods and Liability for Mis-delivery in terms of an Ocean Carrier (해상 운송인의 운송물 인도시점과 오인도(誤引渡)에 따른 손해배상책임에 관한 연구)

  • This study reviews the judgements by the Korean Supreme Court on the time of delivery of goods, as it depends on which bonded place the goods are kept for the purpose of the customs clearance. Thereafter, this study analyzes the Ocean Carrier's liability, when the cargoes are mis-delivered without the presentation of bill of lading in relation to the specific bonded place such as an independent bonded warehouse or a self-use bonded warehouse. Furthermore, considering that voyage charter is a kind of marine transport, this study also reviews whether or not the Court's judgements, which has been developed in respect of the carriage of affreightment, could be applied to voyage charter in respect of the time of delivery goods and the Ocean Carrier's liability for mis-delivery. Lastly, in the case that the substantial importer takes the goods from the independent bonded warehouse without the presentation of bill of lading after the customs clearance, it is noted that the Court has made the Ocean Carrier liable for the mis-delivery through the application of theory of double deposit contract. The position of the Court would be understandable in terms of the protection for the bona-fide holder of bill of lading, but this study reviews the limitation of liability as the device for the protection of the Ocean Carrier, considering the situation where the Ocean Carrier is somewhat unreasonably sacrificed under the bonded system provided for the convenience of substantial importer.

The Effect of Economic Sanction against North Korea on North Korea-China Trade

  • This study attempts to scrutinize the effectiveness of the international economic sanction on North Korea by analyzing the determinants of the North Korea-China trade with Chinese Customs House data classified under general, border, processing, bonded warehouse. The result shows that after international economic sanctions, North Korea-China trade was increased across types of trade. In particular, sanction-sensitive items were increased after sanctions and China also weakened the effectiveness of sanctions. To put it concretely, North Korea's food and fuel imports from china increased in processing and border trade. In the case of luxury good, it was increased in general trade. Strategy goods (weaponry) increased only in bonded warehouse trade. For China's import from North Korea, food and fuel were increased in total, border and bonded warehouse trade. Considering the features of each type of trade, these increase are presumed to have been playing a decisive role in weakening the effect of international sanction on North Korea.

  • After being kept in bonded areas and bonded logistics warehouses, the level of information sharing and progress confirmation on the process until the cargo is released is insufficient, resulting in disputes and legal disputes related to unauthorized and illegal delivery of cargo. This study attempted to present the introduction of standard electronic documents as a way to solve problems such as delivery practices raised in the delivery of existing imported cargo and legal disputes related to unauthorized illegal delivery among import-related entities. The service provider who manages the bonded warehouse/logistics center in the hinterland of Busan New Port and the shipper service user who use the service were classified into two groups, and a survey was conducted to analyze the difference in perception between the two groups. As a result of the analysis, both groups judged that the introduction of standard electronic documents was necessary, and showed high expected effects in preventing and reducing erroneous shipments and preventing and improving unauthorized and illegal shipments. Discussions between related organizations, related parties, and subjects are needed first to introduce standard electronic documents of the entry and warehouse management system, and the actual participation of related entities such as service providers and service users will play a very important role in establishing the system.

  • The purpose of this study is to contribute to reducing distribution costs, enhancing export price competitiveness, and improving distribution system in LCL cargo, by pursuing the present status of warehouse storage fee, a cause & problem about excessive hike, and a plan for stabilizing warehouse storage fee, as for LCL Cargo, which is imported by sea. The plans for rationalizing warehouse storage fee in LCL cargo were suggested the adoption of the ceiling system for warehouse storage fee rate, the obligation of offering information on warehouse storage fee rate, the eradication of illegal rebate, the improvement in distribution system of the imported LCL cargo, a scheme for the importer to designate a bonded warehouse and forwarder, the introduction of the tentatively named 'LORAS(Lowest Rate Service),' and formation of the dispute coordinating committee for warehouse storage fee.

Regional Structure of International Physical Distribution through Clearance Depot (통관거점을 이용한 국제물류의 지역구조)

  • This study is to clarify regional structure and connection of international physical distribution through clearance depot of Cheongju customs of inland location. The trade of clearance depot of Cheongju customs industrial characteristics reflects of territorial hinterland. As origins and destinations of freight as exports and imports region, territories of Cheongju customs trade mainly with Japan, China, and USA. Origin and destination of freight of Cheongju customs territory are hinterland and foreland of Incheon International Airport and Busan port. In case of export, foreland of Busan port is board, and in case of import, the hinterlands of Incheon International Airport and Busan port are similar. Clearance depot of inland-located Cheongju is construct by the advantages of rapidness and inexpensive cost. And the kind of freight and system of physical distribution of each enterprise show different characteristics. For each export and import freight, each shipper corporation has its own physical distribution system, and structure of international distribution is classified into export pattern of bonded industry and bonded warehouse. Again the patterns of bonded warehouse are distinguished free on board price system with division of labor in base of production in overseas, free on board price system, and cost-insurance-freight with division of labor in base of production in overseas. These Phenomena are caused by transaction between headquarter and its overseas corporation, initiative freight handling of export corporation, choice of inexpensive cost, and international convention.

  • This thesis describes the key elements for efficient customs clearance system which can facilitate flow of maritime container cargo in the pier area of Busan port, on the basis of considering great changes on international trade environment, development of customs clearance system, variation of commercial container traffic, and diverse views originated from field experience in the distribution industry. To facilitate the flow of maritime containers, reform plan of bonded-transportation and import declaration is proposed to relieve the customs restriction during the days from discharging cargos to taking them into bonded warehouse. Also, various plans to strengthen maritime security, such as customs exam of high-risk export cargos in loading port, pre-declaration of transit container replacement, container tracing system, are proposed to improve Busan port's competitiveness in safety.

  • 국가 간 무역 활성화로 인하여, 국제 물류의 고도화가 요구되는 현 시점에서 보세창고의 운영 효율성을 제고할 필요성이 커지고 있다. 그러나 현재의 보세창고 프로세스 중 검수 및 장치화물관리 프로세스는 수작업으로 인한 오류발생률이 높아 효율성이 저하되는 문제점을 가지고 있다. 따라서 본 논문에서는 이에 대한 해결책으로 보세창고에 RFID 기술을 적용하여 검수작업을 자동화하는 방안을 제시하였다. RIFD 기술 도입은 검수 작업의 효율화뿐만 아니라, 향후 실시간 장치화물관리, 창고 내 Resource 관리 등 창고관리의 제 분야에 활용되어 보세창고관리의 효율성을 제고시킬 것으로 기대된다.

The Duty and Liability of the Carrier in Relation to Cargo Delivery in the International Air Transport of Cargo (국제항공화물운송에 있어서 운송인의 화물인도 의무와 책임)

  • This paper intends to describe the carrier's duty for the delivery of international air cargo and the carrier's liability for the illegal delivery of cargo under the Montreal Convention, lATA Conditions of Carriage for Cargo and judicial precedents. Under the Article 13 of Montreal Convention, the consignee is entitled, on arrival of the cargo at the place of destination, to require the carrier to deliver the cargo to it, on payment of the charge due and on complying with the conditions of carriage. And unless it is otherwise agreed, it is the duty of the carrier to give notice to the consignee as soon as the cargo arrives. Under the Article 18 of Montreal Convention, the carrier is liable for damage sustained in the event of the destruction or less of or damage to, cargo upon condition only that the event which caused the damage so sustained took place during the carriage by air. And the carriage by air comprises by the period during which the cargo is in the carriage of the carrier. Under the Article 11 of lATA Conditions of Carriage for Cargo, carrier is liable to shipper, consignee of any other person for damage sustained in the event of destruction of loss of, or damage to, or delay in the carriage of cargo only if the occurrence which caused to the damage so sustained took place during the carriage as defined under Article 1. According to the precedent of Korean Supreme Court sentenced on 22 July 2004, the freight forwarder as carrier was not liable for the illegal delivery of cargo to the notify party (actual importer) on the airway bill by the bonded warehouse operator because the freight forwarder did not designate the bonded warehouse and did not hold the position of employer to the bonded warehouse operator. In conclusion, the carrier or freight forwarder should pay always attention the movement and condition of the cargo not to be liable for the illegal delivery of cargo.

A Study on the Methods of Delivery for Containers Goods not Changed with Bill of Lading (원본 선하증권과 상환하지 않는 컨테이너화물의 인도방식에 관한 연구)

  • There are two aims of this research: one is to verify the role of bill of lading and the method of delivery for container goods and the other is to suggest alternative methods for the crisis of bill of lading; that is, goods are arrived in ports but bill of lading is not arrived. The results of the analyses are as follows. First, delivery of container goods should be performed to exchange with bill of lading. Carriers should deliver goods to consignees to exchange with one among the number of issued bill of lading. In addition, when goods are delivered to consignees by the bill of lading, the other bill of lading is invalid. Second, there are several methods of delivery which are not exchanged with bill of lading such as letter of guarantee, surrender bill of lading, sea waybill, non-negotiable straight bill of lading and consignment of bill of lading to a captain. Delivery of container goods should be performed by exchanging bill of lading. In addition, there are two delivery methods by letter of guarantee: one is illegal and the other is legal. If there is damage for a bonafide-fide holder of bill of lading, carriers should make compensation for the damage. These methods consist of the delivery of goods which is not exchanged with bill of lading and there are two advantages of the methods; one is that consignees enjoy saving bonded warehouse fee and quick disposal after arriving goods and the other is that carriers immediately use vessels after unloading containers. However, the methods are based on utmost good faith between a seller and a buyer.
